[closing bell rings] dow is up seventh day in a row. broadcom earns up deck. s&p up eight points. it is not a record, not today, folks. that will do it for "the claman countdown." melissa: stocks inching closer and closer to all-time highs. all major averages ending in the green off the highs of the session. still we'll take it. the dow closing up 48 points in the green for the seventh straight day. the longest winning streak in 16 months. 100 point shy of a new record. i'm melissa francis. connell: i'm connell mcshane. it has been quite a run. faded a little bit at the end. the s&p 500 closing in positive territory for the third day in a row. nasdaq in the green up two days in a row up 25 point. melissa: we'll take it. connell: absolutely. melissa: fox business team coverage this hour. blake burman at white house, gerri willis on floor of the new york stock exchange, phil flynn

following all action in gold and oil on the cme we'll go to blake first. reporter: the word being used by both the united states and china goodwill after president trump announced he will push back a scheduled tariff increase on october 1st, back, october 1st a couple weeks to october 15th, because of a celebratory anniversary that will be taking place in china. the treasury secretary earlier today, steve mnuchin, saying that the u.s. agreed to china's request. >> the vice premier asked us to delay it and the president agreed to that. i would hope that china reciprocates. this was done as a goodwill gesture to the chinese. reporter: spokesperson for china's commerce ministry saying quote, we welcome the goodwill by the u.s. meantime the market earlier today took notice of a headline from bloomberg which said the president's advisors are considering an interim deal to delay tariffs however the white house has not publicly

said that is the direction which this potential trade deal with china is heading. mnuchin also talked up the use of tariffs. >> there is no question, the only reason why china is seriously negotiating with us is because of the tariffs so tariffs do work. it is what brought them to the table. reporter: china also today gave the impression at least that an agriculture buy of u.s. products could be coming. the president took to twitter to say the following afterwards saying quote, it is expected that china will be buying large amounts of our agricultural products. expected is the key word because the u.s. has been down that road before. connell: thank you, blake. we have paul treat trick, michael lee. michael, start with you, to blake's point we've been done a lot of these roads, when we're

up seven days in a row on the market you have to wonder is it trade, we always say it or something else going on here that u.s. stocks are the best of the bunch when you look to invest to? >> latter half of that statement is 100% correct. the u.s. stock market is looking pretty good not only from a relative value standpoint but we have some incredible data points. one that has been less publicized is the act for corporations ability to issue new debt. last week was a record-breaking issuance in credit markets. typically leading into a recession a lack of liquidity pushes you over the edge. we're in fact seeing the opposite. we got really strong consumer data. redbook same-store sales were up 6.4%. we're looking pretty good here. connell: paul, from where you sit are we looking pretty good? what do you say about the market? >> i think so and i've always been talking with some of the people on robert lighthizer's trade team and i've seen oaf the last week they are much more positive than they have been.

i think they thought the chinese were slow walking this until the next election. and now they're basically saying, the chinese seem to think that the progressive democrats may not be as easy to work with as president trump. connell: that's interesting. >> because of the labor unions are the big donors and they don't want any agreement with china. and so i've seen, detected a real change in, they have become more optimistic, president trump's trade team over the last you know, week. melissa: interesting. that's a good point. trade only part of the picture today as stocks also rising on stimulus hopes for the world economy. let's go to gerri willis with more on this gerri? reporter: that's right. normally it is about china. not today. it was the ecb, european central bank cutting rates trying to bolster the economies in the eurozone. they cut deposit rates by 10

basis points, negative 50 basis points or half a percentage point. they decided to restart bond purchases like we did over here. there is no end date for that. that was a surprise for the markets here. they really liked it. you might have thought stocks would sell off because the dollar would encounter headwinds. an interesting morning on the news, the ecb trying to stand behind the eurozone economy. another big story catching trader's attention, walmart will have unlimited grocery delivery subscription service. shares are higher. they're charging $98 for the service. in the back ofou mind, you're thinking amazon, $119 a year for their service. this is undercutting amazon. what you get for this? you get a four-hour window. you have to give them four hours to get groceries to your door. the minimum order has to be $30. think about it, unlimited delivery. it will be available in 1400

stores. 200 markets, by year-end, even more. so, very ambitious targets here for walmart. back to you guys. melissa: absolutely, gerri, thank you. let's pick up on that. paul, there is a lot of factors here. i have been in the online home grocery delivery game since webvan back at the turn of the century. one thing at that really counts, everybody tries this, it's a very difficult business, what counts is the brands that you have, and can you deliver what people want? amazon has a habit of monopolizing the brands that people like. that is how they get a leg up on the local deliveries but walmart might have some buying power here in terms of bullying the brands not be exclusive to amazon. how do you think this will shake out? >> i think walmart definitely has the power to do this. and if you think about the pricing, it is unlimited delivery. it is only about 2 bucks a week. one of the most interesting parts of the announcement today

i thought was that if the client is home or they have a special lock, walmart will actually put the groceries in your refrigerator. melissa: hmmm. >> i'm waiting for the next iteration of this service where amazon and walmart will come to your home and feed me and, that is a disruptive technology i'm willing to pay for. melissa: yeah. michael, we have heard this before though about the idea that they will come, deliver and put it inside of your fridge. i mean, how good do people feel about that if they're not home? >> i don't know about having put it in the fridge but i have three small children. going to the grocery store is an absolute nightmare. melissa: yeah. >> whole foods has this as a service which is extraordinarily convenient. you have to shop at whole foods, if you're not a fan of them like say me, you much rather get your groceries from walmart. i think a lot of the brands that

they are going to have will be very different from the ones amazon has at whole foods. melissa: yeah. >> i think this will work for them. this is such a big company. i don't know how it moves the dial. at least those this company is waking up to where the business is going and can try to compete with amazon. melissa: it is tough to get amazon same day. walmart is saying same day. that is a big difference. we'll watch this one. thanks, guys. >> thanks. connell: let's move over to oil. oil was down in the red for the third session in a row, down more than 1% in trade today. there is lot going on in the market. phil flynn, following it all. what did today, phil? >> it was a little bit of everything. we've been concerned of course the oil market about the return of iranian oil supplies after john bolton of course, the national security advisor got fired. trump talking about more supplies. that has been bearish but wait a second. we have polar opposites of the other side. talk of the u.s. china trade deal. those hopes brought oil off the low. if there is u.s.-china trade

deal. we'll need extra oil, we'll need iranian oil, all the demand expectations lowered over the past couple months predicated there will be a trade war well into next year f that doesn't happen, the oil market will get very tight, prices will go back up. we had a little bit of disappointment come out of the opec meeting, plus one. they decided to kick the can until december. decide on further production cuts. right now stay the course. connell: phil, thanks. as always phil flynn in chicago. melissa: that's smart. there is based on thinking there will be a trade war. they have been pricing that in. that is one thing i hadn't thought about. the top 10 on the stage, democratic front-runners with do night's debate. what to expect. why some on wall street are sounding alarm about one candidate's surge in the polls. let me guess. don't say it. connell: don't give it away. felicity huffman set to be

melissa: a front-runner faceoff. joe biden and elizabeth warren are sharing a stage for the very first time during the third democratic debate in houston. hillary vaughn in texas southern university with more. hillary. reporter: former vice president joe biden will be sandwiched right between senators elizabeth warren and bernie sanders tonight. both those candidates have a lot of pricey, expensive ideas. sanders tweeted today, essentially bragging about it, saying he would devote 10 times the number of resources to combat climate change than biden would. warren is out today with a plan to address social security, which of course comes with a price. warren's plan promises people who get social security benefits will receive $200 more every month. that will be paid for essentially by a tax on the top 2%. high earning families will contribute 14% of their net investment income to social security. this is the first time though that warren will get a chance to

face biden on the debate stage. the debate is here in texas at texas southern university, a historically black college that was founded in texas when texas was still a segragated state. biden is out with a new campaign ad today before he takes the stage reminding everyone he was president barack obama's vp. >> i think we should step back and say something we don't stay enough as a party and as a nation. barack obama is an extraordinary man. [cheers and applause] reporter: sanders is also putting pressure on biden by targeting the oil and gas industry in texas. that is texas is number one producing state in the country for oil and gas. he is calling for a fracking ban. that is something biden hasn't called for. biden has taken a lot of heat for attending a fund-raiser hosted by founder of a natural gas company here in houston. harris and warren supported a fracking ban. the two texans on the stage,

beto o'rourke and julian castro have not gone as far to support a all-out fracking ban. melissa. melissa: wow, those are some extreme policies. hillary vaughn thank you. connell: let's talk about it. the communications director for the national democratic committee. good to see you. welcome back to the show. talk about a dynamic on stage. we see all candidates on one stage. does that change things, if so, how do you think? >> i think it is an opportunity for the american voter what each candidate, how each candidate will help the american people. they will talk about their policy differences. they will talk about their own plans but i think every person on that stage tonight will have better chance and will do more for the american people than donald trump. i frankly believe that you know, one of these candidates will end up moving forward and you know, whether it is this debate or next debate i think they will continue to talk about the issues. connell: one of the questions whether all of them could defeat

donald trump, president trump in a general election, or whether the policies are too far to the left to do so. i bring up a couple columns, written by friends of ours, charlie gasparino had one in the "new york post," everyone is freaking out on wall street about the thought of having a president liz warren. that was the headline. dan henninger, a frequent guest on this show, quote, a normal candidate might defeat trump, beyond jo biden there is no plan b. what do you say to people, who say, biden is quote a centrist, but if you want to get swing voters that decide the election in key states, what if he is not the nominee? is there a plan b? >> well, don't take my word for it. look at polling. look at what voters are saying already. what voters are saying already, top few candidates in a head-to-head would beat donald trump. i would look at actual data behind that, that says you know, i think a lot of people are sick of donald trump. they're sick that he hasn't done

anything. they're sick he continues to tweet. he is not providing for them. and you know, just this recent, a few weekends ago there was a shooting here in texas. he was on the golf course. we had a hurricane about to hit. he was on the golf course. people are realizing this guy isn't for me. they thought he would shake things up, he didn't shake things up for them. connell: what about on your side, economic policies we stay focused on, hillary vaughn focused on specific policies, for elizabeth warren surging in the polls, if you add up her proposals the numbers are really astronomical, way into the trillions and trillions of dollars that, you know almost any independent analyst well tell you, even if you take every dollar of tax money from the so-called rich you're not paying for this stuff. once these candidates are challenged on it, she is, how do you answer for that, how do you pay for all this? >> well that is for her to discuss and to answer but at the same time, i just want to point to you, when it comes to the

economy and just look at barack obama, he inherited a recession and now, you know, what trump inherited was a strong economy. so under democratic presidents our economy has been strong because of the policies that they pushed. what i will tell you that we will not pass is we will not pass a tax cut for the rich. we do not believe that we should be helping out the top few who, you know, we believe we should be helping out the american worker. that is not what donald trump is doing. that is the dnc, what we're trying to do is talk about the workers that have been impacted by donald trump policies. and i think that when you talk to worker after worker, in these battleground states, they will tell you we didn't think donald trump would do this to us. connell: let me ask you as a final question, a strategic political argument a lot of people thought democrats would run against president trump's personality, he is a better guy, we can do better you think there is economic argument to make? the economy is the president's strength, one issue he is above

water on the major polls. the economy he thinks he can run for re-election on. do you think you can run against him on the economy? >> we will absolutely run against him on the economy. we will run against him on health care. those are the two top issues american voters would care about. if donald trump would doing so well he would not have lost the house of representatives. that was a referendum on donald trump. these voters are sick and tired of it. why you had democrats win in the house in 2018 and we believe that if we continue talking to these voters that they will do the same in 2020 and vote for democrats. connell: we'll keep covering these debates. i'm sure we will talk to you, hopefully before the next one. thanks for coming on. >> good to see you. melissa: wonder about the tax cuts for very rich. i must be poor because my taxes went up, dramatically. i don't know. i guess i must not be -- connell: destitute. melissa: okay. new drama in the uk. how boris johnson's latest

melissa: some really concerning new details out of california. the dive boat that caught fire killing 34 people off the coast of santa barbara did not have a crew member on overnight watch as required. this is according to preliminary report from the national transportation safety board. which of means they were all asleep at the same time. nobody was watching to make sure the boat didn't drift into something. the report did not identify yet what may have caused the fire. connell: what a story. now, get to brexit. more drama. always drama. the prime minister is accused of lying to the queen over the

parliament suspension. you don't want to be lying to the queen. benjamin hall in london with the latest. reporter: brexit is 50 days away there and there is complete gridlock. today, boris johnson prime minister, was forced to deny he lied to the queen over advice he gave her over a five-week suspension of parliament which began this week. scotland's highest civil court ruled yesterday that the shutdown was unlawful and politically motivated, to try to push through a no-deal brexit. but johnson insisted that his decision was a routine move, which simply allows the government to start a new parliamentary session. the british supreme court will now rule on the issue. there has been more brexit fallout after lawmakers forced the government to publish its official assessment of a impact of a know deal brexit. the document called a yellow hammer, described potential food

melissa: facing the musing. felicity huffman looking potentially a light sentence for her participation in the college cheating scandal. "tmz" saw the probation report, there was no actually or intended loss. the actress is scheduled to be sentenced tomorrow. we bring in attorney emily campano, a fox news contributor. so good to see you, emily. >> thank you, melissa. melissa: this is an interesting argument. there was a lot of loss. kids who might have gotten in their place. you can pretty well quantify what that degree would mean in terms of the network, you know,

earned income, down the road. there is harm to the reputation of the university. to say, for the sentencing guidelines, i'm sorry for the probation board to say there was no harm, what do you think? >> frankly one of the reasons why i found this probation officer report so surprising. i have never seen something like it before in all my years of practice. not only did they take issue with the prosecutorial recommendation, for reasons you said, this was just an economic crime. they said essentially the alternative measure to a gain shouldn't be a loss. no one gained from this at all. no one lost anything. they also literally tried to divert blame and said we should look at degree of responsibility levied also on the college admissions staff, test processing rather on fell lyssie huffman herself. both those things i find surprising this is not an economic offense. this is fraud. conspiracy to commit fraud.

that is number one. number two, because someone else is equally culpable or also culpable does not avert responsible off the shoulders of this parent. the federal prosecutors in their brief said totally the opposite. she joked about it over emails in 2017, ruh-oh she looked into the same service for her other daughter. this was not out of desperation. this was out of literally moral culpability and sense of entitlement. by the way sentencing her to home with her infinity pool and beautiful view is not any kind of penance. melissa: it is interesting to me, our audience will know, they follow financial things, generally in these cases the biggest problem is the tax evasion. what struck me when this first came out, they had got enthe money for the cheating into the system by donating it to a charity, then taking that as a deduction. i mean that is tax fraud. you talk about financial crimes, usually that is really serious.

why aren'e hearing more about that? >> moral turpitudes well. i totally agree with you. it speaks to the oversimplification we've seen in the case from the beginning, because of all the additional details that has been overlooked. it wasn't about felicity huffman claims, me, just trying to do the best i could for my daughter, it goes far more insidious from that, yes, she was writing it off. the money was absorbed into the system, right? so there absolutely should be some type of culpability there as well. melissa: with all your experience what do you guess? tomorrow is the actual sentencing. we'll hear what happens. what do you think is going to happen as a result? will she do no jail time? what does it mean for everybody else involved? >> first question first. i think it depends. whether the judge accepts either prosecutor's recommendations four to nine months or this probation officer report which is no jail time essentially or up to four, i have seen judges go both ways. i will point to the fact the

stanford coach got one day time already served when he was facing three years. looks like the actual sentencing will be light. at most i see about 30 days. in terms of how it bodes for the other ones, it will likely be lighter for those who have pled but i point to the fact that, for example, lori laughlin continues to plead not guilty. she is not looking to plea at all. if there is any jury trial, those parents, those participant who will face heavy jail time. melissa: hmmm. emily, thank you. thanks for your insight. good stuff. >> thank you. connell: we are getting some breaking news, we're waiting update on national hurricane center on it, there is potential tropical cyclone would threaten maybe, the bahamas where already 2500 people are missing, after hurricane dorian. at least 50 confirmed dead. authorities warning that number as we have been saying all week could go a lot higher. the hurricane center is expected to issue advisory on this, 5:00 p.m. eastern time. we'll keep you update.

melissa: not waste as minute, house is back in session. house judiciary committee moving ahead with impeachment investigation on president trump improving the guidelines. nancy pelosi shying away from the i word. fox business's edward lawrence on capitol hill with the latest on this. reporter: melissa, house speaker nancy pelosi held her first news conference coming back from recess, on that day democrats on the house judiciary committee voted to move forward on impeachment process. the house speaker got tired of answers questions about impeach. let's listen. >> i said what i'm going to say on the subject. that's it. we are legislating focus on work we're here to do for the american people. reporter: still hanging out there avoiding a government shutdown, funding the government, both the how and senate have to pass series of bills october 1st, to avoid the shutdown. also the administration would like the house speaker to bring

up for ratification vote usmca. that is the agreement she says she has some issues with although mexico ratified it and canadian prime minister called the house speaker to support it. >> this cannot be the old nafta and little sugar on top to say we renegotiated it. that is not fair to for american workers to pretend we did something different, that there good things to say about the agreement if they are not enforceable. one word, enforceability. i think that it could be, i think it can be achieved. reporter: democrats looking over a response by the u.s. trade representative to an offer they made about this, talking about enforcement action of it, changing enforcement action within that deal. also congress wants to talk about the gun debate. democrats want action on gun control. some republican senators are working with democrats to come up with some sort of consensus about background checks.

>> no one needs to take any authorship on this just basically commercial background checks is a building block. if we can't do that, it is hard to do anything, to take anything seriously. reporter: a lot going on capitol hill. democrats, started with impeachment today. back to you. melissa: usmca, they are holding the economy hostage by not moving on that. it is ridiculous. edward, thank you. connell: brad blakeman joins us. brad former bush 43 senior staffer of the as edward said it, sums it up nicely. a lot going on, democrats starting with impeachment today. likes of jerry nadler pushing forward. nay pelosi, last thing she wants to be asked about. what is your take on the dynamics down there? >> it's a complete overreach. the american people don't buy it. they have been like the boy who cried wolf. they said, let's wait until the special counsel's report comes out on trump, then we're going to start impeachment because

then we've got him. guess what? he was cleared by that report. and by the way, if it was such a danger to the republic as democrats allege, why did they take the summer off? wouldn't you work, burn the midnight oil to get rid of somebody who is such a danger to the nation that you have to take this extraordinary constitutional step to get rid of him? this is politics at its purest sense, something the american people cannot stand. i think they gave a great gift to donald trump. connell: that is what i was going to ask about. on one side, talk about your impeachment is in the news that is not good for you no matter who you are, but to your point in this environment, if you come back as a republican, you're republican observer, strategist, you say, you know what? you can make a million arguments why aren't you moving ahead on trade or usmca? you feel like this is a political gift? >> i do. as a matter of fact usmca is supported by many democratic constituents like unions who need these jobs and mexican

trucking to make sure we don't have some standard regulation from mexican trucks versus american truckers, taking away our jobs. so the fact is, democrats are not servicing their constituents. donald trump can make a deal, congress can't close it. it is interesting, we'll see how it all plays out i would think over the next few weeks whether they shift on that strategy. while you're here i want to ask you about google for a moment. federal regulators ordering google to assure its employees indeed they can speak on political and work place issues regardless of their stances. "wall street journal" had the report. part of a settlement of complaint accusing google of punishing those who were doing just that. this was a big issue especially in conservative circles. others say it is farther at that than that but what do you say of this story? >> google certainly had a chill on free speech amongst their employees. that is clear. the settlement, that google in fact has to issue standards that

melissa: calling all workers. amazon, target, wendy's announcing they're looking to fill 180,000 positions. underscore agroing labor shortage. right now there are way more jobs than available workers. here is scott martin from kingsview asset management. fox business contributor. so talk to me a little bit about this, scott. obviously there are still people on the sidelines who are looking for jobs. but you get to a point, there is a rate of unemployment where you're, not really going to find more people that match with the jobs. these are a lot of entry level jobs. what are your thoughts? do we have that many more people on the sidelines to do this? >> melissa, we may.

now your point is really prescient. some are certainly entry level, part time. some are lower skilled ones that people, in their own right maybe holding out for a better job, but i really think the takeaway is following. job market is no doubt on fire, remains due to good policies out of d.c., frankly a good point in the cycle, but also should implore people out there, that are struggling, out on the streets asking for money, walking around aimlessly. there are jobs for you. they may be entry level to start. if you look at some companies, mentioned two of them, seasonal ups as well, that is doing a bunch of hiring for the holiday season. those are jobs to get into, elevate yourself in the company along the way if you work hard. melissa: absolutely. we've seen it putting pressure on wages. wages are rising as a result. that is the normal way the market works. you have people out there, you can't attract workers you have to offer them more money in order to come in and work. it is all good news. it's a fascinating point in the
