sentence? >> we are already in touch with his counsel. lou: what turmoil, what nonsense and they just gin it up without so much as a blush. what are the leftist cable networks, what are they failing to mention here? one of the things they're failing to mention, take note of at all, no sitting president can be indicted at any time they're in office. they also have failed to account for every sound legal mind in the country that says the southern district of new york seem to be out of their minds and yet to prove any wrongdoing on the part of the president of the united states. >> so if he gave a million dollars to two women eaz hush money, there could be no crime. if he direct the his lawyer to do it and he would compensate the lawyer, he's committed no crime. >> there's one common denominator. there's not a shred of evidence of trump-russian collusion.

>> the short answer is simple. no 37 paying somebody to be quiet about something that was done or alleged years ago is not a campaign expense. >> i've yet to see any evidence coming from mr. cohen of collision and that's what started the mueller investigation to begin with whrd lou: it was its charter purpose. joining us now is andrew mccarthy, former chief assistance united states attorney in the southern district of new york. he worked in that office for 18 years. he knows it well. he's also a national review contributing editor, fox business contributor. andy, great to see you. let's start with this relationship among the special counsel attorneys were the southern district of new york, the manhattan da. this looks like a network of hack left wing attorneys at various levels of government who are working to assail the president of the united states, not to bring anyone to justice.

>> well, i think, lou, that you do have different groups of lawyers who are certainly have their sights set on the president. i think that the mueller investigation is continuing to look at collusion and obstruction of justice. the southern district of new york investigation is clearly targeting the president in connection with campaign finance violations. lou: you're talking about with michael cohen. but the simple matter is, you have noted this in your columns. michael cohen's crimes are his, not the president's. there is no culpability of any kind against the president. that was a construction of a hypehyperbolic group of attornes attacking the president through his once attorney. i mean, why can't people be

straight about this? >> if i may on that. lou: sure. >> look, there are two campaign finance alleged offenses to which cohen pled guilty and in which he's implicated the president at the behest of the southern district. it was not necessary for them -- lou: when you say implicated, that word means a lot of things. to attorneys one thing and to the rest of us the great unwashed. >> no, lou. i don't want to -- i'm not looking to hide what they're saying here is that there's a conspiratorial relationship in violation of a criminal law between cohen and trump. and what i am saying is, it remains to be seen whether this was actually a crime or not even if it happened the waco hen did. i was quite surprised watching judge napolitano on the program before yours say a federal judge

has found, ruled that this was a campaign finance violation. that's not what happened at all. what happened was the southern district charged what is very dubiously alleged to be an in-kind campaign finance donation and cohen elected, i think for strategic reasons, to plead guilty to that charge without challenging the underlying question which is a profound legal question about whether it is actually an in-kind contribution or not. the judge didn't rule on that. cohen never charged -- when a person pleads guilty in need rale court, that doesn't mean that the judge has ruled in the government's favor on every single conceivable objection that somebody might make to that. what happened here is the judge semid the guiltaccepted the gui. this that is not binding on mr. trump. were he to be charged, he would have the ability and opportunity

to argue that this is not an in-kind contribution -- lou: when you say he, you're talking about the president. >> i'm talking about the president. right. cohen's concession on this point is not binding on the president in any way. and the media is going to continue to say again and again and a number of other commentators are saying that there's a crime here and trump is implicated in it. and what i'm saying is the fact that cohen chose to plead guilty to this allegation does not establish for all purposes that it's a crime. lou: and what you're articulating is precisely why i raised my concern about the use of the word implicate as to the president. because implicate him in what? in what role? and how could michael cohen have any such presumption that he could do so. only at the behest, as you noted, of the special counsel

and the southern district of new york would he be asked to do so. it's showing you what a -- you know, if i'm going to go down a legal rat hole with anyone, i want it to be with your guidance, i assure you, andy mccarthy. but this is such a straightforward, to me as a layman, it is such a straightforward p preposterous,n secured attempt on the prosecutors, the southern district, the mueller team, perhaps as well the manhattan district attorney's office. we know the attorney general of new york is now going to bring in a mob rule in our justice department it seems to me. can you give us your insight adds to why we should tolerate such a network of partisan legal prosecutors in three levels of government going after a sitting president without any basis?

>> well, let's start with where we're at. the president hasn't been charged with anything by anyone yet. lou: well he was charged in a sense, if i may, andy. >> yeah. lou: he was charged with collusion. that charge has since been ultimately -- it's either been removed of its own weight from the charter for this special counsel. but now moving on to all sorts of absurd distractions and hypotheticals. and frankly, it's a tiresome tie task that we have to witness when it should be, it seems to me, whether you're a us attorney whrb you're the chief justice of the united states supreme court, you could be saying end it. >> yeah. well, look, i think, lou, as you know, my objection to this at the beginning was that the

justice department owed tight the president and frankly to the country to identify a crime that the special counsel was being authorized to investigate. and to my mind the crime at the beginning was this allegation of a cyber espionage conspiracy between the trump campaign and the kremlin. once it became clear that they didn't have the evidence of that, i think the investigation should have been shut down in the criminal sense. it's perfectly fine if the fbi wants to do an investigation of russia's threat to the united states election system. that's something that ought to be done. that's what we have an fbi for. lou: there's not been a commission to examine. >> as far as the criminal investigation is concerned, once they don't have evidence of the crime that was the rationale for opening the investigation, then the investigation should end and in a normal prosecutor's office, you don't time to keep investigating in yo if you don'd

a crime. if you don't find a crime in the case assigned you close the case and move on to the next case. lou: if the person who has recommended firing the fbi director is also the deputy attorney general of the justice department and he decide at the behest of a democratic senator and a democratically constructed fraud around a fisa warrant, he decides of his own independent judgment to go with a special prosecutor and refuse to recuse him, if which he is a witness, in which he is a prosecutor. my god, how rank and rancid the corruption in one place, and that's the deputy attorney general's office of the united states justice department. do you not agree? >> well, but i also think that the president is the head of the executive branch. so if the president actually thinks that what went on here

with rosenstein is corrupt, then he should fire rosenstein and people will hem and hk haw but e should look the american people in the eye saying this is what i found and i'm willing to be judged on that. he has to run the executive branch. lou: he does have to run the executive branch. and you and i both know if he made that decision, it would not be viewed as -- we've just been quoting and showing you the video and listening to the sound bites of the left-wing media with their hair on fire over an absolutely congress thrived absurdity, nothing but an art bt word. we can continue this. it's been an interesting voyage down the rabbit hole and when we emerge again i hope it will be soon.

paul ryan, nikki haley. you would have thought she was an international relations scholar from harvard or yale, not the former governor of the great state of south carolina. it's absurd. >> i agree. lou: let's turn to the wall funding where are we going with this thing. you've got kevin mccarthy talking about funding the wall, a little late. pretty late. i guess nobody is paying attention to what the president is said to nancy pelosi and summer. >> we're not going to get anytime the senate but i think the president forced the republicans in the house to move forward in the legislation and at the end of the day here, if he has to shut the government down for a couple of days, go do it. i think it's so important to his constituents and so important a they are saying in tijuana, give us 50,000 dollars and we'll go home and start a small business. lou: can you believe that?

stram american migrants march into the united states consulate in tijuana mexico today and they took with them an ultimatum. they want not only a free pass to enter the united states of america, they want 50,000 dollars each if they decide to turn back and 0 go home. it's called an ultimatum. this as it appears tonight the u.s. and mexican governments don't know exactly what happened to about 3500 of the original caravan members.

you can't say much more than oopses at this point. joining us tonight tom holman. good to see you. >> h how are you doing? lou: i'm trying to keep any sense of humor. when you think it can't get worse, you've got central american migrants encouraged to come to our border and think they can cross with impunity and some of them are finding out they can do that. i don't know what the percentage is. and now a group of them have been told they can expect 50,000 dollars from the united states government. you know, i can see some of the geniuses in congress and the senate going really, that's a good idea. we can give it to them in cash and wouldn't have to string it out in the form of education, public assistance programs. this is just about adds crazy as it gets, don't you think?

these 3500 apparently we can't account for. we probably know what did happen. they probably successfully got across that border in all likelihood. why don't we have a relationship with the mexican government that says, secure your border, take responsibility of your border with us, we'll each share in the responsibility to secure the border against terrorists, drug dealer twbs cartels. that may be the real issue. the cartels have for some time you, decades, run a considerable portion of the mexican federal government. >> absolutely. >> absolutely. and people don't want the talk about it. first of all, you and i talked about a month ago, we thought mexico would do the right thing but they didn't try very hard at it and now they're complaining that they've got all of these caravans here. they should have done what they needed to do on the southern

border, same as we do. it's just not mexico. look at what happened with trump when the president said you're not going to claim asylum if you enter illegally. the ninth circuit says you can't do that. the president had the caravan go to a port of entry and what the aclu did is sue to enter illegally, putting them back in the hands of cartels and we bank roll the organizations that smuggle these people. and you're right, criminal cartels have to be paid a tax. these criminal organizations smuggle people have to pay the cartels a tax to work through their areas. it's all about criminal organizations. congratulation to the ninth circuit and aclu for putting people these people in harm's way. lou: and thanks to this president whose attorneys are now appealing directly to the supreme court to get that ruling straightened out. always great to have you with us. thanks so much. >> have a good night. lou: you too. up next, the caravan migrants resorting to desperate acts. they're trying to cross our

senate for the president to get anywhere near actually getting the funding necessary to build the wall. it's the furthest from the 2020 election. so whatever political damage that might come from a government shutdown fight is pu off from there. he was elected with a mandate, build a wall. chanted at every rally he gave. the president needs to remembe that as he goes into this budget fight. patience is running thin. think about march, september, every spending fight the president has had i'm disappointed i didn't get the wall. next spending fight, it's not going to happen again. prove it now. lou: it is, as you say, this is his signature promise within that amazing campaign. the american people are depending upon him. and it's clear that the establishment that he campaign against represented in the leadership of both parties means to stop that wall come hell or high water. >> yes, they do. lou: i personally would like to see him demand $25 billion because that's the cost of building the whole thing.

just up the ante and watch chuck summer and nancy pelosi and paul ryan will be besides themselves as a result. be an apoplectic fit over it. let me turn quickly to the other issue the president campaign on and is fighting so hard. this president is the only international leader to stand up and say we need an international system of balanced trade for the support of our global economy and to restore it to growth. and not a single leader is standing with this president, major leader, leader of a major country. and this country is watching the chinese work through our business community, wall street, the chamber, the business round table to actually lobby against the president. your thoughts. >> well for anyone who preaches free trade in the united states, you got to get there by being forceful with china. china has been taking advantage of our capacity to be forgiving

in every single conversation we've had with them for decades. the u.s. policy has been roll over, play dead and hope the chinese eventually are a free trade country. it's not what's happening. i think pruch ha president trume at this with the right attitude. if you're going to get china to behave, you've got to punish them in to doing it. they're stealing our intellectual property, forcing technology transfers. they're never playing fair on the stage when it comes to free trade. the president is saying you want to get to free trade, start behaving. it's the right attitude to have. and i haven't heard from a single free trader what better options we have other than to levy punishments -- lou: just think, vince. without this president in the oval office we would have had either one of the 17 republicans he crushed or hillary clinton. none of whom would find it odd to say would you pretty please quit stealing hundreds of

lou: michael cohen sentenced today to three years in prison. u.s. district court judge william paully called the case a smorgasbord of criminal conduct. he said as well as a lawyer mr. cohen should have known better than to cheat the tax authorities and to lie to, mon other people, the fbi. radical dimm leaders pelosi and schumer debating with the president on camera, in full view of the american people, talking about the president's demands for border secure and construction of the border wall.

both pelosi and schumer showed us why it's not a fair fight. they did so a number of times as they tried to move the debate into a private setting away from those prying cameras and those prying microphones. the president made it clear the discussion was all about transparency. >> we came in here in good faith and we're entering into a discussion in the public. >> but it's not bad, nancy. it's called transparency. lou: transparency. the president made it clear he will settle for nothing less than a border wall as part of his border security plan. and after those cameras were shut off, the president said progress was made. >> believe it or not, i think it was a friendly meeting. you saw the beginnings of it but it actually worked out to be pretty good. i've liked them for a long period of time and i respect them both.

and we made a lot of progress. lou: secretary of state pompeo calling out rus russia by twittr after russia sends strategic bomber to, are you ready, to venezuela yesterday. the secretary of state wrote, russia has sent these bombers halfway around the world. they should see it for what it is, scel ching liberty and freedom while their people suffer. not the perspective i would have expected from our secretary of state. i would have expected something like this, get the hell out of this hemisphere and stay out. earlier this month president maduro met with putin and they agreed to ramp up venezuela's oil production. a strongly worded expression of concern for the funding by two

corrupt governments is the best way for the united states to enforce the monroe doctrine. i think we should be doing a lot better than that. cheum schumer says kamala harris will get to keep her spot on the judiciary committee. they were considering reducing the size of the committee but somehow schumer and grassley came to some sort of agreement about how harris will keep her seat, even after her yous ray yous conduct during the confirmation hearings for judge brett kavanaugh. we'll be right back.

well joining us now, fox business national security and foreign policy analyst. fred flice. fred, great to see you. thanks for being here. wally, let's start with you. this is the secretary of state sayinsaying that china is condug espionage against the united states. they've been doing it for 30 years. we know that. what kind of statement is that from the secretary of state. >> the chinese are crossing the red lines at this point in time. half a billion persons information has been taken by the chinese. the other matter is that china is expanding worldwide and it feels that it is now being met by two things. number one, it has to choose between capitalism and communism acting as a capitalist regime

but on the other hand it has the united states under a different direction under president trump. that's creating the situation where china is acting almost irrationally. lou: rationality began this week in credit to the president talking with white house officials, specifically robert lighthizer and the treasury secretary, mnuchin, the vice premier of china announcing that they're going to reduce tariffs on use automobiles. the country went nuts when the president put 10% tariffs on chinese products and started cheering when the chinese proposed to drop their tariffs 40% on u.s. vehicles down to 15% that's madness. >> it's a result of president trump's tough diplomacy with the chinese because of its predatory trade practices. the chinese are going to throw us a bone and try not to change their ways and the president

understands that. lou: the chinese and the russians. now they're sitting in venezuela, the russians are. the china wants to set up shop throughout panama. they want to own it. they well do so. they have loans coming due in ecuador for infrastructure, the debt trap that they've created across africa, they're trying to do it in the western hemisphere, central america and southern america. why are we just now reacting? i mean we've got more people paying attention to saud saudi a than they have to venezuela, to panama, this ems fear where the chinese and russians are making significant inroads. >> there was a hearing on capitol hill today where china was identified as the most serious long term threat to the

united states. president trump knows that. but we've had president after president that did not want to deal with this threat. let china take advantage of us over and over again congress trade. so i mean we've talked about this before, lou. this challenge to fix the economic situation is enormous. it's going to take a long time, a lot of pressure and we're going to endure some pain to fix it. lou: i don't know what endure pain means. but i know one thing you said disturbs me mightily. it's going the take a long time. this country has demonstrated that we don't have patience, we're not good at long wars. ask anyone who served in afghanistan, what has fought the wars in iraq, who is engaged now in trying to contend with the chinese and the russians. long wars, we should fix them fast. >> with one point, lou, is that china has two advantages. it doesn't have elections. doesn't worry about the opposition basically. and it is coordinating with

russia. it is coordinating with iran and that's why our media should see much clearer. lou: and these claims by the "washington post" that the president still has a rupture with the intelligence agencies. fake news. tell us what those. >> well, this is a great story. greg miller of the washington post called me sean aid he wanted to talk about this problem with the president and the intelligence community. i said this problem has been fixed, they've solved the problem that was caused by the political intelligence analysts who have been attacking the president. do you know what john brennan was doing smearing the president over and over again. miller ignored what i said. lou: clapper, comey, the list goes on. >> miller wrote a piece today that is 100% fake news. lou: 100%. you've never had that happen, have you? >> i've never seen anything like that before. lou: he said.
