now. welcome to the show. you are watching the fox business network. let's get to the fallout over the president's decision about iran after shoot they shot down our drone. reporter: the president said he called off the airstrike because 150 people would have been killed. he says that would have been a disproportionate response. the president wanted to deescalate the situation while watching to see if any attacks happened on tankers or any other situation. president trump: the drone was unarmed, there was no man in it. it was clearly over international waters. we didn't have a man or womb in the drone.

we had nobody in the drone. reporter: leaders on capitol hill say the president should have kept his decision making to himself. the president watching iran and his administration getting ready to take on china. his trade delegations are expected to meet before that and restart talks. the administration going forward with putting everything else, the china imports into the united states, under a tariff. however, it may not be a 25% tariff. >> we haven't said what the car river would be. that's not set in stone. that's a function of these hearings. and we will evaluate that. >> the chain a trade issue could be connected with another meeting president xi jinping had

this week. that's with the north korean leader kim jong-un. we'll have some see how this all plays out. a big week next week for trade. liz: the faa issuing an emergency order, banning u.s. airlines from flying over tehran's controlled air space. several airlines now tree routing -- now rerouting flights. john bolton will head to the middle east next week for security talks. don, the u.s. does have several options short of a full war with return. can you spell them out? >> i think the biggest part of our access, let the sanctions continue to work. they are working, they are

strangling iran. each of these acts whether it's the oil tanker bombings, it shows they are lashing out, and trying to put the blame on the united states. liz: commander calen der, iran's revolutionary guard' corps are in the middle east. we are evacuating contractors out of iraq. your reaction to that? >> i think it's a prudent action by the united states to remove our contractors from iraq. iran has already taken actions in saudi arabia and yemen. removing those contractors is a good safe move by the u.s. at this time.

liz: iran is now saying it could have taken out a manned -- people on a u.s. spy plane near the drone. it chose not to shoot down that target. that's addressive behavior there, right? >> absolutely, it's aggressive. they are trying to move the line. this move by the president allows us to strategically place our forces around iran. the president has given them every opportunity to negotiate and come to the table. it's you have to them to take that. liz: i have seen reports out of the united nations calling iran end quote an abnormal regime. it's not a normal regime. when you see the coverage today that president trump is now the

bad guy and iran is the victim, what's your reaction to that. >> this is a case of some in the media, and some of the democratic members of congress. they were going to find fault with it. the president took the exact be correct action don said earlier by calling off the strike. he warned iran to let them know this was imminent. this will give space to both the u.s. and iran. giving them the opportunity to come back to the table. but let them know the u.s. has military options on the table. and it gives us time to bring the democratic members of congress behind, show them the evidence, and bring the european members who have been reticent, bring them behind. liz: stocks fell flat on the last day of the week. and iran tensions offset

exaggeration. he pointed out it was the dominican republic that called the fbi and requested their help. one of their major concerns is the impact it will have on tourism. we asked the minister if he has anything to say to the at least 11 tourists who have died in the last 12 months. he said he is sympathetic. but he stressed there is no mystery when it comes to the death. what people are waiting for is the results of toxicology tests. these are the tests the fbi is said to be helping out with. we could get the results next month. liz: let's get topnotch response. >> i think it main thing going on is they are trying to put a cover-up over this situation.

here is what i do know. they don't do great autopsies. here is what i do know. they don't do great toxicology reports down there. i was suspicion when this couple die simultaneously. i looked at the autopsy and saw that hol holmes had liver disea. and they say his wife died of the shock of seeing him dead? it's much more likely both of them were exposed to the same thing. liz: two theories. methol alcohol, pesticide, another theory. remember terminix wiped out this

a special prosecutor assigned to review how the prosecutors handled the case. could knot that prosecutor reinstate the charges against smollett? reporter: a veteran judge in chicago stated the state's attorney kim fox went against the law when she recused herself then assigned her right-hand man to be the quote state's attorney. the judge said there is no role of an acting state's attorney. illinois law requires that a special prosecutor should have been assigned. now an out of county pegs prosecutor will investigate the smollett case and he could bring criminal charges or recharge jussie smollett. and a special prosecutor will

probe fox's office and its decisions. >> i think they owe all of us answers. as the judge indicated, the confidence in our judicial system will be restored. this will be hand by somebody that does not have a conflict. reporter: she feels there was a conflict in this case because kim fox recused herself for communicating with smollett's family members. in a statement, fox responded writing in part, i am pleased the court agreed there was no conflict of interest. i followed the exis of my chief ethics officer.

deporting 2,000 illegal migrant families in the u.s. but did not leave the country. the report says i.c.e. agents will be in houston, los angeles, and other countries. the mayor of los angeles says the city will not help i.c.e. over the weekend. what's your take on this? >> we have got to enforce the law. we need to secure the border. we want to treat everybody with proper respect. but we are a country of law and order. we have got to enforce the law. liz: deportations are down under president trump. under obama, 409,000 deported compared to 200,000 under president trump.

we have caravans up to 2,000 continuing to head to the border. we have homeland security director saying 1,500 illegals who came here had convictions and deportations for criminal offenses including aggravated assault, murder and sex crimes. >> we need to close loopholes in our law. we moved $4.5 billion which the administration asked for to address the need at the border. this is fundamental to any country and part of having law and order. and making sure we protect our citizens. we want immigration but it should be legal immigration. and people should go through the proper process. so again that's what we need to

do as a country, and the administration is work on it. we took a first step in congress through the appropriations committee. but also close the loopholes. liz: we had reports that hundreds of illegal migrant children are livingn under inhumane conditions. reports are the justice department argued this week in a federal report that detained migrant children do not need basic hygiene products like soap and toothbrushes. these conditions are not great in these facilities. >> homeland security secretary and the administration have asked for $4.5 billion to make sure they can adequately address all of those need. we are working to get that to them. we need help from our colleagues
