states. and canada they have reached a last-minute trade deal and a joint statement trade representative robert and canadian foreign affairs minister said that agreement will, quote, strengthen the middle class and create good well-paying jobs and new opportunities for the nearly half million people who call north america home. >> the dole allows canada to join in agreement reached in august between the u.s. and mexico. white house trade policy director peter on sunday morning futures. >> we want to restore north america as manufacturing power house by reclaiming the supply chain. there's also a modernization component that brings in things protection for digital i.p. pharma and things like that. new deal called united states mexico canada agreement or u.s. mta replaces the 24-year-old nafta. >> well, investors are getting their first chance to react to ceo elon musk settlement with

the fcc. sending tesla shares up about well up 15% in the premarket right now on tesla. this is a big recovery from friday. stock actually fell 14% on news that fec ftion suing muck. now deal was actually announced over the weekend now saturday to cost musk, though, the role of chairman tesla board for three years. 40 million in penalties. all of this, of course, stemming from that tweet he sent out in early august saying he had financing to take tesla private or for 420 declares a share but he didn't. >> calling that the 40 million tweet because that's how much it cost them. musk bullish on company after the settlement. this is e-mail you're looking at that he sent to the weekend. one more day of going superhard core and victory is hour and achieving profitability so trying to get cars out as many as they could before end of the quarter. tesla troubles are nots over. we're going it discuss is risks ahead to the company a little

they're saying that oh, yeah, yeah there's going to be a deal this is going to be -- ting they're labeling nafta 2.0 that is going to happen. and yet people tengd to be on the sidelines a little bit even though they kind of talk a good game now that there is a relief, it looks like there's going to be relief people are saying my gosh, the economy is really going to do better than even we gave it credit for it is time to restart buying stocks again, and obviously, the the futures are going crazy this morning. >> the s&p 500, the broader market is about a half a percent from an all-time closing high so this could be -- a record-breaking day, and you could say it is because of canada getting in the new nafta with the u.s. and mexico. but does it lay ground work or at least make investors think hey if -- if the president's policies and its tactics get a deal with canada and mexico can he do the same with china gary? >> yeah, absolutely. i think there's two parts of

that, lauren. the the part is kind of the headlines trade deal gets done, and everyone starts to buy. i even noticed amazon which should barely be affected by this is up in the premarket trading. but then you get to the second part of the story. first of all this has to go under review ting takes 60 dayses the president has to -- and then it is voted on by congress. that might not even be until 2019. so if you ask me for the details on this, i would say i don't -- you know details aren't out there just headlines. trade deal gets done. we're not even going to know what the trade deal is until maybe -- like six months a year from now. so people are really kind of buying on the the news now. i think, though, back to your point, it shows that trump's approach can work that's the important take away right now. >> annoyed that hong kong and shanghai are closed today gary because then we would see how this deal is impacting the asian markets and their confidence

second here really good journal that point out if there's a new chairman in charge and there will be it is somebody from the outside and that there's precedent from gm and ford when they ran into trouble they brought in somebody from the outside fresh eyes, new game plan new strategy do you think tesla is going to take that route? >> it's hard to say. the board is really stacked with a lot of elon musk supporters , the long time people that have been there through the thick and thin with him. but when i talk to investors they're saying hey really sending a message if there's a strong outsider put on the board as chairman. >> all right let's talk about stock is up in premarket up almost 16% at this point that fell big on friday. but it seems to me that elon musk is going to have a lot of power in this company. despite what he's just been through the settlement with the fec does that surprise you at all that they wield so much power and a good thing for investors? >> a lot of ways settlement is a

big thing for him he's ceo largest shareholder and really the -- the excitement for investors right and you know the reason are that stock is -- skyrocketing is the he's not getting kicked out there was a lot of concern friday with a suggestion that he might get ousted. the stock plunged he's in a lot of ways the the premium for tesla. if you look at the fundamentals of the automaker it, you know, they're not making money. they're selling a fraction of what large per automakers are doing. but it's this belief in what elon can do for future of personal transportation that is driving that stock. >> a lot of faith in somebody that because of one tweet got fined 40 million dollars but let's move on to facebook. because facebook, obviously, one of the most best performing sthoox we've seen in the last five years in particular. that stock is now dealing with this new data breech and they're now facing trouble. do you think that they can, you know, regain not only consumer trust, but also investor trust the stock is down in the prep

market we should say. >> well, this just another blow to them. a really bad year for facebook. you know just one hit after the another you remember cambridge analytica regarding consumer data, getting out that way now this breach the the ftc one of the commissioners tweeting they want more information and now regulators in europe saying hey we want to see more. there's questions about, you know, how much information and how quickly did they release that to those regulators in europe last week. >> i think that's a fair you know criticism after a cambridge analytica, of course, that was a scandal that really questioned not only this is where mark zuckerberg ended up in washington, you know, facing congress and the d.c. an still that question out there is are these companies like facebook and facing more regulation. that's drag on the stocks we should say last month is that sell a worry, though? >> there's definitely that

concern. facebook moving quickly upon, you know, last week trying to get the information out saying they're looking into it trying to explore it. they don't believe these hackers used a -- this technique to access personal messages and that sort of thing but they have to not know at this point. >> really quick i want to ask you overall in general we've seen a lot of technology sector has been strong but if you think it can continue in general what are stocks saying in particular? >> well there's still a lot of excitement look at tesla up dramatically and apple heading into you know one of the bigger periods for them with a new iphone that's always going to have a lot of excitement. you know, there's -- still a little bit still a lot of excitement here. >> all right tim great to have you on the show love to have you back if you don't mind getting up to be on at 2:00 in the morning your time. >> i never sleep. bring in right now martin, senior managing director head over time products at the new bean investors. martin, good morning. >> good morning how are you doing? >> let's first start what we're seeing on market big kickoff to last quarter of the year with the news of the trade deal does this setting to you that stocks have a lot further to run? >> it is very, very positive for u.s. stocks you know, the canada is a very, very important market. i think we did 340 billion of sells to last year. two times that of china so i think it is very bullish for u.s. stocks. >> this is, of course, a big story when it comes to the automobile market. this does mean that more automobiles are going to be made with u.s. labor. u.s.ing workers are making more auto but at the same time there could be an added cost to the consumer at the end of the day we don't know what automakers will do but this could raise up certainly the profits for ford or for your gm but is this a consumer issue? >> we'll have to wait to see.

one important thing that was missed out from trade deal were a -- that bill hasn't been resolved and we have to see how the north american supply chains or these automakers are going to be affected by the new deal. >> what about china? we still are in negotiations with the chinese. but it seems that china actually is becoming weak or player at the bargaining table with the united states considering that exports to the united states are a bigger part of their economy that are exforts to china are. do you think that actually gives the united states an advantage and does this really that president tactics and negotiating tactics are working? we now have a deal with canada and mexico could we strike a deal with china? >> well we have a deal with mexico in canada. that's not different from the deal we had before really the proof is putting what we're able to negotiate with china long-term. but certainly it is keeping things very, very interesting on trade front. >> are you bullish that we're going to get a trades deal with

china. >> i think we'll work something out and trade between u.s. is important for us to fall apart so i think that two countries can find common ground to come together. >> general pictures as we start the fourth quarter you know if you look at the third quarter result ares for pretty darn strong you have for the third quarter, dow actually gaining about 9%. you the the s&p and nasdaq both gaining 7% if n change strong performance considering news that we have out there whether it was worries about china. worries about -- nafta even our trade agreements with europe which are ?il question doesn't this tell you that all of this trade talk is a side bar to what is a strong stock market? >> we have in quarter three i think strongest since 2013. so that's something that is positive for us. q fall looks really good as well with u.s. stocks, some emerging stocks as well so ting things are looking pretty good into the end of the year. >> bullish or markets

interesting i like that. martin great to have you on the the show. sir, thank you. >> thank you. >> let's move on to tesla here company may have settled charges with fec but troubles far from over. still faces share holder lawsuits, and a department of justice investigation let's bring in attorney david bruno to discuss, david good morning. >> good morning, lauren. lauren: i want to know where elon musk had a change of heart because the fe krerks presented a deal last week and elon said no -- no thank you. the stock plunged and then over the weekend he said oak. and terms of the second deal if you will were kind of worse than the first deal. why the change of heart? >> yeah. probably combination between his advice from attorneys and that stock market plunge. right, i mean i think this is a very good deal for hill actually it comes with certain certainty on this fec investigation. you know we've talked about this before. that financing secured same was very, very specific in that tweet. i think it was the problem. it wasn't a publication itself

on twitter because they had previously identified this twitter handle in the documents. but it was that finance secured but tun turns out there was uncertainty there with legal problems and this settlement actually closes a door. >> right in 20 million for him is nothing plus 20 million from the company let me ask you with your legal mind how closely end in this situation do you think the fe and department of justice are coordinating and i'm asking because typically it seems to me you wouldn't setting an fec civil case if you knew that department of justice was going to bring down criminal charges. >> yeah in the right are circumstances, there would be parallel investigations as we have here. there have been reports that there's an ongoing department of justice investigation. i think what's important with the settlement is that he's not admitting gilt right he's agreeing to this sanctions. he's agreeing to the payments, but he's not, and i think that's smart. if there's a ongoing dpght of

justice investigation. however, as an attorney, one would think that the attorney would know what's going on on both areas. you would be very concerned about the fe krerks settlement if you do not know about the department of justice investigation. >> maybe, the stock sup about 16% now in premarket because investors don't think we see criminal charges we don't know. what about -- >> makes sense no this fec investigation is huge. to shut this down it is a great, great news for tesla. >> pretty fast. right, moves pretty quickly. listen, and there's great reporting today. we expect the markets to go up. they're going to be on the wave. right, so they're up -- after hours they're going to be up today. i think this is great for tesla. >> what about shareholder lawsuits? >> always going to be them, and that, that is exposure there's no question about that. especially when we see this settlement. there may be some problems with that, that tweet. and for the people that shorted the stock and are now bringing

meeting on friday google agreed to testify before the house judiciary committee in november to address concerns over the companies alleged bias against conservatives. has been meeting with both democrats and republicans including house majority leader kevin mccarthy on sunday morning futures yesterday. >> algorithm is written by a person are are they influencing the outcome? and if 90% of all searches go through google, that's a real concern if you try to put your thumb on this scale. you could influence it. google has reportedly repeatedly rather denied accusations of bias. >> all right, well let's talk about disney they don't seem to let people sitting down. not because they want them to go on rise but disneyland has been slowly getting rid of places to sit including some chairs and benches in order to deal with the growing crowds and upcoming opening of its newest land "star

get paraphrasing what she sent to gop senators last night. but is that the truth in your opinion if no prosecutor would move forward with this? >> that is true. but that's not the question -- that was -- that report was prepared for the senate for the committee so they could then have some more ammunition not whether or not he committed the act but question is whether he was lying when he made statements to the senate judiciary committee he may or may not have been so there was hard questions asked of him. some of which he answered and some of which he deferred if, in fact, he was not telling the truth about his blacking out about about his excessive drinking, and he sat there and told the committee that it didn't happen. that's a problem. this is not about whether you're prosecuting him for an alleged rape. >> but there's no proof. i mean this is the the problem about with this entire situation. there's no proof. she doesn't have witnesses welcome backing her up and can't remember the date, the location she can't remember how she got home. i mean, you know, and this
