important to talk to on all of this. how do you think it plays out? >> there are many ways it can play out in a way that's not favorable to the people of venezuela or to the creditors of venezuela. if this is mismanaged, you are in an area of the world that has had brutal civil wars. there is a history in venezuela of guerrilla movements starting. right next door in colombia you had the farc and the lm in the jungles for decades. so the ideal thing for all of us is there is a smooth transition, a democratic process that results in a legitimate leader of venezuela. one would hope it's done in a way that's more consistent with something that happened in south africa than i don't know, some places broken down into civil wars. trish: libya would be a bad

example. >> we wouldn't want to see an iraq. trish: iraq as well, i should let the viewers know. you have maduro being forced aside by the international community. he's refusing the aid that the international community is offering. so what is it going to take to get him to go live in that villa off somewhere on the beach far far away from vebs as john bolton has repeatedly offered. >> if you take a few steps back, you realize maduro is not being irrational by hunkering down. he has gotten some raw pledges of amnesty in the united states. but there are plenty of instances where exile has not worked out. so what i think the united states needs to do as a global leader. i don't think we need to go in there and spend u.s. taxpayer

money to rebuild the country. what we need to do is provide global leadership toward democracy. i think the model with that should be truth and reconciliation so you give amnesty to a broad swath of the population that might have been involved in some bad things. but the problem with maduro is, if he starts telegraphing in any fashion he's not ready to leave, there are much worse people behind him who may have been using him for a cover. i don't think you can say that he might be a dead man before he gets to the plane that takes him out of the country. you think about anybody involved in narco trafficking, any of the illegal militia activity that he's protecting. if they lose him as the person with the finger on the levers, they are exposed to the subsequent trials. trish: if the united states says we'll make sure you are safe and

we'll give you amnesty. i would think the word of the united states would mean something. >> i think there is good opportunity to flesh that out. don't wait until you get to the negotiating table to explain how this works. we have good models of a transition of power whether it's south africa or northern ireland where you took basically combatants and brought them into the political process. there were a lot more criminals in northern ireland and south africa who were rehabilitated through the truth and reconciliation process. you need an adult at the table. this is a good opportunity for the united states to be the adult. saying we'll get this guy out of there and oversee the dialogue between the two polarized elements of society to build something that functions going forward.

trish: new reports, robert mueller's russia probe could soon be coming to a probe. the special counsel has been digging into so-called collusion for nearly two years now. but we already know that a pair of congressional panels have turned up zero hard evidence of a so-called conspiracy between donald trump and russia. yet former acting fbi director andrew mccabe now alleges that the president is work on behalf of the russians. just listen. >> do you still believe the president could be a russian asset. >> i think it's possible. i think that's why we started our investigation. i'm anxious to see whether dr director mueller concludes that. trish: he wants to sell books and he better sell them fast because we are getting reports that mueller's report is coming

out next week. and there may not be all that much there there. so i guess andrew mccabe needs to do that book tour pretty darn fast. hillary clinton is escaping any scrutiny at all. at the very least wouldn't you question her ethics of dealing with the russians while simultaneously her husband is getting paid $500,000 by them? let's bring in a former administration official in the justice department. if you want to figure out how the russians might have been manipulating things in the u.s., shouldn't you explore it all? >> certainly. but one of the things that's stunning to hear from andy mccabe is his insistence that donald trump is an agent of the russians. apparently he hasn't been paying

attention to what's been going on with the mueller investigation. with the hacking of the emails, both times it was made clear that month americans wittingly took part in those schemes. so i'm not sure where andy mccabe is getting his information. maybe he's just guessing. i would suspect next week or the week after mccabe will wish he had those words back. trish: or at least hope that he sold a lot of books. trish: what do you think was going on here? >> as far as mccabe? trish: the whole thing. mccabe. the mueller investigation. as far as the democratic party salivating at this opportunity to get rid of the president, now they are realizing maybe there is no there there. it seems to me this is all very banana republic. and there is a rush to judgment

then hector, isn't this kind of a crisis? wouldn't you define this as an emergency situation where we need to be able to patrol who is coming in and out of our border officers. >> there is no doubt in my mind that some of these bad actors are coming across the border. we don't have enough manpower and physical barriers to stop the people coming across. we have people with serious criminal records coming across. this an influence of criminal organizations in south america and countries like venezuela. border patrol agents apprehend a lot of serious criminals but just as many get away and enter the country illegally. we need to make sure we support president trump and physical barriers, infrastructure and manpower. trish: good to get your

perspective. president trump's national emergency is facing legal challenges. 16 states are questioning the president's authority in court. if the president determines this is a national emergency and his intelligence officials agree with him, isn't that enough? mercedes colwin, good to see you. the president of the united states is going to have information that is being expressed to him from intelligence officials that let's just say the judges and the courts don't have. >> well, certainly the judges in the courts will look at the states and say, do you have a compelling interest to have standing? do you even have standing to bring this case forward? much of the complaints set forth, a lot of the states are complaining the president is allowed to take funds from this

particular funding, then our national guard might be affected. they are incentives regarding enforcement. they won't necessarily be where the walls are being erected. states like new york, new jersey. connecticut. the courts may look at those states and say if the walls aren't being erected in your states do you have standing? other states where the walls are being erected there might be different arguments. but that might be one critical issue. the other, has there been legislative, the adoption of legislative remedies. congress can come forward, they can thwart the national emergency. the president can reto it and if there is 2/3 vote in congress
