about venezuela. he's been out in front of the story all along, really pushing for democracy there in venezuela. good night. have a wonderful evening, kennedy begins next. >> indeed i do. thank you, trish. breaking news tonight lawmakers have just reached a deal in their shutdown talks tonight. chairwoman of the house appropriations conference committee of new york tells fox news an agreement has been reached in quote principle. though she did not offer any specifics. she says everyone will not be happy with the terms of the deal when they are made public, but she feels confident about what happened behind closed doors tonight. when asked if president trump would sign the deal, alabama senator richard shelby said i think so. the news breaks as president trump is about to take the stage at a rally in el paso, texas. earlier today the president called the democrats demand over

holding his own event. here now reaction to news of the new deal republican congress congressman from arizona border state if you will, congressman andy biggs. welcome back. >> good to be with you. >> why do you know of the tentative deal that's been reached within the appropriations committee? >> couple of things. it seems somewhat cryptic because it is an agreement in principle. we don't really know the particulars. i did talk to a democrat who indicated to me that i might like some parts of it, but i won't like all of it. i don't know what that means. i didn't go further than that. but what that tells me is that it's probably not going to be what i would suspect is necessary to shut down on the border. >> you know what it's like? it is like when your best friend sets you up with his cousin and says she's a really good dancer and she loves to read. [laughter] >> yes, i'm going to leave that one there, kennedy, yes, absolutely. >> rightly so.

so right now you have dualing events in el paso, one side saying that the town is safer because a wall was built, and the other essentially saying that walls are inhumane and they keep the good people out. so what do you think is necessary for the president to say tonight to counter beto o'rourke's counterrally. >> i think the president can make a pretty good case. there were 250 pounds of fentanyl caught in an area of arizona. there's enough to kill 53 million americans. then in another area a couple days ago, they have barriers for vehicles, but not for human -- won't block humans. they found 325 people in one single group there. this is a persistent problem. experts tell me that only 15% of drugs that we actually catch -- we only catch of about 15% of all the drugs that come into this country.

i think it is a real problem. i think that's the case he has to make. i think he needs to talk about emergency measures and what needs to happen to really get this wall going, number one, and number two, things like asylum, sanctuary city problems. this is real. it is happening. i don't know what beto o'rourke is thinking quite frankly. >> i think he's trying to sum up whether or not he has a shot in 2020. i don't think he does. i think some of the luster has come off his star, which rose too quickly and a good friend once said the brighter they burn, the faster they burn out. that seems to be what has happened with his political fortunes. but certainly he's a good foil for the president on this issue. and i'm wondering if what the president says tonight has any effect on public opinion, and if there is in fact a deal reached, does this rally only reinforce what he has been talking about all along?

>> well, you know, he -- we saw a tremendous boost in his popularity after the state of the union address, and i think that that's going to carry over, and this rally is going to actually give him a boost as well. your point on o'rourke really kind of gets what this is all about anyway, isn't it? it is all about politics as opposed to good policy. that's the problem i have with the whole thing. >> yeah, i don't know what beto o'rourke's policy is. i'm definitely willing to hear about it because at one point, he was considered to be very good on civil liberties, but he has turned into another run of the mill populist, and, you know, like many of his other counterparts in the democrat party, who are running for president, he's made a number of unforced errors, and if he had come out with solid policy proposals, that he forced to the top of any visual agenda that he might have, so that's what the press was forced to report, then you might see something

different from him, but he really has inverted his shot, and i hope that he runs for president. i think the more crowded the field, the better it is for everybody. >> i agree with you. i think that he had too many unforced errors. i don't think he stands for anything in particular, no core there. i agree with you as well that the more people who get in that democrat primary, and i'd really liked klobuchar's roll out last weekend the more people you get in there the better is for at least the people i want to have a shot. kennedy: i think the whole thing is fascinating because the horse race isn't going to slow down any time soon. congressman, if in fact, they have not reached an agreement in principle, if there is an extended stalemate on this, shoe -- on this issue by friday, it seems the two worse options, another shutdown which would be catastrophic or some sort of an emergency executive order, what do you think? >> well, i think you can also do

something, if you just left all the spending intact for a short-term cr, that might not be a bad way to at least solve that problem and then allow the president to take an executive action, and i think that might actually resolve the problem of the shutdown. you avoid that, but you also get to start building the wall. and then also do some other things that need to be happening as far as our immigration issue, like i said asylum problems, detainees and what have you. kennedy: figuring out how to get people into this country legally and get more of them because, you know, the more people who know how the system works, the more likely you are to attract people who are only going to make the system better. too many systems, if you ask me. one step at a time. congressman andy biggs, thank you very much for your time. >> thanks, kennedy, have a good one. kennedy: very good. we will keep an eye out for the president's reaction to the deal in texas. the long list of democrat challengers to the president, it's grown by a couple of high-profile names over the weekend. on sunday, senator amy klobuchar

is blanketed in snow when she announced her candidacy, in her native minnesota. oh gosh. on saturday senator elizabeth warren finally made her much anticipated run official. and yesterday during a stop in iowa, warren fired back at the president after he mocked her past claims of native american heritage. >> by the time we get to 2020, donald trump may not even be president. [cheers] >> in fact, he may not even be a free person. kennedy: he may not even be a free person. lock er up. warren has demonstrated the ability to get the president all fired up. is this just the beginning of what promises to be a very antagonistic relationship? let's bring in our panel.

welcome, everyone. >> thanks for having us. kennedy: so elizabeth warren, you know, i'm trying to figure out who you like because i look at the betos and the liz warrens, and she's got so many missteps, and then she talks about being on the ragged edge of poverty as a kid. and i don't know if i believe her. >> well, i read her book, and it seems like that is accurate. i don't think that any of that is made up. but -- kennedy: who knows. >> i don't know. yes, who knows, but it's in print, and i assume it was fact checked. i think amy klobuchar getting in is a really good thing. that's going to start the ball rolling of the more moderates jumping in here. sherrod brown looks like he's pretty close to getting in as well. according to people close to amy klobuchar, she was nervous about getting into the field because she thought she was too much in the middle, too moderate for it.

kennedy: i guess this is the question. just be yourself, amy. pick a lane and stay in it. i'm so sick of people making this clumsy progressive pivot when that's not where their heart and mind is. >> no, i think that's shifting 10% to the left is fine, but if you are going a whole 40 or 50 people know about that, but i'm not sure how you make it out of the primary without making some shift to the left but you need to go back to the middle to make it in the general once you get there. kennedy: let's talk about elizabeth warren. she apologized about her texas barr application where she put native american. she apologized about her dna test. she had to apologize once again to the cherokee nation. it's too much. no one's even focusing on her dumb progressive ideas which will bankrupt the country. >> her attempts to deal with this have been bad. i think people on the left

thinks she has not done a great job on that. she has strong deeply held ideas that are sincere on economic issues that i find frightening and i'm against. i don't want to be too distracted by the constant attention to the right wing media funny talking point how she screwed up but the substance of her ideas are very important and worth kind of rebutting more seriously. so there's moderate in many senses, right? because there's cultural issues and there's economic issues. i think someone like kamala harris wants to portray herself as some kind of progressive even though she has a very not so progressive record on criminal justice issues. kennedy: we're going to talk about her later on. >> klobuchar is maybe temperamentally moderate but having looked at her policies, i'm not sure how moderate she is. >> hearing about her temper made me think she's not going to apologize for her edge. who cares if you are a man or a

woman, just go for it and stop being like i'm so soft around the edges and pink everything. it's like, just stop it and be who you are. back to the authenticity which is fine. you know what's really interesting, alex, last night on the grammys, michelle obama came out to the kind of adoration that no candidate has come close to. kamala harris had a successful rollout, but michelle obama did something to the crowd and the wealthy ultra left that other candidates have not been able to do. what are the chances of michelle jumping into the race as a late gain? >> i think that would be an exciting prospect for a lot of democrats. there's a lot of obama nostalgia. a lot of people want to go back to that time. i'm not sure she's going to get in with a crowded field of people. kennedy: that's why she will come in late. she doesn't want to get into the

middle of the pack when sherrod browns and all those other people are getting in. she's going to wait till everyone is stinky and she will take the high road. >> it will be devastating not only on the ideological level for all these democrats who are trying to put themselves to the left, also from what kristen gillibrand has described as intersectional level wants to put forth of diverse set of traits in order to, you know, present yourself as a compelling candidate for president. kennedy: here's why she's compelling, i will tell you why, my mom loves michelle obama. she hated hillary clinton. there's something about michelle obama that resonates with her. michelle obama has a very uplifting book "becoming" and it is about taking those traits and turning yourself into a superhero which you know other people when they rely on their intersectionality they come off as the victims. she does something different there. right now i think the idea of her candidacy and the timing of that is interesting. >> she also did something in her

book which is still number one on the best-seller list for a reason, and republicans and democrats alike love this book, and a significant portion of it is not about barack obama. it is about her life before that. and one of the criticisms which i do not share of hilary clinton and i i don't think she got where she is because of her husband, was that too much about her was identified in the context of her marriage or her relationship, and michelle obama has established a coolness and, you know -- kennedy: an identity. >> an identity, unity and respect and all of that around her as a person, separate from obama. they are certainly a wonderful first family, and i think that -- i would hope a majority were proud to have them representing us, but she's very much her own creature and seeing her out there on her own like that with those other women who are breaking barriers -- kennedy: it is a fantastic story and i hope she doesn't make the mistake of running for president. >> she's not going to. she didn't even want him to.

long haul. ralph? >> virginia also needs someone who is strong, who has empathy, who has courage, and who has a moral compass, and that's why i'm not going anywhere. kennedy: well, nothing says strong moral compass like apologizing for wearing black face in your yearbook only to unapologize the next day but admit to wearing it at a michael jackson look-alike contest. he also said lieutenant governor justin fairfax would have no choice but to resign if the sexual assault allegations against him are in fact true. several of fairfax's staffers have already left their positions after a second woman accused him of sexual assault on friday. fairfax is calling for an fbi investigation into the charges, but somebody needs to lead the state of virginia in the meantime. so is ralph northam the man to clean up his yearbook scandal, or is it just time to turn the page? joining me now cohost of the five on the fox news channel the one and only juan williams. it's so good to see you again.

>> nice to be here. kennedy: let's talk a little bit about this because ralph northam has so many holes in his story. >> unbelievable. kennedy: you could strain pasta with it. [laughter] >> yes. kennedy: i know jesse on the five said he didn't think gayle king pushed him hard enough. i thought she did a good job, because some of the stuff he said today i thought was really almost offensive. >> it is clearly in his mind all about him. there's no sense in which he's being apologetic or suggesting real remorse, kennedy. instead he wants to blame white privilege and say well that's where i grew up. okay, if that's where you grew up, why didn't you admit this earlier? no, instead it comes out now, in the aftermath of people seeking to attack him over some abortion argument that's going on in the state, and it makes him look like a thorough hypocrite and worse he made himself look -- he

apologizes without saying he's in the clu ku klux klan or black face -- i don't know how you can trust anyone that has that two faced behavior. >> if you look at that picture, one in a black face and one in a klu klux klan hood and you can't tell one or the other, you have some real problems there. >> what about you should know if you did such a thing. >> obviously you have done many things if you can't tell which one is you. >> right. kennedy: that's problematic. we're not talking about someone doing a stupid prank when they are a sophomore in high school. this is medical school. this is his medical school yearbook. he was a functioning adult. he'd gotten through college. >> we're not talking 40s or 50s or 60s. we're talking about 80s in virginia. so to my mind, i just don't see

ralph northam surviving this, but with one exception, he and his wife are convinced that this is about him and reclaiming his reputation which has been damaged. he says he doesn't want to go out as the racist governor, so he's going to stay, and he says he's the vehicle for healing. now, stop and think about this. half of -- i think it is a little more than half of the black population in the state said in a recent poll we could forgive him. kennedy: which i actually thought was a beautiful thing and a beautiful gesture considering what the people and the commonwealth of virginia -- >> correct, but overall -- remember, white people also live in virginia. kennedy: yeah. >> guess what they are not as forgiving as black people who have been through a lot in terms of the racial front and had to deal with that kind of okay are you a good governor? are your policies in place? can we now expect because of this error, you will be more attentive to issues of race? kennedy: do you know why think it is problematic especially for white people because i think a lot of people work really hard to show that they want to live in racial harmony and someone

like northam comes out and sets any racial unity back -- >> correct. kennedy: -- by many years and that's frustrating. he makes it easy for people to generate stereotypes about white people who don't care about anyone else. >> i think especially for educated white people who are -- i mean, there's a large growth of that population, especially in the northern part of virginia, near washington, d.c., that's where amazon is going, for example, they are intent on trying to reverse the history of the capital of confederacy, virginia's past, and for them, ralph northam is unacceptable. he's literally taking you back in time with this. that's what i think you are saying. i don't think it works -- kennedy: and showing those implicit deeply held perceptions -- >> correct. so he says this is white privilege. that's what he grew up with. that's such baloney at this point. i would say that i make a distinction between him and mark herring, the attorney general, and who did the thing with -- i forget the name of the rap

hear someone's hypocrisy. in 2014 when she was running for reelection as california ag, watch. >> your opponent says that he is for the legalization of marijuana recreationally. your thoughts on that? >> that he's entitled to his opinion. [laughter] kennedy: so like any other politician seeking to leapfrog to the highest office, she's conveniently repositioning herself, but it is pretty disingenuous to say she's been pro cannabis all along. she opposed proposition 19 in 2010 that would have legalized recreational marijuana back then and was vague at best about her position thereafter. but i guess hindsight is 4/20 in this opportunistic oppressor who labels herself an aggressive prosecutor is now repainting her messy history with a kind of brush. the woman who once served as san francisco da is now having her missteps recorrected by the man

who now holds that former post is reviewing and resentencing thousands of marijuana felony convictions that wrongly fell under kamala's watch. even her former sweetheart has soured on her and says her tepid record and cold heart aren't enough to unseat the current president. sure this race is crowded but it will only get interesting when democrats call out the hypocrites among them, take the gloves off and beat each other before they take on the man they love to hate. smoke on that. that's the memo. kamala harris doesn't only have a sketchy record when it comes to weed, a san francisco d.a. and california ag she also stood up for dirty prosecutors, jailed the parents of truant kids,

especially those of lower income and resisted broader criminal justice reform. so how long will it take for the other 2020 contenders to call her out for being a total fraud? the panel is back, alex, robby and jessica. robby, of course, i will start with you. she's trying to say that joy to those who smoke the reefer and marijuana for all. but when she was california ag, she made sure a lot of people went to prison for non-violent marijuana. >> exactly. as you said, this is a recent new position for her. if she has changed her mind, i'm glad she has, but not so long ago she was on the nonprogressive nonlibertarian side of this. her policy for putting that she supported for putting parents of kids who don't show up to school in jail would have exacerbated all sorts of economic problems and for kids who don't show up to school. this is not the -- i don't think anyone believes this is the answer to education problems is put more people in jail to try to solve this issue.

kennedy: of course. >> she has a record that should be scrutinized -- this is an area where i might agree with someone on the left that she would not be the ideal candidate for criminal justice reform reasons. some civil liberties issues with a lot of her positioning on sex trafficking, she's been very outraged about, very concerning things. kennedy: that's one of the interesting areas within feminism where there is a great deal of disagreement. the thing about kamala that i find interesting is there's so many news organizations that are willing to give her a pass on her past record, but at some point, when she really emerges as the crystallized front-runner, the others will have to go after her. when will that happen? >> hopefully not for a few months. you have seen an amazing level of camaraderie amongst this group. they are all playing very nice on twitter, but it is, what,

it's two weeks in to this grind. we will have to get another 10 candidates in before it gets dirty. i think the issue with kamala harris comes down to the fact that there is just a branch of the left wing as my friend puts me yesterday at our friend's first birthday party, i just don't like prosecutors. he was a bernie guy. he was an elizabeth warren person now. i just don't like prosecutors. there are a number of really smart pieces out right now about how democrats are focused on electability. that's what we're going to be first and foremost and we will not have what happened in 2016 again where people refuse to coalesce around the candidate and we end up 77,000 votes shy of winning the presidency. so we've got time before it gets nasty, but it is going to be a talking point, but then i think we're going to get there. kennedy: they are going to have to do something because only one person can be the nominee and take on the president. so, you know, are they doing the smartest thing right now in protecting each other? or is it just a bunch of phony baloney nonsense? >> i think the problem is they

all ran so far to the left and all engaged in this giant apology tour afterwards to sort of apologize for various m missteps whether it's elizabeth warren and cherokee nation or whether kamala harris her record as district attorney of san francisco, a string of apologies that follows a record that's out there that's now indistinguishable among sort of the top contenders that are out there, whether it's warren, harris or gillibrand they all look pretty homogenous from the outside. only a matter of time before they start pointing out these differences. kennedy: they better. the point is, they're having to retriangulate which is more of a zig zag. >> they are. they are different on the issues. booker has a record on education reform on school choice, a long record of supporting those policies in a way that barack

obama and many democrats did over the previous decade but now very much fallen out of favor with the left is really against that and the rest of them will be against that and he's had to run from it. that's a major difference that's unique to him versus the others. >> kamala harris is the only one who has said she wants to abolish private insurance. if you look at the new kaiser family polling, it shows that people support medicare for all but with a private insurance option remaining. that's going to be a big one. kennedy: of course. that's a problem -- that's something -- that's something that they haven't -- i'm going to talk about the green new deal in a little bit. >> they all embrace that, though. kennedy: but with the green deal and medicare for all, you have to get rid of entire industries. >> yeah. kennedy: you have to get rid of the private insurance industry which employs at least half a million people, not to mention getting rid of airlines, and what does that do to the stock market? >> -- can't make it then.
