lou: good evening, the radical dimms and speaker pelosi are trying something new to overthrow president trump. the speaker shifted strategies after 35 days of secrecy, subversion and the outrageous refusal to acknowledge the essential testimony and evidence that clearly exculpates president trump of their specious charges. the radical dimms propose this resolution to invalidate the efforts of several house committees to continue their impeachment inquiry that would
4:01 am
permit but not require public hearings or an equal voice for the president they mean to overthrow, or fair participation of the republican congress. it is straightforwardly a democratic blueprint for the removal of the president of the united states. the democratic resolution would continue house intel chair adam schiff's control over who is called to testify. schiff would have the to continue to deny all republicans an equitable role of assuring president trump due process of any kind. john roberts with the latest. reporter: the resolution in the house appears to give president trump at least some of what he wanted, including a vote in the full house. but the white house says the resolution confirms the impeachment has been an illegitimate sham from the start as it lacked authorization by a

full house vote. he tweeted nervous nancy pelosi is doing everything possible to destroy the republican party. our polls show it will be just the opposite. the do-nothing dems will lose many seats in 2020. they have a death wish led by a corrupt politician, adapt schiff. house investigators heard from the first witness who was actually listening in on president trump's july 25 phone call with the ukrainian president zelensky. while he has been an employee of the national security council since 2018. president trump dismissed him in one tweet calling him a never trumper witness. he said why are people i never heard of testifying about the call. just read the call transcript
4:03 am
and the impeachment hoax is over. he says the democrats can haul as many witnesses as they want up to capitol hill. but it does not change the fact that the transcript is out there for all the world to see and come to their own conclusions. no doubt this will be a topic of the fundraiser tonight for president trump. lou: house republicans lashing out at the inquiry calling it more lack of due process for the president. catherine: ahead of a planned thursday floor vote, quote the house authorizes the commit reon the judiciary to conduct proceedings related to the

impeachment inquiry including to allow for the participation of the president and his counsel. republicans said the move proved their point, the democrat inquiry is unfair. >> the resolution that was filed today affirms the soviet-style process that's been going on and continues to deny due process. catherine: according to his prepared remark. lieutenant colonel alexander vindman told staffers behind closed doors, i am not the whistleblower but i did convey concerns internally out of sense of duty and operate within the chain of command. unlike previous witnesses, vindman says he has direct knowledge of the phone call between president trump and the
4:05 am
ukraine president. he said i didn't think it was proper for a foreign government to investigate a u.s. citizen. house lawmakers debated the significance of vindman's testimony along familiar party lines. >> the transcripts that will be released. you will see how much you have been misled on so many didn't depositions on so many different days. catherine: the house republicans accused adam schiff of shutting down multiple lines of testimony including who he talked to immediately after the phone call. lou: senate majority leader mitch mcconnell seemed to take credit for the radical dimms inquiry resolution.
4:06 am
he claimed they laid out their public ground work to overthrow the president because of pressure republicans. >> they responded to the pressure we put on them to handle this in a more trance parent way that meets basic standard of due process that every american would be entitled to. lou: our first guest says schiff's impeachment inquiry is devoid of rules and antithetical to the constitution. joining us is congressman matt gaetz, a member of the house judiciary and armed services committees. your reaction to the senate majority heder taking credit for this resolution that is best i can read offers absolutely nothing in the way of equity or participation to the republicans. >> two weeks ago you had nancy pelosi calling a vote on an
4:07 am
impeachment inquiry nothing more than a republican talking point. then last week you saw me lead a group of my colleagues down to the meeting room. and this week you see an actual vote occurring to legitimize that sham process. i believe nancy pelosi is feeling the heat, but the way she is responding to that is antithetical to our constitutional principles. the one mistake they made. adam schiff made himself a fact witness. and we intend to call him in the judiciary committee. he said he's like the ken starr. he's the independent counsel. if that's true and he's able to do a secretive investigation, we have a right and obligation to call adam schiff as a witness. doug collins said that's what we
4:08 am
are going to do in the house judiciary committee. lou: i think folks around the country congratulate you for storming the scif. i think for the first time republicans did something in terms of their views, values, and this president. now as to the senate majority leader. this is a document that would seek only your validation by participation in a vote. are republicans going to do that? you would gain nothing in the way of equity or participation without the permission of adam schiff, which is where you are right now. >> this vote is not a legitimate exercise in congressional oversight. we are all for oversight and transparency. but what you see now is the
4:09 am
conclusion before the development of facts. adam schiff and nancy pelosi said donald trump was a russian asset before the russia hoax. they said they had more than considerable evidence on the russia probe. i think that when you have democrats putting the cart before the horse, it's obviously transparent to the american people this is a sham process and not a single republican should vote for this resolution. if any republicans vote for this in the coming days, then they have abandoned this president and have done a terrible thing to the presidency and the congress because they allowed us to cloak his totally illegitimate investigation with legitimacy. lou: wouldn't it be a validation of the process that the
4:10 am
democrats invoked upon? why would you not refuse to vote on this and the conference just say effectively to hell with you until you get your head on straight and do as other impeachments have, that is a house floor vote to inaugurate the issue for impeachment. >> these democrats wanted to impeach the president before the ink was dry on his election certificate. but i will vote no. i want my co constituents and al americans to know i stand against this presidential harassment. this is harmful to our country. when we are trying to renegotiate trade deals and bring capital here to fund the dreams and ambitions of american workers. these democrats are so obsessed with president trump they are trying to delegitimize him because they can't win a debate

or election against him. lou: i say efforts to overthrow this president by the radical dimms. u.s. customs and border protection announced apprehensions this year have more than doubled those in 208. border patrol officers apprehending 151,000 illegal immigrants crossing the border. there were only 396,000 in 2018. a record number of families were and prelearnedded up 341% from last year. mark morgan says those apprehensions have dedpliend recent months because of the closing of loopholes including catch and release. >> the message is going out now for the first time if you grab a
