he's saying federal departments and states have to send their information to the census which is underneath the commerce department. the president will be linking those records. the commerce department tests the possibility of lirnlging the records in the 1990, 2000 and 2010 census. those were just tests. now that will be put into use. democrats say whatever happens, there will be a challenge. >> we are printing the forms. we fully expect the census to go forward. the president's effort to put the citizenship question on the census will be defeated in court. reporter: the president talking about citizenship. the president joke being what

out. liz: let's get right to conservative commentator, kristen thaete. the administration is saying, president trump just blew up the swamp. the social security administration has the best information about who is legal and who his not. it's the agency who writes the checks to the population know who is legal and who is not. the president is saying, washington, change your ways. >> this is trump being a problem solver, finding a solution and finding out a way for us as a country to ask the basic question of how many citizens are in this country. despite what house democrats say, the majority of americans are on board with this. 67% of americans have no problem

with the citizenship question being on the census which includes a majority of democrats as well. the democrats in congress, their motive has been that they could lose congressional seats. we have big numbers living in states like california and new york. when you include the none citizens, this boosts the number of representatives in congress. liz: canada asks its census with citizenship. the citizenship wasr question was -- was on the u.s. census since the 1950s. i don't recall that that was ever brought up that it was

racist under the ice be hour administration. social security has the information. irs probably has the information. i know personally just covering them for a long time, they don't share information. they are getting better at it. the president as a businessman is saying here is a way to do it. this is a pretty effective way to blow up how the government has been operating. the white house believes the american people deserve the information. >> the u.k., australia, canada asks this information. it was never a problem in the past and it protects voting rights. if 300,000 people live in an area and 320,000 votes are cast, we know there is a problem. meanwhile you have democrats demanding that taxpayer subsidized free healthcare and

benefits for non-citizens yet they won't allow us to count the number of non-citizens. so we have no way of knowing how much the programs would cost the taxpayers. liz: social security does give out benefits to non-citizens, including people who are permanent legal residents. people who have visas that let them work in the u.s. the president has more to say about this. let's take a listen to what the president said. president trump: today i will be issuing an executive order to put this very plan into effect immediately. liz: he's going to do it quickly. this will have d.c. and the agencies there in an uproar, kristen. >> oh, yes, and the democrats will fight this tooth and nail. this is what is so upsetting to a lot of voters, is the feeling

that the democrats in d.c. consistently fight for non-citizens over tax paying citizens. another way of having the count of non-citizens is it allows policy makers to direct fund to help those non-citizens for naturalization personnel and other inclusion programs. it helps us better serve these air was community. it's not just citizens that benefit from this information. it's everyone in our country within our borders. liz: the aclu out with a comment. the president may claim victory but this is nothing short of a humiliating defeat for him. his plans for using that data it says will be closely

scrutinized. the aclu says nothing about what the president is saying. the president is saying the american people deserve a better government and how it operates. it deserves information sharing between the different agencies to be better. the president's executive action order is saying federal agencies must gather all record about non-citizens and share it with the commerce department. this is a game change. this is revolutionary. >> i'm not surprised the aclu -- i'm not surprised to see these various left-wing groups and democrats saying they are going to fight back against what is a logical move on trump's part and increases transparency. this is what the democrats have been doing since inauguration day. resist, resist, resist. but i have to think that reasonable americans on both

google executives saying they wanted to prevent trump's reelection. >> if you don't want to mention the project veritas example. we know conservatives have been banned or suppressed for no reason at all. you have very mainstream conservatives like candace owens, and jesse kelly. i'm a free market person. i don't necessarily think the government should break up these companies. i don't believe they are yet monopolies, but this is something certainly to be talked about. and these companies like facebook and twitter should probably be treated like publishers i stead of platforms if they are going to be censoring content.

liz: what a day for the market. the dow closing at a record high of 27,000. gerri: the dow through the 27,000 level, closing at 27,088. the s & p didn't have enough energy to go through 3,000. only the nasdaq was lower. why was the dow so high? managed care, united health adding a lot to the dow today after trump said he'll kill a proposal that would have overhauled rebates collected by middle men in the healthcare industry. the middle men between the insurers and the drug companies. and meanwhile, lots of worries about pharma. this is what drove the nasdaq

evacuating. louisiana is in the state of emergency. tropical storm barry is turning into a hurricane and will be the first this year. it could pack powerful winds and a lethal storm surge. the national hurricane center just issued a hurricane warning for much of the louisiana coast. rick reichmuth is breaking the news on the hurricane watch from the fox weather center. >> hurricane warnings across coastal areas of louisiana. it includes places like morgan city and louisiana. that means we'll see hurricane conditions starting tomorrow into the next day. the reason why this is such a story isn't because of barry itself, but because of the flooding we saw since the snow pack last winter and all the heavy rain this spring.

we have been talking about flooding for months. all that water along the central plains goes into the mississippi river. it has been over flood level for over 185 days in a row, since january. this is the longest we have seen the river continuously in flood stage. keep in mind or think about when katrina made landfall, the river was at 3 feet.

where we have a tropical storm, maybe a minor hurricane, it could have devastating impacts from the water in place. liz: rick leventhal is on the ground. it's an increasingly dangerous situation. rick? reporter: just to reit 8 much of what rick was saying. the governor louisiana says this is the first time louisiana has faced the possibility of a hurricane with the mississippi river at flood stage. but it's up close to the banks in new orleans. if they get that surge and the rainfall they are concerned about, the water could top some of the levees. you can see one of the floodgates right here. part of this wall that's

designed protect the french square and other parts of downtown new orleans from the possibility of flooding. we can tell you there are concerns about some of the other areas including st. bernard parish and the lower 9th ward that was devastated during katrina. there has been a warning for plaque plaque means parish. the authorities are telling us they are concerned not enough people are heeding the warnings. >> people don't want to leave their houses. before katrina we had a bunch of people who stayed. they said it's not going to be that bad. it caught a lot of people off

guard. so we are hoping that more people take heat and go. reporter: you mention the oil and natural gas production shutting down. the rigs and platforms are not producing. evacuated a third of personnel and moved some of the rigs out of the path of the storm. that will go back to normal production. and we are getting encouraging news that perhaps it won't be quite as strong as they originally first feared. so maybe the storm won't be as severe but they are trying to make sure they are read i for it just in case. liz: we are going to dig into whether the democrats would cut and run on cutting a deal on the debt limit. those talks are under way with the white house. the white house is about to send i.c.e. agents out to deport

truman after they left the white house and the courts said the same immunity applies. reporter: mueller is scheduled to testify before house intelligence and house injudiciary that moment. but republicans say the time limit violates the longstanding house rules that allows each member to have five minutes. republicans next week could use a number of tactics to run out the clock. li here are more reaction to what's going on with the house judiciary and the big moment. >> our committee has been rolled on our jurisdiction over special counsel. that's our jurisdiction. instead we ought to be demanding full time to question mueller about the report, then issue

he clearly knew how to say he thought the president had committed a crime or has not committed a crime. he was non-committal in his report. he may make the statement if the president was a private person, but of course he isn't a private person. the other thing is he did not commit any underlying offense and that goes to his intent when obstruction is being investigated. liz: this could backfire and boomerang on the democrats. the republicans could try to grill robert mueller and say what was the basis for the probe. what was the information you used to get fisa warrants to go after carter page who was never charged. that's how the republicans could steal the headlines.
