trish: criminal charges against andrew mccabe. a up much attorney recommending that the doj move forward with an dime of andrew mccabe for misleading investigators. you may recall the i.g. report says mccabe improperly authorized a leak to the "wall street journal" about the clinton foundation. when fbi agents confront mr. mccabe about the leak the i.g. report says mr. mccabe lacked candor. is that enough to land him in jail in joining me now, a trial attorney who says yes, lacking candor can get you into a lot of trouble. >> lacking candor is lying and

misleading. politically correct way of saying lying. think about how many people we saw indicted for misleading or lying to investigators. the inspector general report set forth four instances where mccabe lacked candor. and that could be the basis for criminal liability. the next step, it goes to a grand jury and the grand jury determines wither ther with it r there is probable cause. we have been off the hook if he had told the truth or would he be in additional trouble because he was sharing information he shouldn't have given his position? >> give be his position, he would have still been in trouble and lost his position with the fbi. he's leaking information on an

ongoing investigation. the impropriety in that is astronomical. in many of these cases, it's not the crime, it's the cover-up that gets you into trouble. if he had been truthful with the fbi, would he have lost his job, yes? would he have faced charges from the ethics ask committee, yes. trish: the got tomorrow of the television screen says it's imminent. is he going to be indicted or do they have to report all the evidence and make an indictment. >> the decision to go to the grand jury i think is foreshadowed. they are going to a grand jury.

it's the grand jury who ultimately determines whether there is enough evidence to move forward and indict. the standard is lower. but it may happen. let me cut to a cnn commentator who seems to think there wasn't anything wrong with what mr. mccabe did. >> andy mccabe is a cnn contributor and colleague and friend top of us who work here. this is an extremely unusual prosecution. andy mccabe had the right to speak to reporters. as deputy director of the fbi he had the right to speak to reporters. he also has an impeccable record as one of the most of honored and successful fbi acts of his generation. trish: they have a right to speak to reporters about an

investigation? you have the right to speak to reporters. have drinks, whatever. but do you you have the right to share information on an ongoing investigation? >> no, absolutely not. that violates every rule. there are reasons to protect the information that's being acquired by the fbi. in furtherance of that investigation to provide that to reporters. there is a robe why leaking sensitive information can get you fired from that job, no question about it. and i think what the commentator might be saying from a criminal perspective there wasn't anything wrong with leaking the information which i think is arguable. but he doesn't take the extra step to say now he was asked about it, federal investigators, under oath, he's not truthful. that's the basis of the criminal prosecution.
