"fbn: a.m." starts right now. ♪ ♪ glory days. ♪ well, they'll pass you by. ♪ glory days. ♪ in the wink of a young girl's eye. ♪ glory days, glory days. ♪ well, there's a girl that lives up the block. lauren: welcome to "fbn: a.m.." good morning on this wednesday. i'm lauren simonetti. cheryl: good morning, everybody. i'm cheryl casone. lauren: let's take a look at how your money is moving after a monster rally yesterday. we do have a retreat this morning, dow futures down 102, nasdaq giving up 29, s&p down 10. cheryl: we did see a fall in bond prices yesterday on news of the tariff delay. yield on the 10 year right now is lower by 5 basis points, a little bit of a boost this morning. folks want to watch this on to

today's market. lauren: as we continue to watch what goes on with iran, the price of the u.s. dollar, we do have oil pulling back by 1.3%, $56.35 a barrel. cheryl: china's economy weakening even more. real estate in particular. taking a look at asia, despite that news, there is green arrows across the board for i sahn forn markets. lauren: the german market is down 58 points, half of 1%. second quarter german gdp contracting, big story for the big market there. some calm has returned to hong kong's airport but tensions remain. thousands of protesters threatening to shut down one of the busiest airports in the world for a third straight day. cheryl: police are warning demonstrators they could face prison time. benjamin hall joins us from long

london. >> reporter: some people are saying yesterday was a turning noint the 11 week long series of protests. with the closure of one of the world's busiest airports, a major economic hub, that china couldn't allow that to go on. yesterday the scene descended into chaos as riot police clashed with protesterless. for two days, they prevented passengers from leaving, causing chaos at the airport. yesterday, mob mentality ensued. president trump tweeted, saying our intelligence informed us that the chinese government is moving troops to the border with hong kong. everyone should be calm and safe. sure enough, video emerged of a chinese military buildup across the border on the mainland. up until now, china has let the hong kong police take the lead. but yesterday they described the action as near terrorism. a crucial term that would allow china to intervene directly.

yesterday both nancy pelosi and mitch mcconnell issued statements in support of the protesters, leading china to suggest washington's goal wa wao incite chaos in hong kong, saying comments from the members of the u.s. congress provided the world with new and powerful evidence on the country's involvement. so chinese troops are moving to the border. ever harsher language from china and now we're hearing china canceled port visits of two u.s. war ships new hong kong later this -- due in hong kong later this month. the underlying issues that started the protests have not been solved and the fear is the protests will continue until one side or the other gives. back to you. cheryl: thank you. after pressure from businesses, president trump has delayed plans to raise tariffs on some chinese imports. lauren: edward lawrence has the latest from washington.

good morning, edward. >> reporter: good morning, cheryl and lauren. u.s. trade representative robert lighthizer agreed to delay some tariffs until december 15th. other tariffs will be imposed. now, the tariffs that are delayed are a smaller list of 21 pages. they do include underpants, will be delayed until december 15t december 15th, also laptop computers, cell phones, toys, and clothing as well as footwear. tariffs are not going away, just delayed on select items. another list of items will go under tariff on september 1st, this after a phone conversation between the two trade teams, the chinese saying they made stern representations against the tariffs that the u.s. are imposing here. still, the president optimistic that a trade deal will eventually come. >> this should have been done 25 years ago. it should have been 10 years ago or five years ago. this should have been done a

long time ago. this should have been done by biden and obama. china is taking out $500 billion a year and much more than that if you include the theft of intellectual property. what many i'm doing now should have been done many years ago. >> reporter: he's watching supply chains move out of china, the chinese commerce ministry spokesperson said china did not agree to give up anything to get that. china also not agreeing to buy u.s. agriculture, frustrating the president. >> they said they're going to buy farm products. so far, they've disappointed me with the truth. they haven't been truthful or let's say they've certainly delayed. but their intention to buy a lot of farm products and we had a very good call with china. they would really like to do it. they have a problem in hong kong. not would like very much to do -- they would like very much to

do something knew th. >> reporter: the two trade teams have another call in two weeks. lauren: today fbi agents will conduct a sweep of the manhattan jail where jeffrey epstein died. more questions are being raised about epstein's death. cheryl: griff jenkins joins us live from washington this morning. griff, we're learning that basically records were potentially falsified, is that right, griff? it's something, i'll tell you. this is a rapidly moving story. there are multiple reports from the new york times and associated press, saying the two corrections officers charged with checking every 30 minutes on the most high profile prisoner in the country were in fact asleep on the job for up to three hours and suspected of falsifying logs showing the contrary, which if true, would constitute a possible federal crime. the officers are on administrative leave, pending an

investigation. fox news learned the wa the wars been reassigned. today the attorney general temporarily assigned the warden to the bureau's northeast regional office, pending the outcome of the fbi and oig investigations into the apparent suicide of jeffrey epstein, a former inmate. the otisville warden has been named acting war den of the mcc new york, former acting attorney general matt whitaker says this is simply inexcusable. >> there is really no reason that this failures should have happened. there should have been enhanced procedures because of the previous attempt or assault, most likely an attempt and now the success. there were failures but there should have been more enhanced procedures. it'seit's inexcusable.

>> reporter: after action reports may tell us more as a team will start determining whether employees were following protocols and give information on how the decision was made to remove epstein from suicide watch in the firs first place. they are demanding answers and certainly hearings are on the way. cheryl: griff, thank you. charlie gasparino was one of the reporters that spoke with epstein over the last few months in an exclusive phone conversation. he told gaspo he was not a pedophile. he said the only thing worse than being called a pedophile is being called a hedge fund manager. lauren: mary joe white has been hired as the head of victoria secret's parent company. he accused epstein of stealing

vast funds from his fortune. cheryl: president trump praised the energy industry yesterday. lauren: tracee carrasco has details. tracee: president trump promoting a plan to turn natural gas into plastic. during his trip to pennsylvania, he toured a soon to be completed petrochemical complex. some criticized the building of a plant to make plastics but president trump said pollution in the ocean is not our plastic, it's floating over from various other places. the trump administration's new green card rules are facing challenges in california. san francisco and santa clara county filed suits against the new rule that denies permanent residence t to legal immigrants. the rule is expected to take effect in mid-october. u.s. mortgage debt hitting a

record $9.4 trillion. that's beyond the previous record reached in 2008 as the financial crisis hit. the federal reserve bank of new york said mortgage balances rose by $162 billion in the second quarter. mortgages are the largest part of household debt. cinnamon coke is coming to america. the soda was a hit in the u.k. and now it is coming here. it is expected to hit the shelves at the end of september and stick around through new year's eve. coke is also reportedly launching sprite winter cranberry. the company is adding the new flavors for the holiday season a bit early. and that's what's happening now. cheryl: i'm on board with this. those actually sound really good, especially the cinnamon coke. lauren: i think she means they sound good as mixers. cheryl: , no, really, i think i would drink a cinnamon coke. lauren: they sound good. let's take a look at futures this morning. we do have signs of a global

let's expect more from technology. let's put smart to work. ♪ ♪ lauren: did you see this in amazon beefing up its controversial facial recognition software. amazon says the technology can detect fear and age. the software has come under fire from inside and outside the company. critics want amazon to not sell the software to law enforcement because it violates civil rights. the protest comes as customs and border patrol weigh bids for a contract. cheryl: president trump says he's protecting u.s. consumers by delaying the next round of china tariffs and the u.s. has the upper hand in the trade war with them. does his action yesterday show the opposite. clark packer joins us. you've been critical in the past of the threat of tariffs and the

president's hank handling o had- handling of the trade war. some trade fund managers saying this action with the president yesterday, he blinked. do you agree with them? >> i do. the president made the case that the tariffs are not being paid by americans but just yesterday he said in light of the holiday season, he's going to delay them because he doesn't want to ruin christmas. it's sort of a contradictory message. there's a lot of uncertainty coming out of the white house with regard to china. cheryl: it looks like if you think about this, the fact you've got the trade hawk, peter navarro, and on the other side of the table, we've heard these reports, you've gone mnuchin and kudlow, seems like those voices won yesterday. >> i think that's right. i think the president's political advisers said if you look toward the re-election, you need a solid economy.

the way the trajectory has been lately it hasn't been as positive. i think that the political guys are getting in his ear and saying let's get this thing, try to smooth it out, hopefully pave the way for re-election in 2020. cheryl: you said this in your research and notes that tariffs are a tax on the u.s. consumer. $350, that is the number that a family of four would be paying if the full cost of these last round of tariffs were actually imposed september 1st. it's still coming on december 15th. so at the end of the day, the consumer and the market seems to be where the president has put his focus and attention, versus dealing with the chinese on this, whether it's intellectual property theft or the trade imbalance that we've got with them right now, seems that he's focused on americans. >> yeah. but i do think that the united states has very legitimate complaints here and it's not just this administration, these problems have been festering for a while and to the president's credit he brought these issues

to the forefront. cheryl: we got news overnight about china's economy. there is a weakness that's been shown in china's economy, unemployment at the highest level we've ever seen, this is government data, take it for what it's worth. but also the industrial production is the weakest in 17 years. they're seeing less real estate investment over there. do you think that this trade war is hurting the chinese? >> i do. i think it's hurting both sides. but it doesn't -- it wouldn't shock me if the data were worse in china. they're really dependent on selling products to the united states and as the trade war continues, it's going to hurt their side but it also, again, hurts our side as well. cheryl: well, and xi-jinping also has the hong kong problem which we'll talk about later on in the show and a possible military situation there. clark, thank you. >> thanks for having me. lauren: more fallout from the grounding of the boeing 737 max. boeing delivered 258 planes this year, that was down from 417 a

year ago. airbus now on track to pass boeing as the world's biggest plane maker. and in texas, 58 people under arrest after a demonstration by catering workers in front of american airlines' headquarters in fort worth. the union is demanding higher pay from american's food service company. plus, a woman is suing american for allegedly locking her emotional support dog in a plane's rest room. she said she has severe anxiety and the dog was confined to the bathroom during a flight last april. police say no crime was committed. cheryl: that's a long flight to put a nothing a bathroom -- putting a dog in a bathroom. we have a few red arrows to show you this morning. we're pulling back today. the volatility continues. the dow is down 126, s&p down 13 and three quarters, nasdaq down 44 and a quarter. coming up, a different type of

cheryl: portnoy snapped back he would fire anyone on the spot who contacts the writer. aoc told her followers that portnoy could face legal action. he said you could be sued on the spot, that's from aoc. portnoy responded, he would like to debate the congresswoman. ocasio-cortez has not accepted that offer. lauren: sh shoul markets heldo the trade war with china. does president trump's tariff delay put us any closer towards a deal? dominic davella joins us now. dominic, are we closer to a deal? >> no. [ laughter ] >> no. lauren: flat-out no. how far away is a deal? >> look, we literally started looking at this picture nine months ago, thinking any day now, any week now, any month now, we would get this deal

done, it would get done quickly. here we are, not happening. it's going to take a long time. lauren: the wall street journal editorial board writes admission that the trade war isn't cost-free to consumers. would you agree? >> totally agree. they've obviously devalued their currency, they're trying to offset the increase in prices. at the end of the day it's a tariff that gets imposed on the goods when it enters the united states. either the company absorbs it or the consumer absorbs it. companies are doing a good job of absorbing some of the costs. lauren: can macy's absorb the cost? they report this morning. their stock is down 35% this year. earnings are expected to be down 35% on an annual basis. can they absorb let's say these increases. >> it will be tough. they say they can. they say they're going to offset it. but it's going to be very, very difficult for them to absorb it. either they eat it or the consumer eats it. some of it will get passed on.

lauren: or maybe the consumer buys less of something, lesser quality of something. i spoke to the national retail federation yesterday. they say when you look at macy's, it's furniture and clothes and shoes and if you put a tariff on clos clothes and sh, let's say it's 25%, that will cost an extra $7 billion a year. >> the consumer% doing really well. consumer confidence is an all-time high. we have extra money in our pocket. but all of a sudden that could be taken away and if that consumer confidence starts to roll over and go down, that really could be negative to the economy. lauren: does president trump if he loses the consumer, does he lose the voter? >> i think he does. if you look at the everyday voter that's a trump voter, these are hard working, blue collar people. if he loses the consumer, he's done. lauren: walmart also reports

this week. how does the trade war play out for walmart. ubs says when we're in times like this, historically walmart is a beneficiary. >> when consumers are hurting they go to a walmart, looking for the bargain basement price. they may downscale, looking at the quality of the product they're buying. walmart is a beneficiary of this. having said that, a considerable portion of what they sell comes from china. outrageous percentage. lauren: what retail stocks do you like right now? >> you've got to look at amazon and you've got to look at anything that is internet-based because the consumer's shopping for price. they're going to take that powerful tool in their hand, they're going to google it and find it. lauren: we do all the time. >> we all do. amazon is a a ben fai beneficia. cheryl: i love a little super target, guys. listen to this, speaking of amazon, could britney spears be part of the reason that target

cheryl: the race for 2020 is heating up. a new poll shows bernie sanders edging out former vice president

joe biden by 6 points. elizabeth warren in the close third, 3 points. is the democratic race about to be hit by a progressive storm. let's bring in reporter emily larson. this is the poll and the push in the democratic party right now. who is winning? >> right now, joe biden is ahead in most polls nationally and in a lot of early primary states. the poll so far seems to be an outlier. it will be interesting to see if this is a trend that continues. bernie sanders is expected to do very well in new hampshire, it's right in his backyard there in vermont. but i think the bigger story is whether biden will be able to take -- keep hold of his lead that he has, especially with so many voters worried about his gaffes and fumbles. cheryl: he has to pay attention to what the far left candidates are saying. bill de blasio was on bulls and bears yesterday, listen to what

he said -- well, it's a good old democratic addage, listen. >> if you're a working class person or middle class person, your taxes are not going up. we're asking for folks that have done well, often with the help of the federal government, to pay their fair share and that's how we'll make investments in the country. what i would do to pay for infrastructure is get the tax rate back to 25% and that would fund the infrastructure program and we would be better off as a country. cheryl: likely these two men will not be on th the debate ste in september. they're leaning on old democratic theories on the economy which seems to be the wrong message if you want to get the moderates out there. >> sure, i mean, bill de blasio is talking about taxes not going up for the middle class. voters are wondering how people like de blasio who supports medicare for all will be able to support that and not raise taxes

on the middle class. bernie sanders is saying that middle class -- that taxes on the middle class will go up. there's confusion with voters. right now, with the crowded field, it's not about the intricacies of the tax plans. it's more of a cult of personality. cheryl: to your point, emily, most folks out there still really don't know these democratic candidates. they're just now starting to tune in because it's such a crowded field. something interesting that's happening on the democratic side, looks like john hickenlooper, there are reports that he will abandon the presidenpresidential bid and rua republican held seat in colorado. what do you make of that? >> certainly. i think this is something chuck schumer is excited about. he's been trying to get hickenlooper and a lot of other democrats who are seeking the presidency to not seek the presidency and instead run for senate in their own states. this is not necessarily surprising.

cheryl: flights have resumed at hong kong's airport following two days of demonstrations. some of them did get violent. several dozen protesters continue to occupy the arrivals terminal right now. president trump seems optimistic the two sides will reach a solution. >> the hong kong thing is a very tough situation. very tough. we'll see what happens. but i'm sure it will work out. i hope it works out for everybody including china, by the way. i hope it works out for everybody. cheryl: our next guest says the u.s. should urge hong kong's government to resolve these disputes and find peace. retired army lieutenant colonel daniel davis joins us now. good morning. >> good morning, how are you? cheryl: i'm good. it is disconcerting when you think about continu tianemen sq. the president said the intelligence agencies are

telling him the chinese are mobilizing on the border. doesn't that concern you a little bit? >> well, i think that because china really values stability and they recognize that hong kong is really important to their economic future, they're going to do everything they can to avoid another tianemen square situation. that would harm their own interest. i think it's in their interest to get this resolved peacefully. i think it's in the united states' interest to affirm the agenda of the protesters because we want people to have freedom everywhere, but we should urge the country as president trump did in that tweet there, or in that convent, that they should get that resolved peacefully. cheryl: the other situation is the image for china, we are in a trade war with the chinese, but xi-jinping is under a lot of pressure by the hard liners in

his own country. that could include hong kong. >> they have to be concerned how this would be viewed elsewhere in china. they can't be seen as giving in too much to people who demand more freedom because that could have cascading effects elsewhere in their country. they also have on the contrary side that they can't go too far because that could cause more problems for them, both domestically and internationally. it's a balancing act they've got to have. they're in a tough situation. cheryl: what do you make of the chinese throwing shade at the united states, accusing officials here of inciting this violence in hong kong? i think a lot of americans found that pretty of fence i've. >> they do. -- offensive. >> they do. the united states, we always want to affirm anyone who is protesting for freem. wfreedom.-- protesting for free. if we go too far, to say the protesters can do whatever they want and it's bad on the chinese part, that's not going to be resolved well and will limit our

influence. cheryl: what do you make of the fact that u.s. war ships have been turned away from the port there. >> i don't think that's surprising at all because they don't -- they're already accusing us of being behind a lot of this, and the last thing they want is the presence of u.s. military actually in hong kong ports. cheryl: hong kong at the end of the day, it seems to be the crown jewel for the chinese, i would assume, because of its financial independence, because of the travel industry which is crucial to the economy there. and that's where i think we hope there can be a peaceful solution, if carrie lamb resigns. last word. >> right, right, absolutely it does. that's why i think it's in our favor and in the protesters' favor, that china wants to resolve this peacefully. they don't want to mess this golden goose up. cheryl: hopefully they won't and things will calm down. colonel davis, thank you for being here. >> my pleasure. thanks. lauren: more privacy concerns with facebook.

lauren: it is only august but toy companies are already full of christmas cheer, thanks to president trump delaying tariffs on most of the toys we'll put under the christmas tree. let's bring in rebecca mond of the toy association. how relieved are you and how severe would this tariff be if it does in fact go into effect? >> well, we are certainly relieved and glad that ustr and the administration heard the

concerns of the u.s. toy industry and the nearly 700,000 jobs in the united states that we support. if these tariffs were to go into effect, it would have a huge impact on the toy industry. so it's great to have this four month reprieve but the fight is certainly not over. lauren: you know, you said 700,000 jobs. 95% of the toy industry is small business. 85% made in china. so we think of like big walmarts and the like but these are small companies that if there is this tariff they don't have the ability to absorb the cost and don't have the ability to move the supply chain. >> it's the small companies that are really going to feel the impact and that are feeling the impact and there's small companies like a small hat manufacturer that are located in colorado, 10 employees, and they are feeling the impact of those tariffs that are in effect. lauren: do we have, rebecca, the toys here on our shores already that are expected to be hot for christmas?

are they here already? or are we awaiting shipments? >> well, consumers can be put at ease that this holiday season they shouldn't see any impacts in the toy aisles and there is tons of hot toys for children of all ages and all interests. my nephews, they're obsessed with pokemon and my son, he's one, and he loves anything that makes noise and so there's some great musical instruments and drums out there for him. lauren: rebecca, are we relieved for this holiday season because the pokemons and the l oolsurprise dolls are already he or because of the tariff delay? >> we're relieved because of the tariff delay. a lot of companies are still having shipments come in this september and october. and so they are not going to be seeing that impact this christmas season. lauren: yeah, and i think that's what a lot of people miss. many people who excuse the

threat of these tariffs say, well, the stuff's already here. but especially when you get that hot toy, we can predict how hot it's going to be sometimes but there are other times where it kind of surprise -- where you're kind of surprised and you have to rush shipments to satisfy the kids for the holidays and if those toys did get a tariff come december 15th, that would be a big deal. >> certainly. i'm guilty of that last minute christmas shopping as well. so i'm a part of that problem.
