"the evening edit" starts now. >> the process has been ruined by fear and anger for too long. >> it looks to be a product of an incomplete investigation. >> the supplemental background check with three senators and 10 witnesses. >> this is a very limited process that would constrain the fbi. >> you will never be enough. he's a tumbling bumbling drunk, serial sexual predator. >> nobody is supposed to be guilty until proven innocent in the united states of america.

5:02 pm
really a date in the midterms for you and your money and what those protesters are missing and how they are wrong. plus, a surprise change in which party is turning out to vote. lots of talk about "the new york times" piece on president trump taxes. look at this. elizabeth warren getting called out for tax deductions, inflated tax reductions. her office confirming that senator warns tax information was wrong. senator warren wants to raise your taxes, she's wrongfully low rate hers. thank you for joining us. thank you for watching. money, politics, elizabeth mcdonald the -- elizabeth macdonald, "the evening edit." the market now with 300 points
5:03 pm
at the end of the day at 26 points 67. again down 200 points. that's a loss of about one weeks worth of gains. don sellars hit the panic button over fears of even faster interest rate hikes and the federal reserve as the economy heats up in the 10 year treasury yield socket a seven-year high. this looks like a temporary spasm. another great earnings season is about to kick off. s&p 500 profit growth is expected to gallop ahead of the stunning 20% plus growth rate for the last three quarters. that's pretty unheard of. deirdre bolton on the new york stock exchange. what a day, what's going on? >> is so busy here as you know it. right across the screen you have the biggest losses in the stock market. you have to go out the way back to june to see levels. these kinds draw. one thing i will say in the last basically 20 minutes, you did have stocks start to pare some
5:04 pm
of those way, way deeper losses. you had markets clearly closing lower. no way to sugarcoat it, but definitely off their lows of the session. the s&p 500 come in the 10 major groups that make up the s&p 500. you only have three closing higher on the session, but at one point i'll were down. we will take three. the ones that finish in the green and limit these broader losses were utilities, financial and telecom stocks. the financials not such a surprise because the rising rate environment if you are i want to get a loan from a bank, we are now going to pay more money so that obviously makes the profit margins bigger for the money lending banks. you have bank of america, citigroup, jpmorgan chase are closing the day higher than a lot of regional banks as well. the silver lining if you like as far as the rest of the sector went. a lot of traders here talking about which you alluded to as well with the treasury yields coming in at a seven-year high.
5:05 pm
it's unusual to see investors want to sell stocks and bonds at the same time and traders here saying that is because people really are worried about inflation. worried the fed will raise rates. >> here's the thing, what's so interesting is 4% interest rates were normal before 2008. so they are still historically low. should investors be worried? what are traders selling them? >> what people are focused on the myopic view of today is they are really focused on tomorrow morning on the jobs report. we thought the adp report, which just underline that our economy looks pretty good right now. employment included. if there's more jobs in the economy and our wage gains gains, which we finally began to see them last month set of data that does bolster the argument for inflation. rates could go higher, but a little caution here.
5:06 pm
elizabeth: great to see you. let's get to the kavanaugh confirmation. chuck grassley now say the media is biased against kavanaugh. senators coming out today in his defense going into the room to read the fbi report. the white house saying there's no corroboration of the fbi charges against him. senate majority leader mitch mcconnell is moving towards a debate tomorrow and a final vote on saturday. let's get you at reliance on capitol hill. >> a very politically charged day here in capitol hill today. protesters marching the streets outside the capitol outside the capitol and the rest made inside the senate buildings throughout the course of the day. republicans are frustrated, accusing democrats of moving the goalpost with senator chuck grassley. >> what i've been dealing with since july 10th, the downhill slope that schumer has put us on is really dealing with the demolition very.
5:07 pm
>> there's no corroborating evidence in the latest fbi report. marx judge, and the other friend whose claim to be in the room. the woman ford claims was that the party with her. all eyes turn to republican senators, to republican senators. schneider jeff flake, lisa murkowski and susan collins. we have heard a ton from senator flake and senator collins today. both flake and colin saying it agreed to be a fair report. senator flake saying he did not see any corroborating evidence in their that would back up his allegations. democrats read the report
5:08 pm
differently. there were hints of misconduct. so very frustrating with a fair investigation if they did an interview while potential eyewitnesses. i'm actually shocked. >> senator dianne feinstein says this is incomplete because it didn't interview kavanaugh or ford. or something democrat votes, too. they will likely help the republicans that they could vote yes if republicans have 53 of those. one senator joe donnelly says he did know but the white house hearing from sources is still trying to get them to change his mind. senator heidi heitkamp this afternoon saying no and senator joe manchin undecided just finished reading that report in the secure room. he did say on its way out that it's going to to go in tomorrow morning. tree into their holes in her
5:09 pm
story. >> three and half hours were kavanaugh and if you don't include the 31 hours that he did in front of the committee. he is on the record at length and that is what the fbi are saying they need to reenter them. but at this point the republicans are saying they did need to do that. elizabeth: edward, great to see you. thank you so much. democrats accused of sitting for weeks and weeks with accusations. democrats are crying foul over the fbi investigation, saying you know what come it's only taken a week, but when the fbi interviewed witnesses.
5:10 pm
listen to what democrats are now saying. an fbi investigation is a way to answer these questions. >> the fbi made against you. >> some online does not ask the fbi to investigate their claims. who is not asking the fbi to investigate these claims? the white house. dr. kavanaugh -- excuse me, judge kavanaugh. >> why aren't you also asking the fbi to investigate these claims? >> well come in and up to you give effect to the president of the united states. his failure to ask for an fbi investigation in my view is tantamount to a cover-up. elizabeth: there is no cover-up. democrat senator dianne feinstein and chuck schumer are still criticizing today, saying it is an incomplete fbi inquiry on kavanaugh.
quote
5:11 pm
>> it looks to be a product of an incomplete investigation that was limited, perhaps by the white house. i don't know. >> we have many fears that this was a very limited process that would constrain the fbi from getting all the facts. those fears have been realized. elizabeth: again committed democrats on this information for weeks. they call for an fbi investigation at the 11th hour. the privy inquiry was done. here's how to read this. we reported this already that the president succeeds in getting a conservative majority on the supreme court, he and the republicans will dominate all three branches of government. we haven't seen that since fdr and lbj in the last century. the former federal prosecutor andrew mccarthy. but you make of all this with the democrats satisfied? >> they'll never be satisfied
5:12 pm
because as we've discussed before, this was never about what they said it was about. this is never about whether kavanaugh was a serial. it was never about whether he was a boos back in high school and college or whatever else they alleged the last few weeks. this has always been about delayed. we are talking about democrats in the senate who announced from the beginning that they were never going to support kavanagh whether it came out that he was the greatest legal minds in history and he was the biggest choirboy in the history of maryland. they were never, ever going to support him for ideological jurisprudential reasons. this has always been about delayed. elizabeth: it's also been about big consistency and liz's testimony. her memory is the only evidence here. she does have witnesses that she put forward. an old friend by the name of leland kaiser. but here is her attorney in a
5:13 pm
statement to the judiciary committee saying, quote, the truth is that she is unable to corroborate it because she has no recollection of the incident in question. leland kaiser was named by ford as a corroborating witness. when she was interviewed by the fbi on saturday. again, a witness at the event after the fact whose now saying doesn't remember it. >> that's why you're hearing all this stuff about -- is why you hear all this stuff about process and nothing about the allegations made. i was a prosecutor for 20 years. if people bring you allegations that on their face don't seem to match up with the facts you are ready now, why would anybody be surprised if the fbi goes out and beat the bushes and they can't find any corroboration. there is never any reason. this stuff was never a quantum of evidence that you would
5:14 pm
credit in the first place. so not surprisingly they collide and can't find anything to corroborate it and the democrats are talking about the allegations anymore. they're talking about the process. it's exactly what you'd expect of their objective is delaying. elizabeth: you can disagree or agree with eric kavanaugh. you can say it's inappropriate. the bottom line is the higher principle. by the way, what i mean to say if the shoe is on the other foot. if the democrats are putting up with what republicans are putting up with now, they would like it. they would say there's a higher principle at play in that it's evident supporting accusations, right? >> that's exactly right. we are not even speculating about that. experienced fact. a lot of us were opposed to merrick garland being on the supreme court for philosophical reasons. no one ever tainted him. no one ever suggested he was anything but a patriot.
5:15 pm
you know, we were just philosophically against him. nobody did try to destroy them as a human being. elizabeth: great to see you. is there to catch chuck grassley on "mornings with maria" tomorrow at 7:30 a.m. eastern time for the updates on the kavanaugh nomination. coming up, the policy hyperbole continues in nancy pelosi is trying to connect brett kavanaugh to kim jong un and vladimir putin. the lactating judge kavanaugh hard about his teenage drinking habits. an old video service and revealing basically you see him right here, former president barack obama talking about his drinking habit in taking illegal substances before he became -- way before he became president. >> -- and consume substances that weren't always legal. elizabeth: coming up, we will play the full-time paid immediate going big on president

what is your take on all this? >> obviously, democrats are not only trying to shift the goalposts. i think they're trying to shift the entire field to dig it up and replanted so that nobody can play and that is essentially what they are doing by trying to delay this though. this is what the senate does. i have a confirmation for the supreme court. they are supposed to stand up and be counted in boat on that consent function. the democrats don't want to do that. they've gone off the grid and instead have replaced their function with these protesters who are supposed to make the american people turn against brett kavanaugh. i think it is backfiring. elizabeth: you think so? >> so many people were not watching this closely. what are they seeing, violent protests against kavanaugh. elizabeth: is this an upcoming column in "the wall street journal"? >> i think it might.
