same time for greater safety and control. yesterday the white house senior advisor for policy, stephen miller, gave democrats an ultimatum. watch. >> at the stake is the question whether or not united states remains a sovereign country. whether or not we can establish and enforce rules for entrance into our country. the democrat party is a simple choice. they can either choose to fight for american middle class or immigration you can't do both. kennedy: man oh man. chuck schumer said the president should blame his own party for the standoff. >> even the house which is majority republican, they don't have the votes for his $5 billion wall plan. they just don't have the guts to tell president trump he is off on the deep end here and all he will get with his temper tantrum is a shut down. he will not get a wall. kennedy: they poke him and he goes, where's the beef? so, will it take for the two sides to make a deal?

waterworks and the tears about the poor federal employees but the vastmajority of the government is funded. it's been the historical norm that after the shutdown , the government employees that were affected by this, will still be made whole and they will be paid retroactively. so everyone will be good and if we can do anything from this, i think they will see the president is absolutely serious about protecting our borders. kennedy: jim jordan says they can go ahead and force a vote in the house to give the president has $5 billion. he sounded very confident. nancy pelosi equally confident saying there's absolutely no way the republican caucus gets his house in order before christmas. what do you think will happen? who is right? >> i hope jim jordan is right. there are a lot of hurdles there. including in the lame-duck we

have a lot of people that will not come back next year. many don't even have houses anymore offices. so they could be logistical hurdles getting the members back here to vote for it. i hope jim jordan is right. if he is, then republicans should vote on it as soon as possible. send it to the senate and what we already know to be true, the biggest thing between reality and chuck schumer is a wall. kennedy: the wall means so much to both sides. it almost means too much. is there a way of changing the language at all to make it more palatable to both sides? >> well, i hope so. we also need to remind the american people that democrats used to stand for border security. just five years ago chuck schumer and 54 democrats voted for $46 billion in border security.kennedy: where did that money go? where did that money go, seriously? >> i have no idea. 700 miles of fencing and enhanced security measures. now they are for open borders and in room with a pulse get

succumbing to the united states of america and live scot-free. kennedy: this is one of the areas where i think we need to seek congressional accountability. because if they allotted that much money and we know it doesn't just go into a giant suck hole even though it might feel like that. it went somewhere. and obviously, it did not go toward the kind of security that both parties committed to at that time. $46 billion is a lot more than $5 billion. so you should easily be able to drum up at least 10 percent of that. >> absolutely. and they were supposed be 700 miles of fencing. we do have better infrastructure, more people, better technology on the border. in some cases we do have better barriers. but we need to figure out where the money is spent, what is left to remain to be spent and president trump should spend in addition to holding firm to the extra 5 billion he wants. kennedy: i think talking about that and doing some simple accounting is a little more productive than the play-by-play of this ongoing

game of shut down chicken. i don't mind shutting down the government. i don't mind showing the american people that their lives function even when entire swaths of the government is dysfunctional. and you know, if this is the way we demonstrate that, i don't have a problem with it. this is an economy where there are more jobs than workers. so if there are federal employees who are frustrated that they are being used as pawns in this ongoing game, then they should go out and seek employment elsewhere. and you know, maybe live more fruitful lives than just working for the federal government.>> absolutely agree. and there is a great economy there to support it. kennedy: marc lotter, thank you so much. >> thanks kennedy. kennedy: michael flynn will be sentenced tomorrow flying to the fbi by his contact with russia.

many legal experts say he was railroaded by then fbi director, james comey whose team told michael flynn there was no need to bring a lawyer to his interview. james comey testified in capitol hill for a second time. he says we should be more concerned with the presidents actions and with his. >> another day of hillary clinton emails and the steele dossier.this calm while the president of the united states is lying about the fbi, attacking the fbi and attacking the rule of law in this country. how does that make any sense at all? >> it does make sense because you're employing strawmen and fallacies and of course, just last week james comey told msnbc his range interview is something i quote - probably never would have done or maybe got away with in a more organized administration. well, it takes a special kind of sanctimonious sleaze ball to admit he played dirty pool and then get mad when someone calls shenanigans. but such is life of everyone six feet seven, emo poet. what does this mean for michael flynn in the mueller probe as a whole?

russia interference investigation. kennedy: i think they should have all known better. flynn should have known better and certainly mccabe and peter strzok had a professional responsibility to let him know what the stakes of the interview were. and that michael flynn might've been the subject or target of an investigation and this was not merely a couple of fellas sharing intel. >> agreed. they should have done this. they should have gone through mcgann. potentially they should have given him his miranda rights. kennedy: but that's -- and i tend to agree with some of the other legal experts to say that this is not necessarily entrapment. but, if what follows from this interview is a series of criminal charges, then certainly, it should have been a much more forthright process. it -- if nothing else.>> it is possibly unethical but there was a remedy that michael flynn had. he could have filed a motion to suppress if he was going to challenge which he did not.

he waved the rights and he pled guilty and he waived any appeals on the issues. kennedy: alan dershowitz said michael flynn did not commit a crime lying in this context. how do you feel about that? >> special counsel just released a three or two. i have not had the opportunity to see it. i will like to see that but lying is a tough thing generally speaking.here, he had to actually forget about the conversation, forget about the topic of sanctions.it is a tough case to prove generally.and we've not seen the transcript of that and we just got the three o2 which i have not seen yet. kennedy: is interesting because flynn pled guilty to the stuff. and that is an admission that he has done something wrong. if he went to his attorney and said, we were just sharing stories, they did not tell me this interview was going to lead to charges of any kind, they told me not to have a lawyer. a good lawyer would have said no, we are going to defend this vigorously, don't plead to anything. >> listen, if that is the only

partner was indicted for being a foreign agent of turkey. he was on the transition team, the trump transition team. michael flynn was head of the dia. he knew better. and as our friend judge napolitano has been pointed out, he hasn't doing the president any favors pretty closely we can just changes the timeline for the president and says that there's collusion is not a crime but then collusion is. he is changing things around and really irritating the prosecutors in the southern district. the only people who he knows, and he might want to call a favor and it would be helpful in a material way. kennedy: no, i think the southern district of new york is so different now than when rudy was a federal prosecutor. and they are so politicized. i too, surprised to hear you say that because i think the fbi is overstep their bounds. >> look, they overstepped -- kennedy: i think there is so

much heavy handedness with the fbi and surveillance in the way a lot of this is being carried out. i would say the same thing if this were democrats. >> but if you are counsel, you don't agitate the people who are hunting you down because you have to do this. >> that seems to be a strategy. and one way of looking at is the president is such an agitator, he doesn't want to be president anymore and he's gone down swinging. he will go down in a blaze of glory and he will frank sinatra his way right out of the white house.>> well, if you wanted to do that i think you just sit down with robert mueller. i think that would be an absolute disaster. he's not the best at keeping his stories straight. he tends to tell one story and then another story and then he just doesn't so much people don't really care. a lot of supporters don't care because they like his agenda and it really doesn'tmatter. but there is really nothing he can gain by sitting down with robert mueller and everything he could lose . generally, if there's nothing that you can gain and everything you can lose, you don't go. if i could apply that to my dating life, i am sure things

that this is a bear market. many think it is still a correction.but it is just early in a bear market. i think the bear market will be particularly vicious. but the more important thing is the recession that is coming and there's not just going to be a garden-variety run-of-the-mill recession. we will finish the recession that we started in 2007 and was interrupted for 10 years with quantitative easing and zero percent interest rates. but the back half of this recession will be much worse than the front half. and i will probably start next year. kennedy: you have written extensively about the fed and monetary policy, exacerbating and creating a number of bubbles. are we seeing that manifest, and if so how? >> well, sure. donald trump inherited the bubble. that was passed down from obama. but it was the fed that blew all of the air into it. and unfortunately, the bubble

is going to pop on trump's first term which means he will have a second term.will still be in this recession on election day 2020. the problem is not that the fed is raising rates. i mean, the problem was that they slashed them to zero in the first place. and they left them so long. so at this point, and it did not matter when they raised them or how rapidly. that was it. they sealed our fate the minute they checked us into this monetary roach motel. i said from the beginning, it was impossible to check out. and the fed is about to find out the hard way. unfortunately for the country, the consequences will be far more dire than just having to go through a horrific recession because politically -- kennedy: let's say you say with certainty we are heading to recession. what can we do? what about the ending the fed? is it a place to start it is it a realistic solution?>> well, i mean it would be nice to

eventually ended but it will not happen anytime soon. i do think we will go through a horrific period -- kennedy: that word! >> very high inflation. but the problem is that the democrats are going to nominate the socialist and that socialist will be elected president in 2020 and he or she will have a socialist congress in 2021. in all of the blame for this collapse, is going to be laid at the feet of trump republicans and what trump and republicans supposedly stand for. which is lower taxes, fewer regulations, freer markets. so unfortunately, now that trump has rebranded this as his and they have claimed it for their own therefore shall get all of the blame. and this is a big danger. because we will go hard left in 2021. so investors --

texas ruled on friday obamacare is now unconstitutional. since it no longer qualifies as a tax and since so much of the law hinges on that portion he says the entire thing has to go. something the supreme court should have rightly decided in 2012 when they deemed the mandate as tax. and now it's heading backwards last rates for healthcare as a source of most of our current political drama. politicians want to use the entitlement to be all things to all people. and both parties have failed miserably. obamacare was too big,

ambitious and complex to begin with. and it was designed to be too big to fail. and assume big government would swoop in and save it. dismantling it has been very tricky and replacing it has been ruinous as republicans cannot attest. so what are we doing now? it seems the impasses brought us enough time for lawmakers and the bliss loosely insured to decide which fork of the road to finally take. if we swallow the blue pill, we are on the fast track to hell on the express. that we cannot afford a new entitlement and cannot save enough money to pay for it castles led to the grand rationalization that somehow, one-size-fits-all health insurance is the least poisonous file. it will force everyone to have the same crappy health insurance with the same burned-out doctors as it leaches the joy and promise out of american medicine.

should have been from day one. kennedy: all right, so how do we actually get incredible healthcare? joining our attorney and former policy advisor to george w. bush, michael, welcome. >> hi kennedy. kennedy: what you think of the judge's decision? >> it is wrong, it is not based on really any application of the facts in this particular case. the judge indicated that there was intent on the part of congress to sever this tax penalty from the rest of the affordable care act. but that was clear in 2017 when the republicans and the senate were not able to repeal that fertile characters susan collins and lisa murkowski voted no against repeal but then ultimately voted for the tax bill that included pulling off this tax penalty because they did not expect it to be a repeal of the affordable care act. and so now the judge's being a judicial activist trying to do it congress was not able to do.

kennedy: that is -- i don't want, someone said this today. i don't want congress acting like judges in a don't want judges acting like legislators. it seems everyone has forgotten their role. but i don't disagree with what the judge is saying. is it because, is this based on, the attorneys general who filed this suit, did they base their brief on the legislation? that was in the tax bill. the language. >> they base the brief actually on the prior legislation from 2010. looking at a severability clause and not looking to the updated facts from congress was actually as i explained makes it clear that congress did not intend to repeal the entire affordable care act. and so, it's actually really interesting to see how they are trying to manipulate congressional intent for the purpose of their own political means when ultimately, this is something as you suggested, that should be dealt with through the elected legislative

process. kennedy: yet, but both sides have failed. the thing i was thinking about today's obviously, when they cooked up obamacare, it was pretty comprehensive and they found a way to make it like chinese finger cuffs that are very difficult to get out of especially when you are panicked. republicans did not go to the same process. and they have paid the price for it. with house leadership that is now shifted back to democrats. so you have senate republicans it didn't really know where they stood before as you point out with susan collins and lisa murkowski. you have house democrats, senate republicans, i don't see any way that they work together. so where does that leave us? >> i agree there's no real way we will see a significant fixed healthcare from the federal government.as you suggested, it goes back to the states. with some good states are doing is trying a way to the

innovative. trying to find ways to fix some of the loopholes that the insurers have exploited to be able to take advantage of consumers and really doing their best to make do with what we've got. because it's clear at the federal level our voters wanted to be gridlock. and not a split like we see. that will occur in 2019. kennedy: even one is just one party and it doesn't matter if it is republicans or democrats, they spend way too much money. michael, thank you so much. >> i am with you. kennedy: thank you. the president announced friday budget director mick mulvaney will be the acting chief of staff replacing john kelly. the president tweeted quote - for the record, there are many people who wanted to be the white house chief of staff. mick mulvaney will do a great job. then listen 24 hours later. the president announced that secretary of the interior, ryan zinke, leaving his post amid flurry of investigations and allegations.

primary much to my chagrin. and it worked on the election and it's working out for him now. let's be clear, mick mulvaney is a solid choice. we know that is because after it was announced left-wing media started digging through archives trying to find film of him from way back during the republican primary say negative things. if they were not worried about him then they would not have done that. he already interacts well with the white house he's been in doing a good job as director and is doing good on capitol hill. that's what you're looking for in chief of staff. kennedy: he has to keep things organized, he has to act as a presidential filter , pharmaceutical quality of course. and he also has to have a good grasp of the political landscape. do you think that this is an addition or they still looking for a long-term permanent chief of staff? >> well, i don't know how long the situation in the white house lasts. but i think mick mulvaney is a good fit in everything you just

laid out. and the last one being the most important because he was member of the freedom caucus but well respected across both sides of the aisle. he is liked on both sides of the aisle.anyone that knows him likes a lot. because of that he will give the president the ability to interact with congress, maybe in a way he has in the past. with new leadership coming anything from that standpoint he is solid. moving on to your point about ryan zinke. let's face it, there are two people the left really want to try and take out. they will look into them on a microscopic level but they both did a job. they rolled back the regulations to a pre-obama administration level. and they kind of did what they needed to do. kennedy: yet but that is the private flights in the corruption and the distractions and the nonsense and the finding lotion in the middle of the night. all of that stuff is weird and unnecessary. i want to ask this because you are a big part of the ted cruz campaign.

i came as close as anyone to being the president. how do you beat president trump?
