want another september nearly a dozen republicans voted against the legislation. including ted cruz, marco rubio, rand paul, mike lee, for reasons we'll get into in a moment. five democrats trend including three running for president. elizabeth moran, booker and kamala harris. sarah sanders released a statement outlining the administrations position saying quote - president trump sign the government funding bill and as he has stated before, he will also take other executive action including a national emergency to ensure we stop the national security and humanitarian crisis at the border. the president is once again delivering on his promise to build the wall, protect the border and secure our great country. that sounds fantastic on paper but in reality, it could gently be a double edged sword.

a veto. when i think that will happen based on what the president told mitch mcconnell, senate majority leader earlier. breaking down the vote as i look at it, we were told by mark meadows, the chairman of the house freedom caucus a little before the vote started that he thought there might be up to 120 republicans it would vote yes. there are hundred 97 republicans in the house of representatives and they didn't even hit 100. there was a little bit of chatter i was hearing in the past few minutes that maybe the president is not happy with the package, could this influence or re-influence his thinking? we have seen this before the president trump where they have indications on capitol hill that they would sign something and then it has changed. at the end of the day he's going to declare a national emergency. he has some agility to move money around. but i have to tell you, it is not really that much money. $1.375 billion for the border wall. there is 750 million, million with an "m". that only gets you to $2 billion. that is far short of 5.7

billion. and there's going to be a lot of chatter among republicans, among democrats because when you move the money around, you are robbing peter to pay paul. taking from one program to another.all the programs have constituencies among lawmakers from both parties on capitol hill. there will not be very happy when they go to the program and say wait a minute your damaging national security because we need this ice cutter we need this for pandemic flu or we need this for other areas of homeland security. that is a real problem. kennedy, all the ministrations test the limits of executive power. president obama certainly did that and you heard republicans park about that. and we'll see what they say if they think president trump is abusing the 30. we thought that he was going to declare the national emergency, that would drive the numbers of republican up. but it didn't as much as we thought.

i spoke with scott perry, a republican congressman from pennsylvania, one of the leaders of the freedom caucus. he said, and for america. and i said the president is for this. what does it mean? and he said i am for america. and i said are you disagreeing with the president? and he said i am for america. implying that this is not for america and the president is going against that. kennedy: there are some interesting no votes in the senate. tell me about that because we saw that break off from the president including ted cruz, mike lee, rand paul and marco rubio. was i thinking? >> rand paul i spoke to earlier in the day.i said, how long do you need to process this bill? he says really about two weeks and i questioned him at that point in the day.

were they going to try this blowup? there procedural things you can do to slow things down. he said no, i'm just going to vote no. so everyone just kind of giving up at that stage. another interesting vote was the republican freshman senator from missouri. he says is 1100 page bill, dropped in the dead of night. that's what's wrong with washington. i should point out that they were really dealing with seven appropriations bills. this just does not fund the department of homeland security. there are 12 overall bills and this address is seven. when you're done with seven different sections of funding it is no surprise you get up to 1100 pages. that happens pretty quickly. kennedy: and ben sasse was one that brought up how it was like $270 million per page, the text. >> exactly. keep in mind that they did have caps in all of these bills. the back tax had been worth it because they said we cannot go above that. that dates back to the sequestration that they approved in 2011 as part of the debt ceiling in 2011. and that will be the next big fight here on capitol hill. over the debt ceiling. if there is a glimmer of hope in this, if there is a glimmer of hope, it did not do a continuing resolution and in terms been able to keep the government funded through

september 30, the end of the fiscal year. by having large bipartisan vote on this, what that signals actually is some degree of competency that they can get something done. the new group of democrats want to get things done. some of them are quite moderate, they represent swing districts. it's an interest to accomplish things and work across the aisle. kennedy: that's a great point! >> this is been dead in the water it might've set the tone for the rest of the congress. and they actually work something out.kennedy: excuse me, they mistake the incoming freshman house and the house is being all aoc -- when factors many moderate democrats who overtook republicans and one -- won a critical primaries.>> you have virginia and maine is a good example, southern california. kennedy: it will be interesting what happens from here because obviously the speaker is going to go into another room and she's going to have the

enrollment ceremony where she signs the document that will then go to the presidents desk. and we are told he is going to sign it. then immediately into declaring a national emergency.how does that work? >> the president under statute has the ability to do this. jerry nadler is the chair of the judiciary committee and the house of representatives.he said a few minutes ago to fox news he thought this was a terrible idea and it was extraconstitutional if it is something that he interpreted had never been used before. this is why the president at least from their interpretation, why they need to declare a national emergency. as i said, he moved things around but you need to get a signoff from the appropriations committee chairs and ranking minority members. democrats are not going to go for that if you're going to try and plus up the wall funding. so with the ministration might do, and we have not seen the text of this national emergency say, can we go around this? that is where you end up in

court. if you look at the constitution, article 1, section 9. it is pretty clear that the power of the purse resides in congress. and are you ceding that if you are allowing the president to decide where the money goes versus the congress. kennedy: and it's interesting because you can sort of clean that from nancy pelosi 's tone. she had somewhat of a warning for the president. but she was also pretty delighted at the thought of a democrat president using the same mechanism for their own wish list. >> and she talked about what happened in the anniversary to the shooting in parkland florida. eunice she said after state of the union, she was dismayed that there was no comments made by the president about gun violence and so she said maybe if we have a democratic president 2020 or 2021, we could have the president declare a national emergency on guns or climate or something. your opening pandora's box there. and that is where mitch mcconnell a couple of weeks ago was kind of mulling this idea that they might do a motion of

disapproval. saying we don't like what you've done mr. president.but when i pressed senator mcconnell on this tuesday, he said, i am all for it. whatever he needs to do. so maybe he is trying to fly your cover here for the present break-in signature. notice where mitch mcconnell came to the senate floor today, he announced two things. and speaking for the president. on thing of ever seen a senate majority leader do this. he sent got off the phone with the present he will sign the bill and will declare the national emergency.this didn't come from the white house or sarah sanders. it came on the senate floor which is what was so remarkable. -- remember that mcconnell felt he got burned back in december. that's really the government shutdown because he put a bill on the floor and then said he wasn't going to sign. kennedy: you're absolutely right. if you can stick around we would certainly appreciate it. but now, we are going to take
