gregg: good evening, i'm gregg jarrett sitting in for the vacationing lou dobbs. an agreement with el salvador allowing the u.s. to send illegal immigrants. the latest attempt to stymie the president beginning to crumble as we learn new information

about a phone call that inspired a whistleblower complaint from the intelligence community. chief white house correspondent john roberts leads us off with the latest. >> we don't know specifics about the complaint to the intelligence community's inspector general, only that it involves a possible quid pro quo between the president and the ukrainian president. according to the wall street journal which shares ownership with the fox news channel, president trump in a july phone call urged ukraine's president five times to look into joe biden's' son hunter. president trump did not deny it. >> did you discuss joe biden? >> it doesn't matter what i discussed. he talked about millions of

dollars he's not giving to a certain country unless a certain prosecutor is taken off the case. reporter: president trump dismissed a wis whistleblower's complaint about an alleged promise president trump made to a foreign leader during a phone call. moments later the president acknowledged he didn't know who the whistleblower was. but he insisted all of his calls with world leaders had been totally appropriate. and according to the "wall street journal" there will be was no quid pro quo offered. on tv last night giuliani denied and appeared to acknowledge the request. >> did you ask the ukraine to investigate joe sphwhiend. >> no, i asked the ukraine to

investigate the allegation there was interferenced in the election of 2016 by the ukrainians for the benefit of hillary clinton. >> you never asked about joe biden? >> to get to the bottom of how it was -- >> so you did ask ukraine to look into joe biden off course i did. reporter: it would appear to confirm some of the reporting about the inspector general's come plawnlt. but the apparent lack of a quid pro quo would appear to run counter to the narrative that there was some sort of promise made during the phone call. joining me is harmeet dhillon. the vice president of the rnc

corporation. i wrote a column entitled "the trump whistleblower may not and whistleblower at all." if you look at the statute on whistleblowers, they are allowed to file a complaint against other people in the intelligence community who may have engaged in abuse. president trump is not a member of the intelligence community. >> there is so much other stuff there. to meet the standards for the statute. there are a number of definitions that have to be a matter of some urgency. ways more likely is this is a partisan effort to undermine the president from the swamp. somebody who is probably leaking and using this as a cover to do so. we have seen dozens of examples of this. i am looking at this accusation with a bleary and jaundiced eye.

i think joe biden and others have a lot to gain by change the subject to kavanaugh and this allegation. gregg: negotiating with foreign leaders to make promises. it does not grant power to an unelected inferior employee of the federal government to second guess what the president is doing or approve or disprove of what he's doing. would you agree? >> absolutely. for one thing. huntser biden's deals should be investigated. it's a disgrace that they weren't. these people want it all different ways. they want the president to tell saudi arabia what to do, so it's very much situational ethics. but it's the president's job to community communicate with foreign leaders and share his views with them. there is no quid pro quo.

there are so many issues uncovered here. gregg: setting aside that quid pro quo is as standard policy of negotiations. the "wall street journal" is report there is no quid pro quo. what journalists seem to be ignoring is there is a quid pro quo with bind and ukrainian leaders. he's seen on stipulate bragging about how he threatened them if they didn't fire a prosecutor he would with hold a billion dollars from ukraine. why is it the media ignores that. >> that's a rhetorical question. they hate the president and they are willing to give a pass to anybody who criticizes him. who knows what the whistleblower is doing behind the scenes. soap here is what joe biden had

to say. take a listen. >> not one single credible outlet has given any credibility to his assertion. i have no comment except the president is not time pressive. gregg: what bind said is completely untrue. there was a main story by the "new york times" which detailed quite a bit of this tory involving joe biden, his son, and isn't he just -- isn't bind taking a page out of the hillary clinton playbook and deny it all and say it's been debunked and nobody believes it? >> of course. people are used to saying whatever they want to the media. that's what's going on here. increasingly the mainstream media doesn't seem interested? the truth. you are correct in our column. the president is the head of this edfills of national

security. he isn't part of it. so the whistleblower idea that anybody who works in the swamp can make a complaint against the president is silly. gregg: you had a legal victory in your battle against the state of california. california as most of people know, passed a law that was clearly aimed at donald trump. it says you can't be prient mary ballot as president unless you expose your tax returns. you convinced a judge to place an injunction on that law. >> not just myself. the president's lawyers were there. i argued for the rnc, the republican party. after 2 1/2 hours of argument we were able to convince the judge there were potentially numerous

grounds to strike this down. he issued an injunction from the bench. it's bad news for the governor who signed this, for the legislature that passed it. for the attorney general that defended it, and the secretary of state who wanted to enforce it it's a tko by the president and his supporters. the government should not put hurdling between the citizens and candidates. they are not allowed to do that. only the constitution sets the qualifications for federal office. gregg: the constitution also prohibited a beautiful attainder. states can't target individuals with pieces of legislation when a state is infringe on the federal rules in the

referral against the guy cnn hired, and he's on almost every day. today he's on talking about corruption. this guy is the symbol of corruption. isn't he? >> exactly. and there is this big problem at the fbi, and frankly the justice department. we had documents that included mccabe's misconduct showing there western 14 fbi agents and senior officials who improperly leaked classified or grand jury material. not one of them were prosecuted. and many of them got away with even a lighter punishment than the -- >> cnn hired him probably because a month before the mueller report came out. mccabe went on cnn and said i think the president of theouts may be a russian agent.
