rock 'n' roll day. jackie is on the floor of the new york stock exchange and grady is covering the blockbuster opioid settlement in many surprised morning. we start with like. reporter: good afternoon. if it was the morning it would be a long day and a long week at the white house. we've had a busy one so far. there was an hour plus long cabinet meeting in the white house calls for deregulation as we saw from him in this cabinet meeting but also news drop by the u.s. trade representative robert lighthizer reviewed deputy level discussions today between the u.s. and china trade team and there would be more senior-level talks between himself, steve mnuchin and their counterparts in china at the end of the week on friday. the president talking about the china trade deal during the cabinet meeting in which he expressed optimism for phase one of the deal while suggesting it could be the more difficult component.

>> while were papering the deal, that is going well and we hope to sign it in chile when we have a summit in chile. or wherever that may be. but we will be able to sign a completed document with china and then start working on phase two. things in phase two are easier than phase one. reporter: there are still questions about whether phase one will be agreed upon before the apex, and chile next month. lighthizer said there are still outstanding issues while the secretary told maria that the mid-november target date might not be as big of a deal. >> there are still some issues we have to resolve. were working towards that goal. >> from mike point of deal, it doesn't have to be the correct deal in towards november and more big of a deal for the proper deal. >> this is the first time we

it. as i said this is opening up an entirely new doors for a chairman of the board who is no longer chairman he is now the ceo and what happened on his watch. >> a lot of blockbuster news happening today. stay with us for the next story. >> let's tell you about the story, a fox business alert they have a deal that for drug companies agreed $268 million settlement with two ohio counties. this avoids a trial in cleveland on the role on the opioid crisis. grady live with the latest. reporter: the pharmaceutical is one of the companies that reached a deal here today. but the company reached an even bigger settlement with several states worth $23 billion. here in ohio a landmark federal trial was set to begin but the drugmaker settled at the last minute with the big three drug

distributors, cardinal health, amerisourcebergen, all of those chose fueling the opioid epidemic. they have agreed to a $260 million settlement and were told a large portion will be paid out to two ohio counties almost immediately to help with addiction treatment and education. >> we have problems now, people are suffering and dying now. we have to deal with these issues now. so the fact we were able to get the money in a short timeframe is very helpful. that is one of the motivations for settling this. >> walgreens was also a defendant in the ohio case. it was not part of today's settlement and could still go to trial with other major pharmacy chains like cvs and walmart. they said walgreens never factored prescription opioid medications, marketed or promoted opioid medication, we never prescribed opioid

medication. a federal judge overseeing around 2600 remaining cases is pushing for a large group settlement as opposed to all of them going to trial or settling separately although those discussions have been unsuccessful. >> back to you and the judge. >> let's bring the judge and to react. a massive settlement took a lot of folks by surprise. the negotiations to happen between 11:00 p.m. and 1:00 a.m. today. are they making the right decision and settling? >> i cannot make that judgment because it's a financial determination paid the 200 million they agreed to pay 22 ohio counties is a lot more than the damages the ohio counties were able to demonstrate. a lot less than the billions they demanded but also a lot less than what the lawyers for the defendant thought a jury might award these plaintiffs. as grady pointed out, there are three sets of litigations, one brought by the human beings that were actually injured, one

brought in the state that spent money to help those human beings. this is the third set brought by two ohio counties. why two, there with 2300 cases as he pointed out involving cities and counties claiming that they spent money on ems, publicly owned hospitals, police, welfare because of opioid crisis is and they want reimbursement. this is the first of the 2300 and we'll see if they can settle the rest. >> as insensitive as this will sound, wouldn't the companies say this is personal choice, even though they make these drugs and distribute these drugs, some people need these drugs for pain those that took it too far to pay a personal choice. >> the choices made by the physician. you cannot go to the drugstore and get these things. you need a prescription. that's a walgreens defense. we just had prescriptions issued by lawfully licensed physicians
