[♪] david: tonight, democrats impeachment push moves from behind closed doors into the light. i'm david asman in for trish regan. the house approving a resolution laying out the next steps in the democrat-led impeachment inquiry. fox business's hillary vaughn is live on capitol hill with the latest. reporter: the white house says phase two is not bad for the president, it's bad for americans who are paying lawmakers to get things done that make their lives better.

but democrats are moving forward and republicans say the ground rules the democrats set are tying republicans' hands and denying the president due procession. somewhat we are seeing down in the scif right now is like a cult. >> this is soviet-style rules. >> here is my challenge to mr. schiff. you want to be ken starr. be ken starr. come to the judiciary committee and be a witness and take every question asked much you. this ain't over, get ready. reporter: adam schiff could now be a witness. republicans have questions for him and witnesses who showed up for closed door depositions. but they say schiff blocked them. air yea why it's a different stage. it's not -- once it goes to the judiciary it's a different stage. >> i doubt anybody inning this place or anybody you -- more anybody in this place comes to congress to impeach the president of the united states. reporter: to give you an idea of how much power adam schiff has. he's one of the few people who knows the identity of the whistleblower. jerry nadler was asked the timeline and he said you should ask chairman schiff. david: the inquiry will be hand not by the judiciary which is

proper, but the intel committee. he got if you are pinocchios from the "washington post" for lying about his staff's contact with the whistleblower. he also lied about having evidence of collusion with russia and the trump campaign. and he made up out of whole cloth, while pretending to read the transcript of the ukrainian phone call. he said he's open mind on whether the president should be impeached. >> i make no prejudgment as to whether that remedy will be warranted when we finish these hearings. i will wait until all the facts are put forward. david: with us now, indiana congressman jim banks. do you believe northward mr. --

do you believe mr. schiff ahe says he has made no prejudgments? >> of course not. the lies of adam schiff, the very fact that the democrats put this process in his hands says it all, how much of a sham of this process is. this is a shame for our country to go through this process. it's even a bigger sham that adam schiff is put in charge of it. david: how did it slip out of the hand of jerry nadler. how did schiff get it when jerry nadler should have it? >> that's a great question. it has a lot to do with the democrats being embarrassed of jerry nadler. there has been and lot of chatter on capitol hill that nancy pelosi had a lot more faith in adam schiff to do her

bidding and move the process forward in the way we want it to go, and we know it's to march toward the drum beast impeachment. the chatter about impeachment, nadler, schiff, pelosi all said they would not put our country through the impeachment process until it was done with bipartisan support. the vote today shows there is only bipartisan support to not move forward. david: not a single republican voted with the speaker for this process. two democrats voted against the speaker. just the opposite of bipartisan support. it's so strange, is it not, that the speaker would have more faith in adam schiff, a man who has been prove on lie about several dee key incidents in this whole process than she would in jerry nadler.

>> i think there is another aspect of this, too. the house intelligence committee, much of what they do is done in secret. it appears the democrats want to continue to hold secret hearings. there is nothing transparent about this impeachment process. the vote to formize the process doesn't mean anything will be transparenting moving forward. i think that has to today with why nancy pelosi is putting it in the lap of adam schiff instead of the judiciary committee. david: people would have to ask mr. schiff about things he said that turned out to be true. >> you put a very dishonest person in charge of a process -- this is a make it up as you go process. there is no logic or rules. they are getting the cart in

front of the horse. at this point there is no high crime or misdemeanor that this president is being impeached for. the democrats are just moving forward whitneyway. david: they are putting the conviction ahead of any evidence. by the way, that conflicts with what speaker pelosi said at the outset, that there was no intention to carry out an impeachment. let me play that sound bite. >> this is a sad day. because nobody comes to congress to impeach a president of the united states. no one. david: well apparently speaker pelosi had heard rashida tlaib say the following back in january. when your son looks at you and said mama, look it won. i said bullies don't win.

we are going in there and [bleep]. david: that was right after the congressman became a congress plan. so it's clear this has been the agenda for a long time. >> my blood boils when i hear those sound clips. speaker pelosi and the democrats in the house have been gunk for impeachment for three years. i am proud to stand with him for what he has done for our economy, our military and our country. democrats know they can't beat him at the ballot box and he has the support of the american people. they have to beat him through the impeachment process. that's not the way our found thing fathers envisioned that this is the way the impeachment process should be used.

david: congress one and ilhan omar facing scrutiny over campaign cash she reportedly received from an ally of turkish president erdogan. omar voted against imposing sanctions on turkey and voted

against recognizing the armenian genocide. there may be an even great massachusetts delusion. we'll get to that in a second. if the president of the united states could be investigated over charges of quid pro quo with regard to this phone call, can't she be investigated, ilhan omar, be investigated for another quid pro quo? gregg: you would have to show a nexus between her vote, the only democrat who favored turkey and the money that came from the reported cousin of the turkish prime minister. but bob menendez went on trial for corruption. they couldn't prove a nexus and they had aing hung jury.

absent a smoking gun document that says here is money, give me your vote. david: there is a law out there saying you cannot accept funds for a particular vote. you cannot confer a benefit to a foreign government or anybody in exchange for something of value. i.e. money. that violates a variety of anticorruption statutes. gregg: if worse, she violates the house rule, the appearance of impropriety. but even there that's probably not enough. there is another law that holds members of the house of representatives to strict acting for foreign money. if there is any connection between this organization which is based sheer and turkey, then she is in trouble as well. >> the money appears to have come from the personal wallet of

the purported cousin of the turkish prime minister and not necessarily through the lobbying group as i understand it it's not a huge amount of money. it's not like the ukrainians are recently criminally charged. david: she is not on getting criticism from the right, but also from some on the left as well who realize turkey is a bad actor in many things. the impeachment. there was a former nfc member advising the president on ukraine who gave testimony. schiff was all excited about it. how it's going to be a blockbuster. it turned out morrison maybe he didn't like what the president did. but from what we could tell he didn't say the president was guilty of anything. gregg: it was exculpatory on

behalf of the president. morrison and including vindman are offering their interpretation of a conversation. it's opinion. what matters are facts. the only relevant facts are what's stated in the transcript of the telephone call and the two participants. you have no ki quid pro quo, no pressure, no demand. vindman testified i thought it was improper there was a demand. and was asked on cross-examination. where was the demand if and he stumbled and mumbled. he said it's implied, i guess. we are now clairvoyant on somebody's interpretation of a conversation, we'll impeach the president. this is another mass collusion only twice as ludicrous. david: the more we look into it

and the more evidence schiff -- calls it evidence -- the less there is. remember that it was schiff who was the one who came out and said he had specific evidence of collusion between russia and the trump campaign. even bob mueller who was no friend of donald trump at all said there is no evidence. gregg: i go through in my book all the lies spun by adam schiff and it's a lengthy part of a chapter. this is a guy who doesn't have any credibility. he launched a top secret inquisition in which americans are not entitled to peek behind the curtain and all the hocus pocus. we are supposed to accept this out of ignorance and have faith in adam schiff. there is a reason why he's nicknamed shifty schiff. david: you can't write books

american public. things might change with these public hearings? >> the problem itch with it is the fact that adam schiff still can dictate who comes on, who testifies, he completely interrupts any question he doesn't ask. there are 435 members of congress, 106 members are on the three committees that have been able to see the testimony. that leaves roughly 232 americans from hearing what they have should be able to hear. they are trying to drum something up that's not there. david: what about the reputation of adam schiff. i mentioned several times the lies he's been caught at. even "the washington post" has given him four pinnochios. won't that come back to bite him

in these hearings? >> it already has. he has no respect. look at what he did before the president released a transcript which he didn't think would happen. he quoted the call as going like the president asked to dig up dirt on the biden family. he said that 8 times. it never happened. when the president released the transcript it turned around on him'. why do you think they want the whistleblower out? since the transcript is out, the whistleblower has no knowledge. the falsehoods they are saying he said will come out loud and clear. adam schiff has no credibility. he will be challenged more. as doug collins says, let's put him on the witness stand if he's going to be judge and jury. david: i'm wondering how long ago congressman can get away

to young people in high school or college. i didn't know the true meaning of socialism until i left college and started studying it. bernie sanders is a snake oil sales person making promises with no way to pay for all of these programs. i totally get as a millennial and young person in america. young people feel stuck. they are drowning in student loan debt. they don't know how they will buy their first home. the list goes on. they are underemployed. they are looking for answers. something to help them get ahead to create their american dream. but socialism isn't the answer. in fact it's the exact opposite. they need less government, more freedom and to keep capitalism

the way that it is. david: i can't imagine it could have avoid their attention that we have the best jobs numbers that we have had in my lifetime. if you don't like your job and it's not paying enough you can trade up. we have a job market that allows that kind of freedom to happen because we have less government, not more of it. >> i don't think young people understand the more government gets out of the way, the more prosperous we are aloud to be. rather than seeing student loan date and housing costs as something that comes from the government and the government puts so many house and zoning laws in place, it's impossible to build places where people want to live. you know less government is the answer if you know what's going
