emergency on something else like the parkland gun shooting. >> you know, miss pelosi is going to say what she is doing -- her goal is to win 2020. she is not worried about the now. she is looking at 2020. what we have at the border it's a humanitarian crisis. but for the people living on the border in texas and new mexico and arizona. when people are coming there and holding you at gunpoint and robbing. there is a crisis. for those people it is an emergency. when we look at the drugs, and granted a lot of the drugs come through normal channels. but there are plenty of drugs that come unchecked through these borders. this is a crisis in our country and it will lead to a national emergency. secure the border whether it's a wall, technology, beefed up at

the legal checkpoints. but do whatever you have to do to make this country safe. that's the number one task of our federal government. president trump tried to do this through the normal routes and it comes up short year after year. this is the time. let's get this done so we don't have to debate this the future. liz: your reaction to the democrats fundraising asking for funds to fight back. >> democrats are going to do what they do. there always low bar level of how they participate in this. the political process. they will raise money on anything they can because their hatred for donald trump is so strong. what they should focus on and raise money on is what's best for america. what's best for this country. if you take it politics out of it, it's national security. and we are not even addressing those things affecting this nation. it's our national debt, our

educational system. we are going down in world educational scores. we spend so much time in the political circus on investigations. we don't go after those things that are serious in effecting this country. those are the things that we should. those are the things the democrats ought to raise funds on instead of a political dwield they shall on the wrong side of. liz: democrats alexandria ocasio-cortez and joaquin castro introduction emergency legislation to stop the president's declaration. this is look to be a war of attrition fought in the courts. analysts say you can expect landowners, possibly environmentalists filing suit. the white house counsel say together president, don't do it, it's a highlight nation risk. we went through the laws and

found the president has the authority to use funds for a border barrier. let's bring it up with a former defense attorney. what else your take on this, sir? >> it's absolutely legal for the president to declare an emergency under the national emergencies act. even the president's critics have pointed out rightly that the president has broad discretion to invoke an emergency. the word emergency is not even defined in the statute. the real fight, the real legal fight will in the next step. where is the money going to come from. reprogramming of funds. the president head clear that it will come from various departments of the executive branch. the ultimate question is, this is a constitutional issue that is called separation of powers. nancy pelosi wants to say it's unconstitutional that the president doesn't have this

power where the president is saying under the constitution the president has the authority and obligation to secure the nation. and the courts generally have given the president broad deference. liz: we were first to break this story about how the president can do this more than a month ago. let's roll the tape. let's show loophole number two in a 2016 law that's authorized the pentagon to fight drug trafficking. you can use appropriated funds for the building of roads and fence construction and more along smuggling corridors. we looked at a 1993 supreme court ruling saying the president can do this with already appropriated funds. the '76 emergency declaration act. there is language that says yes he can do this. the gao says yes he can do this. we found two other laws passed

that say the president can do this. he has a shot of winning, even at the supreme court level. >> you put two lawyers in a room and you get three opinions. at the core of this, is this an emergency. i'll tell you, being a native southern californian, i ask everyone to come down to a border county like san diego. the illegal fentanyl coming over illegally into the united states, human trafficking, minors and adults being trafficked over in san diego. i would like anyone to come over here and challenge the factual basis that this is an emergency. nancy pelosi called it merely a human carian issue. liz: california's attorney general disagrees with you. would you take him on? >> absolutely. i would be happy to take on the

billion sitting there that they were going to give them. that's incentives. >> that's money they would have earned that would have been taxed that would have been abated. liz: watch what one local new york man had to say. >> to say the capital of business in the entire world doesn't want business. we are closed forward business in queens. if you are too big you get the ire of office seekers. liz: democrats were ripping into amazon for opposing unionization. but the building trades wanted this deal. >> they did because it would have been built by union labor. the iron workers and electrical work were going to get a lot of money. plus 3,000 building service workers would have worked in those buildings and they would have been unionized.

can. >> in terms of the fate of that what can you do in the next year what will give you the most impact to determine changes you might make? >> we obviously are schedule is set. we have the daytona 500 on sunday on fox which we are excited about so our season is set for 19 and will come up with a new schedule for 20 around april 1 and that will have a lot of the things and the offense we think they are going to be interested in and help generate excitement. >> so for people who are not that familiar with nascar at this track at the international speedway is one of 13 tracks. it was essentially controlled by the founding france family and in essence these tracks they want to fold them into the body of nascar and bring those together. their other tracks. people are talking about this is

do they realize they would have to raise middle-class taxes to pay for it? >> this isn't a real proposal. first of all it was great that you call that a single-payer plan. has nothing to do with medicare. it isn't medicare for all. it's an government takeover of health care and as you suggested on affordable. the mercatus institute at george mason university estimated senator sanders plan which is what we have to go on would cost $32 trillion, trillion dollars. liz: medicare has private insurance inside it so you can't really call it medicare for all because medicare again relies on private insurance and medicaid advantage as well. >> it has nothing to do with medicare. it's a great slogan but it's not true. it simply is not what medicare is. medicare has a lot of individual personal contributions not only currently.
