intelligence committee chairman adam schiff and his staff met at least four times with cohen before his testimony last month. the meetings lasted a total of 10 hours. joining us tonight, tom fitton, the president of judicial watch. good to see you. let's start with what in the world were they doing with 10 hours? is that regular order now on capitol hill? >> it's highly irregular and arguably corrupt. if you talk to staff or a member, it's a five-minute phone call, what are you going to talk about, you sound like a good witness. come own. you present your testimony written ahead of time. the idea you had mr. schiff collaborate or collude with mr. cohen -- lou: i'm sure collusion is his

preferred language. >> is extraordinary. he has a demonstrated record of ethical misconduct. there is a pending ethics investigation based on the judicial watch request over his confirming classified information inappropriately. you had the secret meeting with glenn simpson. he's been called out on the cohen issue. lou: why sent recused as chairman of the house intelligence committee? it seems like that would be the automatic result since he insisted devin nun's recuse himself as chairman. you don't need to follow the rules if you are out to get president trump. this is not just a scandal more mr. cone. it's a scandal for adam schiff and his staff who enabled this man to come before congress and lie.

lou: the notorious left-wing 9th circuit ruled that asylum seekers have the right to file appeals in the u.s. courts. the immigration courts have a massive backlog of 700,000 cases that will take decades at the current rate of adjudication to

resolve them. i.e., they don't work. the ruling will likely be appealed. joining us tonight is tom holman, great to have you with us, tom. jessica vaughn, director of policy at the center for immigration studies. the projections are as many as one million illegal immigrants will be apprehend at our southern border this year. what will happen to those folks? will they all be deported? is that the result? or will they be indeed clogging up the system? >> they will be clogging up the system. 60% of them will be released into the country to settle in all oath country and probably

will be living here indefinitely and will be added to that immigration court backlog. most of of them won't even fill out the asylum application. it seems the 9th circuit will allow them to appeal to the federal courts. lou: the democratic house of representatives. >> it's a crisis at the border. if this pace continues with what when have seen this year with hundreds and hundreds being apprehended every day and released into the country. this will be the highest level of illegal settlement since at least 2000. maybe even before that. it is -- it's fully out of control and it's getting worse and worse. lou: obviously so. the house democrats as you know, tom, today making it clear that they want to give the right to vote to illegal immigrants on

top of everything else. and they deny there is a crisis because they have a million voters coming acros across the , in their judgment. the question becomes where is the border patrol, where is immigration and customs enforcement. where is all that wire and where are the u.s. troops on our southern border? how can this be? >> congress has refused to close loopholes. let's talk about i.c.e. if congress is failing to fix it legislatively then we have to do what we can operationally to address the surge. we need a nationwide operation, they need to look for these people and were ordered removed. then go find them. arrest them and remove them to show -- i did that back about three years ago, and that had an immediate impact on illegal

crossing plummeted because we showed we have consequences. so i think i.c.e. and the dems are going to raise holy heck that we are arresting family members. but the democrats can't demand to see a judge, demand they have a right to see the judge. but once the judge said removal. you have to remove them or there is no integrity in our system. lou: let me refresh everyone's thinking about what happens when you have a million people crossing the border. i don't know what the current ratio is, when i was covering the border when i was down in arizona the ratio was 3-1. for every apprehended illegal immigrant apprehended, there were three that made it over. >> they are now turning themselves over to the border

patrol. the reason there are such big family groups coming across. the cartel send them that way. so they move drugs and bad people through a different sector. people are taking advantage of the family groups. lou: what we do know is this is a disaster. it is a national emergency. and jessica, we heard tom's view of what should be done. it makes all the sense in the world to me. this president could order that straightforwardly. would you agree that's the best course? >> absolutely. this is a huge mess for ice to have to pick up the pieces for. but we have to get to the point where we are just not letting people enter the united states just because they have asked for asylum. lou: how do we do that? >> the administration is testing a new policy called the migrant

protect protocols. if they want to ask for asylum. we let them do that. but they have to wait in mexico. lou: obviously that's not working because they are coming into this country. they are entering the country and not being sent back. at these numbers the border patrol can't contend with them. >> the policy has not been implemented across the whole border. lou: why in the world is not the head of the department of homeland security being fired? >> i wouldn't call it a success right now. lou: you wouldn't call it a success. okay, i'll put you down. it's not a success. i'm asking, what do you do -- >> you will have to fire all the members of congress, too. lou: tom, are you telling me we can't hold accountable the

people responsible for securing the border coming up with solutions for this president and the american people? >> i have never seen it this bad. think about the people coming here, they are not going home. back which was a border patrol agent, we would turn them around the same day. we have to locate and remove them. lou: are you telling me the department of homeland security in a national emergency with these people flooding across that border simply throw their hand up, the director of dhs, the head of customs and border protection, they throw up their hand and everybody sits down and the whole department is paralyzed? are you kidding me? >> i don't think they are paralyzed. why don't they do something. >> it's clearly not enough creative thinking going on.

their hand are tied by a lack of fund, a lack of support from congress and crazy judge ruling. but they need to be working with mexico to stop these people. >> we heard that. we heard about mexican return in certain sectors. to this point it's all bull. the fact of the matter is, it's an absolute national emergency. and the people who are responsible aren't even moving. they are sitting on their hand -- i love the dhs secretary kirstjen nielsen telling county's a crisis and unsustainable. tom homan do you think we'll get it done or not? >> we have to remove people who have due process and as soon as the immigration judge is removed. we have to remove them.
