be planning human stampede. what's going through your head as a military professional. >> it's likely we have pretty good intelligence. we saw manifestation of this when a caravan reached the guatemalan mexican border. the mexican police had given the indication to dhs or secretary nielsen's folks they were going to stand fast. and they did not stand fast as we all witnessed because they stormed that side of the bridge and the police recognized this may get into a violent situation, and they pulled away. we likely have some undercover agents wick suspect, with this caravan, particularly in mexico. we have some sense of what's taking place here. trish: some have been critical of that. they don't like the fact that we

have undercover agents and we have paid informant. but i'm sure this is what the cia has been doing for years. i think you can go back to the revolutionary war and you will see george washington made sure we had paid informants so we knew what was going on with the other side. dhs has the intelligence. of course, we do. i think as altruistic as we want to be and as much as we want to help people, we have a history of helping people and have a history of immigration. this is a different case. and when the president talks about an invasion, do you think, general web's on to something as we watch these people marching towards our border threatening a human stampede and carrying their flags? >> i think this is the first president who tried to put his finger on what has become a

continuous problem leading to an epidemic. thousands of people a month entering the country illegally just doesn't make any sense if you are trying to maintain the sovereignty of your nation. it becomes a national security issue to be sure. it was a big part of his political campaign. but i'm more interested in the fact he's trying to get something done with this. we need some laws to be written because the ones we have are not all that useful. but he's trying to use the resources he has to disincentivize people from coming to let them not won't be as easy as it was in the past. and obviously to do something about it at the border. >> even if it means using force, general, to protect our people. our troops. >> well, let's be clear about

what the' u.s.' military is going to be. you know posse comitatus prevents us from using fed cal troops for law enforcement. but as i listened to secretary mattis, he received the executive order from chief of staff kelly doing that for the president of the united states. and it did indicate that they can use lethal force if necessary. they can control crowds and detain for a minimum amount of time. what mattis has decided to do is -- hasn't changed any of the standing rules he has. he has new authorities. but he's only going to use them if secretary nielsen needs them. he's saying that the military police are the only ones that

will back up the border patrol and they will only do it with shields and batons. they will be unarmed. he'll only arm them if the situation gets to the point where that's lethal force is necessary. he doesn't think it will be necessary. trish: i certainly hope not. i want to ask you about the opinion piece in the "new york times." it's titled trump's border stunt is a profound betrail of our military. the president used the american military as toy soldiers with the intent of manipulating a domestic mid-term. >> i recollection. you worked in the -- you worked in the military for a long time. i would imagine if you worked in the military you wouldn't appreciate being referred to as a toy soldier. >> i think it's nonsense,

rubbish and likely politically motivated in opposition to a president whose policies they don't agree with. no one can dispute the fact that using military forces to reinforce the border patrol to deal with this kind after crisis is legal, authorized and justified. and listen. are there political implications with the use of military force? of course there are. if we are going to war overseas huge political implications. when george h.w. bush provided troops to hurricane andrew weeks before his election, were there political implications? yes. when george w. bush deployed troops' after today trin a, some people thought he didn't send enough and get enough done. but to suggest that this is a

to do equal right to those appearing before them. joining me is sean duffy. john roberts is trying to defend the court system. but let's face it the 9th circuit doesn't have the best'' record when it comes to donald trump. >> whether it's sanctuary cities or the travel ban. they want to look for a court that will look favorabli' upon litigation. we would like to think our court as non-partisan and they leave their partisan cred behind when they put on that black robe. but some of these petitions are filed in the 9th circuit because they are liberal. trish: then they get overturned in the supreme court. it seems a waste of resources to go through all that.

and it doesn't put the country in a good spot. you get furt earth division when the 9th circuit is going one way and the supreme court is going another. >> donald trump is trying to protect our border. you have the 9th circuits who has a different opinion on that. congress has to act. our immigration laws are broken. we have to come together. republicans, democrats, house and senate, and figure out to way to move forward and secure our border. deal with those inside the country, but figure a legal pathway for people to come into the country and fill the demands'. trish: you are talking about legal immigration reform. >> the courts would have direction from the congress. trish: instead we are look at what we are looking at tonight. the potential for a violent situation on the border where we

committed this crime and they are going to be punished and they sentenced five people. they are facing the death penalty now. so president trump's question is whether the crown prince ordered this or not. he's not 100% sure we have all the facts surrounding this. president trump wants to keeped in mind they are one of our strongest allies in the middle east. trish: i hear you, liz. this is why i would never want to be president of the united states because i think it's this kind of complicated stuff that causes you to not be able to sleep at night, and believe me from all we have seen and heard about the president, he doesn't sleep much at night. but you think about the challenge. let, think about it from his stand point, from america's standpoint. it's estimated the white house has said, edtold me this when i -- he told me this when i

that's what thanksgiving is all about. trish: we were talking about this upcoming holiday. my mother was a pretty big hillary clinton supporter. she liked her a lot. she still likes her a lot. i learned the hard way, don't talk politics at the holiday dinner or ever with one's family sometimes. some of us in the media, i would include myself for sure. we look at things analytically and we can appreciate the good and the bad in different circumstances. i try to be ex treesmly objective and independent and economically mind. i look at caravan from a national security standpoint and economic standpoint. but not everybody has the ability to distance themselves. a lot of people feel like they want their candidate and their side to win.

and it's about side versus side. again your 2020 campaign advisory board member for donald trump. but it hasn't have to be about politics. it's not left versus right, receipt versus blue. it's -- red versus blue. i would welcome the opportunity to have a meaningful conversation with people at thanksgiving dinner, i just don't want it to dissolve into an emotional mess. >> it's sad to see where we have come as a country with it comes to political polarization. when we look at this from a broader perspective, we all want so many of the same things. we just have different ideas about how to get there. you learn so much more from people you disagree with, and people in your echo chamber. i think that's what we can think
