an order to deny asylum to migrants who enter the country illegally. the president's announcement is the latest push to have a hard' push on illegal immigration. immigration groups sued in california to block the regulation, arguing the measures were clearly illegal. it's not clear whether the case will go before a judge prior to the rules going into effect saturday. they could be extended, and they do not affect people. this is a strong underline, that we have already in the country. last year the president evoked similar powers to invoke a travel ban that was upheld by the supreme court.

lot of authority. the executive action president obama took, i think president trump is in a strong position. i wish this could be resolved with legislation. most of of the problems we have is because congress has failed to act for decades to impose some more. on the asylum, i'm not sure he's limiting asylum. he's trying to establish a process that's more orderly to force people to go through. we talk about the numbers of people coming in. one out of everybody five asee you slum claims are upheld. so they are trying to have a process there. i am sure judges will block it. everything president trump does seems to go to the supreme court. liz: we didn't see the aclu or anybody else try to block nor

of their own, a path to citizenship in exchange for turning of the border wall. both sides got greedy on that one. but that would still be a reasonable trade-off if they were interested in solving the problems. unfortunately i don't see unless pelosi giving that to the president in the next congress. i think she doesn't wants him to have this kind of victory going into 2020. it's sad. these are human beings coming in, and it's difficult. we need an orderly process. liz: what does it mean for the country that the supreme court may decide the border. can they do senate. >> effectively yes. they will decide whether president trump is acting constitutionally or not constitutionally. he has a lot of latitude under

the law. so this is a lot of nonsense in the lower courts, in the 9th circuit. but president trump has a better case in the supreme court. what he's saying is stuff president obama would have said a couple years ago. it seems to me they don't want any control at the border. abolish i.c.e. and sanctuary cities. what kind of rule of law is that? i'm pro immigration. i have got three daughters who are immigrants. but like a lot of the immigrants, most of of the legal immigrants want a lawful process. and that's clear and understandable that they can navigate, and we don't have that. liz: now you have the migrants saying we are not going to texas, we are going to california. >> what's the alternative to stopping the caravan? we are going to let just anyone cross in?

legislation that came forward other than attaching border wall funding to a spending bill. there was a bipartisan bill in the bush administration that couldn't get through glass you were people on both sides republicans and democrats who opposed it. it's a 20-years plus failure, and i don't see you pointing fingers is helpful. liz: we have thousands of caravan migrants. it looks like we have them deciding to leave mexico city and head toured the california border. this is a crisis. i think jessica makes an important point. stop the finger pointing. >> as the migrants are marching toward our southern border, they are waving their own national

2011. >> the dollar took a hit, the stock market took a hit, the bond market took a hit. nadler should know better than to threaten this sort of thing. it's the same thing that will happen if they threaten impeachment. it makes me disconcerted. liz: i want your thoughts on max eenl waters saying she wants to target wall street as the incoming chair of financial services. >> what i'm going to do to you is what you did to us. liz: what's your take, dennis? >> i love maxine because she is good for my newsletter. she gives me at least 20 pages a year i can comment upon. i love the fact that she is still in the congress. i am dismays, however, that she may be the chair of the house banking or finance committee.

what i understand is in the back room she is amenable to compromise. she is not nearly as bad in-house as she is when she is outhouse. so let's give her a chance. but nonetheless. there are better people to put in positions of authority for the banking committee. but she is good for 20 pages a year. i like her for that reason. liz: what's your short-term outlook for the stock market going up or down? >> for the next several weeks, i think down, i'm afraid. we had a good rally, but we did the on lighter volume. and go down to heavy volume will go to lower lows. if you ask me for the next two weeks, three months. i'm bearish on stocks. for the next several months, i'm afraid lower.

. liz: let's get to it's going to florida. allegations of voter fraud, democrats trying to steal the election? two major rulings within the past few hours. phil keating in miami for us tonight. reporter: good evening. also, the democrats here in broward county, palm beach county and the state of saying we are not trying to steal an election just trying to vote every vote cast. the two victories in court, critical for republican governor, rick scott. he was trying to unseat the democratic senator, bill nelson. in a closely fought battle race that looks like it will go to a recount which could start as early as tomorrow afternoon. the rulings by the judge's say that the superintendents of election and supervisors in broward and palm beach county, were not letting access by the campaigns, to watch the process of how the votes are counted,

how provisional ballots are determined to be good or bad as well as voter intent. also better access, closer to the action. so the observers from the campaigns can actually see more. all this was demanded by rick scott and he won his case. all day long in fact, it is happening still right now. the canvassing board meetings throughout the state in broward county, they are still meeting. counting provisional ballots. hundreds of them throughout the day. checking voter signatures, either making them valid or ruling them invalid. and either add them to the unofficial vote count or discarding them. it all should be wrapped up by this evening. that is because of accounting. the final 200 provisional ballots in broward. should end. also, outside quite chaotic outside of the supervisor of elections office be reminiscent of the year 2000, in that election recount. partisans on both sides yelling and screaming at each other.

each accusing the other of trying to steal the election. and change the results. florida's eunice senate race between governor rick scott and bill nelson shows a difference of 15,000 votes. that is the margin.out of 8 million votes cast, it is .18 of one percent testing for a recount. the latest numbers in the governors restaurant republican ron desantis, leaving democratic tallahassee mayor, andrew gillum, by 36,000 votes. it is .44 percent of the total. also, in a recount territory. in florida, any race decided with a margin of victory of one half percentage point or less, triggers an automatic recount. all of these unofficial results in the secretary of state office two more weeks for the secretary through an order every county in florida take the ballots, scan them to the tabulation machines, one more time for the recount. we expect county workers will

home and send in a ballot way too soon. that needs to be fixed but as long as it is not, our system is not going to be credible. particularly if the voting officials that do not let the accounting be public. liz: marco rubio tweeted a troubling -- palm beach county filled out new ballots to replace damaged ones without letting campaign representatives witnessed the process of creating the new ballot as required by florida law. there is that, there is also an florida state law it says, all absentee ballots and early voting must be canvassed, tabulated and shut down within one half hour of the polls closing. i mean rick scott was winning by 57,000 votes on tuesday.

now, he is just 15,000 votes ahead.why they still counting ballots? >> because there's so many others in different places and they let so many people vote, not on election day. they can vote at home, they can vote in lots of places. they can mail in ballots and they have to collect all of those. you have to look in closets. and it does mean that our election system, really does lack credibility and it needs credibility. liz: fred barnes, you are great. there so many things happening out there. brenda snipes, who is the official overseeing the broward county vote count. she's been accused of destroying ballots that were an issue in a lawsuit before the lawsuit finished. a lot of stuff happening. we will stay on that for you. come out, nancy pelosi opposition growing in the house from an unlikely place. now our efforts to become house speaker could be derailed by fellow democrats. we have that story for you. watch out for your taxes, it could be going up under the democrat-controlled house.

a tweet storm say the media has been tricked by donald trump. the media has been quote - easily played by the migrant caravan crisis. he downplays the problems of border security and is also worth noting that the new york times has been covering the crisis. this with a high profile drug bust. they seize half ton of crystal meth in days gone for the us. the question is, is it height? back with us we have kristin and jessica, good to see you. your take, jessica? >> i think is referring to that they are seeing daily live coverage for a week or two prior to the election coming from the migrants and their caravan. and as soon as the election happened, that is basically all but shut off. there was very little to date about the president 's order and what's been going on.

>> kristin, what's your take? >> the reason has been in the news last visit because the media has been focused on the midterm election results and of course the mass shooting that happened just a few days ago that was very sad. but i find it hilarious that the left thinks that the coverage of the caravan was some sort of trump trap set at head of the midterm elections. immigration is a serious issue that all americans care about. and yes, it is alarming when thousands of migrants are heading towards the southern border to rush it. but i really think this is just a pathetic excuse to explain a way the democrats underwhelming performance in the midterm elections. the message seems to be that, there is new blue wave because of the media. not because the democrats did have a compelling message. it seems that the inerrant nothing 2016 producer reflecting on what went wrong for them their finger-pointing again. liz: do you want to respond to that? chris sure, i have two points. one, the immigration issue is the largest issue that drove gop voters to the polls. according to all the exit
