one point, he was sending troops to the border. again, these are families, these are not terrorists trying to cross the border and it will come in, these are desperate people. i think that is the reality. kennedy: i still feel the government has not done a good job of figuring out who the families are and who the awful people are renting at the children and people paying money to cross with those children. >> fine but i just do not think it is alliance share of the issue we are dealing with. kennedy: i do not think so either but i still do not trust that the government has figured out the system. >> republican or democrat! kennedy: no one will stay handled as hot potato. >> and the president did incorrectly say, all of these drug dealers are coming across. if he had ordered it slightly different and said there's a crisis with all of these different things here, let's --

state. but can the state supreme court now decide and do their judgments, is that now the official precedent?>> that is exactly it. and what roberts did -- kennedy: he said it and i'm wondering if he is the new -- >> one thing interesting is that the absence wasn't felt in either of these. kennedy: he loves the power, doesn't he? >> i think he is an institutionalist. kennedy: he is the swing voter. while the balance of the court remains as it is. >> and we see this with presidents of think they're getting aconservative and end up not being . it will be interesting because it is a young chief justice that will be there for a long time. i think they are very much single step out of the political fray.it is very important. kennedy: let's talk a little about the census question because clarence thomas was very upset about this. and he wrote in his dissent, not of the quarters opened up the avenue of attack, permissive executive actions have strong incentive to craft

narratives that would derail them. and basically, what he is saying that the court questioned the intent of putting that question on the census. >> right. kennedy: you can question the intent of any federal agency and that gives a lot of ammunition to people who do not like the epa! >> sure. and this is a slightly obscure statute of the administered procedures act. general agency actions, actions of you know, the executive, a huge event of discretion. kennedy: is not included in chevron deference? >> you exactly right. unless you are arbitrary or doing something clearly unlawful. the agencies can do pretty much whatever they want.there was an unusual amount of evidence actually introduced in the lower court showing that actually he wanted to come in and it was something really on the trump administration right from the get go. they put forth the rationale is

and i do not know the government has to force this. but having hospitals and even doctors listed the prices of people know what they're getting into before they seek service. also, we need block grants for the state. for medicaid expansion.we need health savings accounts. we need to be able to buy insurance across state lines and right now i am in obamacare hell. some feel the pain of the people across the country still beholden to this awful system. >> a couple of things. the amount -- the administration has put in place some things. price transparency. they want them to publish prices even if they don't want to. and right now we're working on a bipartisan bill. right now providers use gag clauses to use insurance companies from telling patients where they can get their lowest-cost care. kennedy: that is shocking to me

that there's a roadblock. it seems so basic that you will be able to see where you can get treatment and who you can get treatment from and who you might be able to turn to if you know god forbid you have a pre-existing condition or you want to keep your dr., why is anybody blocking that? >> i had a conversation recently among several others with a new director of the congressional budget office but he said in the healthcare marketplace, the only person, the only without marketplace leverage is the patient. everyone says leverage. they will do which maximizes their profit. by the way, i'm all about profit! but more so about the patient. and if we give the patient the power, the power of knowing the price, the power of choice, the power of competition, competing for her business then prices come down, she is better served. kennedy: actually but with bernie's plan the government
