an nba fan says he and his friends were censored for holding a free hong kong banner. good evening. i'm david asman in for trish tonight. house intel committee chair adam schiff saying nothing to see her. schiff claims there is zero reason for the american people who kicked off this whole thing. take a listen. >> our primary interest is making sure that person is protected. there is more than one whistleblower, that they are protected. given that we have the call record. we don't need the whistleblower. we'll make sure we protect that

whistleblower. david: the whistleblower's identity is another in the long lift of secrets in the democrats' impeachment push. the republicans have had enough and they are calling them out. >> they leak out selectively the thing they want for their narrative. our position is the american. you should know about all of the facts. >> the tragedy and the crime here is that the american people don't get to see what's going on. louon.dave will be congressman louie gohmert joins me. i understand one of your colleagues matt gaetz was kicked out of a committee hearing by adam schiff today. tell us what happened? >> he was doing as i would expect any of us would be allowed to do, and that is sit in on the hearing. he wasn't demanding to ask questions, and they threw hip

out and they said we expect this to be secret. and you mentioned earlier, actually you go back to 1813 when the judiciary committee was formed, every impeachment has gone through the judiciary committee. there was one -- andrew johnson went through judiciary, then went through reconstruction committee. and i know you are aware there is no more reconstruction committee. but it's important to understand that yes there is witness protection, and the reason we did that is whistleblowers were not going to remain anonymous, and the laws are to keep anybody from retaliating against them. if they are going to keep their identity a complete secret, there is no reason for whistleblower protection. but even trumping that, if you

pardon the expression, is the 6th amendment to the constitution. you can't go after somebody if you are in a federal position allowing the person to know about the allegations against them and the opportunity to confront the witnesses against them and to be able to question the person that's made the allegation. so this is the whistleblower's rights do not trump the constitution. david: more than that, the bottom line here is an impeachment inquiry even though this is not an official one because it hasn't been voted on. an impeachment inquiry is a very public event. this is an effort to overturn an election. to kick a guy who was elected out of office. it has to be not shrouded in secrecy, but open to the public.

>> it's supposed to be. this is what we see going on in spade. it's ridiculous. this is supposed to be public. but it tells you that this is indeed a coup, and star chambered effort to try to take out a sitting president. and they under estimated president trump at every turn. they thought if they went after his friend, which associates and family, then he would probably resign within 6 months and say i don't need this. but they don't know him very well. he's not a quitter. >> i'm wondering if democrats and it's almost a rhetorical question. if they are overplaying their hand. "axios" had an interesting focus group. "axios" is no friend of president trump's. the focus group was from ohio. what they did was ask the people

whether there seem to be ground for impeachment hearings. instead they found there was outrage over the idea of impeachment. they want congress to get busy doing what they are supposed to be doing. do you think this will backfire on democrats? >> i hope it does. but the bottom line is they are being destructive of the constitution and the political process and opening up future elections to this kind of abuse. i would add, i think eventually we are going to see charges against co-conspirators, and so the question arises, how many democrats in congress want to be co-conspirators with those who are attempting this coup of a duly elected sitting president? i think that's where it ought to end up. >> let me ask you a final question. you are a former judge. did you ever see a case just

of people had a false impression of me. i wish they knew i was funnier. gregg jarrett is joining me. he's the author of "witch hunt." good to see you. david: i have my own copy and i have been reading it. let's talk about something which may be coming out at the end of this week according to maria bartiromo. saying the i.g. report could be coming out soon, if not this week, soon. will comey feature in that report? >> prominently. principally he signed off on the first three nice a warrants to spy -- the first three fisa warrants to spy on the trump campaign. he claimed it was verified information when he knew it

wasn't. he withheld exculpatory evidence. he night was paid for by the hillary clinton campaign and he didn't tell the court that. in my book i talk about six different misrepresentations he made to the fisa court. that's defrauding the court so it will be a harsh judgment on the self-righteous james comey who never passed a mirror without falling head over heels in love. david: could we see in this i.g. report a criminal referral? >> you already had one criminal referral in the second i.g. report for stealing government documents and leaking them to the media, including one classified document. of course, the department of justice took a pass on presenting it to a grand jury and indicting him. maybe that suggests they feel they have better evidence coming

out in this forthcoming report against comey. david: the top three guys at the fbi. comey, mccabe, and peter strzok. it could be argued there are others involve, too. but these guys controlled a lot of the operations of the fbi for the time they were in power. their minons are still there. presumably there are people working under these guys. with they still active in trying to do the same? >> none much them are at the fbi, comey and mccabe, strzok. but it makes you wonder, are there others still there that we don't know about? but you know, i call in my book, comey the seemer-in-chief. he was the head of the malignant force operating in the shadows of secrecy first to stop trump from getting elected. when that plan failed they

take action against the kurds to create a buffer zone between turkey and syria. >> it's hard to know because erdogan has been threatening to go in there and fight the kurds that he believes are an afilliate of a turkish terrorist organization, the pkk. but he's been threatening this for years. he hasn't gone in because we had a united states force working with the kurds trying to address not only our security concerns against isis but to reassure the turks we'll not allow this kurdish force in syria to threaten turkey. we have been successful with that up to this point. david: do you think they will be deterred at all from the sanctions mentioned today? i don't think they have been officially put into place, but clearly they will be soon. >> my guess is no, this is a day

late and a dollar short. the threats against the turkish economy should have been made by the president before erdogan went in. to do it afterwards whennered garn and the turkish military have clearly been unleashed in a very big operation to destroy these kurdish fighters on their border. i think it will be difficult to have these sanctions make much of an impact at this point. david: there is another thing that's not mentioned very often aboutered garn, the lead -- about erdogan. his son helped isis sell some of the oil they were in control of at the time in iraq, and they may have given sanctuary to al-baghdadi, the founder of

isis. >> we know for sure isis was earning tens of millions worth of revenue selling oil. one of the places that oil was going was into turkey. at the beginning of the isis rampage into iraq, turkish officials were look the other way while 40,000 foreign fighters and jihaddists poured into northern syria and iraq. the tip of the spear for you are quiche forces is in fact arab militia filled with jihadists, former fighters from isis and al qaeda. david: finally we get far too little time to explain this in detail. but the president says these issues in the middle east have been going on for decades if not centuries, the fight between the turks and the kurds.

we could be in there forever if we don't get out. to which you would say what? >> i have got sympathy for the president. he made a promise. but there is a right way to get out and a wrong way to get out. to get out without planning or preparation or diplomacy to do it in such scene off-handed off-the-cuff manner in a single conversation with a turkish despot and dictator is the wrong way to do it against the advice of all of his best military and diplomatic leaders. david: is there any way to turn this around? >> i think not. it will be very difficult. we can try to mitigate and limit the damage. but there is no avoiding this will be an absolute mess and handled a huge victory to all of our most of dangerous adversaries, the russians, the iranians, isis and the assad

dealing with that may have somehow intersected with his father's work when he was vp. >> perception is important to a degree. i think he thought he was doing a good thing by stepping down now to help this his father, but i think it opened a can of worms and made it worse because of the laundry list you just mentioned. if it's wrong now, why wants it worse when he actually took the job in the first place when his father was vice president. david: hunter will be talking about this tomorrow, right at the time. abc has a morning program and night program. the night program with keen side with the debate. the timing continues be worse. right? >> i don't know if it's a strategic move here. i am glad we are getting fighting joe. that's the joe biden i knew

since the 2012 election when he was out there fighting in that vice presidential debate. we haven't seen that until just now and it may be too late. david: i love your loyalty. you were an army ranger and you have to rely on loyalty in a fight. david: if you lie when you are caught red-handed it makes it look even worse. >> this is strategically done on purpose. the fact that they will have this interview done during the democratic debate is probably due to the fact that they have poor viewing numbers. so they are going to have more people want to turn on the television set and flip back between the two stations and hope they get more people to pay attention. david: i'm told by producer it's actually an hour before the debate. it may make it worse. they will have ammunition. >> it could be like the preshow

to the super bowl. david: i want to switch to economics. a lot of what the president is riding on in his reelection is the economy. you have to admit the jobs numbers are incredible. we have a great jobs market. a lot of that is because the tax cuts. a lot of democrats say the tax cuts increase deficits. tax revenues increased enormously. corporate tax revenues came in 12. mercedes: better than the year before. so the tax cuts did pay for themselves. how are democrats going to respond to this? >> the best way they can possibly respond is to talk about the rural areas. they are seeing wage and income stagnation and not the job numbers they need in those rural areas. and they will probably be talking about farmers.

david: republicans, i don't hear it often enough. sometimes they sit back and allow these charges. they think they will bounce off of them. they should be out there cheering that the tax cuts actually worked at lowering tax rates, increased economic activity and that led to even greater revenues. yes we have a terrible deficit, but it's caused zero percent by the tax cuts. it's caused by increased spending. >> i think this is a losing issue for them. you have might as well give credit where credit is due and choose other areas to basically try to differentiate with the current administration. david: robin and amy, you are a great pair on the republican and democratic side. the nba trying to silence the voice of one of its fans after

night before. that's why we decided to go. because we saw two protesters in philadelphia who were removed from the arena. my buddies and i were like we need to go do something about this and see what the nba is going to do. the gentleman you saw on the video just doing his job. kind of too bad because it got 2 million views on twitter. it's pretty sad. david: i know one of your colleagues lived in hong kong for a while. did you have a personal connection with hong kong? >> i have a personal connection to the nba. i am one of the biggest nba fans out there. i watched as they have become one of the most of woke sports league and constantly weighing in on political controversy after political controversy. using their power to try to impact carolina state law, removing the all-star game from

there. i have been following that. it's a glaring hypocrisy when it comes to china. we have protesters in hong kong demonstrating for democracy and freedom and liberty. the nba claims it advocates for these human rights. but when it comes down to it money talks. they are more interested in profits in china. david: did they deter you? are you going to try this again? >> i think we made our point. i hope other people try this again. this is something, we should stand with those pr protesters n hong kong and stand with prohibition against speech on their can soil. it's incredible they are censoring political speech at those games here on american soil. david: i'm just wondering if they would be more tolerant if they had some message supporting

colin kaepernick. because of their political correctness, i would imagine they would be more tolerant of other messages displayed as you tried to display yours. >> it's fair to wonder that. we have seen nba players constantly protesting black lives matter. all sort of slogans on their uniforms. when it comes to this. we are the nba, we don't do politics. we just want to shut up and dribble. it's ridiculous to think about. >> we laugh about some of this, but the chinese president through an ominous warning at protests. he didn't pinpoint hong kong. he said any attempt to divide china will end up? crushed bodies and shattered bones. these people are totalitarians. we must not forget that. that's the kind of people it

seems like the nba if not supporting is at least protecting. >> and other corporations. it's not just limited to the nba. we have to consider our relationship with china from a business and policy perspective. but they are not our friends. our adversaries. so i think we need to reconsider some of these relationships. reconsider whether trade in every instance is worth it when we are seeing them exporting their values over here to the united states and our corporations imposing chinese values on american citizens. it's really unbelievable. david: the nba, it the not known how much they get from china. but it's estimated they get $4 billion a year from all of their business with china. do you think there is any way they would be willing to sacrifice that for principle? that's a tough sell for a

corporation. >> i think the nba commissioner adam silver is doing his best here. he's answering to owners who want to make a profit, too. china is a huge market. 1.4 billion people. and they love basketball. it's a growing market over there. i think the nba is looking at this as their potential revenue streams and they are wanting to make a buck. cave * what we are look at right now we can't ignore. these are american flags standing for liberty of course as it always has, held up by protesters in hong kong. that's what really gets to you have about all this. they use the american flag and american identity as the base of their confrontation with the communist ideology. we should be proud of that, not trying to suppress it in any
