hour of do your day. >> tomorrow night, we break down mueller show, give you th truth. it be great, good night. network. have a good evening. lou: good evening everybody. the rocket man may have returned. there are three developments tonight that darken perhaps the prospects of a successful denuclearization of the korean peninsula. first, no matter how many summits, north korea remains unwilling to move one iota. two, the reported summit between kim jong-un and russian president vladimir putin could occur as soon as next week. and three, the associated press is reporting at this hour that north korea has launched a

test-firing of a tactical guided missile. the united states also tonight has an attorney general intent on not only enforcing law and order, but insisting the department of homeland security understand the law and follow it correctly. attorney general william barr obviously takes seriously the national emergency declared by president trump. he also takes seriously the failure of immigration judges to over at least the past five years to have correctly interpreted and applied the law. he says they haven't. attorney general barr overruling an immigration judge's decision, and that ends catch and release for thousands of illegal immigrants seeking asylum in this country. the attorney general ruling that such illegal immigrants are not entitled to bond, while they await their hearings and must remain in custody. and our broken border, tonight, two congressmen join us from the arizona border with mexico,

where they have witnessed first-hand the influx of illegal immigrants. they praise the attorney general's decision. congressman andy biggs and matt gates with us tonight from the border. the law and order attorney general following the lead of the law and order president. president trump today praising the efforts of the men and women stopping illegal immigration at the border, arresting the criminal illegal immigrants who have made it into our country. >> border patrol has been incredible. i.c.e. has been incredible, what they are doing. they're taking ms-13 out by the thousands who came into our country, the gangs, rough people. they're getting them out. so i.c.e. has been unbelievable. lou: the radical dems however have quite a different view of immigrations and customs enforcement. they are continuing their march to the left and beyond. the work of the border patrol

and i.c.e. is now reprehensible in their view, and those radical dems are calling on those agencies to be defunded. and tonight china accusing secretary of state mike pompeo of slandering communist china and trying to, quote, sow discord between latin america and china. china's rhetoric all the more outrageous as china is smuggling massive quantities of deadly fentanyl into the united states, stealing hundreds of billions of dollars of american intellectual property and technology. joining me now to take up north korea's latest missile test, the prospects of denuclearization now of the korean peninsula, gordan chang, columnist, author, senior fellow at the institute. good to have you with us. this timing of a first ever summit between vladimir putin and kim jong-un and tonight's firing of a tactical missile,

test-firing, to be sure. >> yeah, what kim jong-un trying to do is put pressure on president trump, and in addition to those two things that you mentioned, also there are reports that we're now seeing rail cars at the nuclear facility. they're bringing in fissile material it looks like. what they are trying to do is to say to president trump if you don't cave into me, kim jong-un is saying, you know, we're going to ramp up the pressure. i think it is going to be a big mistake, because i don't think they understand how this president works, but, you know, their misjudging us. lou: frankly it is stupefying. kim jong-un reported to be a smart fellow. he's met with the president twice and should know better of this president than to think he could be intimidated by anyone under any circumstance. this is mindlessness if that is the correct reading of kim jong-un and his motivations in

launching a test-firing, this launch of a tactical missile and moving -- well, we don't know what kind of fissile material, uranium, plutonium, in a position, that would be madness. >> well, you know, i think what kim is looking at, he's seeing that president trump has tried to have a generous policy since the middle of last may, and he's thinking he can push -- lou: a generous policy? >> i think it's been a generous policy. lou: okay. >> because what the president has been trying to -- lou: not in the bush, obama, clinton sense of generous. >> no, but what president trump said a few days before the historic summit in singapore, he said i'm giving kim a one time shot to do the right thing. what our president has been trying to do is create favorable environment so kim will feel secure enough to give up his weapons. kim is misjudging our president. he's looking at the generosity and saying it is weakness. trump is giving him a chance.

if he doesn't take that chance, i'm sure president trump will bring down the weight of the united states on north korea. lou: exactly what form would that take? at the same time, north korea, however everyone wants to characterize the state, it is a client, a proxy of communist china, communist china has been hoping they can preserve blinders on the part of their negotiators as well as our as to issues of national security, our national sovereignty, to pretend that venezuela doesn't exist, the south china sea doesn't exist, the theft of hundreds of billions of dollars of u.s. intellectual property and technology, just doesn't happen every year, and now suddenly, they are watching an awakening because of the absolute madness of kim jong-un. >> well, you know, the chinese have always tried to dangle cooperation on north korea in order to get some other advantage from the united states. in this case, it is obviously trade. but, you know, if you start to

look at american policy, especially over the last six or seven months, it's been really hard edged with regard to china. you know, with regard to venezuela, the comments from secretary of state pompeo were really tough and really good on china. you see them going after huawei, the chinese telecom equipment manufacturer, we're doing that across the board. and we're starting to see, you know, revocation of visas for chinese scholars who may be spying for china, and we're going to go after them on fentanyl as well. lou: again, this is a process, that is, removing the institutes is taking time. we still have thousands, literally thousands of students here who under the thousand grains of sand are without question exploiting their host, american academics for intellectual property, for technological secrets. this is taking a very long time, and it is amounting to vast,

vast treasures or communist china. >> yes, but you know, we've seen the administration act pretty quickly. once they made a decision, you know, if you go back to 2017, trump was pretty easy on xi jinping. again trying to have a generous policy of can you work with the u.s.? when xi jinping didn't reciprocate, trump brought the hammer down on the chinese at the beginning of last year. now we will see the same thing with regard to the north koreans. lou: don't misunderstand what i'm saying, it is not a suggestion in any way that the president is not doing the right thing nor has failed to act promptly and with effect. he is after all the guy who has brought the 301s, has applied tariffs and as he puts it, he loves tariffs. the chinese despise them. but the issue is, how fast does america academic reacting? how quickly is this big broad nation of ours reacting to what

is a clear and present danger to the united states and the face of that danger is certainly, certainly the dragon. >> yeah, academics is not reacting at all. they are resisting what the united states administration is doing. you know, we're starting to see, though, other parts of society are starting to move in response to what president trump has been doing. and really more important, we've seen europe and other countries start to actually get tough on the chinese as well, and they are taking their cue from trump, and that's really -- lou: the ones who are not at this point signing contracts with huawei. gordon, i take your point. and i would like to say that in seeing movement, i'm excited by response, but at least as you say, it's a response, if if it is glacial on the part of the european unions. i will take that to my opttism classes. who thought you would be my

lou: it turns out we have got an attorney general in this country. william barr and the department of justice working for the united states and the american people once again. william barr blocked the catch and release policy in a recent ruling that has attracted tens of thousands of illegal immigrants into this country, catch and release as it's known, under the attorney general's decision, overruling an immigration court, apprehended illegal immigrants will be

detained indefinitely until they have their court hearings, with the u.s. immigration court backlogged with hundreds of thousands of cases, the average wait time for a hearing stands at just about two years. according to recent reports, more than 125,000 illegal immigrants have been released into the united states, waiting for their court date, a court date that most of them never show up for. well, joining us tonight, two congressmen, they are in yuma, arizona this week, where they have witnessed first-hand the state of emergency at our southern border. joining us tonight congressman andy biggs of arizona and co chair of the border security caucus, congressman biggs also serves on the house judiciary committee, a member of the house freedom caucus. congressman gates a member of the house judiciary committee as well and armed services committees. gentlemen, i would kid with you about your sunglasses but i worked too long in that area

where you are standing. i know the intensity and the glare of that sun. it is great to have you with us on the broadcast tonight. what have you seen? and tell us a little bit about your thoughts there on the border. >> lou, what we have seen here is where we're standing, for instance, right now is right next to a fence that you can see behind us that will stop nobody from getting over. it's right next to the colorado river, which at this point is about 10 feet wide and ankle deep, and in the trees and bushes behind us, and on hills behind us, we know, border patrol knows, i.c.e. knows that there are literally hundreds of people waiting to come into this country tonight, and but for attorney general barr, all of them would be released within about 20 days, but right now it is going to be people who come over with a kid, and when they bring that child in, they are going to be out of there within about five days, even with that ruling. it's a crisis. i mean, we ran across a

significant apprehension last night, and we anticipate more later today and tonight. lou: yeah, yuma of course one of the busiest -- the busiest sector is of course the rio grand sector, but yuma does pretty well in that department as well, and in particular the drug smuggling that's going on there for decades. congressman gates, your impression? >> well, we are right here at a funnel point in the yuma valley, lou, and border patrol jokingly mock what's behind us as the obama wall because it's not doing anything to stop the floods of migrants. we can literally hear the cartels, you know, zooming back and forth, spotting us on their atvs, and here's the tragedy, the 42 people that we saw apprehended last night will be out on the streets before the end of a week. in four days, they are released. so today -- or the policy we witnessed last night was catch and release. and what's so sad is these migrants, these cartel members,

these smugglers, whomever they are, that are crossing the border, they simply turn themselves in. they don't even run or fight because they know our laws are so broken that they will be released out into the public anyway. it is a total joke. they are laughing at us right behind us. i am glad that we have a president and attorney general that's willing to fight to preserve the country. lou: right. i should point out if there's any confusion, the ruling by the attorney general overruling an immigration court judge that doesn't take effect as a matter of policy for 90 days now. so there will be that lagging effect at the border of where we will still need all of the help and luck we can in this country to sustain what has obviously an orchestrated surge, funded by the leftists, who knows, maybe by the business interests of this country. corruption is on both sides of this border, and no one should make a mistake about that, thinking it is simply the

cartels south of the border. am i correct, congressman biggs? >> yeah, you're absolutely right. we know that people are coming over -- this border is controlled for instance by a cartel. and the reality is we're facing people who are corrupt on both sides of the border. and that's what's part of going on here and what makes this a crisis. so when you start seeing, like we did, 42 people caught in one group last night, plus an additional half dozen or more in the short time we were kind of shadowing the border patrol, if you will, i will tell you, it is an incredible reminder of how pourous our border is, how dangerous it is, what a threat to national security it is, and that's not even getting into the humanitarian crisis of people who are coming up here risking their lives. lou: yeah. >> so i'm grateful. matt's right, the president's right on this thing where he says it is an emergency, and we have got to stand up. we've got to find an answer. matt needs -- i need -- we all

need more congress to come out here and see what's really going down here so they understand the massiveness of this problem. >> lou, if i could add some of the techniques we have seen used by the cartel, they actually work to create something called gap time, where they will send a group of 40 or 50 migrants over. that will absorb all of the border patrol resources we have, and then they will use that as an excuse to maybe send two or three around, creating those gaps. the second way they create gap time is each migrant that is caught is going to create an hour and a half to three hours of paper work, that takes our border patrol out of the work to secure our country and puts them in a bureaucrat role that they shouldn't be in. the cartels are using it and laughing at us. we have got to get serious about this. lou: absolutely. and the president is obviously -- sometimes he must feel that he is alone in his seriousness about this. he is now moving the primary mission of the homeland security department from counterterrorism to straightforwardly border

security and illegal immigration. your quick reactions, if we may, to his decision in that shift and emphasis and focus and priority for homeland security? congressman biggs? >> yeah, when you start talking about border security, you're actually talking about national security, and it's evident in everything that we have seen down here, what we will see in the next couple of days as well. i applaud the decision. >> we continue to see not only guatemalans and hondurans but even stories of cubans, haitians, special interest al n aliens thalie aliens that are woven into this mix with these caravans. so the cartels fund the caravans to create the distractions to create real security consequences for our country. it is so obvious to everyone here. we don't know why it's not obvious to our fellow members of congress in washington. lou: i think you are referring mostly to democrats, weren't you, congressman? >> well, but even some republicans that we need to do more on border security, lou. lou: yeah, i remember those

there is a national emergency, not simply a declaration by the president. this is a real emergency, crisis at our border, whether we're looking at the 70,000 drug overdoses a year as a result of the drugs being smuggled across that border, whether we're looking at the millions of people entering this country illegally, the cartels benefitting from both. it's stunning that they are endorsing crime. they're endorsing open borders and the prospect of terrorism as well. >> well, and how about this, you're going to be floored when i share with you that actually here in the state of nevada, we are getting ready to take a vote in the legislature, which is predominantly democrat by the way, on whether if we should become a sanctuary state or not. my mother-in-law is the mayor protem of las vegas and she's given information on security on a regular basis, and the

international gang ms-13 which is made up predominantly of illegals from central america, it is full-blown and alive in southern nevada. and we also not too long ago had an illegal immigrant who killed four people, and he had been captured and released, captured and released. this has to stop. lou: it has to stop. the president has tried. by the way, he tried with the republican party in control of the house for two years, to no effect. >> that was embarrassment. lou: because of the leader that is speaker paul ryan and the rinos in congress and the senate who blocked him at every turn who wouldn't give him a dime for the wall that's so desperately needed. even some democrats are beginning to acknowledge the crisis and the porps of securing the border -- importance of securing the border. do you think this president, will there be a point where he doesn't have to fight basically

basically led by its most radical elements, and they don't know how to rein them back in. and they have shown little appetite to even do that in the first place. you have to have immigration enforcement. this is not unique to the united states of america. every country on the planet has to have immigration enforcement or else you lack sovereignty as a nation. there are these calls to eliminate i.c.e. immigration enforcement has to be done or else we have open borders, chaos and actually no sovereignty. lou: as the president says, the democrats are the party of open borders and crime. they obviously don't care. and the democratic party to have to embrace this in the elections of 2020. it's hard to imagine that they are even conscious that there is an up coming election, but of course almost 20 candidates suggests they are keenly aware that there is one. >> yes, and this is how they lose elections. if you're actually going to take up this line -- lou: that's fine with me, if they want to lose it any way they want to, that's fine with me.

what's not fine is not -- not helping this president secure the border and to control out of control illegal immigration. >> that's exactly right. you know, democrats recently had a summit where they were discussing immigration behind closed doors. last week, thursday, actually, and the reports on this suggested that the solutions they were coming up with for the immigration crisis involved figuring out ways to release more immigrants, to detain fewer immigrants and to have less enforcement. those aren't solutions. that's the way to create more chaos. lou: speaking of chaos, pew research pointing out that hispanics in this country will soon be, just in time for 2020, the largest minority group overtaking black americans for the first time. the implications of that for the democrats principally and then the republicans? >> well, there's obviously a cynical hope among democrats that -- especially as we get more migration, illegal

migration coming from central america and mexico, that all of those people will eventually be amnestied and become democratic voters. in the short-term, you know, lou, that they are just hoping that they get the power of those bodies in the united states census. that's the kind of thing that can support democratic states having more representation in congress, whether or not they're citizens. that's how our system is set up. democrats are happy with the status quo. lou: did you love the report today that the chamber of commerce and the rest of the koch brothers and wall street, everybody, all the business interests, were just lined up with the left on the issue of not asking a citizenship question in the 2020 census? one of the reports suggesting it is the first time that the koch brothers, the business roundtable, and the chamber of commerce had ever aligned themselves with the left wing pro-amnesty crowd. absolutely laughable. they are joined at the hip. >> yeah, of course. and they have been for a long

time. it is actually kind of strange how much the democratic -- especially the democratic-led media wants to ignore that topic. it's been that way forever. and increasingly so. in fact, so many of the big corporate interests in our country are directly connected with the open borders crowd and the democratic party. it is the party of poverty and hedge fund managers, and nobody wants to talk about it, but that's what we've got. lou: we've also got some really -- an interesting city in chicago, you know, the most corrupt city in the country, in the third most corrupt state -- or is it the third most -- it doesn't matter. it's the most corrupt city in the country. kim fox, the prosecutor who recused herself but ran the entire jussie smollett prosecution, or should i say persecution, that resulted in no charges, your reaction to her troubles and prospects now? >> that this is utter corruption

on full display, and we should sort through every single sentence of it because rarely do we get this much insight into corruption in the city of chicago, and now we're looking at it, and the test before us is where do we go from here? and where does the city of chicago go from here? she claimed that she was recused as you just noted from the case. that was a lie, and now we see these text messages where she's working to help a celebrity who has got powerful friends including the obamas, including kamala harris, out of trouble, when other people in his situation, who aren't famous, who aren't rich, often actually have to face penalties, have to admit guilt. lou: good for the chicago police department for insisting that there be standards and that there be justice for a hate crime hoax that cost an estimated $130,000. >> they are furious. they don't have the support of their political leadership and they wasted all the time and taxpayer resources on a case that deserves justice and didn't get it. lou: speaking of justice, tomorrow william barr releases
