"kennedy" begins now. kennedy: thanks so much, trish. the most important midterm election in the history of the world just one week from today, and by all accounts it will be a brutal sprint to the finish line. the senate up for grabs, the house up for grabs, and so are many governors mansions, which party has the edge as we enter this critical homestretch. well, first, let's go to the high-profile gubernatorial race in florida, former republican congressman ron desantis is battling tallahassee democratic mayor andrew gillum. and several polls show gillum in the lead today. they each made a pitch to

voters, sfwhuch andrew gillum, may be a third rate mayor but he is a first class demagogue and doing this stuff throughout the whole campaign. >> on november 6th right here in the state of florida -- [cheers and applause] >> we have a chance to send a message to donald trump and all of their followers that america is still america and the common sense of decency prevail here in our state. kennedy: hallelujah! the race for senate in texas also a nail-biter. a new "quinnipiac poll" shows ted cruz, lyin' ted, up by five points over the skateboarding challenger beto o'rourke. that number seeming to narrow by the day. republicans will likely hold onto the senate but the house, that's a vastly different story. if democrats win 23 seat, they take control. that's right. nancy pelosi gets her hands on

the scepter once more. many democrats have promised to impeach the president to undo the tax cuts and to generally sometimy the republican agenda and the latest real clear politics average has democrats almost eight points ahead on the generic house ballot. that apparently has the republican party pretty spooked. as we are already seeing finger-pointing as to why they may lose, but is it possible the blue wave stalls at the last moment? joining me now fox news politics editor chris stirewalt. welcome back. >> ma'am. kennedy: i'm so glad your tie and my dress are of a matching hue, sir. >> kiss met, meant to be this tuesday. kennedy: let's talk about this a little bit because republicans are hoping some of these last-ditch efforts and some of the immigration passion translates to secret voters who have been hanging up on pollsters where democrats just want to ride the donkey of

history right into the stable. what do you think is going to happen? >> i think your metaphors will crash over the third district of florida and we will be crushed. people have overstated the polls, overstated -- the polls are always wrong, how about this, the polls are generally right but always wrong somewhere, and always wrong somehow, and we don't know whether we're going to have republicans outperforming a point or so which could save a bunch of house seats for them in key districts and might hold on for them, or the democrats could outperform by three or four points week have a hard time polling lower income and especially hispanic voters. >> okay, there are certain groups that are difficult to poll and others who are obstinant and flat-out lie or won't answer the phone, that changed polling. those seem like static variables, what the dynamic

ones that can be influenced in this last minute jockeying. >> that's why the president all of a sudden is revisiting birthright citizenship, remember he started talking about ted cruz. you revisit stuff like that. talk about the kara van, keep people afraid. those are the good motivators. andrew gillum, be angry at donald trump, charge your anger for donald trump into something. way you want to keep your voters at a frenetic pace, feverish because it's not enough for them to go vote. they also -- you need them to drag their spouse. get their family, drive their mother, you want them so fired up, they're a forced multiplier and fear and anger the best tools to do those things. kennedy: interesting, i don't know that a stock market that has the yips right now is helpful to the economic message that has been driving the president's improving poll numbers.

that's how the president has been tweeting about it. you are absolutely right about immigration. one thing that's interesting, there was talk of impeaching justice brett kavanaugh, but with all the horrific news that we saw last week with the shooting at the pittsburgh synagogue and, of course, with the pipe bombs, brett kavanaugh is way on the back burner. is there anything within this seven-day forecast that you see coming up that we haven't thought about that might influence? >> it's the silly season now, and hard to have it come in effect. but you're quite right. electoral consequence, the polls are unambiguous on this count, sharp turn away from the president and the wake of the pipe bombing by, saturday was unmistakable. we've seen it already. people are grossed out about the national conversation about how rough they are, and now the democrats and republicans are fighting about whose fault it is. here's the rule. when things aren't good, the party in power pays the price and the republicans are the party of power.

kennedy: and trying to make the case that things are good and to maintain the status quo. now let's say in the offchance that republicans lose the house, who gets the blame? >> there will be plenty to go around and everybody will say if only the party would have followed whatever their own ideologically based argument was, they would have won. they would start a bitter period of recriminations. that's okay whether you are republican or democrat, that's okay. the real show will be one week from tomorrow when the democratic 2020 primary starts in ernest. kennedy: the president has a lot invested in florida, and some of the house races and certainly with the governor's race, is he somehow laying the foundation for 2020? is that part of his two-year strategy? >> he can't win without florida in 2020. pennsylvania, ohio, michigan,

wisconsin, in the upper midwest, he has stunning victories, especially in michigan, wisconsin and pennsylvania. if voters are this sour on republicans, that's a big warning sign for his party, so he's looking at scott walker in wisconsin. a host ever congressional seats in pennsylvania. kennedy: does walk ver a chance by the way? >> he's got a chance, but boy, he is in for very rough sledding and knows it. he's one of the people telling republicans for six months, hey, this is happening, it's serious. kennedy: don't take anything for granted and don't get complacent. he's one of the few people that says we're going to get shellacked. if he does survive, what will that do -- how does that cement his legacy? >> if scott walker can survive this, this will be fourth statewide win in five years and a guy who wore a duck hunting overcoat with a suit to be interviewed by bret baier yesterday, this would mean he can do anything. kennedy: he really can. i think the man can levitate.

he doesn't need a hoverboard. chris stirewalt, thank you so much. >> you bet. kennedy: can't wait to see what happens this next week. president trump talk tough on immigration, but today he dialed it up to 11 and said he plans to sign an executive order that would end the practice of birthright citizenship, watch. >> can definitely do it with an act of congress, but now they're saying i can do it just with executive order. how ridiculous. we're the only country in the world where a person comes in, has a baby and the baby is essentially a citizen of the united states for 85 years with all of those benefits. ridiculous. it's ridiculous. and it has tend to. >> have you talked about that with counsel? >> yeah, i have. >> where in the process? >> it's in the process, it will happen with an executive order. kennedy: man, those things make me nervous. legal experts believe such an order would lead to a battle in the supreme court over the 14th amendment which states that all persons born or naturalized in the united states are citizens

of the united states and of the state written they reside, but the president is facing skepticism even from some in his own party, including that rascal paul ryan. >> well, you obviously cannot do that. you cannot end birthright citizenship with executive order. we didn't like when obama tried changing immigration laws, executive action and conservatives, we believe in the constitution. kennedy: i love the constitution so much. democratic lawmakers have trashed the president as racist and accused him of demagoguery, but despite the blowback, republican senator lindsey graham plans to introduce legislation that would end birthright citizenship. will the president's pen be mightier than the cultural sword? joining me now, senior fellow at the cato institute, ilya shapiro. welcome back. he's back.

>> good to be back, kennedy. kennedy: it is great to have you. let's talk about this and talk about it from a constitutional angle because there is a bit of wiggle room you pointed out within the 14th amendment because obviously the president cannot undo a constitutional amendment with executive order, but there is a tricky line in there which gives him some leeway. what is that? >> well, the part of the 14th amendment opening clause that you didn't read when you quoted it, i have my handy cato pocket constitution. shapiro wedding edition i might add, and subject to the jurisdiction thereof, that is where the debate is. that is originally that excluded the kids of diplomats, foreign armies and indian tribes because those are foreign sovereigns, different sovereigns, not beholden to the united states. at the time in 1868 there was no such thing as illegal immigrants. but i think it's a close call, there are good arguments on both sides, but i think that

you would need a constitutional amendment because the kids of immigrants, tourists, what have you, unless they're diplomats or the foreign aggressors, what have you, they are subject to the jurisdiction of the united states. if illegal immigrants commit crimes, form contracts, they are subject to american law. and by the way, this is a debate about whether you need a constitutional amendment or an act of law. like what lindsey graham is proposing. that's where the fight is going to be. i can't fathom a plausible legal argument how the president can do this by himself. if the justice department offers legal counsel or something is hiding a memo, i would love to see that. that would be ingenious lawyering. kennedy: i agree with paul ryan here they was critical of president obama when he was issuing so many executive orders on immigration because he simply couldn't work with congress, but said he had a pen and phone, and by gum, he was going to get stuff done. but as we've seen, as this

president continues to undo much of president obama's legacy. the next president is going to do the exact same thing. >> me too. kennedy: and it's going to be more chaotic and confusing for people trying to come to this country legally. >> that's right, if you live by the pen and phone, you die by the pen and phone, i was highly critical of president obama. president simply doesn't get more power when congress doesn't act. that's not part of the constitution. i think this was more of a political ploy by donald trump. might be effective. see what happens in the elections next week as chris was describing. ultimately the legal debate before we get to the policy debate whether we should end birthright citizenship. the legal debate is over lindsey graham's legislation, he's proposed it before. i'm not sure he can get it through congress, you have to get through the legislative filibuster, i'm not sure whether cocaine mitch is going to get it there. kennedy: i want to bring something up, not only will you see a lot of congressional

fighting if democrats take the house and republicans maintain the senate. house republicans and senate republicans already hate each other so i don't see how they pass something like this, the only meaningful thing they've been able to come to agreement on is tax cuts so far and immigration, that is something that is much, much more hotly contested as we are seeing right now. go ahead, last word. >> my position on the policy side is we don't want to create a permanent underclass like germany has with its third generation turks that are still not citizens. that sort of thing. but on the legality it's a closer call for me than the policy. i think you need a constitutional amendment, but there are good arguments on both sides, as long as you don't do it by executive order. a president is not a king. kennedy: absolutely right. not yet. we'll see what happens in 2020. it's only going to get stranger. ilya shapiro, thank you so much. >> my pleasure. kennedy: very good. coming up, much more on immigration including the number of people in the caravan

crazy. this doesn't seem like a reasonable, thought-out plan. i understand people are afraid of the caravan coming in. better ways to solve the problem than to do this. the man loss of the marionette and loves symbolic gestures, we're all talking about it, aren't we? . i think there's a laziness to t the narrative in politics today and the president is doing a good job of leading them to where they need to go. >> the president has the ability to behave like a distractor in chief. a natural ability to manufacture a crisis in a time where there's not a need for a crisis. that's why you see him talking about this caravan, and that's why you see him talking about border security, sending troops. why? the media goes like this when he goes like this and it's a distraction. instead of talking about the issues that run the day, the issues that matter to voters, the things that republican

party and this president failed on, we're talking about something that will not matter come next week, seven days from now. he's done a masterful job of that, and i'm so frustrated by my own party who go off on this chase when he throws out the red meat. kennedy: have you ever seen five-year-olds play soccer? they don't do a zone strategy. they clump around the ball and it's like a millipede. they like -- all over the field. jim? >> true story. i do support efforts to strengthen the border. i disagree with the idea of tents in texas. because you're going to have every hipster in austyn glamping thinking it's okay. kennedy: where is the yert? i was told there would be wonderful salvadorians here. >> how are we paying $367 million for tents. kennedy: borrowing the money from china. >> it would have been cheaper to buy them off the fire

festival, which was a little bit of an overcharge. embarrassing. in that regard, to your point, i do agree that he does a masterful job of orchestrating the news cycle but at the same time, when you say the superficial issue that we shouldn't care about, that is the only thing we're talking about which is like stormy daniels and russia and things like this. it resonates with voters. kennedy: 52% of voters want stronger borders for security. this is a winning issue for the president. stronger border security and security theater. people start to see through that, last word. >> you know what does not cost millions of dollars? the president behaving like an adult sitting down with democrats and republicans. >> he sat down with chuck schumer and nancy pelosi. >> and rejected their proposal by graham and durbin. kennedy: let's stop acting like they were being chivalrous and

they hated sarah palin so much they became alexandria ocaseio cortez. kennedy: you know what i always hated? gisele. president trump was in pittsburgh where he visited the synagogue where a gunman killed 11 people as they prayed on saturday. fox's garrett tenney is there with all the details. garrett? reporter: hi, kennedy. the president and his family came to pay homage to the 11 people killed in what's the worst anti-semitic attack in u.s. history and deliver a message of support to the jewish community, not everyone welcomed that message. hundreds of protesters filled the streets near the tree of life synagogues at president, first lady and ivanka and jared kushner, practicing jews, visited the site where 11 people were killed. first couple laid white roses at a star of david for each victim. second stop was the university of pittsburgh medical center

in your apple. that sounds dirty. touting his company's beefy and bolstered security measures, tv time raved about europe's new private law the gdpr and hopes the united states will follow suit. i applaud cook's national inclination towards privacy and less liberty which is implied in several amendments of the united states especially the first and fourth, it is the special insidious cronyism that is developed between big tech and big government that's most worrisome. silicon valley is a grab bag for sticky fingered politicians in particular, california democrats, who were more than happy to steal your wealth to ensure their power. and if they're on the take and beholden to hoodie wrapped millennial billionaires, why wouldn't they let the technocratic pent afterate deal with the nib.

look at the history and destroying public unions to see how such systems corrupt themselves. tech companies who wield that much power and influence shouldn't have to be told what to do, and a new series of laws shouldn't need crafting when they invent new ways to thieve and lie. it's not right to steal and sell information and who's to say facebook isn't buying favor to stay in uncle sams good graces? tech companies will shamelessly work with the government to help the feds streamline what they do so clumsily. take your stuff. but tech will be ahead of government, and they should use that advantage to bolster the lives and experiences of individuals and not to boost their unholy alliance with the bumbling and corruptible state. and that's the memo. the constitution enshrines our right to privacy but the world is a tad different than it was in the 18th century. how do we ensure our privacy in

this brave new world? joining me former utah congressman and fox news contributor jason chaffetz is back. welcome back, sir? >> thanks, kennedy. glad to be with you. kennedy: let's talk about what tim cook was saying. i agree with him that privacy is certainly a right, and you know, you can be backed up by reading and interpreting the constitution, but do we really need new laws? >> well, we've got to be very diligent about what our government is doing. i think tim cook is right, what i'm worried about is i think most americans have no idea what the tech companies are doing. diving into our personal lives and doing things in cahoots with our government. most people don't realize that more than one out of every two people in the united states is in the fbi database. they may be suspicionless americans but facial recognition is in use by the government and getting that when you go get driver's license photos. kennedy: also clear at the

airport. i signed up for it which goes to show you that you think there's a certain level of ignorance. i think it's rational ignorance and i think it's generational. i think our entire generation of younger americans, particularly those raised on technology and have known only that who just assume there is no such thing as privacy. what happens when they assume power? >> well, and that's what i worry about. the laws changed a couple decades ago so a 13-year-old can enter into a user agreement. you are trading personal information, everything you look and see online, then become the data and property of these companies who go and sell it for a profit. but what i think is -- you give that consideration and you get value out of that, but you can't ever get out of that contract. >> i know, but the thing -- i understand that but two thing here they think are right. one tim cook bringing up the implicit right to privacy in this country, and that being a

natural right, and number two, the free market doing the job it's supposed to do without government force which is someone saying to his competitors, you are stealing information. we are good at protecting that information, therefore people should buy our products and that's why apple has a lot of devoted adherence, but the other thing they bring up in my monologue is there is so much money in silicon valley between facebook and google alone, you don't have to name other social media companies or tech companies, and they're more than happy to sit down and help craft these laws, to their benefit. that's how cronyism works. look what's happened with the health care industry. i brought up unions as an example, but look at teachers' unions and there are so many examples of this, where big money sits down with big government and crafts things in their favor. >> well, we have about 250,000 employees that work on i.t.,

and they make handsome salary. we spend about 90+ billion dollars a year, billion, more than the tech companies spend. federal company spends and it doesn't work. they still rely on the tech companies. very hard to attract the talent. but i worry about what they're doing with the data. the government can't secure this information. they demonstrated it through the office of professional management. opm, but now they're out collecting the department of justice, you're suspicionless. why am i in an fbi database and searched through public cameras when you've done nothing wrong. that is wrong. we don't collect dna or fingerprints when you're born but we are collecting your face. that scares me. kennedy: biometrics, that's the thing, tech will always be ahead of the government. if they pass some laws now, they will find a way to go around it.

that's fine as long as they're using technology to benefit humanity if there are not other companies should not call them out. i have more faith in the free market than the federal government. jason chaffetz, thank you very much. >> amen, thank you. kennedy: the u.s. enjoyed a surging stock market for several years now. and it was up more than 400 points today. we're all rich! october has been through a very rough patch for investors. president trump warned it's only going to get worse if democrats take congress in november. he tweeted -- if you want your stocks to go down, i strongly suggest voting democrat. they like the venezuela financial model. high taxes and open borders. president's trade war with china has been a big driver of stock volatility and last night, he told laura ingraham there would be more bumps in the road. >> how confident are you about it? >> i just say they're not

ready. >> $250 billion additional tariffs if that deal doesn't go through. >> $250 billion and $267 billion waiting to go if we can't make a deal. kennedy: lord, the dow tumbled yesterday. shot back up today. down about 7% this month. how do you keep your money safe in uncertain times? joining me national taxpayers union senior fellow and center for a free economy mattie duppler is back. people are checking their 401(k)s and are freaking out. what should they do? >> stop freaking out. just be cool. two reasons people want to look at this. one is that price in stocks isn't that relevant. what matters when it comes to the stock market is the price of a stock relative to the value of that stock. and remember, this year, we saw for the first time, companies reach trillion dollar values, amazon and apple, big tech stocks, those are massive valuations, in some sense it's not surprising that the stock market had to cool down a

little bit. you saw trump too talk about context. context matters when it comes to the stock market. for too long we've been conflating the stock market and the economy. kennedy: the president does take credit for it when the stock market goes up. will he take responsibility when it flattens? >> this is the question all observers have been asking all year when. is the stock market finally going to price in all of this trade anxiety. we've been waiting for months for the market to finally start to behave. that is a major factor what we've seen this week. you mentioned before that all of october, we've seen a lot of volatility, but remember the fall is generally september and october are volatile months for the stock market, and end of october we see an uptick. september was not as bad as anticipated. i go back to original point that stock market movement is relative. we thought we would see more of a downfall in september, we're seeing it in october ahead of a midterm where you heard from the president. democrats may take control of the house which case we'll
