>> certainly since on facebook has been poor going into earnings. you know, there's concerns about advertising and how great of an advertising platform it is. because of the data breaches and overhang from cambridge analytica it is a great user base 2.2 billion users finding way to monetize and monetize effectively could turn stock so maybe some strategic comments would help. but i agree sentiments is bad. >> you have the stock itself facebook actually is down year to date right now. 19.9% we were just looking at that chart. that, i mean, the nasdaq is only down maybe 4, 5% for the year blanking on that purple. but 11% of value lost in october so far. month to date on facebook sew the question is, if you were maybe buying this stock on dips maybe this quarter could be turn arngd and that's when investment could pay off and to your point. advertisers in north america and canada will see with north america that is breads and butter for facebook it turns out. >> absolutely.

they make about $6 a user in advertising. in north america, that really is a breads and butter, and finding ways to either increase ads spend from a company or to increase other ways per userrer to monetize that user base to bipt the stock we haven't seen anything straw teenage that i can point in that direction yet. >> you're not looking for great things from are facebook but we're going it see when facebook reports excuse me, after the bell tomorrow. let take a look at apple. because the different, different story for apple right there are worries china we're going to get into that but at had point the stock is higher in premarket looking pretty strong. it seems to still be about iphone with a l and they did kind of escape that chinese tariff on apple watch those seem to be more positive notes when you look at the commentary surrounding apple earnings this week. >> more volatile sector compared to market. apple is stability and user base

with iphone, and their ability now to sell services, and accessories has really been what's driving earnings underneath because iphone itself is a single digit unit growth story they are getting higher sp on the iphone to roll through this quarter. but it is really that underlying growth in accessories once again monetizing monetizing that stalled user base. >> one thing that is key when earnings cool out later this week the services that is the app store that is a l music. those are things that they really have been able to grow, and so seems like whether or not they sell more iphone and price points have gone up because more expensive iphone 10 is they can deliver there that seem to say a better future for apple than trying to come up with next big thing, and we don't really have that steve jobs the next big invention from apple we haven't anyway. >> well certainly apple is still an incredibly innovative company and innovating in services is a

you thanks for joining us. yeah i know let's start with robert bauers the pittsburgh shooter, 29 federal counts that's what he was charged with late on saturday including hate crimes why are these federal crime and not state crime? >> the hate crime nature -- it is in the federal code it is objection of exercise of religious belief resulting in death that particular statute allows for death penalty that's what everyone is talking about today including ag sessions yes. >> certainly. the state there are state charges that also pennsylvania has a state death penalty too. i think this is a no-brainer when it comes to prosecutors decision to seek the death penalty. >> do you think he gets the death penalty the way that would play out -- >> a long way from there. you know, the most common defense on things like this is the insanity defense. so we shall see. we should see the mental state of the individual, that is the task that the fbi and law

enforcement has right now. to get into the mental state as to why he did what he did. if it was intentional, if he went in there and he has no other underlie issues yes i believe it will be a death penalty case. >> so his neighbors he appeared as normal which makes this case in scenario even more frightening. let's move to the pipe bomber the suspects there -- he was charged with five federal crimes. including interstate transportation are of an explosive illegal mailing of explosives. threats against former persons et cetera but he was not charged with terrorism. what do you make of that, david? >> well that's not to say that he will not be right. the criminal complaint itself is just the first step because the -- because the united states attorney office has 30 days to diets and it is normal that they do not include all of them here. the first two charges that you see there, that interstate, that travel as well as mailings are

the most serious of these chargeses they each can carry up to -- ten years. and there's 13 bombs so it's all going to be within the discretion of the prosecutor as to who they think is a fair resolution. qnch lick here david speaking of the bombs. he says -- he didn't intend for any of them to go off and he didn't intend to hurt anybody. how does that or does that change the nature of the way he's tried? >> well first of all there weren't, there wasn't confetti in pipe bombs he put explosiveses so he has a problem there. he may say that. but the actions that he took, and the materials that were in the packages themselves just defy that explanation. so it's just not believable. point-blank. >> your expertise is always appreciated on matters like this davids we appreciate you. >> yeah thanks appreciate it. all right, well let's get some appreciation to our markets okay

this economy is absolutely on fire but we have a lot of political concerns that have added to volatility. volatility indeed but bull markets go high or with earnings from facebook and apple that are out this week. u.s. stock market futures starting week mixed dow is down 24, and nasdaq is up 30 points. and that follows rough week last week with dow down 3% the s&p 500 and nasdaq down 4 nct on track for worst month in eight years. >> in european stocks opening the week to theup side green across the screen here. german market is up half of one percent. shanghai composite down another 2%. some are call for him to deliver bad news. fbn:am continues right now.

the election and, however, that being said it really depends a lot into critical earnings for the market. facebook reports apple reports, an i do think that market could recover from the selloff and in the last two weeks if we get good news out and reports bit end of this week and a strong rally. >> i want you to keep talking as you're speaking s&p went from negative to positive looking at futures and dow is 11 right now. what do you make of -- facebook intending earnings report what do you expect from them? >> we're in desperate need of a tech savior and facebook has been in the penalty box. i mean, they're still repenting for violating user privacy and data what's baked into share price right now is addition appointing report profits are supposed to be down about 9%. it is lower that that, look out below we're going to be praying for thursday to get here and apple to save us. because if facebook can't do it

apple will have are to. do you expect a toll save tech and i want to get your opinion of the wall street journal report this morning that billions of dollars in fines from asia and lasten america i shouldn't say fines but taxes can come on these big tech giants because that would look to tax their revenue instead of their profits. >> the global first question the global tax and regulatory changes happening to tech stocks is one with of the reasons they're not doing well right now. they've gotten kind of easy ride for several decade both regulatory and in taxes waiting to shift earnings around those gory days to coming to an end quickly as far as what will say we've with had a lot of great earnings reports this quarter and not slaving slide. they are scared that end is here and take more than just one tech company got earnings led expect instagram to look goods and facebook not so good and apple sell expensive phones to help but it is not going to turn around this slide and tech stocks take more than that.

a real shift in confidence. >> melissa do you think these worries -- that are impacting stocks are spilling over into other asset classes like commodity and currency? >> not necessarily. it is the tech stocks have always been in their own separate bucket and earlier this year facebook is even in its own bucket right now. because i really don't look at that when i look at google and amazon because stock and took is down trend and when you look at what's happening in overall worlds and look at the pus dollar it is getting stronger and stronger and stronger and i think we're a long way off from a recession interest rates are rising because economy is so strong and no reason to think that economy is strong and not be strong. we have had goods earns like jonah said and even though some stocks are react ared not as positive as we would have liked in earnings, based on as far as the stock training, but you have reported well. i truely believe that apple is the one to watch this week and here's why. apple is strongest stock right
