>> vice president mike pence we have an exclusive interview. he's holding a roundtable with exiles and community leaders in miami florida. we will have more for you. kennedy begins now.>> president trump take a major step toward a trade deal with china but he may be ready to say no deal to democrats in his standoff over wall money. good evening i'm guy benson and for candy today. first the board about. lawmakers working on a compromise potentially can to avoid another government shut down in two weeks. today the president said republicans may be wasting their time if the negotiations do not involve money to build his wall. but earlier house speaker nancy pelosi said the president will never see one thin dime. >> they will not be money and legislation.
12:01 am
however, if they have some suggestions about localities about where technology, some infrastructure i said about the ports of entry, that is part of the negotiation. >> the speaker having some trouble speaking. that did not please the president one bit. during a meeting earlier at the white house he let nancy know exactly how he feels. >> if you go to tijuana, and you take down the wall, you have so many people come into our country, that nancy pelosi will be begging for a wall. she will be begging for a wall. she will say mr. president, please, please, give us a wall. >> no she won't. the presidency also saying that he is through with the semantics of calling his will a fence or barrier or whatever.
12:02 am
tweeting let's just call them walls. from now on and stop playing political games. a wall is a wall. so with both sides dug in should we just plan for another government shutdown next month? join me now, fox news senior capitol producer, chad, good to see you, sir. >> think you have me. this is a lot of noise, noise so far. and the reason it is noise, is because in the capital, appropriators who are members of the conference committee, their working and not paying attention directly to what the president is saying and not directly paying attention to with the speaker of the house essay. there appropriators and work on money bills. they are ignoring the noise. >> one piece of noise does come from the speaker today. your same perhaps lawmakers began close doors are ignoring up and trying to nail down in the comment that we just played what she said, no money for walls, it won't come out of legislation, is she talking about the wall? capitol t and capitol w?
12:03 am
>> use the term earlier, symetics. i spoke to appropriators, people working on this legislation behind closed doors and they said the term wall is not going to be in the bill. there is democrats and republicans. and part of it is because of the way the legislation is written but it also gives an exit ramp to democrats and republicans so they can say look, republicans can argue i voted for a while even though it doesn't say wall. and democrats can sever different border security i did not go for a while and everyone is happy. the trick of horses getting the president to sign that. this is about optics, what's going on today with the president in the speaker. >> but is the speaker actually open to additional physical barriers that would stop people from walking across the border? her number two hennepin, was on fox news channel not long ago saying that does have to be part of the solution. but it seems like nancy pelosi is allergic to even the word barriers at this point. sort of. >> right.during her press
12:04 am
conference today, she talked about these norming defenses. unit is kind of cross barriers and things. she said that there was a need for that, things like that might be okay. so it seems that she is open to some degree or barrier. she cited a study by a congressman that represents a border district, he is one of the conferees. he's also the chair of the appropriations subcommittee that deals with homeland security. this is in terms of actual wall or fencing or whatever you want to call it, it is pretty minimal in terms of the miles they still have to put through. their argument is, maybe finish that part and then everything else is just semantics. >> over on the republican side, are you hearing any pushback or agreement with the president today talking about a waste of time through the whole process? are republicans in the committee sharing frustration
12:05 am
and worrying that this is a waste of time? or are they saying this is worthwhile? >> that is where appropriators are a special breed, it's often been said there are three types of members of congress. democrats, republicans and appropriators. it might help them in that regard but you know what is going on? the term used today was that they are clearing away the underbrush. they are trying to say what do we need to do you know, let's get the issue settled in the bill, get those on the table and deal with specific things. one big issue that still remains, and we do not think it will veer off is scope. there was a lot of talk earlier in the week. maybe they can address immigration, daca, lindsey graham, the republican senator from south carolina talked about the debt ceiling. i'll read your quote - from a senior source i spoke to earlier in the week about maybe trying to add listings into the bill, taking away from border security. here's what the source said. taking a complex issue which caused the 35 day shutdown and combining with another complex issue like immigration reform, and resolving it magically just
12:06 am
won't happen. it would be a recipe for failure. that is why the appropriators are so focused just on the money. here's another newsflash. the presidents request is $5.7 billion. if you talk to the appropriators, they will tell you, and this is bipartisan. they cannot add money into that bill. in 2011 when they passed a piece of legislation to raise the debt ceiling, they imposed something called sequestration. and imposed spending caps on what we refer to here on capitol hill as discretionary spending. they are capped at how much money they can spend in the individual bill. if you start putting money for a wall or these other requests by the president, this is republicans i'm talking to. they tell me that that would hurt homeland security in other areas. so you have to have this balance. and that is why i think the appropriators are kind of ignoring all of this noise. >> another wrinkle to keep an eye on, chad pergram, thank you.>> my pleasure. >> meantime the largest seizure
12:07 am
fentanyl in u.s. history. helping, worlds? at a checkpoint for mexico. 254 pounds reportedly enough to kill get this, 100 million people.it is also one third of the u.s. population. that is what they discovered. the stash was in a truck full of cucumbers. they also found that nearly 400 pounds of meth on board. does this 45 one of the presidents biggest points on border security? let's ask the panel tonight. emily companion was here adam johnson and the president and lgbt for trump founder. i would start with you. first i want to complement your shirt tie combination. looks like you waiting for agenda reveal. >> i think it is! >> i was getting his in my interview with chad pergram. why is it that nancy pelosi, and that the government is
12:08 am
reopened and seemingly everyone is in the party has said, yes, some berries would be a good idea. why would she do say that? >> because she thinks that she is winning. i don't know what she thinks the endgame is. i think she thinks that donald trump will fold. i don't think that will happen. it is clear at this point that is what pelosi thinks. otherwise she will be saying i'm against a wall but i am for barriers. i understand we have to have some increased security at the border. she will be saying the things. also think a little bit if this is she acts like i'm a she literally has just been speaker this time for the last 15 minutes and actually she's been running the show in d.c. for the last 50 years. >> in her mind she has been. >> i know! there's a level of cockiness that if i were a democrat i would be concerned that she was overplaying her hand here. >> let me ask you this. a lot of people i talked to our maybe not bedding but guessing we can get to february 15 with no deal in place. do the legislators recognize in both sides that this is why
12:09 am
people loathe washington? >> yes more from the do-nothing congress to the they won't talk congress. a little historic perspective. in 2006 actually passed, this is amazing, right? bipartisan. the past the border security act. it was voted for in the senate. 81 ã19. then senators schumer, clinton as in hillary, and obama, as in the former president when he was a senator, all three voted for it. so there was a magical time in washington when democrats thought a border wall was actually a good idea. and that somehow we've got to the point now where think it is so pinned upon trump that they just don't want to give him a win. in the same way admittedly do-nothing congress over obama did not want to give him a win either. >> emily, i'm not sure if you are a betting woman. but this will either go to the president and get resolved or another shutdown or an emergency declaration from the
12:10 am
president. where are you putting her money? >> honestly, emergency declaration. i want to point out something for the viewers. i think this is oversimplifying things. the democrats on the left are considering this a loaded weapon. right now we have 30 states of emergency is in effect that have been in effect since the act was passed in the early 70s. and the president can use up to 123 of the statutory powers. statutory references for this power. and pursuant to that, congress is supposed to meet every six months to make sure that the neatest overripe and assess how things are going. in summary things there? 30 states emergency in the last years? zero is one of those in existence, only two don't have to do with the emergency economic powers act. and that is a threat that is substantially outside of the us. what do you think the white house still controls export? that was a legacy succession handed down from reagan. through every single president. so the notion that this is some
12:11 am
type of rare or horrible or again, a loaded weapon situation, flies in the face of reality that's been in place for decades. >> i think the question would be how would he appropriate money and whether it will be legal. i appreciate the history lessons all around tonight! meanwhile a controversial topic that will be back in 2020. this week, a virginia democratic candidate put a proposal that would allow women to terminate pregnancy up until the moment of birth. for the health concerns. in the virginia governor, spoke about the bill on a local radio station yesterday. >> if a mother is in labor i can tell you exactly what would happen. the infant would be delivered. the infant would be kept comfortable, the infant would be resuscitated if that is with the mother and the family desired. and then a discussion would
12:12 am
ensue between the physicians and the mother. >> northam getting slammed by the president and the republicans and frankly, non-republicans. rightly so for the comments be his defended remarks by saying they were taken out of context by the right. but here is nebraska senator ben sasse reacting on the daily briefing earlier with dana perino. >> the comments of the governor of virginia said on the radio are about fourth trimester abortions. it is not abortion it is infanticide. they need to see if they stand with this repugnant comments. these aggressive pro-abortion democrats will continue to duck and talk about if they stand with the little baby girl. >> this was set aside by a subcommittee. but democrats running for president, do they really want
12:13 am
to be talking about this? and why on earth are people in the party pushing is really extreme and unpopular late term abortion bills? all right, emily, abortion generally is a very difficult topic. i am pro-life, and proudly pro-life but i have lots of friends pro-choice.and to have discussions, we agree to disagree on certain points. even some of my pro-choice friends are looking at some of the laws and saying that this is going too far. it's a little nuts. and the polling bears that out. what is your take on this controversy? >> i agree with you. i think legally, these are absolutely extreme laws being set forth for you nailed it when you said vaguely. i think the specificity aspect, it's lacking here. it is what makes it so horrifying. and that shocking the conscience given the fact that the offering that has ensued. things notable that the states are starting to generate this kind of momentum in answer to what they perceive as a potential attack on roe versus wade.
12:14 am
this is what we are seeing every state collecting their wits. also is not a slamdunk on either side. so i do think regardless of the candidates don't want to get into it they will be forced, because it will be a hot button topic. today and said it is because of the trump show that is why it's devolved. it is a blame game that is going to play out with the candidates when they're first to answer specifically how they feel. >> trump did not write the bill. the democrats introduced it. chris, i now live and vote in virginia and help the government is paying attention to that. he campaigned as a moderate. >> we've gone from safe, rare and legal you know when clinton ran for president to now talking about, post birth abortion. i literally could not believe, i'm not even someone whogets fired up about abortion and i was revolted . i thought, he has to clean this up! and today he was given the opportunity and said you regret how they came across? he said no. >> don't listen to trump. and by the way, we're listening
12:15 am
to -- >> what is so gross to me there was that fox was the only one of the major news outlets that carried this controversy. nothing on cnn, msnbc, i wash my local fox affiliate in washington d.c. today. guess how much coverage of this? zero! not one mention. >> i said it before and i'll say it again. of all the issues in which the media is biased, guns and abortion , they take the cake on both. >> they go to the extreme. >> is bill external extreme to the vast majority of americans. but not the vast majority of newsrooms is my fear. adam, how does this become a flashpoint 2020? possibly even within the democratic primary?because democrats across capitol hill today were not wanted to talk about this. >> we don't want to wait until 2020 for this to become a flashpoint, it already is. justhave to listen to the court that you played . my hope among us all is that there is a natural break on the
12:16 am
system. the hippocratic oath. when a dr. becomes a doctor, he or she pledges, i get emotional about this. to do no harm. i mean, can you imagine a doctor, that -- giving an abortion?i'm in the day before a child can be born? talk about do no harm. i cannot fathom a dr. would actually do that in good conscience. without local authorities, be the hospital administrators or even government officials, arguably, the police, would actually stand by and let that continue to happen. it defies logic. >> on that note, we will move on. thank you panel. you will be back later with a much happier topic. but first, the president says time will prove him right in a standoff with his intelligence agencies. but chuck schumer claims the nations top spies need to stage an intervention at the white house. so who is right about america's biggest threat?

and the army taught me a lot about commitment. which i apply to my life and my work. at comcast we're commited to delivering the best experience possible, by being on time everytime. and if we are ever late, we'll give you a automatic twenty dollar credit. my name is antonio and i'm a technician at comcast.
12:20 am
we're working to make things simple, easy and awesome. >> don't expect to see chuck schumer and president trump at the super bowl party on sunday. the new york senator and simpsonville and come to a further letter to intelligence official to stage and intervention with the president after he rejected the threat
12:21 am
assessments.the president shot back calling schumer and the democrats quote - big fans of being passive and weak on iran. he also met with his intel team in the oval office today to clarify the remarks after was tweeting most of what they said during the hearing was quote - mischaracterized by the media. which is odd because it's so unlike him to go after the press. is the president really on the same page finally with his team? or should we look for him and them on the next season of intervention? with me not, former cia officer and most of the buck sexton show. what you make of this over the past 48 hours? >> a mountain out of a mole hill, not a big deal. you can look at this in a few different ways.first of all, is someone that worked in the cia during the bush and part of
12:22 am
the obama administration, the same people that you see right nowthe democrat side who are , my gosh! how can ever question the intelligence community? they wanted to lock up some my former colleagues were doing their jobs. some of us have not forgotten how crazy the democrats were. not just about the intelligence but other measures taken and interrogations. i cannot go through all of the now you know what they are. but democrats were making fun of the intelligence community saying that it was inapt, cumbersome, too expensive. now they are beyond reproach. wesselhoft understand that this is not information or rather intelligence so much as it is assessment based on intelligence. these assessments, used to help write them. they bring to the whole lot of different people on a vast array of issues. it is watered-down stuff to begin with because it's unclassified. obviously that's why you and i got to read it today. but there's really not as much daylight between what trump is saying and similar people in the intel community are saying is the democrats are pretending there is. >> here is what bothers me.
12:23 am
he is a meeting in the oval office income sentences actually, everything is fine! it is the media is faulty mischaracterized things. whether it's true or not, should the president do his homework before he goes on twitter and dumps all over his own intelligence people if in fact, they did not have that type of daylight between. >> look, the president -- you know, i cannot begin to explain or preempt his twitter habits. sometimes i think his twitter is amazing and sometimes i'm a little speechless. overall i like it. as to how he interacts with both the intel community and obviously the democrats on the issue, you know, is trying to sell his positions.which is different when the intel community is doing.it is up to him to come up with a strategy. an issue like north korea, yes, north korea is locked ineffectively, a nuclear stalemate situation with the
12:24 am
rest the world. that will continue.in the intelligence community is great to saying hey, the status quo is likely to continue being the status quo. trump takes a position from trying to sell the deal to my own people, the international community and hopefully kim jong-un himself. so they're just viewing this in very different prisms. which manifests itself in some differences in how they will specifically assess the threat of north korea. obviously with all the different situations, you have to deal to specifics of them. by and large i think trump is a will chip on her shoulder about the intel community because what brennan and klapper and some of the others have done. this was not his finest moment would also not a problem. and chuck schumer and nancy pelosi just tax on national security. we love the intelligence security so much it's a joke. >> i think she wears glasses slipped further down his nose as he was stunned by what the president said. very briefly, one of the gotcha 's is that none of the mentioned national security and the border. i did feel like you can
12:25 am
separate geopolitical threat from a crisis of the border that does still have a national security component, right? >> absolutely! i think i have to go back and read the 40 pages again but there were mentions the transnational threats and drug smuggling and international cartels. quite frankly, if there were not mentions of all these things were just talking about, then it is on the intelligence community. it is their fault. because that is absurd and obviously, was going on at the southern border is a much bigger imminent national security concern then many of the other things addressed there. trump is right whether it was in the assessment right that we have a big problem at the border. i think the media and democrats clown themselves when they pretend otherwise. >> buck sexting, i appreciate you coming in here. coming up, roger stone now claim in the mueller investigation is a plot to install hillary clinton as president. i will explain this 90 theory
12:27 am
i am not for colds. i am not for just treating my symptoms... (ah-choo) i am for shortening colds when i'm sick. with zicam. zicam is completely different. unlike most other cold medicines... ...zicam is clinically proven to shorten colds. i am a zifan for zicam. oral or nasal. >> here is what you may not
12:30 am
have seen coming. president trump says he will not interfere with the justice department decision whether or not to share the results of the mueller probe with the public. there been rumblings in washington that the special counsel could be wrapping up in mid february.they were also saying that last february. the president has often referred to these allegations of russia and collision as a host and witchhunt. but his former advisor, roger stone is now taking it several steps further. >> i honestly believe that they are going to try to charge the president and vice president with some hooked up frame of russian collision. that way they can make nancy
12:31 am
pelosi president, she can make hillary clinton vice president and then step aside. it is a nightmare. but i think that's what they have in mind. >> okay. it is not really get surprise by what roger stone says but the fans are like that is crazy. of course stone was indicted last week on multiple charges of lying to special counsel, like the congress, when is tampering. but did he tip his hand when he said he expects the president and mike pence to be charged along with him? join now we have andrew mccarthy, former assistant u.s. attorney and fox news contributor. look, this is sort of crackpot stuff from roger stone who says all sorts of things all the time. why would he say something like that and should we really be paying that close attention to his latest ideas? >> yeah well, let me answer the second question first because the first question requires me to read his mind, that is really sort of a place i don't want to go. >> no, i don't think we really should be paying it much mind. what we should be saying is
12:32 am
that robert mueller has now filed many charging instruments including one against roger stone and he has yet to fabricate any collision case. he has yet to make up a conspiracy case not only between the president and russia, but even between roger stone and anybody. roger stone, i think that you can make a fair argument that he got caught up in a very politicized investigation and you know, had he not been caught up in this particular investigation, maybe he would never have been subpoenaed to testify before congress and he therefore, would never have said some of the dopey things that he said in his testimony. but even he is not being charged with a you know, framed up, trumped up if you will,
12:33 am
collision case. so i would think anyone else should be would be beyond me. >> ought to be clear, forget subpoenaed and appear before congress, he should not lie to congress you should not tamper to witnesses and tell them to lie or not participate in investigations. but you are drawing a distinction between what he appears to be guilty of and we will see if that is proven, versus the bigger picture which is sort of the central core charge of the mueller investigation. let me ask you this. because you come at this from a legal perspective. you were a prosecutor. is there a distinction or a difference here to be made where perhaps robert mueller doesn't find evidence of an actual chargeable crime when it comes to criminal conspiracy like hacking the dnc emails. but he finds enough smoke and evidence that collision, a nonlegal term, looks likely. and therefore, it goes to the political question of whether it is impeachable. do you think that is a possible outcome to this? >> that is why the justice
12:34 am
department role here is so important. and as he reported a couple of seconds ago, apparently, the president is saying that he is going to let the justice department work this out and how much of it gets public. >> which is good, he should say that. >> is good instincts. he should not only say it but he should do it. yes. but the reason this is so important is, robert mueller is a prosecutor. he's not the council to an impeachment committee. he's not a guy like bob woodward writing a book about whether he thinks the president is fit for office or not. you'll thing a prosecutor has to decide, is whether there is enough evidence to indict a case and bring it to a jury. if there is not, the prosecutor is not there to answer every other interesting question or to weave together, some kind of potboiler that might make for some you know, interesting political misconduct.
12:35 am
>> whether there's a crime. we are out of time, but good stuff as always! i really appreciate it. >> thank you, guy! >> as you know things like the investigation from robert mueller in anyone else, they've done nothing but divide the country. congress is that a partisan lo . it is hard to get republicans and democrats to agree on the sky being blue. so how might we unite our fractured country with wings and beer and the super bowl, that's how! in a new column in the wall street journal, it is titled, super bowl sunday is bigger than football. the author claiming the big game is the last piece of common culture that we all share as americans. so can the super bowl give americans a big timeout from the partisan food fight? or are we about to super bowl shuffle our way into the abyss if we are not already there? the panels back. emily, adam and chris. adam i want to start with you because last year, with the anthem kneeling and the

boycotts and everything like that, the nfl did take a hit. but it came roaring back this season. ratings were again very good. i believe sr written of the top 26 primetime broadcast all year, 18 of those were nfl football telecast. >> and one of them was my team from alabama losing to clemson. [laughter] sorry! >> we would say condolences but i was rooting for clemson. i'm a college fan over nfl but the numbers speak for themselves. is nfl football this magic elixir to bring us together? >> it actually is. and i think the right people were so upset about the colin kaepernick thing last year because it's like how did he get in there and mixes up and turn our elixir into this politicized thing? and i think we've got passive time so part of everybody for just standing up and honoring
12:37 am
the country with the national anthem. yet, chips, beer, football. tom brady is probably the greatest quarterback of the era, maybe ever! i don't particularly like in being a new yorker but i will probably root for him anyway. >> will get to that in a second. strong hard disagree on this one for me. i agree with your point about politicizing sports. but this piece, it sort of talks about how the super bowl is this valiant american creation. we have at the center, football, nfl football at the highest level. but they are commercials that everyone wants to watch and talk about unto themselves a huge attraction. then the halftime show we bring in celebrities and you know performances. it is this phenomenon that of course it will draw 100 hundred and 50 people million watching. who does not love that? who isn't watching is my question? >> yes, i agree with what you're saying. i think the concept that a sport brings us together is true. but the concept that it is the overproduced super bowl that is the mechanism to do it? i disagree with. and i respectfully disagree
12:38 am
with your point. >> that tom brady is the greatest quarterback ever? >> yes. i cannot even bring myself to hear the words. i was a cheerleader for the oakland raiders. so first of all -- >> i did not know that! >> yes. i hate the pats nation. we want anyone to win but the patriots. in the nfl is not without a significant amount of controversy would have been pure football fans absolutely recognize. especially with roger goodell. this super bowl in particular with the rams even be in it. right? weave an entire state that would be boycotting the super bowl -- >> does emily have a point? is the true reunion of the country going to revolve around rooting against doing that? >> absolutely! really brings us together as a country, whether a democratic republican is hating bill
