fully denounces white nationalism. other leaders are saying they are worried that the president comes it would serve as a distraction for the funerals of those who were killed. white house is hoping that this trip will serve as a moment of national healing in unity. this afternoon the man is possible for this work attack made an initial appearance in court. 46 -year-old robert bowers was in a wheelchair, still recovering from gunshot wounds in a federal magistrate read 29 charges that he is facing. investigator say the pittsburgh native repeatedly said he wanted to kill all jews as he went through the synagogue saturday morning for killing those who were there to worship. those who survived say it is a miracle that they are still alive. >> [inaudible] there was a pause in the shooting. i'm pressed up against the wall and carol was kneeling on the floor to my right and the

gentleman walks in with a loan gone and i could see the jacket he had on and a pair of pants of some sort. he did not see us, thank god. reporter: the gunmen shot several times by police and today we learned the first hospital worker to treat him were all jewish. >> as i understood the gentleman was getting off of the ambulance and he was continuing with his rant of kill all the jews. but he did not realize that the nurse that took care of him, was his father's rabbi, and the doctor in the emergency room was jewish. these people put aside their beliefs they had about what this gentleman was into us, he's a patient. reporter: you can see tonight here outside the tree of life synagogue this vigil that has been growing over the last couple of days. thousands of people have been coming by to bring flowers, candles, cards and a lot of them

singing, praying and a lot of tears shed, as well. all of them wanting to express their sorrow as well as their unity with the jewish community here. the first funeral will take place tomorrow. one of many in the days to come. kennedy: garrett, thank you so much. people want to express somebody and take some of that pain away. it's incredibly helpless feeling but they're doing whatever they can in that community setting an example as we come together. meanwhile, the suspect in the mailing of at least 15 potentially exposes devices to prominent democrats and cnn was also in court today. that comes on the same day in muscular sound another suspicious package, 56 -year-old cesar sayoc was arrested friday and he is not yet entered a plea according to the feds. the strip club dj lived in a van that was festooned with bart right propaganda. one of his attorneys urged people not to rest to judgment.

senator cory booker, james clapper, former director of national intelligence as well as others. he faces five charges including interstate transportation of an explosive, illegal mailing of an expose of in the threats against former presidents. if convicted, he could face a maximum sentence of up to 48 years in prison. as he entered the courtroom using pictures or drawings your, his wrists were shackled, calm during a short hearing and not mouthing the words i love you to one of his sisters in the gallery. prosecutors argue he should be denied released on bond which means he would be incarcerated at least two until after the trial. cesar sayoc had a list of roughly 100 possible targets that was discussed or discovered after his arrest and officials are notifying those targets. that disclosure coming as authorities intercepted a suspicious package addressed to cnn headquarters in atlanta today. that package was discovered at a male facility.

charged and it is interesting because why wasn't he charged with terrorism? why he comes? >> is a unique situation in pennsylvania because there has been a moratorium on the death penalty since 2015 by the governor so federal prosecutors applying for authority from attorney general jeff sessions for that. this was an act of domestic terrorism. if you define terrorism, a targeting of a silly and publishing with an intent to course or intimidate a publishing but we have no crime of domestic terrorism. we have the code under 23398 section and b which prescribe material support to designated terrorist groups and foreign designated terror group but we don't have designated domestic. there is a debate. kennedy: i don't understand the difference between being a lone

wolf who does something because they were inspired by isis and being an individual who is really inspired by hateful, murderous neo-nazis and goes out and mows down 11 people in cold blood. >> the controversy around the issue is that you can designate a foreign terrorist group like isis, for example, or islamic jihad and there is a long history showing that you can be prosecuted for providing material support to a designated terrorist group but you don't have a free speech first right to associate with these groups and to aid and abet them in a way when it comes to the master group like a neo-nazi group you have first amendment concerns. if they are designated and you provide legal counsel to them with that be a violation of material support? how does that comport with their due process rights? with my free speech rights if i want to retweet something they did provide an element of advocacy for them? which is white with someone commits an act of domestic terrorism they are charged with

murder, first-degree murder with federal crimes and so forth. kennedy: what you think the chances are that we will see federal prosecutors go after that death penalty conviction? >> they have indicated their asking for authority to do that right now. kennedy: what will jeff sessions do? >> i think it's likely he will authorize it and we will have a conviction. clear evidence of this man's culpability and there was a shoot out and he was caught on the scene and i don't think there's any question as to whether or not . kennedy: can they still think that the front of the? >> yes they can. it goes to a particular sentencing trial, so to speak, where you have a jury and the jury has to convict unanimously unless they are mitigating factors. kennedy: in federal court? >> yes, and also there will be a separate sentencing and is a due process issue in the top of that the defense will argue that medicating factors whether or not there's a mental illness

issue and they will convince a jury which has to come to unanimously the conclusion that they would apply capital punishment. kennedy: premeditation. he knew what he was doing. he broadcasted so i think you'd be hard-pressed to get the mental illness conviction, given that some of the cohesive sentences he was posting online. brooke bolton, thank you so much. we'll keep the conversation open with you. multiple media outlets quick to point the finger at president trump in the immediate aftermath of the attack in pittsburgh and of course that bombs sent as well. earlier today, he offered his own theory tweeting quote -

>> thank you. kennedy: i will start with you, kaylee. people were very quick to point out first with the pipe bombs that were sent to various democratic operatives and news outlets that it was the president who directly inspired this person and there was a cause and effect between the president's existence in this person manufacturing and sending out pipe bombs. what you say to the people who want to pin it on the president? the neck is appalling and irresponsible. the same folks that are trying to pin the blame on the president are now the putting by pointing to the president tweet this morning. i believe in backs. cnn has that ad with the apple being the banana. let's look at the facts. president calls for unity and you point out cnn says were not just the president for blaming their sanders for the pipe bombs. then in the second scenario, horrific shootings we can, president called for prayers' pre- * law-enforcement and then watch cnn morning show and folks

over there are blaming the president and even joe lieberman has to say hold on, guys, this individual did not support the president. he's an anti- trump individual and he was a strange man. i believe in fact the fact that the media is putting blame and it's despicable. kennedy: something is obviously going on but not just the president not just the media because these attacks on synagogues and a big uptick in its isometric rhetoric and attacks and attempted attacks just in the last two years. what you chalk that up to? >> right-wing extreme is on. it's not coming from in this country at least not coming from muslim extremists which is something that might happen and perhaps europe or middle east. the vast preponderance of political activism that results in violence in this country and this is data base is coming from right-wing extremists often white supremacist. to a pin that on the president? i do not fit the president's rhetoric can be volatile at

times but they were in that political moment but the idea that this exists in a vacuum is not true. kennedy: go ahead. >> don't you think there's a little extremism about besides right now? the political attention from the extremism on the left and right are high and we can also say that the leaders of both political parties have a duty to tone it down as well. it becomes problematic when people take the leap and say because you have your rhetoric has been extreme because it has gotten the worst of america out that somehow you are responsible for that with both sides similar doing that and yet the bernie crowd and we know what one of his supporters did but he's not responsible for that. kennedy: i'd like to look at these things and abstract the variables we have including the president. if donald trump were the president and if it were hillary clinton would be still have this level of inflamed rhetoric? i argue we would.

i argue that before the candidacy of hillary clinton and president trump we had the obama ministration and you still had school shootings and mass shootings and i don't know if he was necessarily the best position for the health, cultural health of this country in that regard. >> but i don't think we've had piece for a minute. as you indicate it's not like in these troubling moments that is much as a great oratory as president obama was he didn't bring peace when it comes to race relations were anytime we had these national tragedies. i think both political parties have a duty to bring the temperature down and quite frankly leaders of the past ten, 12 years have failed. >> it's important to point out the media's role in us. when you have the washington post headline that reads in the wake of the de-escalation, serviceman shot no mention of the bernie sanders i dedication

[laughter] kennedy: let's talk about the challenges you hear from voters. >> people care about healthcare for sure. the funny thing is the astonishment parties are both fighting over that narrow point of pre-existing condition and that is an opening for me. in the debates we have had i been able to turn around on them badly because both parties, as we no, centralized healthcare in washington prices are skyrocketing and people feel bad about the options they have and i can make the point that look, medicare will be insulted starting in 2026. kennedy: it's insane. >> it's insane. and both parties are responsible for. they have no answers and ignore that point so i turn it around and i have been anything to resonate with people that they want someone being honest and that is honest. kennedy: in your theme for your entire candidacy has been something different. you give up healthcare.

you gave or i should say health insurance. >> that's right. it's amazing. i'm with a nonprofit in its group of people that decided to opt out of health insurance and we share each other's medical expenses. in the cost last year a blue cross blue shield of my family was 770 we paid $21,000 but this year we are under 6,000. it is truly a miracle with people can take ownership of their health insurance and put us in the driver seat and then things happen like costs come down. kennedy: that's a fascinating model. i'd like to see someone like you elected so you can hear more about those options because what they are offering now is a false dichotomy and you, my friend, when you assume the government here in new york state you're going to be tackling the greatest behemoth. >> correct. cuomo care here. looking at medicaid for all in horrible two-tiered system would

make sure that all the best doctors don't take any interest. that's what were looking to happen in the new york state. to his point, in reality we made an error we confuse healthcare insurance with healthcare. obamacare is not healthcare reform. it's healthcare insurance reform. i'm less concerned about interns are now but much more concerned about healthcare system which is a system. it's a cartel system where we get horrible care unless you pay out of your pocket. we have to change the actual health care system and make it to where it's far more transparent and where it's more like nonessential medical care where he gets do we have higher technology and higher service and lower pricing be what you want the innovation but you don't want to squash that and sometimes you have to pay more for things but with actual solution like matt talked about, publicans have shied away from campaigning on their tax cuts and midterm and is voters are not hot on the topic as they were before. more americans should be upset about the fact that our national deficit in 2018 will hit $779 billion in part because republicans only cut taxes and

not spending. how would a libertarian cut on the size of government? >> fi for tax cuts all the time on the trail and it's a good issue. i was a business reporter for a local station and a lot of businesses really do well from the tax cut so i talk more about cutting taxes and people feel it viscerally. you are right, spending such an issue and the republicans because they did such a terrible job on it with total control of washington they have opened up that flank where democrats make this argument that well, tax cuts are why deficit is so huge even though we know that's not the case but if we live within our means and cut spending we could do both so the ruffians have blown it on that. have to step in and be the responsible ones will be fiscally responsible to be one it is though publicans have given up and sets the tone and instead of admitting to failure and changing the attack the other side.

kennedy: you don't want to sound like a lute although i don't because crazy to want to get rid of these higher government agencies like the department of congress and move on apartment of education but how can you practically work people to make cuts? >> models are out there. take margaret thatcher, the great prime minister of england who privatize so much of england's public sectors. she went to a public, private partnership and slowly moved it out of the public side into the private sector. it's a model we could use here in the states across the board and it goes back to the competition. what is the role of government? if it's to protect our rights, life, liberty and pursuit of happiness and property then it goes beyond that at that point we need to think about writing it in and reeducating people. kennedy: reign it in. >> two issues. you mentioned how do people care and they don't care because of lack of opportunity. when you have a lack of opportunity people began to give up and learned helplessness.

they stop caring. new york state about 70% of us don't even vote anymore. we've given up. we don't care about anything. i want to feel better but how do you deal with texas? you can't just . kennedy: politicians just throw stuff at people and they give me your vote and i'm selling out. >> yes, but we can't just cut things either because when you cut things and cut them people become afraid. people who are afraid make bad decisions. kennedy: peter was at could use a scalpel and you can't use a cleaver. hemorrhaging and uncontrollable hemorrhaging - >> i talked often about the idea of using naming rights and in the structure and using the mta with at right lines in the evening. kennedy: i love for an effort to be named after me. this is a quintessentially american idea to take on a seemingly insurmountable flow and be done. that's how the country literally was formed. i appeal to it from a pragmatic standpoint. independent and congress have a lot of power both sides would be courting me for their vote and when pelosi and the democrats went too far i could check them and when trump and the republicans go too far, i could take them. it's empowering our district to have a more inferential voice. kennedy: is like a floater on big brother. spoiler. >> the spoiler of the democrats and republicans. they are thelma and louise and have driven over the cliff. kennedy: are you brad pitt? >> i'm not but i like the top of it. >> it is not true. the biggest group of people at the voting block are those who [inaudible] the concept i'm taking both from someone else is not accurate. i'm getting people who do not care to actually vote.
