the wall through the trade deal. the president getting criticism on that one. let's get to edward lawrence live at the white house with more. reporter: liz, the president just tweeting minutes ago actually, a video of himself with border agents saying, the wall will be with built one way or another. he was there for a roundtable discussion for folks on the ground in mcallen, texas. the president wanted to know what this looks like, the situation he calls a crisis. this could be used as justification for the emergency declaration. the president floated the idea of emergency declaration to divert money to build a wall. >> if we declare a national emergency, we have a tremendous amount of funds. tremendous!if we want to do that. if we want to go that route. again, there is no reason why we cannot come to a deal. reporter: infect usa today report and the pentagon is now looking at options to build the wall. funding could be used, if the

183. i should point out 10 republicans broke ranks to vote in favor of the bill alongside democrats. then they passed a bill for transportation and housing programs. the vote was 244 ã188. and lindsey graham, has been trying to work out some kind of agreement, maybe have little border will funding and work out with the grand bargain or immigration may be daca. that deal we are told this afternoon was essentially killed by none other than president trump. this is something that lindsey graham was trying to work behind the scenes. i asked him about this earlier and he thought nancy pelosi, the house speaker, had been dealt out of the equation. his words there, but at the end of that it was president trump that dug out lindsey graham. lindsey graham says he's never been more depressed in his life on the situation. he thinks they are really stuck.

surfaced from jeff bezos to a woman that he is having an affair with. that could exacerbate a divorce fight. he is now embroiled in with his wife of 25 years. her name is mckenzie. they have four children. hillary has more. reporter: this is on track to be the most expensive divorce in history. president trump today actually wishing the couple luck in these negotiations. calling it quote - a beauty. the news though has shareholders not feeling like it is too beautiful embracing for changes that a settlement could have on the company , amazon, because they reporting he did not have a prenuptial agreement and that the couple filed for divorce in washington state. washington state is a community property state where assets are split 50-50. it is not just his personal

military funding already appropriated by congress to build the border wall and stop the shutdown here let's bring in our top constitutional attorney, jenna ellis, great to see you. >> great to see you. liz: let's lay this out for the viewers. this is a court for commit. you will see it here first. two loopholes that the president can use. in 1982 law says construction authority in event of a declaration of a national emergency in support of the use of the armed forces. the president and other presidents have deployed troops at the border. can this be used? >> absolutely it can. and the pushback against president trump declare a national emergency using these funds is that the national emergency act of 1976 was designed to curtail the presidents of 30 to declare national emergencies. importantly, this was not designed to limit the power in all instances. in fact, there are over 135 separate statutory provisions that allow for a declaration of

national emergency and specific use of the presidential authority. and here we do have the appropriated funds that the president can use. also unappropriated. this is something where congress has not clearly defined what it means to have an imminent threat or what the definition of a national emergency means. liz: let's show loophole number two. in a 2016 law, it authorizes the call for the pentagon to look at drug trafficking and organized crime or you can use appropriated funds for the building of roads and fence construction and more along smuggling corridor is. here is the thing, a president, jenna, has done this nearly 5 dozen times. for things like dealing with diamonds imported and a 2009 swine flu epidemic.i mean, that is what we have seen in the past. the fear now is, this could set a dangerous precedent to declare national emergencies for things like climate change.

where do you come down on that? >> we have to understand the national emergencies do happen. and things like drug trafficking, human trafficking, protecting the borders, protecting american families. what is actually more important as terms of the national emergency?we have seen border construction under the military appropriation has been used 18 times.including in the united states. we are ready have precedent for this to say it is going to unleash the floodgates is really just, i'm trying to strike terror to get people to object to the president very clearly laid out. he has the authority, he should do it. human trafficking and drugs are a real problem and he's finally standing up and saying the united states needs to take a moral position on this. liz: the ninth circuit court of appeals in california will likely oversee this initial fight. it covers the area of the country with the border issue. there is another part that the president can use to say yes, i can do this. bill clinton used emergency spending waivers to do things like occupy haiti or to sell

oil to north korea.that was in the 90s. and remember president obama use an executive order to raise minimum wages for federal contractors. i mean that a spending taxpayer money there too. >> absolutely. and when it comes the court system there will be legal challenges. but we have to remember an activist court will decide cases based on whether or not they like the policy and agree with it. that is not what they are designed to do and have the limited vested power under article 3 of the constitution. all they can determine is, does the president have this power? can he do it? not whether he should. that is a political question absolutely prevented prohibited. if the ninth circuit wants to play politics it will end up in supreme court and guess what? we have a conservative majority now. it means they will faithfully apply the original intent of the constitution and say yes,

word and it puts on the family. and that is why democrats need to come to the table. everything the president is proposing is common sense. the proposals have come from i.c.e. and cbp agents on the front lines of the border. he is talking about a barrier, humanitarian crisis, the democrats have supported time and time again. chuck schumer voted four times for a barrier. now because it is president trump, they are saying no deal on anything. we are walking away. it is just ridiculous and it is purely partisan.there is compromise their. the president is willing to work with the democrats and they have rebuffed every effort. they have to say whether or not reopening the government and work with the president and taking care of the immigration system that is completely broken. liz: with the media saying the president is court unfit for office. your take on that? >> i just laugh at that. because let's look at what

happened under president trump in the past two years with tax cuts and deregulation. you've seen the economy boost, using 4 million jobs, you seen wages increase, 3.2 percent. you've seen him take on isis, from the military. issue after issue, he has delivered. the economy is doing well, country is booming. we saw the great jobs report in december with 312 jobs, 12,000 jobs added. i just don't understand what democrats are coming from. they've never accepted the results and the will of american people in 2016 when elected president trump. from one day they made a mission not to work with him. now with the new congress they will make a mission to investigate and obstruct and do everything they can to prevent him from doing the good things he's already done. liz: switching gears quickly come michael cohen is set to

when he became president. liz: tells a little about your back story. >> yes, i am a daca recipient. i came to the united states when i was one year old. i grew up without a father. i grew up homeless, i grew up undocumented. i grew up in a rough neighborhood but if it wasn't for conservative values, with his faith, family, god you know working hard, standing on your own two feet, i don't think i would be the man i am today. liz: went to college and now you are a taxpaying worker. is that it? >> i am a taxpaying worker. sometimes i play too many taxes but that's another problem. liz: probably why you are talking to us! we opened up the second with a montage of angel families. and we've been covering the story for two years now covering angel families. they feel like democrats ignore them.

we've had people on the show saying you know what, illegal immigrant crime is lower than the rest of the population. we don't treat people and human beings like statistics or rounding errors. what is your take on illegal immigrant crime? >> first of all, my heart goes out to those angel families. i cannot imagine what it's like to lose a loved one and wake up every day and them not be there. i pray for them and i pray for peace. as a man of god my heart truly goes out to them. that is part of the problem. the more we choose not to do anything, the more stories we will have like angel families you know, more stories like families you know, who lose loved ones through the drugs coming from the south of the border. i think it's very important that we all unite together and we put a face to the problem. to the people that are really being affected by congress and and ability to do something. i'm talking about angel

their hostages because they're finally being challenged by someone who means business. it is real now. i would also say when it comes to the crisis, we remember a few weeks ago democrats, all americans were shocked and outraged to the deaths of two children. i would consider and suggest that children are still getting sick at the border. people are moving through the customs border patrol saying there moving through with illnesses that do not happen overnight. tuberculosis, pneumonia, other issues that take time like the flu to develop. these are people living homesick, getting sicker in the process. that is a crisis, those individuals are dying. when democrats realize that being concerned about dying children wasn't going to help them, they certainly don't think it's a crisis anymore. we still think it's a crisis. it still needs to be resolved in the american people, they

liz: r. in and around the green rooms and fox, we have had multiple border patrol authorities here. and i have not encountered a single one who doesn't have strong views that some kind of barrier is absolutely essential to slow down the penetrators so they can actually apprehend them. and it's worked in san diego where it's reduced over 90% of those penetrations. it's a major defensor. i think the president is motivated by one thing only and that's to protect the sochty of this country dz that's general jack keane making the case that president trump is motivated by protecting the country with border security and the wall. nathan, what did you think of the general's point there? >> like i said before, democrats are no opposed to border security. there are other ways to secure the border other than building a wall and seizing private property from land owners in texas. that's fonl wa the only way thes

outcome is going to be if the president declares a national emergency. >> any time a future president, no matter who it may be doesn't get what they want through congress, this is setting the precedent that they can create a national emergency to get what they want. that is not in line with the constitution. liz: we've had national emergencies over swine flu, bill clinton used emergency waivers to do emergency spending to occupy and help out haiti and also getting oil to north korea. there has been precedent already in the past, madison. >> right. eni understand his concern. we never want to set a precedent that isn't right and we're calling national emergencies for any reason at any time. that's not what's happening here. i would argue that's maybe happened in the past but it's not happening today. we need to make sure we're protected with the drugs coming across the border to wipe out our population, that's a crisis.
