elizabeth: okay. even more details in the college admissions cheating scandal. the story just does not stop. prosecutors signaling that felicity huffman could face up to four to 10 months in jail after pleading guilty for writing $50,000 to rick singer, the fixer to get her child in the school. "the new york times" reporting that other parents have pleaded guilty and are facing longer sentences, possibly because they bribed with more money. joining me now is our memphis university law professor, thank you so much for joining us tonight. >> thank you for having me. elizabeth: do we think that felicity huffman is going to go to prison? >> you know, it is possible. the 17 guidelines for this level of offense, we have talked about four to 10 months under the prosecution, even felicity huffman's lawyers have indicated that she would plead guilty.

under another interpretation of that allowing zeromac vasco 4 months. either way, a number of months in jail is on the table. but however, the relatively low amount of money, they are going to claim that she honestly thought what she was doing was maybe shady but not illegal. that's not a great defense. elizabeth: this is a segue into the next question. because that is exactly what lori loughlin and her husband are saying. they pleaded not guilty to all of the charters that they are now facing. and they are saying that they plan to argue that they only broke the rules, but not the law. they thought they were misled and manipulated. my question is -- i mean, they are breaking the rules. but they also say they thought they were given to nonprofit. they also had a photograph or whatever showing that the kids were on the crew team and they

never did. is this argument would apply? is this defense going to apply? >> as a matter of pure law, being able to say well, i didn't know it was technically illegal, i thought it was a violation. it typically isn't a defense. if you engaged in conduct violative of the law, you are typically guilty. as a matter of plausibility, you just pointed out correctly that they actually did try to doctored the documents to make it look like that she participated in a sport that she never did. it's a hard sell. >> the prosecutor of the jussie smollett case recused herself, but then texted a deputy saying hey, basically she was comparing the charges to r&b singer r. kelly. singh pedophile with problems, line, case eligible for deferred

border in mexico. mexico also stopping its visa policies and trying to disband those camps. that's according to reuters. this as attorney general barr rules that detained border crossers facing deportation who have asked for asylum due to credible fear are no longer eligible for release on bond while their asylum cases are pending, meaning they could be detained in detention centers indefinitely. let's bring in former tennessee congressman with his reaction. what's your reaction? >> hey, liz, well, our polling shows the top two issues are actually congressional dysfunction and immigration. so the president's right really, the congress needs to address immigration and it's a two-sided thing. he's really savvy in trying to asylum seekers and sanctuary cities together because that puts people on the spot, but then congressional republicans have the conflict that a year ago, they voted down the goodlatt bill which the

president supported which funded the wall and now they are saying we need the democrats to fix this problem, when in fact they could have fixed it a year ago. so both sides have a lot of dysfunction right now, and the american people are kind of tired of congress not addressing big issues, like immigration. liz: you make an important point. by the way, we're also counting at least a dozen things that the president has tried to do to fix the border problem. still nothing from the democrats even though they promised that in the government shutdown deal that they would work on the border. what's your take on that? >> well, again, they are now a majority in the house of representatives so, you know, you have the obligation, that's what newt gingrich used to tell us when we won the first majority in 40 years when i was in congress is once you have a majority, you have an obligation to try to work with the president, in that case, we had a president from the other party. so yes they have an obligation, but republicans have voted against goodlatt last year they look kind of two faced because they actually -- republicans had it all last year and voted down the border bill that the president supported.

we wouldn't even be here today had they passed goodlatt a year ago. so both sides again the american people are sort of thumbing their nose at the united states congress because it's broken. it needs fixing, and that's what my organization issue one is all about. liz: we have seen it in the past, history here in the u.s. when for example president nixon stepped up and said enough with illegal marijuana crossing the border. mexico stepped up when nixon stepped up. mexico stepped up when reagan stepped up. what do you make of the attorney general's decision on detaining asylum seekers? that's a big deal. mexico saying we're going to try to disband these migrant camps at its border with us. that's the news coming out of reuters. >> listen, liz, people can criticize the president, mr. barr all they want to, but on the border, and on immigration, he's done pretty much what he said he was going to do. he's trying to do what he promised he would do. so what does anybody expect except for us to be strong on immigration and the border. we've got to do something about

illegal immigration in this country, but congress is lame and ineffective. now it is divided. really the burden falls on both parties almost equal. liz: there's no bill in the senate by the way for the democrats to get back to work on, no immigration bill underway in the senate right now. >> that's what graham says. if they don't have something to vote on, it won't do any good. liz: great point. what would have been the first thing you would have done, quickly? >> as the president or member of congress? i would have voted for the goodlatt bill. if the republicans had passed it, we wouldn't be here today. i think the president does need to use his authority to bring people together. it is a very difficult for him to do it because obviously 20 something people are going to run against him and they want him out of there, but at the same time, we have crises and problems that require bipartisan support, and really the american people want everybody in washington to put their country above their party. there's too much tribalism and frankly this is where we should
