trade fight. but trading volume has been pretty heavy there. let's get right to christina for a report on the big boards. reporter: the jobs report came out. you had weaker numbers for september. but the revised numbers for august and july shows the economy is still going strong. you had investors move out of bonds. for the 10-year you saw that climb higher. we'll bring that up on the screen shortly. but there is an overwhelming fear there will be tightening by the fed and interest rates climbing higher. that means it's more expensive for businesses, hence the sell-off. but the day ended on an

indifficult ease a little bit higher. investors are saying this is a small blip in the market. the tech stocks, you saw the basket lower for the day. there are several reasons for that. you had people moving their money away from the more expensive valuations. and also like you mention you have the chinese possibly spying, you have the looming regulations that can come into play in europe and the united states. there is a lot weighing on that basket. you have got utilities on the board. look at that. they are all in the green. you are seeing 2%, 2.5% for xl energy. traders around me today said this is a small blip. they have 11 weeks left to go and they expect strength in the

market. liz: republican senator susan collins and her closing argument in support for her vote yes. the senator collins vote is coming in. she'll vote yes tomorrow. she is calling kavanaugh's confirmation process a caricature of a gutter-level campaign. she says this is rock bottom. susan collins effectively shining a light on the state of our politics. no uplifting rhetoric about hope or the shining city on the hill it's 24/7 grievance, and who's fear or resentment is stronger as republicans continue to try to debate policy that will help you and your families. brett kavanaugh one step closer to sitting on the highest court in the land. key procedural votes to advance

his confirmation less than 24 hours away. the white house believing it has the votes to confirm. republican jeff flake and joe manchin voted to advance kavanaugh. lisa murkowski voting no to advance saying quote i believe we are dealing with issues that are bigger than the nominee. in my view of he is not the right man for the court at this time. is murkowski now the new maverick in the senate siding with the #metoo movement? reporter: she has other pressures related to the native alaskans who were there. there -- there could be part of that pressure that caused herd to be a no vote. the swing votes did start to come down in favor of judge kavanaugh. first was jeff flake, then susan col lidges saying yes.
5:08 pm
>> despite the turbulent bitter fight surrounding his nomination, my fervent hope is brett kavanaugh will work to lessen the divisions in the supreme court so we have far fewer 5-4 decisions, and so that public confidence in our judiciary and our highest court is restored. reporter: former president george h.w. bush tweeting out his support for collins. political courage and class. i salute my wonderful friend and her principled leadership. democrats, though, still trying. >> the minimum standard for supreme court nominee should be someone who we are confident will demonstrate impartiality,
5:09 pm
integrity, and truthfulness. but the nominee we are voting on has not demonstrated those qualities. every american is entitled to the benefit of the doubt. but nobody is entitled to a seat on the united states supreme court. reporter: we are on pace for a 5:00 start to the vote tomorrow top confirm judge kavanaugh. it appears he has enough votes, 51, to be confirmed. liz: we have manufacturing confidence at an all-time high. minority unemployment at record lows, construction hiring booming, this as hundreds of anti-kavanaugh protesters headed to d.c. as the senate' got ready to vote. >> this business hijacking our
5:10 pm
democracy. i am angry, i own it. a vote for vaf thank you is a vote saying women don't matter. let's stay together. let's fight. liz: republicans are saying it's not that women don't matter. women of course matter. we are groaght republicans. they are saying i have matters, proof matters, we cannot lower the standards there. here is senator joe manchin, he was confronted by a protester who said she was the victim of sexual assault, demanded to know how he would vote. watch. >> i don't understand how you can't look me in the eye. are you coming here to vote? how are you not listening to us? are you? you are going to get in this elevator. how are you going to vote.
5:11 pm
tell me. liz: if you would ask the survivors about proof, what would they answer? they are not address that. manchin ended up voting yes to moving kavanaugh on to the senate for a vote. protesters were shooting shame when man chin was trying to vote. orrin hatch was telling a group of protesters to grow up. >> don't you wavy hand -- don't wave your hand at me, i wave my hand at you. how dare you! liz: republican senator roger wicker. female sexual assault is an outrage, it sams disgrace. everybody on both sides of the
5:12 pm
aisle agree with that. i agree with that. it's about the standards of proof we accept as a society. >> yes. i think no one said it better than susan collins today. i sat there watching her spellbound. and i have to say, i think 25 years from now, 50 years from now, historians will look back at this moment at this speech and say it was one of the most of profoundly significant speeches in the history of the senate. she laid it out point by point. methodically. thought any. convincingly, and, you know, i have been to maine with susan collins to the shipyards, up and down the streets. the people of that state love her. today i think it's obvious to the nation why that's true. liz: when you put on the black
5:13 pm
robes of supreme court justice, it's to uniformly. we had an audible gasp in the room when manchin voted to move the kavanaugh nomination to the full vote. he's under a lot of pressure. >> i was pleased to see another democrat coming around. it may be he had his eye on the election 4 1/2 weeks from now. but for whatever reason, it was a relief to me. back to the general point susan collins made. a president is entitled to his or her choice on the supreme court, and she never voted against an appointee. i think that americans need to
5:14 pm
realize in this debate is that regardless of whether you come down center right or center left, if the judge is qualified, if he's thoughtful and learned, he or she deserves to be confirmed. this was a lesson to americans and to me today. it was a profound and emotional moment for this senator to listen to. liz: what line jumped out at you the most of. susan collins is saying judge kavanaugh is not going to give special protection to president trump when it comes to the mueller probe. >> she went point by point to explain why that's true. i think one of the main things -- one of the pain important points she made was
5:15 pm
the standard of proof. you didn't have to prove an allegation against judge kavanaugh by beyond a reasonable doubt. but at least the charge should be more likely to be true than not. and she conclude a sympathetic a witness as dr. ford is, her account was less likely than not to be accurate. i appreciate her analyzing it and standing up showing that courage. liz: great take on that. thank you, senator. thank you so much for your time. despite 51 senators voting for kavanaugh. the resist movement going full throttle. hundreds of protesters descending on d.c. in a last-ditch effort to change votes tomorrow. first, a new report saying dr. ford's former best friend
5:16 pm
and alleged witness leland kaiser said she felt pressured to change they are statement at the last minute about what she remembered. we have matt schlapp reacting after the break. stay there. >> the latest story is the whole investigation is invalid because individuals who had only recently been told second hand or third hand about nearly 40-year-old allegations weren't treated as essential witnesses. never mind that they didn't actually witness anything. they didn't witness anything. how do you win at business? stay at laquinta. where we're changing with contemporary make-overs. then, use the ultimate power handshake, the upper hander with a double palm grab. who has the upper hand now? start winning today. book now at lq.com.

leland keyser telling the fbi that a friend of dr. ford's urged leland keyser to change her initial statement to the fbi. leland keyser said she didn't remember going to any party with dr. ford where the alleged assault allegedly took place. monica mcclain allegedly urged her to change her statement. senators like bob corker said the most of important under views that could sway the senate's vote are those witnesses closest to ford. great to see you, matt. what's your take on this? what's going none this circle of friends? >> these are the beach friends, i think. the more we learn about the people trying to push dr. ford to be public are probably the
5:21 pm
same people who leaked this information. not necessarily to the "washington post." dr. ford said there were other reports on her front lawn and one came to one of her classes. there was a cabal of people around her trying to make her be more public about her allegations. this is the woman dr. ford may have coached when she took a polygraph. the more we learn about this story, the worst it's going to be. liz: the issue is about proof and how this was hand, and how the media has been reporting it. cnn getting criticized for letting their reporters join anti-kavanaugh reporters on buses going to washington, d.c. usually reporters cover protesters outside the bus, not on them. >> this is one of several buss of protesters heading down to
5:22 pm
washington, d.c. to protest the confirmation of kavanaugh. the idea is to rally outside the courthouse where judge kavanaugh currently sits. they want to do everything they can to keep the confirmation from happening. >> i would never use the word fake news. i consider you folks policemen for our democratic system of government. but i want to show where you some of you have had bias. i have had demonstrators in my office for two weeks now. for kavanaugh and against kavanaugh. one time the people that were for kavanaugh wanted to be interviewed. they said we only are interested in interviewing people against kavanaugh. that's a bias that none of you should be tolerant of.
5:23 pm
liz: msnbc *, dzhokhar borrow agrees the media has been biased against judge kavanaugh. >> the media cover has been so biased. there has been a presumption from the beginning that every single allegation against the judge is true. if somebody said before the allegations -- liz: your reaction? >> dzhokhar borrow has been a critic of almost everything the president has done, and he can even see this is outrageous. as far as the protesters are concerned. they shout down these senators. i am proud and happy for my friend brett kavanaugh. but i'm worried these simple questions of democracy like confirmation votes are coupled with this huge political outpouring which i'm okay with
5:24 pm
them being calm and peaceful. but i just hope things day calm. >> it's not about hope and change or the shining city on the hill. or about policies. this is what happens when democrats like barack obama and hillary clinton allow identity politics to swamp their policies. if this is the way we are going with the democrat party, if they get back in power it's big government taxes, regulation, and the economy will stall out again. >> i was called a racist on cnn because i was rather critical of the way kamala harris and cory booker handled themselves in those hearings.
5:25 pm
liz: who did that? >> don lemon on cnn. we have to be able to have disagreements on policy. we have opposed many of the democratic nominees on various positions. we oppose them, but we don't try to destroy them. this blatant character assassination against a good man, it gets us to a place we have to pull back from. i think susan collins and lindsey graham will show us the way, and maybe joe manchin as well. liz: first it was the sexual assault charges that didn't hoimed. then it was his teenaged drinking, now it's his temperament. senator feinstein says she is voting no because of that.

5:29 pm
>> at the hearing last week we saw a man filled with anger and aggression. judge kavanaugh raised his voice, he interrupted senators. he accused the democrats of lying in wait, based on all the factors we have before us, i do not believe judge kavanaugh has earned this seat. liz: that's senator dianne feinstein choosing to vote against judge kavanaugh after what she calls belligerent testimony. judge kavanaugh wrote in a column i was emotional and i said a few things i should not have said. i hope everyone can understand that it was there as a son, husband and dad, i testified with five people most of foremost of in my mind, my dad, my mom, my wife, and most of
5:30 pm
all, my daughters. justin, your reaction to today's events? >> i am pleased it looks like judge kavanaugh will become justice kavanaugh. it reminds me of the birth of a child. it has a happy ending, but it's not a process i would wish on my worst enemy. liz: was kavanaugh partisan in his testimony? he did work for ken starr and he was part of george bush's legal team in the recount in the vote in 2000. and kavanaugh did sound partisan when he testified this was political revenge on the part of the clintons and a political hit. he did not sound impartial as a judge should be.
5:31 pm
>> for 12 years judge kavanaugh has been an impartial, independent, fair-minded judge, and i expect that's the kind of justice he'll be at the supreme court. what happened at the hearing last week is judge kavanaugh expressed outrage about an outrageous process. and i'm glad he did. this process included hecklers interrupting the hearing constantly. it included a senator calling him evil. it included two leaks, one of dr. ford's name and her story, and the publishing of senators' home addresses and phone numbers. this is a process that included michael avenatti. liz: it appears brett kavanaugh answered more questions than any other supreme court nominee in lift.
5:32 pm
it was 324 questions for justice neil gorsuch. >> i think the questions he was asked are just one piece of evidence that show a strategy against him. they didn't inquiry into his judicial philosophy. the strategy has been delay for the sake of delay it's transparent from the start when there was complaining about how producing one million documents wasn't enough, we needed to wait for two million documents to be produced. it explains why christine ford's story was kept secret and leaked on the eve of the confirmation vote. >> the federal judge should have been confirmed when with he was a nominee. but i think his performance
5:33 pm
during the hearings caused me to change my mind. >> congress has broken the confirmation process. they cannot break the supreme court. the only thing that can break the court is the court self. statements like that by justice stevens don't help. liz: it is a month to go until the mid-terms as the democrat lead has been vaporized. the democrats' so muched earth tactics. republican north dakota senator john hoeven next.
5:37 pm
5:38 pm
the vote to a full vote in the senator. many voters are less likely to vote for a democrat for the senate if that democrat is against kavanaugh. a ma rirks st poll found interest skyrocketing among republicans. the share of republicans that say the mid terms are very important shot up 12 points. what is your reaction to all of this going on with the mid terms? >> it's very positive. you talked about the agenda we have been working on. not just today with judge kavanaugh, getting a constitutional conservative on the court, ta tax -- tax relief. stock market at record levels.
5:39 pm
less than 34% unemployment -- less than 4% unemployment. when people go to the ballot box, that's what they are voting for. >> the democrats and people protesting on the left, sexual assault is a serious charge. and you feel for dr. ford. she evidently did go through something. but they are treating her like an avatar for all sexual assault victims. she did not have the witnesses there to said they agreed with her rendition of what her memory is. they corroborated witnesses are not there. democrat senator dianne feinstein having a difficult time giving a straight answer on if they are staff was responsible for leaking dr. ford's letter. dr. ford was mistreated there.
5:40 pm
senator, dianne feinstein saying i don't believe my staff will leak it but they didn't ask her staff directly that question. how could she not ask her staff if they leaked the letter. >> if you haven't had a chance, you should listen to susan col slips speech on the floor. she went through the whole thing you talked about, talking about how sexual assault is a very serious issue of that has to be dealt with seriously and carefully. but you have to go to the facts. in regard to our colleagues on the other side of the aisle, why didn't they protect dr. ford's confidentiality and go through the confidential process of addressing her concern rather than leaking her information. not only did they leak the document. but why sit on it rather than address confidentially and fairly the concerns she raised
5:41 pm
the way she wanted them to. liz: apparently dr. ford was not aware the judicial committee members wanted to talk to her and she would fly to california. senator feinstein just tweeting out, dr. ford came before the senate and told 21 senators she had never met along with millions of americans the most of traumatic and difficult experience of her life. unfortunately she was met with partisanship and hostility. how are you voting tomorrow in. >> i of course are supporting judge kavanaugh as i did today and indicated i would through the process. we worked through this carefully. seven fbi background checks making sure dr. ford would be able to come forward, understanding something happened to her, but understanding we have to address the issue on a
5:42 pm
factual basis. we worked very hard on a fair process. but we have to go based on facts and corroboration. liz: despite 51 senators appearing to move towards voting for calf enough, the resistance movement going full thoughting. we have hundreds of protesters descending on d.c. hoping to change the vote in the confirmation of brett kavanaugh. . i had no idea the amount of damage that water could do. we called usaa. and they greeted me as they always do. sergeant baker, how are you? they were on it. it was unbelievable. having insurance is something everyone needs, but having usaa- now that's a privilege. we're the baker's and we're usaa members for life. usaa.

liz: of course women matter. of course, you want to listen to sexual assault victims and give them justice. the problem is ford didn't have any corroborating witnesses. despite 51 senators voting for kavanaugh, the resist movement going full throttle. amy schumer among those arrested for protesting. her father is a cousin of senate minority leader chuck schumer. reporter: do you think there should be a separate investigation into kavanaugh, high school and college drink habits? does that concern you? >> i don't see why not. >> if that's what it takes. >> it goes to his credibility.
5:47 pm
>> sure, that was proved the points, he misrepresented himself. liz: let's take it up with our panel. brad blakeman. they could not find any witnesses to corroborate dr. ford's allegations. >> when their leadership says brett does not deserve the presumption of innocence. that tells you everything you need to know. they are not interested in corroboration or brett's innocence. what they are interested in is the result, judge kavanaugh to be denied something he's entitled to, something he earned. finally we are getting joe man chis chin and others to step up to the plate. it's about fairness and it's
5:48 pm
about the rule of law and the presumption of innocence. even though it's not a court of law. liz: do you think protesters will have any effect on pressuring senators to vote against kavanaugh? >> not at this point. but after the fbi investigation they didn't find anything. ultimately this has to be about facts. i recognize in these types of allegations we want to be careful. but there weren't enough facts to make a difference. we need to be a democracy of facts. it just wasn't there. >> let's turn the tables. say the was a democrat nominee facing these accusations. how would the democrats be behaving if there were accusations with no corroborating proof. no witnesses stepping forward saying they were told at the
5:49 pm
time the accusation took place. what would the democrats be doing? >> what we are doing. she has the right for the presumption of innocence to face the accuser and have those facts corroborated. that was not done in this case. it's clear. susan collins probably gave the best or tory of any senator in -- the best oratory of any senator in modern history. joe manchin was the only democrat who said let me give this guy a fair shake and a fair hearing. he was railroaded from the beginning. liz: liberal silicon valley company facebook apologizing to upset workers after one of its top executives, he runs global policy, was at the hearing in support of his friend judge

liz: facebook apologizing to workers. facebook held a company-wide town hall meeting admitting it made mistakes. because facebook's head of public policy showed up at the kavanaugh hearing. facebook said sexual assault is an issue society has turned a blind eye to. our leadership team realizes they made mistakes handling the events of the last couple weeks.
5:54 pm
sheryl sandberg criticized him for attending the hearing. i talked to joel about why i think it was a mistake for him to attend, given his role in the company. she also says she respects his right to associate with who he wants to outside the office. liz: what do you think about the issue that joel capling has no right to associate with who wants to outside the office. >> you have joel kaplan going because he's a friend. and now's a heretic and they want to figuratively burn him at the stake. it isn't just about the women's issue. if you look at other statements that have been made.
5:55 pm
it's about the fact that he violated the the corporate culture or left-wing ideology facebook seems to have. liz: facebook's joel kaplan admitting he made a mistake attending the hearing in what is being described as an intense facebook meeting. what is your take now that joel kaplan is apologizing. >> this is what the old soviet union used to do. we'll bring you in, force you to confess your crime. they will ostracize you, for us out, embarrass you, make life for you. i find it outrageous this guy want go sit at a hearing of a friend of his. he's not advertising he's from facebook. he just happens to be there. and that upsets people to such a degree that they have to have a

town hall to get over this. it seems like you have a bunch of snowflakes melting out there. and you have to cool it down and help their self is steep. we are bad, joel shouldn't have don't and let's all pile on joel. i think it's unfortunate. it says a lot imt big left dogma of religion. what do you splect happen tomorrow? >> i think kavanaugh gets confirmed.
