what people didn't like was what they added to the bill. they put handcuffs on what the president can and can't do. it's an injustice. it's not fair to the american people. he was elected for the most of part because he said he was goinged to build a wall. he's building a wall. and he's not talking about it. for congress to get in his way is not fair. susan: why did he sign the bill, since you vote nod for the spending bill. >> it's a national crisis. anybody who has been down there as i have and seen the caravans coming across. he had to get the wall started and the wall built. he had to stop the drug cartels from coming in. he didn't want the shutdown and neither did i. but something had to be done. he made the right choice. for the democrats to be criticizing him, susan, i talked

see what's going on. susan: clinton 17, obama 13, george w. bush 12 times he declared national emergencies. but some are going to say if you use this option, doesn't this open the door for a democrat to do this in the future if they wanted to invoke something on climate change? >> oh, yeah. if they want to, they have that opening anyway. if they want to change the law, they will change the statute. but the american people will be the final judge. if any president uses it frivolously, they will be judged on that. susan: i will tell you what the american public things according to a cnn poll. 2-1 disagree with declaring a national emergency to build this border wall. do you agree? >> the man in the white house who was elected who staked out what he was going to do with the wall. they elected him president.

he's in the oval office. you can tell by his approval ratings after his state of the union speech. look how he focused on building the wall and the need for it along with the other things he hit that the democrats are pushing now. but they are going to fight him on everything. i know of nothing they will give this president. they will make it as hard as they can. again it's unfair to the voters in america. suen * -- susan: , i have to play devil's advocate. thank you very much. president trump predicting a legal fight or his emergency declaration saying it will end up at the supreme court. president trump: we'll have a national emergency and we'll then be sued, and they will sue us in the 9th circuit, even though it shouldn't be there, and we'll possibly get a bad ruling, then we'll get another bad ruling, then we'll end up in

the supreme court, and hopefully we'll get a fair shake and we'll begin in the supreme court. susan: that is going to be a long process. joining me now for more on what comes next. we have attorney brad nicklin, and brad, that's the expectation. >> i'ller was quick to jump in with one liners. they are going to run to a trial court in california. they will select the court. they will win there, then they will tight 9th circuit. then it will go to the supreme court. but the reality is the armchair legal i am is accurate. there will be a number of lawsuits. it will go to theth circuit. but -- but it will go to the

9th circuit. but he'll win in the supreme court, crystal ball. susan: the -- the supreme court is divided. >> i think it will turn on the issues more than the makeup of the court. a lot of the statistics are suggesting the numbers are reducing with border issues. it will be challenging to say it will be decide on the court's makeup. >> it depend on who is looking at it. you turn on various cable segments. one side says this is absolutely necessary. and then breathlessly, seamlessly the other side this is ridiculous. you put that to the side, the

reality is, the complicated issue that will go into the court. the question is what exact authority does the president have. congress gave him a good deal of authority. but i don't see it as a snap one-liner. but in the end as i said, i do think there is enough authority for the president. i have zero hesitancy that it will prevail in the end. that's not a political sound bite. i am a legal analyst. susan: this is not the first time a president has invoked a national emergency. clinton 17, obama 13 times. isn't there already a precedent? >> it's a power vested in the president. the uniqueness to this issue is almost all the past usages were for foreign crisis or international issues. this is for domestic construction. but i think the issue is -- it shouldn't go to the supreme

court. i think we often vest in the supreme court the right to make our decisions and our laws. it should go to the congress to see if we can get a super majority. they can still vote to change the national emergency. the president can veto it and congress can super majority his veto. susan: that may be a waste of time. >> we'll spend years in the supreme court. susan: there is another pressing issue we need to discuss. the supreme court agreed to decide whether the trump administration can add a citizenship question to the 2020 census. isn't there a time crunch because census has to be printed by june? >> i don't think whether they come down or not, i know they did decide to expedite the hearing. considering the deadline and the hearing on this.

i think the consensus will go out without the question. >> i think they will expedite it very quickly and get to it before the census has to come out. susan: isn't it leading? is this legal to add a citizenship question? >> sure. they have don't in the past for many many years. both side to a certain extent suggest this question is going to frustrate the purpose of the census to get a few accurate representation. >> the judge got angry with the government because he said this is a ruse you are doing. you are arguing -- the government was arguing they needed this data to enforce the voting rights act and the judge slapped them down and said you want to do it because you will have less in terms of districting and funding. and it became political.

emergencies. >> as you know. congress still has to go and they can pass a bill and aoc will try to stop this from happening, but the truth is, the president can veto that legislation and ultimately i don't think congress is going to override his veto. i know the president has used this as his last resort. he negotiated in good faith. he closed the government for 35 days to negotiate to soft border crisis and the democrats refused. now the $1.4 billion he got it not enough to soft crisis on the southern border. so he'll make a declaration to protect our people. susan: there is $8 billion to play with until the courts

decide. are you baffled that those on the left, they don't think there is a crisis at our southern border? >> it's amazing to me. the president highlighted this so many times. we have seen the fentanyl coming across the southern border. we heard too many times the stories. so many others in our community who have been killed by people who have come across the border illegally. deported, then come back into the country. kate steinle. the firefighters son in tennessee. we have seen too many of these. one life is too many. what the democrats refuse to acknowledge, their answer is illegals commit crimes at a lower rate than americans do, except when they come across the border and kill americans. susan: another president trump story unfolding.

andrew mccabe is pushing back pretty hard on the backlash that he received after confirming that top officials discussed invoking the 25th amendment against president trump. do you think mccabe realized in that 60 minutes interview he might have admitted to something that was really problematic? >> i think andy maccabe should have been arrested. while he was serving as at acting director of the fbi from the day jim comey was appointed until bob mueller was appointed. he lied three times under oath to the inspector general. he had been referred for criminal referral. he's the highest ranking fbi official other than jim comey to be fired from the agency. all of a sudden this spokesperson is walking back his statement. but we know because we have independent verification that

deputy attorney general rod rosenstein recommended wearing a wire. and jim comey and andy mccabe seriously considered invoking the amendment to remove the president because they didn't like his politics. they used their badges to spy on americans because they didn't like our politics. susan: even the interviewer pushed back as well. >> there were meetings at the justice department in which it was discussed whether vice president and a majority of the cabinet could be brought together to remove the president of the united states under the 25th amendment. they were speculating this person would be with us, that person would not be, and they were counting noses in that effort. it was also said at a previous time that the deputy attorney general rod rosenstein offered a wear a wire.

susan: it pretty much says he said what he said. why walk it back at this point? doesn't this corroborate that there is a deep state, a group work inside the white house to undermine the administration. >> there is no question there is a deep state and that's part of the intelligence community. the comeys, clappers, brennans,ed the strzok's, the pages. they use their power to prevent trump from getting elected. and once he was elected, working to remove a duly elected president from office. if this took place in another country it could be a coup d'etat. i want to see these people prosecuted for the crimes they committed while serving as government officials. it's long overdue. susan: good to see you.

all in the hopes that food and medical supplies will get inside venezuela despite nicholas maduro's blockade on the borders. bob, we are talking about humanitarian aid this week, it's nice to get it there, but if you can't get it in the border, was the point? >> that's a great question, susan. shows the subtlety of the strategy. of course, you need the aid to relieve the suffering of the venezuelan people. but, the aid in many ways as a weapon. first of all, the idea that venezuelan opposition will be the one that delivers aid to the border of the three crossing points, it reinforces to the venezuelans that the real power rest with the opposition, not with maduro. secondly, and equally important, by delivering aid to the border, it is an opportunity to smoke

out the military. can you imagine the young privates standing on the border whose relatives are starving. they have to be the one who has to shoot their own countrymen to prevent aid from coming into the country? here's the third thing, it's a subtle way of telling other countries in the region, like brazil and columbia, that the united states is going to approach this with soft, not hard power. remember, almost 30 years ago we put paratroopers into panama to get rid of that evil regime. now, we are using soft power, humanitarian aid, and sanctions to push maduro out. >> susan: but does that work? soft power containments, we have done this before. is that really is powerful and effective? >> susan, that's a great question. if you asked me that question two weeks ago, i would say yes. now, i'm not too sure. look, maduro would have been out months ago if it wasn't for the cubans. the cubans are doing for maduro what the russians differ aside. the idea is to embarrass the united states by keeping dictators in power and pushing

back against american influence. i think i'm at the end of the day the united states needs, to your point, plan b. what that plan is, nobody knows. >> susan: must change topics. we have general scales, we been talking about president trump's fiery press conference this morning. one thing that came up which was surprising, think was breaking news for a lot of folks, the president hinting that president obama may have gone to war with north korea. literally, he said that they were very close to going to work. does that surprise you at all? >> no, not at all. i'm a military historian and strategist. i have started studied wars throughout my life. most are started through miscommunication. most start with accident. were start when tensions rise to a point when people are no longer able to talk to each

other. now, i'm not saying obama would have started war, or kim would've started a war against the united states. but, anytime you raise tensions, at least understanding and strategic years. what this administration has done, i think very well, his tone down the rhetoric and reduce the pressure. that moves us further and further away from a complex. >> general, thank you so much. also knew tonight, the united states intensified pressure against venezuelan socialist dictator, nicholas maduro. they're announcing new sanctions against top officials in the maduro regime. all this is part of the efforts to try to encourage maduro to step down and transmission power peacefully to one poin one juan. we do have these treasury limitations in place.

again, this is soft power, circumventing the situation. doesn't have the effective control the u.s. is looking for? >> this is exactly what the u.s. does with organized crime in the united states. we use the so-called rico statute to seize the assets of organized crime families. when you take with their assets, when you make it impossible for them to move money, do banking, make transactions that is the lifeblood of their actions, that is a form of hard power, it's not using bullets, but it shuts it right down. that's kind of what were doing. were saying the venezuelan is a rocket tearing corrupt organization. >> susan: that's right. the targets are foreign individuals with the maduro regime. mostly part of the intelligence and military, a special actions force, it's just for individuals.

how much damage and how much limitation does this put on the maduro regime? >> it puts tremendous amount of damage, because the way he controls people, for 19 years, were shot as in the maduro have systematically raped and pillaged and stolen everything of value in that country. turned it into cash and bestowed upon a tiny circle around the leader, bought their loyalty. if you take away the economic power to hang onto the loyalty of those people then they start fighting for each other about what's left. >> susan: is it enough for regime change. isn't this the outcome we want, here? >> look, we will see if it's enough. this is in the only thing we are doing, man. you're acting like were just going after four people.

point that is not part of the bigger picture. >> incremental tax revenue of $10 billion and not just 25000 high-paying jobs of a hundred $50,000 of average on salary, that has a multiplier effect for the community. by the way, they would only get the 3 billion in tax subsidies when they create the 25000 jobs. do they understand the math? >> i think sometimes democrats and republicans can be shortsighted on these issues. i think this is a prime example. i'm so from south carolina, god's country. we had a similar issue when they were trying to come to south carolina. but you have democrats and republicans working across the aisle and is the greatest thing that's happened since barbecue. it's been a great thing for our state and region. also, just giving people a

chance to improve their overall quality-of-life. it's also an attraction magnet for other jobs to come to the area. i think some of the leaders in new york were shortsighted on this. i agree with governor cuomo who work so hard of putting this together. it's frustrating because the real losers are the people who would have a better quality of life, perhaps for generations and now those opportunities will be able to be presented to them. >> susan: i agree. i think this is the biggest missed opportunity for long island city which could have been a hub. what is it say about socialism? millennial's are cozying up to socialism. do they know what it entails and means? take a listen and look at this. >> based on what you part of this plan, and are you do you

young people are saying it's great. when you break it down and talk about what's in these ideas, what's in these plans, something like the green new deal similar to medicare polling. you say would you support medicare for all, 70% say yes, but when you say it's going to eliminate private health insurance and your insurance, then it drops to about 25%. it's similar with the green new deal and other policies that people like alexandria ocasio-cortez support. their unrealistic and unaffordable. even young people don't support. >> susan: unrealistic, don't you think? >> this is a very valuable lesson for all of us. the devil is in the details when it comes to all things. reading is fundamental. the second thing, i command aoc for wanting to have a discussion about how do we handle god's most precious resources. however, when you set a
