strzok. they're the ones exchanged text messages about doing anything they could to stop the trump train. house republicans have now released transcripts from the closed-door testimony from last summer. she was questioned repeatedly about the fbi investigation of the trump campaign.in it she revealed the feds had almost no evidence of collusion before launching an investigation. and much of that we already knew. what we did not know is that paige also confirm the fbi said there was evidence to charge her claims with mishandling of the unsecured email service. but the doj told the fbi to stand down repeatedly to bury the investigation. pretend like nothing happened. and they were called back, loretta lynch had the tarmac meeting with bill clinton. add few weeks after the meeting the fbi director james comey came forward and said he would not recommend charges against secretary clinton. keep in mind that little red lynch was his boss. he reported that james baker

kennedy are this, first of all, how is this not obstruction of justice? we are all of this chatter about trump and obstruction of justice and witness tampering. how is this not obstruction of justice? the second thing is, deliberately lynch really act by herself and ordering the fbi to stand down on the issue? did she not talk with the white house? if she did, who was she talking with about doing this? i would love to know those answers but again, this all starts to add up. a series of coincidences ceased to be acquainted and start to show a pattern of behavior. showing the doj and i would argue against senior management at the fbi were heavily politicized. and i would argue politically correct for them. if someone was politically connected you know what? we were just, they will get a pass. if you and i had done anything like hillary did had done we would be sitting in jail. kennedy: yes, absolutely. i don't think we will be granted the kind of leniency that she has seen. there were also some questions, richard, about the witnesses, there were witnesses in this

email server investigation under the fbi who were allowed in as advisors during hilarious questioning. and even lisa paige says that was highly unusual because this was not outside counsel at the former secretary of state hired to guide her through the process and the fbi grilling. these were her right hand people. cheryl mills and heather samuelson, who were changing hats, depending on the day. just one of many questionable aspects. >> a couple of things. these are people also involved in setting up the private server. the statute they're talking about -- kennedy: even more reason why they should be separated from the witnesses in question. >> but the gross negligence statute in this document, does not say who intended to commit a crime. that her acts were grossly negligent. i'm trying to figure what is the obsession about hillary clinton? she's overly lost the election. is that not paying enough for

secretary of state, treating the law with such cavalier indifference and treated the national security with cavalier indifference. and i will argue this again, she seems to think the state department is just an extension of the clinton foundation and clinton world. and i have to say that the reason i think there was a private email server was to hide some of the evidence in regards to how she was mishandling and misusing her position as a secretary -- [multiple speakers] kennedy: hold on richard, i'm going to ask you about something specific.ned, you make a good point because heather samuelson and cheryl mills were the two people to help secretary clinton decide which emails to delete end than wipe the service. there was potentially no evidence of any of that at a later date. we are talking about extremely careless whispers here. so you know, they say there was in fact enough evidence and these are the lawyers at the fbi. there was enough evidence to

charge with gross negligence. why are you discounting that, richard? >> of not discounting anything i was asking a question. number one, the fbi works for the doj. the doj prosecutors determine if there is enough evidence, not lisa paige or any lawyer at the fbi number one. and number two, to your point about caring about the point of law and justice, if that were true then we will be talking about what happened in the ninth district but we are not. >> you want to talk about voter fraud? [multiple speakers] kennedy: let's refocus the discussion a little bit. let's refocus and talk about james comey. because during the congressional testimony, he said he had the goods on loretta lynch and she had behaved so inappropriately that at some point at a later date, he was going to let the world know how truly compromised she really was. he was clearly frustrated by the fact that he was hamstrung by this woman and her justice department.who is putting so much pressure on the fbi to curtail the investigation. and not just with regards to what she was charged with.

but how the investigation was executed. go ahead, ned. >> i will say this, kennedy. the whole reason that this matters and the reason we have to have this conversation about what took place at the doj and fbi, they are supposed to be guardians of the rule of law. one of the basic fundamental principles of our republic. if you made a complete travesty of how you actually handle the investigations, how you are actually charging people. again, general flynn being charged with lying to a federal official and cheryl mills and huma abedin doing the same thing and not being charged for it. people might start to think that we have a legal system the cause the question a lot of different things about the society moving -- [multiple speakers] >> for decades african-americans had this little system. so you know -- kennedy: richard -- to your point, richard, it's not

acceptable. bifurcation is not acceptable because something has been historically askew, does not make it an excuse. it is you know, if you're talking about a privileged woman who is able to use her connections to get out of trouble, that is unacceptable. i don't care if she lost the presidency because her own -- >> thank you gentlemen. >> thank you. >> paul manafort will be spending more time behind bars. he was sentenced today to 73 months for two conspiracy counts related to his political consulting work. in ukraine and washington. u.s. district judge amy berman jackson said that they will run concurrent with his seven month sentence. he got last week as you remember. that means paul manafort is looking at 7 and a half years in the big house. the president was asked about it possible pardon. watch. >> i've not even given it a thought as of this moment. it is not something that's

right now in my mind. i do feel badly for paul manafort. that i can tell you. kennedy: he feels badly! problem is, after the sentencing, separate state charges for residential mortgage fraud and other crimes. in that case, is paul manafort out of second chances? terminal -- glenn, nice to see you. >> nice to see you, kennedy. kennedy: looks like paul manafort could be looking at more time with these indictments. tell me about that. >> the charges by the district attorney could carry up to 25 years. we've seen in the recent cases that you just mentioned that the sentences were lighter than might have been sought by the prosecutors and guidelines. no one is really expecting a full 25 years. but you made a good point there which is these are state charges. and state charges outside of

the purview of the president to pardon. >> inventing andrew cuomo was in the habit, nothing in the mood to pardon paul manafort. >> is a political divide there. >> it looks like near state will have a republican tran -- will not have republican governor anytime soon. the guidelines for the first sentencing in virginia were 19 ã24 years. he got 47 months. i don't know how much time judge jackson could've thrown at him. how much time can he do all together with the new york charges? >> it is hard to say but it could be double that. and you know, you make a point, they're interesting about this, with three different cases, right? many of them are similar charges. the charges between the district of columbia case and the virginia case, related but because actions were taken into

two separate districts they went to district courts. >> it could've been prosecuted together but paul manafort chose, why did he do that? >> this is just speculation but i think he was hoping you might build to play the different courts in different ways and trying to evaluate the chances. >> he did get two lenient sentences by some accounts because it was much less than what could have been. and in those cases though, he also got some concurrent sentences. 30 months of the sentences were concurrent. they count for both of those charges. but you know in the end, he came out with a letter sentence that many had expected and prosecutors were seeking. kennedy: paul manafort, might be pardoned on the federal stuff. it's interesting though, with this manhattan prosecutor, do they have an ax to grind personal with the present? >> it's hard to say. one thing i think that we know -- kennedy: another southern district of new york does. >> there been some signs of

that perhaps. what i was going to say that they were with mortgage fraud in the state charges. which is different than the bank fraud which were in the federal charges. based on the same actions, they are seeking perhaps to do is new york has a double jeopardy law. you cannot be charged for the same crime at both the federal and state level? kennedy: that's why they went after mortgage fraud as opposed to bank fraud. >> absolutely. it some people have said pardon proof, they stuff to make their case in court. kennedy: will do think paul manafort will plea or will this go before a jury? >> this is hard to say. he has played on some of them but not all of them and found guilty on some of them but not all of them. so he will have to worry -- way his chances. and so he will be in prison for at least 7 and a half years. kennedy: those lawyers really
