suggested there may have been spying on the trump campaign in the 2016 election. a little later in the hearing he was asked to clean this up may be amended statement by democratic senator, from hawaii. i will review what he said to that. he said, i am not saying there was improper surveillance that occurred. i am saying i'm concerned about it and i am looking into it. richard blumenthal, connecticut said later he thought william barr went too far and should apologize and maybe redact the statement. i spoke with lindsey graham, chair of the senate judiciary committee and house majority about this. they had different takes on the attorney general, william barr. >> did he go too far? >> is a serious allegation.>> i don't know. why didn't they tell trump russians were trying to infiltrate the campaign? were they spying? were they trying to? [inaudible] >> i believe the attorney

general of the united states of america believes he needs to protect the president of the united states. reporter: here's the other thing we did not get clarity on. we still do not know when the mueller report will come out. but barr said something different at today's hearing compared to what he said at the house hearing yesterday. he said it would be out within a week yesterday and today he suggested the mueller report will come out next week.back to you. elizabeth: chad pergram, great reporting. >> thank you. elizabeth: let's go to retired general, thank you for joining us. he says whether it was adequately predicated. do they have legal justification for spying? >> yeah, look, i spent the last four years in the army of the deputy undersecretary of defense for intelligence. in the bush administration. i watched this very closely.

i'm neither an expert nor a lawyer but i can tell you i believe this meets the threshold of being a case of spying on an american. i will tell you, in the bush administration when i was there, i had oversight of a lot of this. we went to great lengths to include the heads of the intel agencies to ensure that we handled correctly, it was called minimization. any collection against an american and now it appears that that has happened again. and i think he is right to call for an investigation. elizabeth: here's what the president said about this earlier. >> it was an illegal investigation. it was started illegally. everything about it was crooked. every single thing about it. these are dirty cops, these are bad people look at mccabe and james comey and lisa and peter strzok. these were bad people. and this was an attempted coup.

an attempted takedown of a president. elizabeth: okay, let's back up. backup from that. the question is, was there proof or was it a fishing expedition?in other words a sitting president doing unauthorized surveillance of civilians working on a campaign for the opposing party. look at the text messages between lisa paige and peter strzok. quote president trump will never become president, right? and peter strzok replied, no, no, he's not we will stop it. your reaction? >> i think it speaks for itself. for this phony outrage by some of the people on the democratic side, i think is ignoring the facts. we heard peter strzok testify. we heard what kind of person he was. we saw a lack of integrity but i think people need to understand this has been done before and this is what the commission 1973 was supposed to put an end to. you know, we had been monitoring martin luther king and quite frankly, we had

monitored other people, historically. i think that we need to recognize that this has happened before. do not act so outraged at the fact that the attorney general, a man i think of great character and courage, has now said he believes that there is a possibility that they were spying and it was not predicated correctly. elizabeth: general, you put into historical context. the attorney general testified today about how bad it was when the government during the nixon administration spied on protesters during the vietnam war. since 9/11, since the patriot act we've had searches, it is unusually unconstitutional. warrants and searches that may have been abused here. that is at issue. we talk about the historical context here, right general? >> right, and the fisa act was passed in 1976 or 77. i forget which. but look, the patriot act actually opened the door to what i considered to be

potential abuses. and it came down to the question and argument between national security and the right to privacy. i think that they were still advocates on both sides of the issue. but i think that the attorney general is on the right track. elizabeth: general, thank you for your insight. come back soon. >> thank you. elizabeth: now to the border fight. the president, broken border laws and the people he says are taking advantage and abusing those broken laws. the jobseekers, migrants that are not covered by asylum laws pushing aside those who genuinely need protection. >> the whole asylum rules, laws and regulations have been taken advantage of by people that are very bad people in many cases. they are running cartels, gaming the system. they have been for years. the only difference in the economy it is now so strong

see you. what do you think? >> for sure, has been described many times as soon as you prefer to porous the border, if you say you are here for asylum you have a right to a hearing. because we don't have enough judges, what generally happens is that you get processed, get put in the system. but your hearing might not be for many months or maybe even a couple of years because of we are short judges. people get into the country and i will take, people who are coming, the thing i disagree with the president on he says these are bad people. these are people that want to live in the united states. who doesn't want to live in the united states? money, rule of law, get a job -- elizabeth: you said majority of them are not bad people. >> i think basically their economic migrants and they are the way people have been coming to the nine states for years. i'm not saying he's not right. you cannot just have a border where everyone can bum rush the border and get him. he is right, we need to control this and you know, we need to

close the loopholes and somehow change the asylum laws so they have a higher bar. people that do not qualify, those people have to get in line make everybody else has to get in line. elizabeth: the problem is so bad that homeland security is talk about housing them in military air force bases in texas and looking at vacant buildings in houston, dallas-fort worth, atlanta, phoenix. here's the thing. alexandria ocasio-cortez says the climate change is triggering this. what do you think? quasi-thing is absolutely silly but let's leave it at that with her. you honduras, el salvador, wrote about this in my column this week. they've not had the kind of economic reform that you need in order to attract investment. they are simple things but they are difficult things. these are developing countries in the recent developing countries are not rich countries is because they don't have a rule of law.they do not have sound money, they do

democrats asked meaningful questions about the financial stability of the markets and what you would do if you have seven ceo 's collectively over a million employees in the u.s. of a, massive contributors of the growth of the economy, the envy of the world economically. what would you ask them?and we saw that today. elizabeth: you make a great point. they're trying to relitigate the financial collapse, we've done that the last 10 years. we understand that. when other bankers have abused the authority in many ways. what is striking sir, i would like your reaction to what happened with maxine waters. getting schooled by bank ceos but who really does our own student loans. watch. >> the committee received testimony last year a million students loan borrowers defaulted which is on top of the a million borrowers that defaulted the year before. what are you guys doing to help

us with the student loan debt? who would like to answer first? mr. monahan, big bank. >> we stopped making student loans in 2007 or so. >> so you do not do it anymore. >> we ended student lending in 2009. >> mr. diamond? >> when the government took over student lending in 2010 or so we stopped doing all student lending. elizabeth: this is an awkward moment. what's striking is maxine waters praised the government takeover of the student loans. how awkward was that? >> i think it caught her off guard. i'm not sure she realized how little they still did or were, for these banks, not even participating. she specialized private finance that has stepped in. because they do underwriting for the federal government doesn't actually underwrite student loans. they take the average risk and allegedly, and interest-rate consists of time value of money and of course default risk. they placed all of the risk and devote the same.

but if you look at some companies that do underwriting. elizabeth: my questions, maxine waters house financial services did not know basic facts there. >> hopefully was helpful. it is a real debt crisis. hopefully was helpful for her and the committee to focus on a real problem. elizabeth: let's watch alexandria ocasio-cortez grilling j.p. morgan. chase 's jamie diamond. >> i represent kids a go to jail for jumping a turnstile because i cannot afford a metro card. do you think more folks should have gone to jail for their role in a financial crisis? that led to 7.8 million foreclosures in the 10 years between 2007 and 2016, mr. diamond? >> i do not think people should go to jail for jumping the subway. i think too many people go to jail i think people broke the law they should go to jail.

elizabeth: congressman, your reaction? >> i think was an odd contrast. yes, there are people, wells fargo that have committed fraud. and it begs to question if anyone is ever prosecuted for these things or to the banks just pay fines? regular people would be prosecuted. it is a meaningful question but the contrast of what's going on with the financial crisis you know, a decade plus ago, with a kid jumping a turnstile, it is just incoherent. there are lots of things like that that you can pick on or nitpick on. one thing i will say about my colleague from new york, she is incredibly successful -- elizabeth: congressman, thank you for coming in. we appreciate you coming on. thank you so much. we are tracking of the developing headlines for you tonight. one person killed, at least five more including a firefighter injured in a major gas explosion today in north

carolina. because parts of a billing to collapse. it happened when a contractor accidentally struck a gas line when he drilled into a sidewalk. this story we've been covering for you. brazilian prosecutors now plan to file criminal charges against the big mining company over the deadly dam collapse that killed an estimated 300 people earlier this year. this with the wall street journal is now reporting. the dam was weak and had poor oversight. that is what government regulars are saying. they have been accused of running multiple dams that have collapsed and hurt people. regulators now say that they were aware of the risks before the latest disaster. look at the story. uber now reportedly looking at a public evaluation of as much as $100 billion paid lower than the $120 billion valuation for the ridesharing company, morgan stanley and goldman sachs last year. suddenly we have another lawsuit.

this time this alleges that uber did not do enough to warn women about rape by bogus, fake, uber drivers in los angeles. the lawsuit claims nine women were raped by fake drivers between september 2016 and february 2018. the lawsuit comes just days after university of south carolina student was kidnapped and murdered when she got into a car that she thought was her uber driver. uber now telling fox business that it is working with local law enforcement including the lapd and how to stop fake uber drivers. finally, for the first time in history, you are seeing the unseen table. what is once thought invisible is now visible. further first time scientists got a picture of the super black hole. 3 million times the size of earth. it has a mass that is six and half-billion times the size of the sun.

you will not want to miss that one. let's get back to bernie sanders. a man that never ran payroll. we'll talk about his mistaken -- let's go through this john. i'm glad you're on the show. bernie sanders and the income inequality fighters. they only use income data from the irs and census.it does not count government and company benefits, jobless benefits, medicaid, medicare, social security, 401(k) on and on. what are your thoughts? >> you're absolutely right. and of course if you ignore all of those things then the society seems much more unequal than it really is. a couple in their 50s right now has $1 million in social security wealth. that is the value of social security benefits they will receive. add that into their other assets and we are a lot more equal than people think we are. elizabeth: that is a good point. by the way the lower and middle class own all half of income accounts be they say 9/10

minors are not born wealthy. they do not start life out on third base. what is your reaction to that? >> a normal worker making honest contributions to a 401(k) plan or ira throughout his work life, will be a millionaire at retirement. that is not that hard. elizabeth: they said there's a lot of income mobility in the country. about half of those in the lower bracket move up to the upper brackets and the reverse for the upper, back temper that have been from 1995 and the last decade. the other thing, the one percent paid nearly half of all federal income tax revenue. it is about 43 percent there. what are your thoughts on that? >> i think we have most progressive income tax system in the whole world.it is still just as progressive as it was before after tax reform. people don't realize how much of the tax burden is paid by the top one percent or the top 10 percent. elizabeth: is like the flip of what jfk said. socialists are now about, ask
