paris market and frankfurt market each down a quarter of 1%. cheryl: stocks in asia higher, big reaction to midterm election bounce we got here shanghai the only market that actually saw loss. lauren: tesla named new chairman of the board to replace, elon musk, fbn:am starts right now. ♪ cheryl: 5:01 a.m. in new york, good morning, i'm cheryl casone. lauren: good morning, everybody, i'm lauren simonetti. cheryl: we start with breaking news that we are following out of southern california right now, a gunman opening fire at a bar in thousand oaks california injuring at least 11 people including a sheriff's deputy, live pictures from kcbs, this happened around 11:20 local times, 40 miles west of los

angeles, this happened at the borderline bar which is known for country music line dancing, large space, 2500 square feet according to website. lauren: that bar was packed with college students, they were there for college country night and the man, the shooter reportedly used smoke bombs and fired at least 30 shots. >> apparently shooter came in and they did whatever they could to get out, broke windows, got out, got friend out, said friend tim was hit through the shoulder. after that, he said took up to 10, 15 minutes before he saw cops and everybody started getting there. lauren: suspect has not been caught, the suspect not believed to be outside of bar either. witnesses say man had beard and hat and black jacket, we are going to monitor this breaking news story and bring you the latest developments as we get them. cheryl: we also have other news we are following this morning to washington now where it's either

new era of working together or gridlock, house democratic leader nancy pelosi saying that her party would, quote, strike for bipartisanship and democrats have priorities that need to be addressed. >> the biggest winner in yesterday was health -- the health care for american people, for our seniors and hard-working american families. health care was on the ballot and health care won. cheryl: senate majority leader mitch mcconnell does agree that health care will be top priority. >> well, look, the health care system is still pretty big mess and it's obviously now going to have to be addressed on a bipartisan basis because the democrats will control the house and i don't think anybody is satisfied with the status quo. lauren: president trump also addressing the importance of bipartisanship. >> there are many things we can

sit down and talk to you about it. there's no great secret. a lot of administrations make changes after midterms. i will say that for the most part i'm very, very happy with this cabinet. we are doing a great job. >> the president vowed he would try to work with democrats the next 2 years, the president telling me he would be open to some sort of deal involving middle tax cuts even if democrats raise taxes on corporations. >> i'm a big believer in tax cut i would pursue something if it means some adjustment. >> corporate individual in. >> to make it possible, i would love to see tax cut for the middle class now, that'll be their decision. >> sessions firing remind they're democratic takeover of the house isn't the only shake-up in washington, remains to be seen what the president's cabinet looks like come 2019 back to you in new york.

lauren: normal tweet coming from elon musk, congratulations there . investors will watch rate hike meeting and additional increases they they foresee and predict for 2019. the fed has been gradually raising rates from preventing economy from overheating and control inflation, we would have the federal reserve's announcement for you 2:00 o'clock eastern time. cheryl: also today latest earnings earnings from wallet disney, after the bell today, earnings for shares expect today jump nearly 25% from a year ago with revenue rising and expectation 7% and investors also looking for any additional comments from disney following its deal to acquire most of 21st century fox entertainment assets, the parent of the fox business network, taking a look at shares of wallet disney, up 8% so far this year, stock to watch today.

as well this morning, you probably saw it happen on your screen, dow industrials soared nearly 550 points yesterday as a result from midterm elections came in. pretty much as the street expected, could this be the start of 20% gain for the s&p 500 one year from now. alan, senior portfolio at ebs, is here with us, good to have you, sir. >> good morning, cheryl. cheryl: if history points to what they believe will happen, they are looking for 20% gain from s&p based on the structure that we have now, which is a democratic controlled house and republican controlled senate. what do you make of that as we see these numbers from yesterday which are pretty big for market? >> market is clearly optimistic and that reflects a real sentiment among the business owners in the economy and people participating in the economy, business owners are extremely positive. we did a study at ubs of

business owners and what their sentiment was and what they thought of the president's policies and with all of these things we see a market that can go higher because people have such a sense of optimism. cheryl: yeah, optimism is there, business owners obviously like the fact that we have less regulation, they like the fact that, you know, corporate tax rate has been lowered, i mean, is this really proof to you that the trump economy is working? >> the trump economy certainly seems to be working, if you look at the numbers, if you just metric like the unemployment numbers, we have 3.7% unemployment and we have people who were hungry to get people to work for them and we have stock markets that have done this well since the president was elected, you to give some credit to this administration to brought about new policy change and real animal-spirit shift in the economy. cheryl: yeah, let's talk about some of the sectors, we saw a lot of the marijuana stocks

actually start to spike yesterday because you had some of the referendums that passed in a couple of states as far as expansion of use recreational marijuana or from medicinal purpose depending on the state and you also had healthcare names, healthcare names got boost because seems to be the think asking that you're not going to have anymore interference with these drug companies or any restrictions placed frankly on drug company stocks, what do you make of that? >> well, i think there has certainly been a pullback in regulation, that's one of my areas of expertise, regulation, you have seen pullback in regulation, you have seen it across a number of industries and that has certainly helped markets, in terms of marijuana stocks this is an area that a lot of people are focusing on and looking at but, look, the fundamentals are extremely powerful, extremely strong in the country, potential head win, there's things like the federal reserve but right now the economy looks strong and value looks like the place to be in america. cheryl: we can show viewers pot

stock and as we do i do want to ask you before i let you go g20 meeting president trump and xi jinping seems negative catalyst if nothing gets done. >> business owners feel like america has not been treated right in terms of the world economy, the tariffs are the expression of that and so what we are seeing is a positive look even at things like tariffs, so i'm hopeful for the g20 meeting. cheryl: i like the optimism, alan, great to have you on the show. please come back. >> thank you for having me. lauren: 3-day rally on wall street stalled this morning, futures are down across the board, dow is down quarter 1%, still ahead, midterm ballots, they're still being counted, leading go getters are claiming victory while opponents are saying not so fast.

rush into stocks, yesterday we saw the major averages surge more than 2% each, broad-base rally but some sectors like the prospect of divided washington more than others, we bring in jimmy lee of wealth consultant group to talk about but first, jimmy, i wanted to ask you, why are we seeing such a rally, we are giving that up this morning but over the past 3 days when we might see gridlock and no legislation -- legislative action for two years, why a rally? >> we know that one thick investors hate is uncertainty, i think with the election we know what to expect, maybe a lot of gridlock and there are certain things such as maybe the president's infrastructure plan that will get attention in congress, investors are excited with that as well as other sectors that might benefit with this type of a congress. lauren: infrastructure stocks whether it's u.s. concrete, bulk materials all up in big way, healthcare stocks too, united health all-time high, what do

you make any progress on health care, big issue on voters as we saw? >> we know the president has been talking about bringing costs down and that's a good thing we think health care is great sector, if we are entering the last phases but going to infrastructure names, utilities, telecom, energy, technology enablers, those are all sectors that potentially can benefit from, you know, infrastructure spending and a lot of money on the table and so i would look at government contractors that are specializing there. lauren: absolutely, and what about the marijuana stocks? they've been up 7 days in a row, ag session who is didn't want to legalize marijuana he's out, also several wins the governor in illinois is prolegal marijuana, what do you make of marijuana space, do you think there's more to come?

>> valuations are important and some stocks are trading at crazy valuation, they make money, it's unlike the internet bubble that we saw where companies didn't have any sales or earnings, but i think i'm bullish on cannabis and we have seen major investments already coming from the beverage space and tobacco industry is getting involved now, it's just a matter of time literally before all the states have some sort of form legalized cannabis and maybe federal government might get ahead of that, it's really troubling think when you think about all the cash that's been generated at places, they can't be banked and so i think something has to be done and i am bullish on the space. lauren: you would put money at these levels? >> well, again, company by company in very specific, i paid a lot of attention in valuation, though, i would be careful about paying too much for the hype. lauren: lastly, fed decision today, moody's global forecast,

expect today stall next year and the year after that, they cited 2 reasons, trade and the removal of globally of monetary policy accommodation, what do you make of moody's outlook? >> i think the biggest sea change of investors is can companies grow and make money without all of the stimulus that we've had from the world central banks and that's the biggest question, but we have a very strong economy here in the united states and so i think that, you know, the fed probably moves one more time and my biggest fear actually the fed moving too fast and killing the growth and we are watching closely but i still see opportunities for growth in the equity's markets. lauren: jimmy lee, thank you very much for joining us. cheryl: all right, change of leadership at the justice department this morning after jeff sessions admitted his resignation at the president's request, chief of staff met whittaker tapped to be temporary replacement, what does this mean for doj moving forward and who should take the reigns of the

department, some names being floated around are people that we know very well, alex azar, health and human secretary, pam bondi, the attorney general of florida, william barr who was the attorney general under previous administration, even chris christie of new jersey, what do you make of names seeing on the screen here? >> a lot of them are not surprising, long road to sessions' resignation, some has played out in the media, as of now matt whittaker is acting attorney general, trump will be seeking permanent replacement, now he has 210 days to make that nomination, have person confirmed by senate, all of those names obviously all very viable candidates, a lot of the analysis is going to be who will have a smooth confirmation.

cheryl: doesn't this kind of need to happen quickly considering that there's a lot going on at the justice department, the mueller probe comes to mind but also other investigations, you know, the issues at the border, immigration, crucial time to not have an attorney general in place. >> oh, absolutely and the attorney general oversees all matters in the purview of the justice department, so you're talking about some serious issues that need resolution, russia probe, border, there's so much that's on their plate right now so matt whittaker, he will be in the role of acting attorney general, that within his purview, he would be acting in that role, however, you're right, cheryl, there's a necessity of getting a more permanent replacement there. the law allows 210 days, you're talking about almost a year with the temporary replacement although, matt whittaker he's

been sessions' right-hand man, up to speed on the issues and very capable of oversight while trump decides who is going to be the permanent replacement. cheryl: what happens to deputy attorney general rod rosenstein? >> well, that's the big question mark because in typical succession rod rosenstein might have been the person designated as acting attorney general under the circumstances but remember back in september rod rosenstein there was the controversy about the joke of taping trump so not shocking that trump did not tap rod rosenstein in this instance, so -- cheryl: rosenstein, i want to add did deny those allegations. >> yes, he did deny allegations, but hey, it's certainly somebody to be considered in determining who you're going to appoint as acting attorney general. cheryl: misty marris, one of our favorite attorneys, thank you very much. >> thank you, cheryl.

marriage, maybe more of a shotgun marriage and i do think it's hard to say what might happen when you have a legislative leader like flanky -- nancy pelosi and someone like donald trump, some magic could happen here but we have to wait and see. lauren: shom marriages do work, nan, i question if it can work or we are like lie to see investigation after investigation after investigation, what advice would you give to pelosi and democrats? >> i would urge them and i welcomed former speaker, perhaps future speaker pelosi's words of bipartisan cooperation but i would urge them to get going on legislation, there's a lot of potential common ground including on infrastructure which everybody likes, but, yes, the more they concentrate on investigation and her incoming

chairs including jared nadler have been loud and clear that they want to spend time throwing the book at president trump, that will, i think, fail politically for democrats in the 2020 election cycle, the president has the economy and national security on his side, so they really do need to concentrate on solid accomplishments and that can be done if they have the right attitude. lauren: howard, president trump needs democrats support for nafta 2.0, the u.s.-méxico-canada trade agreement for raising the debt keel, they do have to work together. >> i mean, that is the expectation, i think you're right, i think you're laying out a need and certainly this president if he wants to continue his quote, unquote winning streak he certainly is going to need the legislative support of the speaker and the lower house, i do think, though, as conditions change if the economy falters or as the

democratic party also has to look to its base and certainly within the base a lot of desire to address some of the -- some of the -- i don't want to call them outright lies but some of the things that president trump has said and done over the last several years, i think there will be natural gravitation pull to pull loose threads of presidency and i don't know that speaker pelosi or anyone would be able to stop that desire from bubbling to the surface. lauren: in asking for the speakership she outlines, nancy pelosi outlines 3 priorities, nan, health care, increasing wages, as two of them and that makes people worried that the president might cut some antigrowth deals, are you worried about that? >> i think it's a concern that should be made loud and clear over and over again to both congress and the president and, you know what, we've got, again, the economy is on our side

because under this great president for our economy wages are rising, lauren, so they need to keep making that argument, 2020 has already started and it's going to be crucial that the president continue his agenda from whatever levels he can manage it and raising raisie minimum wage i think would be a very challenging proposition, that said, his new u.s. mc trade agreement does include wage requirements for certain industries, so that could be a stop to the democrats, we will see. lauren: as we wrap this up, howard, do you expect any deal to be done on immigration or do you expect the issue to remain a question mark for 2020? >> that's a great question, i mean, i think this really comes down to whether the president insists on a wall. i don't think democrats of winning back the house can see a way clear to making a deal that includes a border wall but if it does not include a border wall i

later, there was also two patrol on scenes who had been on local traffic stop and heard the traffic and responded right away approximately 3 minutes later the patrol officer and sheriff sergeant made entry into the borderline because they heard shots being fired and felt there might be additional victims inside. upon going through the front door the sheriff sergeant was struck multiple times with gunfire, the patrol officer stepped back and secured the perimeter until additional units arrived and he rescued the sheriff sergeant out of the line of gunfire. additional units arrived including s.w.a.t. personnel

from oxnard police department, ventura police department and additional officers officers fr, they made entry into borderline bar and grill, they found 11 victims that had been killed. the suspect who we believe -- was the only suspect was dead inside and there were multiple other victims of different levels of injury inside that were rescued from the scene and taken to local hospitals, in addition to victims inside and the numbers are upwards of 10 to 12, additional victims with minor injuries fled the scene on their own and took themselves to local hospitals. we have not identified the suspect yet.

our partners from the fbi were on scene almost immediately to help with identification process and crime scene processing, we have no idea if there's a terrorism link or not, as you know, these are ongoing investigations and that information will come out as soon as we are able to determine exactly who the suspect was and what motive he might have had for this horrific event. i would be happy to answer any questions you might have. have multiple shootings, we have no reason, i have nothing to lead me to believe or the fbi that there is any terrorism link here, but we certainly will look at that option. i'm sorry? [inaudible] >> what do you mean by devices? >> smoke bombs that -- >> there's some initial report that is a smoke bomb might have been used. we have not done anything yet, we have called in our bomb team to go and we have a couple of bomb dogs here that are checking the area but we have not found any other expose ifer device or confirmation that there was a smoking device. [inaudible] >> hindsight speculation is pretty easy, it was certainly more a planned attack and not something spontaneous. sergeant hill was on the force for 29 years, was looking to retire in the next year or so.

no we have not. >> what about the weapon -- [inaudible] >> we have not found any type of assault rifle inside the location. the only weapon we have found that we believe was used was a handgun but it's still early on and we haven't gone through the scene in detail yet. [inaudible] >> well, we certainly -- we have to wait till the medical examiner gets here and family notification so candidly it would be hours and hours. >> do you know if he had been to the bar before? >> we don't know anything about the suspect, we haven't talked to anybody that had any contact with them him prior. >> does he live here? >> i have no idea who he is.
