what do they want to give us kennedy? what have democrats offered republicans to make us feel comfortable? kennedy: you do have moderate democrats who are saying things can we figure this out because my constituents are very frustrated because there are parts of the country where progressivism doesn't win the day and you have a lot of lawmakers from border states to say that we haven't heard from and i'm very curious to see what those democrats have to say. i know it's obvious what they are trying to do with national aspirations and everyone looks at this as a way to consolidate more power by having a future pool of guaranteed voters to give away as much as possible to illegal immigrants now. but to be honest what you are brokering you have a lot of people in that space.

the courts we don't have to worry about through eminent domain because who decides and defines a national emergency? . >> that's a great question the act was passed in 1976 and congress did not define what a national emergency was. kennedy: that is an important part? . >> if you think about an emergency you may not be able to anticipate anything the president would have to respond to quickly most people do not think about planes flying into the world trade center. there are many emergencies that have occurred over the decades where they could not say ahead of time what it was. sometimes it's very obvious national emergency was called related to iran with the revolution and that has been carried on since 1979 with over 40 national emergencies declared right now three of which president trump has called national emergencies. hurricanes, national

it's informative to look at the travel ban which the president has broad executive authority to decide which category the citizens could be excluded from travel to the united states and the supreme court in that case recognize that congress had delegated this power to the president. kennedy: it is too much power delegated to the executive branch that is a huge problem and it shouldn't be okay when someone is in power that you agree with. >> this is definitely becoming litigated even if the president or congress would want to go through the courts i think everyone has gotten so lazy absolutely they don't want to do their jobs especially in congress which is unfortunate but thank you
