evening and it starts right now. ♪. elizabeth: welcome to the show. let's take you to capital with vice president pence meeting with republican leadership at this hour. chad is on capitol hill with the latest. reporter: this is the advanced team vice president pence acting chief of staff nick mulvaney and the homeland security directors to nielsen making their case for a border wall in the situation at the border to house republicans. what is going on simultaneously here on capitol hill house rules committee is meeting. that is the committee that is the gateway to the house for. starting tomorrow house democrats will start to move a series of individual appropriations to reopen the government and start with the financial services bill which runs a treasury department and irs. the advance to bills last week which moved with bipartisan support to reopen the government and a lot of people think there

could be even more republicans vote for these bills in the coming days. it's an effort by democrats to put pressure on republicans to vote yes and reopened the government. in addition to president trump and vice president pence coming to the capital to meet with senate will begin tomorrow with house republicans we been told what we call here on capitol hill the big eight, top two leaders from both sides of the capital, both parties to a total of eight house speaker nancy pelosi, chuck schumer and mitch mcconnell, kevin mccarthy and so on they will know to the white house tomorrow afternoon at 3:0. first meeting is that rather extraordinary session on december 11 that was in public that you remember they met in the situation room last week but we don't know how this meeting will go. anytime you start to have people talk that's a good sign and people said the other day when they have these meetings with aids with vice president pence during the meeting on saturday and sunday they really were deputized to get anything done.

steel dynamics all of them hire as the president said he'll build his wall out of steel not out of the concrete. no one wanted to be short those steel names today. liz, back to you. liz: let's take on the democrats case. they are saying is open the 25% of the government to shut down and talk about the later. president trump they know. to the wall first then open the government. senator lindsey graham warning president trump that the wall has become a metaphor for border security and talk about that instead of just the wall. president talking about both. look at these republican senators. the starting to peel away from president trump. facing difficult reelections in 2020 and they say reopen the government, we are talking cory gardner, susan collins and tom tillis in morbid for his take a spring in steve forbes. it sounds that trump and pelosi have boxed himself into a corner with uncommon reminding positions.

national security and community in crisis. the facts backup president trump and even the washington post agrees. generally we want to reduce illegal immigration at the southern border you erect physical barriers but erected six or 700 miles so far as reduced but traffic up to 90% in san diego, yuma and what i don't get is that work so why are democrats against it? is all only asking for more fencing. liz: we are monitoring the republican leadership about to head to the cameras with vice president pence met with them. nearly 400,000 illegal apprehensions at the border and last fiscal year it is down from 1.6 million in fiscal 2,000 and i don't want to go too much overboard with the numbers here but here is what is striking. estimates show 820,000 criminal illegals inside this country of estimated 11 million across the border. by air, literacy but hundreds of thousands of convicted felons and robin, you know this. nearly 200,000 texas prisons along were talking homicide, assault, burglary. robin, your take.

is the media quibbling about the differences in the numbers when the facts are this is an issue? >> the media is not being completely honest and that is all media they are all guilty. the facts tell the truth and credit to our border control for apprehending the suspected terrorist. they say they did us a huge favor and i need for both sides of the party here and both sides of the aisle to understand and try to work together on this issue because we do need comprehensive reform. if you listen to democratic party leadership the minority whip in the senate says he doesn't have a problem with the wall but it's a one layer of security but he wants to see other reforms like more cars of the border and doing something about the fentanyl crisis. liz: robin makes a point that the wall is part of a broader picture, right? let's show the drug seized at the border.

look at the thousands of pounds of methamphetamines and cocaine and fentanyl that robin was just talking about. i'm telling you it's an issue. illegal declared asylum has rocketed higher and inundated our courts. 800,000 cases in the courts. how could this not be a crisis right now? >> it absolutely is. the wall is just one part of the crisis but you take away the incentives that create this crisis and illegal immigration. that's not just open 2,000-mile border but asylum rules but were talking sanctuary cities. they are basically refuge for fugitives but were also talking about governors in california and a mayor in new york city who want to give away free health care to the entire world. you have to take away the incentives that create this crisis and essentially beyond the wall or couple of changes the democrats have no interest whatsoever in getting rid of the root cause of the problem. liz: democrats did sign off on generate last year, 25 billion

crisis on the border i urge our democratic colleagues to get past these horrible political games and get serious about negotiating with the president. liz: that is senator mitch mcconnell talking about getting on with it. talking the top floors of president trump meeting the unmovable objects of nancy pelosi. both boston about taking serious political risks as a government shutdown looks like it may be the longest in history if it moves past saturday. both are sticking 2020 on it. let's bring in texas republican representative. congressman, you just came out of a meeting with vice president pence, is that correct? >> that's right. the kateri nielsen, department of homeland security and the vice president gave us a briefing on what is going on in negotiations have taken place. the president, my impression is he has been negotiating in good faith. secretary nielsen presented the leadership the democratic party

with the facts and figures and they refused to listen and i can tell you there is and i was on the border two days ago down there in three different counties on the southern border in my home state of texas and it is indeed a national crisis. this is something that has to be addressed, people are literally dying. 50 people a day are going to medical emergencies, 60,000 illegals are hitting the border every single day. they are arresting terrorists and would be terrorists and criminals in the activities there. it's not a status quo situation in status quo funding is not going to get it. we got to have border security and that is what everybody in my district i talk to and even those folks on the border, border patrol agents .

liz: congressman, stay right there. we do have a problem. we hear you but we cut right now to the republican press conference that you just attended of the meeting with the talk about the meeting with vice president pence. let's listen and. >> is a security crisis. we got to ensure we provide the resources necessary president has been and continues to negotiate in good faith he's getting an address this evening, first time he's given an address from the oval office that shows you the importance of the issue. at the same time, we are in a situation where even though we provided the information democrats asked for in terms of detailing what the resources are necessary to use for they have not responded they are not come back and refuse to negotiate. we are absolutely dedicated to major we secure the border and stop the political games and partisan games and vice president was received very warmly and was able to get everybody a very clear idea of what the president stands in his commitment on this issue. with that i turn it over to the whip.

>> we have a clear crisis at the southern border. i appreciate the fact president trump has a strong result to solve this crisis while working to reopen the government but what we have seen from pelosi and schumer are a refusal to negotiate. this goes back to weeks ago we passed a bill out of the house to fully fund the remaining agencies. while solving the crisis at the southern border. that bill went to the senate and the president immediately started to offer the negotiation with chuck schumer. they started talking numbers through the vice president and yet not one day did you see a counter offer. vice president pence did a great job of addressing our conference to explain seriousness of the crisis and to talk the numbers. they are astounding and alarming. i'm sure president trump will go into some of that night but just last year over 70,000 people with prior criminal convictions

tried to cross the southern border and we are taught those are the ones we caught by the way. how many more got through because we don't have a secure border. that's what this is all about what we want to get the entire government reopened while securing the border. you can't have one without the other. you can't say you are for border security and then refuse to support the very things it will take to secure the border. these are numbers from the president but from the experts tasked with keeping our country safe. want to keep our country safe but don't have the tools they need. we will see tonight how serious this crisis is at the border but what we've got to get this problem solved and reopen the government while securing the border. >> we had our update from our conference and it was a positive conference. vice president to secretary of home and talked about [inaudible] more importantly, this president from the day of the shutdown was to begin they

tried to negotiate the agreement but to keep government open the more poorly solve our border problem. when we met last week we cannot get to a point because we do not have our leadership. you watch how closely some of these leadership were and that made a difference but we waited to come back on friday and made improvement and in that agreement we stayed over the week and this is the time to solve this problem before we get to the point of federal employees. the president is committed to that to try to solve the problem about keeping border security. in the meetings of the white house every single person says there for border security. then that is the definition of border security. that is the fundamental. and watch the floor it seems like it's more games because those bills are going nowhere in the senate. mcconnell is already said he agreed to it. now is the time for both sides

to come together, come to an agreement especially all sides say they support border security. and find common ground to make sure the rest of government open back up we continue to move forward and end the crisis on our border. mr. president will speak tonight and i look forward to hearing what he has to say. i hope they speak at the same time and we may listen and find that this president was to solve this problem. >> did they give indication of what the president would order a national emergency - >> they do not touch that topic. you will hear what the president will say tonight. >> is concerned that they were because under president obama your side was concern always saying we need to exercise our article one and will you give the okay at the president went around. >> i watch this president and the number of meetings i've been in with him with the democrats on the other side i watched the speaker of the house first

messy court fight but congress does hold a constitutional pursestrings. we need [inaudible] we will bring in constitutional attorney. what's your take, can he do it? >> absolutely. congress has the ability to legislate under the constituti constitution, it's very clear in article one for what they've done is delegate authority to the president for instances in advance of national emergency he can close the border and use construction funds the secretary of defense to build the wall. in 1983 the support held by seven-two as a decision that congress cannot grant authority to the president and then block that action simply when they disagree with policy. liz: the president, to your point, could point to a number of laws starting in the 80s that were enacted in 22016 that say yes, he can build the wall without congress basically you can do with the army the financial civil engineer and

defense spending done with international drug trafficking which is by law the defense department can build fences and barriers. what he be hit with court challenges here? >> i think he will be hit with court challenges and the question is never can someone sue but will they prevail? we don't have an activist liberal court and if we have an originalist, conservative umpires on the court which we do now have a conservative majority if they are applying the rules to the president and allowing him to stay within the margins of the constitutional authority granted the congressional 30 granted then they will say we don't care whether or not we disagree with this policy but look at whether he's acting within the martian of the scope of authority and clearly he is. it's not only a border security and national security crisis in the interim and
