"kennedy" is next. kennedy: thank you trish! breaking is in a cave it's getting crazier by the hour. prosecutors charging jussie smollett with falsely reporting he was attacked by a pair of racist trump supporters. legal experts say it could mean a few years in prison if he is convicted. as you know, the case exploded late last month when the actor claimed he was in a subway sandwich shop when men and redheads beat him up, poured bleach on him, put a noose around his neck and called out maga country. parts of the story just did not add up from the beginning but jussie smollett had been

sticking to the story. tearfully telling good morning america that it was devastating. that nobody believed him. >> you know at first it was a thing of like listen, if i tell the truth, then that is it because it is the truth. but then it became a thing of like, oh, how can you doubt that? how do you not believe that? it is the truth. and then he became of like oh, it is not necessarily you do not believe that this is the truth. you don't even want to see. kennedy: you don't want to see! blinders off folks!since then, his story has begun to collapse. according to investigators the so-called attackers, they were not from supporters, instead, they were nigerian brothers. who now claim that smollett paid them to fake the assault. they are also actors on the show empire and now we have surveillance video of the pair snapping up some bargains. there they are! buying the supplies that they later used in what is looking more and more like a very

as a class iv felony -- kennedy: what does it mean to you? >> it speaks volumes and they mean business. the alleged crime, filing a police, false report. this is against public justice to have people do this. the consequences are severe and here, the da is pursuing it as such. >> is very interesting. i just assume that he's not going to get any jail time because i think actors in this country by and large, they can afford better lawyers to argue their way out of real trouble. unlike people like into the system and have a really hard time extricating themselves for years and years. but if convicted he may have to pay for the entire investigation. >> absolutely. this, these are very serious allegations. i think one of the larger stories that we point is a narrative that is surrounding the story. beyond the trouble that he will be in specifically. there's a lot of issues here for i think the left in general.

and the media in terms of how the story was approached and the outrage machine and how it drove the narrative and pushed the story and he was kind of tried in public court rather than the issue of due process. kennedy: but i think he knew that because if the story were true it would be outrageous! it would be unconscionable and it is hard to fathom that we live in a country where stuff like that can happen. it can happen, is entirely within the realm of possibility. that's why think people had the reaction to it but then you go to this next bubble, he's no longer a victim, now he is charged, indicted with, on a felony charge! a felony count here. what is the motivation for someone like that? >> that would be very interesting to see if it comes out during a trial. and the real tragedy here, one of the real tragedies, is that i hit hate crimes are on the rise. it's a problem. and for someone to claim this happened falsely, to make it

up, to concoct the story, makes it harder for real victims a thing to be believed and possibly to get justice. we will see if this is just someone that wanted attention for himself, wanted to be the victim. if you really just is, i do not want to use the term crazy, but is mentally challenged in some way. there is also reporting now that the police are looking into whether he faked the initial letter that received as a threat. they are also looking into that now as well. so it could be a pattern. spoon and the brothers said he was really upset that the letter did not get more traction in the press. now the brothers are saying and he also made -- >> is a pattern. and to point out something about the litter, just like when you go through tsa, it does not matter if you're joking or not, a terroristic threat letter is taken seriously no matter what. it has such serious consequences beyond a police report. kennedy: if they find that he was in fact, the one responsible for either directing the brothers to craft a letter where he had a big

part in that, will that mean extra charges?>> 100 percent. so much more serious and filing a false report. kennedy: is a chart since it was over the mail? >> yes it is. remember in 2007, he was charged with false identity impersonation, a dui. he gave his brothers name. >> and the court appearance, as such. certainly there was evidence of a pattern before this unfortunately.>> so bizarre. >> who is a bigger liar, him or andy mccabe? >> are not getting into that. >> you're getting into it! >> i'm not getting into that but you made a very good point. the most recent fbi report on hate crimes shows there's a 17 percent increase. this followed an increase, the past three years. we seen hate crimes increase the past three years. when summer comes up. we do not know all the facts in the case yet, but we are certainly pointing to the

politically motivated lawsuit. kennedy: their tweets and correspondence. >> it seems to me to try to make a political point. i will defer to emily on the legal case they have with the amount of money they're asking for, the fact that they think -- kennedy: but i think whenever we see people seeking judgment is because they're trying to make a big splash and get a lot of publicity which they are doing. the question is, does the kid have a case? >> in the reason asking 250 million -- to respond to the social media thing the strength aspect is the amplification aspect that is cited meaning that it went just on the initial first few moments of everyone is jumping on what is happening right now. with the lawsuit it specifies and states that the seven articles and three tweets that were amplified to the millions

of viewers continued to push the narrative with very defamatory in their words, headlines, characterizing the minor child who is 16, that as a state representative or whatever. and if that is what was so damaging. and it was reasonably foreseeable that all of the people would see it and he would then be ostracized because of it. i do think they're making an extremely valid point. kennedy: that was the point of the tweet storm not just from the post but other outraged you know, further left news organizations and celebrities. it was the cactus guy. so one who was such a bad person they had to pinpoint who he wasand make his life hell . what are the ramifications for journalists if nick sandmann and his family are in fact victorious? >> there's a lot of accountability for journalists where there is a narrative or another they are not held

accountable. it is not true whatsoever. we shoot retractions and corrections and we get slammed. we're just talking about in the hallway before we came on here. we get a lot of hate on twitter. and it is serious hate. death threats, he let a female journalist face rape threats and other things. there are serious ramifications when reporters get things wrong. sometimes even getfired. so it's not as if there is no accountability for the media. does it mean that they cannot do better? the media world can definitely do better. kennedy: but you can also , as members of the media in general, not be so overly sensitive so when neiman marcus cells fake news t-shirts you throw a hissy fit to get that removed. >> and trump could have some humor too. >> are be curious to know, and i raise this as part of the case, there will be a discovery process. could other videos come to light that shed more true than what happened and possibly complicate it even more. in other words, now the media narrative is that the covington kids were wrongly painted as aggressors and they were

actually victims. this is a risk, right? because more information to come to light as part of the process. that shows it is more complicated. >> 100 percent. and it's been part of the lawsuit already. they requested that the court go to all of the people in the video and say hold the evidence to make sure. and to answer question about what ramifications do journalists have, supreme court justice clarence thomas as we should revisit new york times -- which is not theirs here according to the attorneys of sandmann. but the future could be very different for journalists. kennedy: judge napolitano said he is a temporary public figure. which exonerates the post. crisis with the "washington post" will be but attorneys were quite clear and very adamant in the lawsuit why he was a private citizen. that is their main argument. >> does age have anything to do with this? >> now they say that is where the negligent exhibit is. >> all right we have so much more to talk about.

the democratic primary and that is that. kennedy: is a really big point. i know it's been an issue for you sometimes. other people in your party particular leadership that feel the same way? the bernie sanders is not a real democrat. therefore he should not be supported to get the nomination. >> i think the people in the party believe, we believe in a healthy primary. we are an open tent and we welcome bernie and and we want to debate the ideals. we have 10 or 11 other candidates, more that will likely join the race. what we want more than anything is for iowa voters, new hampshire voters, d.c. voters, maryland democratic voters have a chance look at all the candidates, assess their records and then have a chance to vote. kennedy: he's not the first person in the race and it all comes down to money. bernie sanders, because he still has a lot of excitement and a lot of resentment that carries over from 2016, was able to raise four times the amount that kamala harris was in her first 24 hours. she was the previous big-money grabber entering into the race. but he's also backing some proposals that will bankrupt the country. as he the president's dream candidate? >> i will say this, first of

all, i think bernie sanders might become the victim of his own success.think about and 2016, he was the only progressive socialist in the race against the establishment candidate, hillary clinton. it was really beside the two pygmies of jim webb and chase lee. the problem is them there so many candidates have signed on to a lot of his agenda, he is going to have diluted some of his power in the primary. i think that will be a big issue for him. i think that he might be a gift to the president? i think he already is. because he is taken the democratic party so far left that they are talking about these crazy ideas a medicare for all integrating -- the green new deal. which are convoluted to this and you did to that he's really not democrat. what if he decides he just says i'm going to burn the house down. >> that's a great question! a third party candidate, richard could really upset this court. i think bernie played nice last time.

our panel is back. emily compagno, john haltiwanger, marie harf. welcome back everyone! let's start with you. gavin newsom. i'm surprised is not gone into the presidential frame war. maybe he's waiting until 2024 and thinking that president trump will be reelected. which would be a great foil for him.the cost overruns on the project has always been prohibitive and they have always underestimated and undersold to voters how much it would cost for this high-speed train. and newsom is abandoning it. >> he is. i don't think the money should be diverted to the wall because of different reasons. in practice, i think that the country needs to figure how to deal with infrastructure. including high-speed rail, including fixing the roads and

bridges. it's a bigger conversation. the fact of the project was so overbudget and has been so mismanaged is a problem because i think it makes it easier to caricature infrastructure projects like this.i don't know what california is doing. but they need to figure out some way to handle this. i don't think the government should take back the money and use it for the wall. and if they politically or legally it's a good thing. kennedy: i don't think it's a good thing either. they're going to build a bullet train from la to san francisco it sounds great but is never going to happen because they have to use the existing rail. they're not going to belize high-speed japanese rails and just because holland and japan has doesn't mean you will transfer them and people in california like to drive. >> you make some valid points. it seems a california government perhaps has mismanaged the project. the list talk about trump and the wall. the project is a waste of money. what about the wall? is the wall really a good way to spend government funds? kennedy: no. >> to relocate military funds for nonmilitary purpose? kennedy: no. >> i think is larger than the debate. and the department transportation decision to take

mandated and have to be used for that specifically that purpose. it will not go back and be relocated but for someone like him that has a peer environmental as it would behoove him to have other issues. where pollution is literally truck up to 70 percent of certain cities on the border pretty is not dressing up because he so focused on philosophical ideas and getting into the contest with the president over the fight. i think he needs to divert his attention to more serious and impactful issues. kennedy: give the money back to the people they earned it. the hard-working taxpayers a place like california and stop siphoning off the federal teet. >> we talked about a lot there! kennedy: faster than a high-speed rail ever can. coming up, an alabama woman that joined isis in syria now wants to return to america. she says, she made a mistake but should she get forgiveness? and is she an american citizen?
