that is the most statesmanlike speech i have seen in the well of the senate in quite some time. kennedy: stop or a sec and i want to know how important was that speech for justice kavanaugh and setting aside some of the fears and feelings that independents have not necessarily the left but how important was it for people to sift through the laying out of her case? >> i think it was significant. i'm a swamp creature just like you are in the middle of midtown manhattan. neither of us was the intended audience but the average american who has only been paying attention occasionally when she laid out methodically justice kavanaugh's record, the history of the supreme court nomination battle, how do you deal with the he said, she said situation? i thought her speech did a fine job and the narrowest

confirmation since 1848 that we have seen in 150 years or something like that. we saw the obviously divide the country but for the independent-minded voters that don't like either how the republicans or the democrats proceeded during the confirmation battle i think it's the right way to move to the next stage. kennedy: the next stage obviously is the docket. there are several areas of the law that will be tests for the new justice. what do we have coming up and what should we look for and what do you predict we should look for in justice kavanaugh? >> so far the term is pretty low-key. none of the biggest cases of this term would make the top half-dozen or so. in fact probably some of the biggest cases were argued last week so we could have a situation where a few cases have to be reargued or decided 4-4.

kennedy: if they are 4-4 you're absolutely right there were six cases that justice kavanaugh meant in this process. in the event of a tie what happened? >> well if the court decides to release the court the lower court affirms without presidential opinion. the court could decide a stone match and nations who have a re-argument. traditionally the new justice does not take part in that although there's no line preventing justice kavanaugh from taking part like reading the briefs in hearing oral arguments. but really this term going forward what really is significant is which cases the court takes up. they've been delaying even deciding what cases to take up-ending the ninth justice and those are issues like partisan gerrymandering, the 2nd amendment across on public lands

also the bigger and more controversial issues that tend to be decided by the floor. kennedy: we talk about the states rights issues but gerrymandering in particular effects it's had on places like pennsylvania and california, how is justice kavanaugh known to rule in terms of states rights? >> well he comes from the d.c. circuit and he is not a stage and he doesn't have to deal with federalism issues. he has no judicial opinion for that sort of thing. he is clearly an originalist in the textualists. he believes in federalism and separation of powers so presumably he'll be enforcing the constitution abstract or on a lot of these cases this is all just based on an educated speculation based on his theories rather than what he has decided impasse. kennedy: we will see what happens. every new member of the supreme

court accepts according change that. we'll have a few seconds left. how do you think justice kavanaugh will affect this supreme court? >> he will hang back for a little while but he has been on the d.c. circuit on the second highest court in the land for judges here. i think you will be a powerful force to be reckoned with and will clearly put his stamp on the court just like justice gore said chas. kennedy: justice kavanaugh's confirmation ignited a culture war that could be at the top of voters minds when they had head to the polls in a few weeks. the president made a very bold prediction today. watch. >> i think a lot of democrats are going to vote republican because i have many friends that are democrats. the main base of the democrats have shifted so far left, this country would end up being venezuela. i think a lot of democrats are going to be voting republican.

>> no questions or publicans right now but the key phrase you used the word top of their minds there's a of a lot when to go actually between now and when most people propose. i would be surprised if the kavanaugh effect is still lingering on in their something new to keep it going. the president is true to getting people exercise so maybe has something up his sleeve. maybe the democrats will make the mistake of going on the ballot and promising these investigations and keeping the pot boiling but unless something like that happens i think it will fade away so the republicans will need something else to get that find that, election day. spirit there's no doubt that the president will have the dozen something else is between now on the midterm. it's interesting because if everyone turned out to vote we

would have high voter turnout for the midterm and we have equal excitement on both sides. what happens then? did they cancel each other out? >> to a certain extent. you the go back to july you look at the enthusiasm and democrats have a 16-point lead. this is really what we are talking about are the independent. they disapproved of the handling of the kavanaugh confirmation. by 20 points and that's devastating. when you're in the middle-of-the-road moderate in what we used to call a blue dog democrat and you look to see have a treated this man, look at the rallies. look at the protest and the clawing at the door of the supreme court. do you even recognize the democrat party anymore and for many people in the middle the answer may be no. >> there are also liberty minded republicans who feel left out in the cold here but there are some pricing lay close republican races. neal love is in the fight for

her young political career in utah. rick scott having a tough time in his senate fight in florida. you've got all these races which are so close. mark mcsally running as a republican for that senate seat in arizona. if you are a republican strategist and you are talking to your donors and fund-raisers would you tell them makes a difference? >> i think in order to make a difference we need to bring this up is not an issue about judge kavanaugh at his confirmation by the a window into what will happen as the democrats retake power in 2019. kennedy: he is talking about essentially the possibility of an impeachment hearing for justice kavanaugh and all sorts of investigations. >> we have seen this already play out with tom stier's impeachment campaign with the

president and that issue plays horribly at among independent voters like we are talking about people do not want to see the president impeached and they definitely don't want to see justice kavanaugh impeach so in addition to bringing it up as this crystal ball into what will happen next year i think they also need to play out the cultural issue. if we are country that no longer recognizes people being innocent until proven guilty is a huge cultural shift. kennedy: it shows you how important the supreme court really is. the president talked about on the campaign trail and he said it's the most important decision a president can make. he may have one or more pics in his first term and certainly if he has a second term. does that weigh on voters minds right now? >> not as much as a point which you just made which is the fear of the loony left mob taking over. i do think also especially the

independent voters a you touched on those are basic issues, the economic issues. again it's voting out of gratitude. you can talk all you like about the record. kennedy: the status quo doesn't get people as excited. >> this goes away if the democrats get in. >> it will compare the mop with the drive for socialism from the left. they have gone so far to the left of the motivating factor for people in the middle and people to the right. >> republicans have to do a better job of explaining that while being unapologetic. we are going to's hear more from the paddle -- panel later on the show. we are going to talk about rod rosenstein and is it time for him to dust off the old resume? to present making about the deputy attorney's job security and what does that mean for the mueller probe? jason chu davis joins us.

racist. he really gets unfair press in that regard. we will see what happens. march 31 rex tillerson was fired in the present on december 1 a few months before the speculating the media that i fired rex tillerson, fake news. the list goes on and on. the president said i had a great meeting with rod rosenstein so when does he get it? >> i think the day after the midterm elections. remember rod rosenstein is in charge of director marler is doing an investigation now think the president prior to the midterms is going to make any sudden moves. the difference kennedy is on thursday rosenstein has a meeting with house people i believe trey gowdy john radcliffe and others who are going to ask them pointed questions that probably the president didn't ask on air force one. kennedy: and the president knows that he's letting some of these congressional leaders and

committee chairs do the dirty work for him and he is allowing them to build the case against some ammunition to justifiably buy or rosenstein especially if they can get him to perjure himself or show some glaring hypocrisy. how hard will that we for the congressman? >> i don't think it will be difficult to first of all there are many complex of interest apparently with rod rosenstein. there many people that have now calmed to testify in public or transcribed interviews behind closed doors. they will be very pointed questions about that in mr. rosenstein, this report had a lot of sources behind it. they have talked to a number people about it. it's very curious and even if rod rosenstein according to his own words was just out there making this in just her saying it hypothetically to the extreme wall was the underlying

conversation? if congress really wanted to get to the bottom of that they would invite the other six people are so into congress. kennedy: they also need those memos from andrew mccabe which essentially documents at least some of those conversations so i think it's smart for the president to do that. if you had to make a choice between firing rod rosenstein and jeff sessions who do you fire first? >> you swing first for the current attorney general who is there in name only the very worthless jeff sessions. he is never there. kennedy: he is recused from life. >> yes. he is there in name only. he is the most ineffective attorney general i've ever heard of in the history of this country. kennedy: he makes us long for drawnout -- that we didn't know was possible or are lonely souls. >> can you imagine him on "dancing with the stars" the sessions and rosenstein?

paul was the first to take public issue with the fourth amendment in regards to government collection of meta-data. we have upheld the constitutionality of federal spying and brett opined quote in my view the government metadata program is entirely consistent with the fourth amendment. first of all, no it's not. they were stealing vast amounts of information from innocent people without warrants and then they lied. that is wholly inconsistent with the language and intent of the fourth amendment which we designed to protect us from that very brand of intrusion could kavanaugh again came up on the wrong side of the constitutional point in the night states versus -- where his court heard the case about the government putting a tracking device on an individual car because according to kavanaugh that sort of action is also entirely constitutional.

them? joining me now reason magazine senior editor i'm in i rarely get to talk to jacob is back. tell me, do you share some of these concerns about justice kavanaugh's past opinions and dissents in regard to the fourth amendment? >> yes i do. i hope he doesn't take the view that neal gorsuch does for example but in telephone records he correctly stated theirs is thing called a third party doctrine which was invented by the supreme court which said once you entrust your data to somebody else all bets are off and there is no longer any fourth amendment protection for that information. he he's relying on supreme court precedent especially about his opinion in that case was that he said even if this qualifies a certain part of the amendment it

certainly is justified because we have to prevent terrorist attacks. it's completely deferential to the governments excuse without any inquiry at all into whether tax this program does prevent terrorist attacks. kennedy: those two things, third-party and special needs, they are both terrifying because they can both be rationalized and abused depending on the whim of the government agency. let me ask you because you have a better understanding of the history of the supreme court and obviously having that lifetime appointment needs -- means you never have to interview for job ever again. how does one view historically change in terms of the constitution if this is the starting point? is it likely that brett kavanaugh has some sort of a constitutional evangelical moment or he sees the light of originalism?

>> conceivably he might change his view. we don't really know what his view is of a third-party doctrine. he applied the supreme court's precedence in that area but he was asked during his confirmation hearings about it this year where they said if you go to cell phone companies and get records to track somebody's movements over weeks or months. >> at does require a warrant. kennedy: every single thing is third party and all the information we have and we have everything on the hour phones. >> were such pointed that out and it was very interesting he was highly critical of the third-party doctrine in that case. he wrote a separate opinion where he said what is left of the fourth amendment if everything we trust is stored on were more servers is open for

the government to peruse at will i think because kavanaugh said that decision was a game-changer and not nearly precedent perhaps he is open to rethinking the wisdom of that doctrine. kennedy: and how the fourth amendment directly relates to technological innovation which is a critical issue and you have to have a justice who understands the importance and the breadth of technology. do we have that now? >> for example justice sotomayor had similar misgivings about third party saying think about all the sensitive information about you. you are trusting them to protect those that the government is claiming the right to look at it kennedy: i will tell you the one

endorsement due to the landscaped? >> i'm going to afford taylor swift some liberties which of course liberals mocked her in 2016 and derided her for not supporting hillary clinton are being vocal about the election. if she wants to speak her mind about these elections she's welcome to do so. i also don't think contrary to what she she said and superimposed the she's obligated to support marsha black born because she herself is a liberal. in terms of the impact on the political landscape i think her post was clearly timed against the registration deadline. clearly it was intended to gin up some votes which is notoriously difficult to turn out in midterm cycles. it remains to be seen but as you mentioned or as the president mentioned rather marsha black earned up in the polls and i think that kavanaugh momentum

will propel her forward. kennedy: the thing that propels her was her political agnosticism. what is that due to those who love and adore taylor swift? >> breaking news and artist supports liberals. but you always run that risk. as soon as you leave your area and she has freedom of speech. she is just as much has the right to voice that is to not voice that as you pointed out. as soon as you enter that different round you open yourself up for criticism whether you're an athlete or an artist into pms with you those are the two groups that were deciding fewer future was going to be governed by. kennedy: does anyone change their vote because of taylor swift? >> i think of course you can be against the trump candidate.
