good to see you. >> good to see you. the next set of public hearings from the impeachment process will feature another diplomatic official. david holmes is expected to testify that he heard the president ask about the status of the investigations in ukraine after he had the phone conversation with ukrainian president. now the president denying that he ever asked about those investigations. now house speaker pelosi today clarifying that they are looking to see if the president is guilty of bribery. >> the bribe is to grant or withhold military assistance in return for a public statement of a fake investigation into the elections. that's bribery. >> -- looking in an article of impeachment -- >> we haven't made a decision to impeach. that's what the inquiry is about. >> republicans saying that the process is still not open. they are saying yes, they are having public hearings, but they have to run by the democrats any witnesses that republicans would like to have up, and they are

just remash what you heard the last six months. let's bring in congressman chris stewart from utah sits on house intelligence. you were at the hearings sir. give us your reaction. >> oh my gosh, i have been at this hearing it seems like for years we have been doing that because i guess we have been doing it for years. you got it right when you said there are no got ya moments. there are no bombshells. there are no surprises. people think this is going to be like watergate. they expect john dean to crawl out of some closet somewhere and jump out and really grab people's attention. it is not going to happen. we've heard from these witnesses. we know pretty much exactly what they are going to say. and for those people who think at the end of this process they are going to convince the majority of americans that it is time to remove this president from office, i think those people are going to be really really disappointed. elizabeth: to your point, chairman schiff not wanting to hear the other side of the story, no whistle-blower yet, no interest in learning why hunter biden got rich while his father was overseeing ukraine. some snarky critics labelling

that quid pro joe. but here's the real question, a legal pro jonathan turley says the democrats are on really thin ground lehere. where is impeachable offense? how do you distinguish what this president did with what presidents do with heads of state? >> i read that piece by mr. turley. i think he's right. you mentioned two things. i would like to comment on both of them. one of the way is the way it is proceeding. the fact we have done it is in secret is nonsense. the american people need to hear. they are doing it in open but the fact we can't call witnesses? show me a trial in the court in the country that would say to you we're going to allow the prosecution to call whoever they want and not allow the defense to call the witnesses they want. i think that's nonsense. the second thing that you bring up is this idea it is built on foundation that won't sustain itself. to have a successful impeachment, to convince the american people that you need to remove this president and you need to remove him right now,

can't wait till next fall, can't let them decide. schiff and pelosi are going to decide. you better have a rock solid case, and if you have to lie about your case, or exaggerate about your case, then that tells you that you don't have something that you need to be successful. elizabeth: headlines in the l.a. times, the economist, reuters say it didn't go well for the democrats. andrew weisman, worked on the mueller russia probe, he went on nbc saying they should -- watergate. watch this >> the democrats need to focus on that this is about election interference in our election and then more time you can analogize this to watergate which is also about election interfeerns the better because that was election interference that also didn't work. elizabeth: here's the thing, 31 house democrats in districts that trump won. we know the republicans lost five seats in the house impeachment hearing, you know,

during the clinton era. they went on to win alabama and south carolina, the gubernatorial races there. i mean, so that's really the issue. the country is really divided on this. >> yeah. elizabeth: basically the witnesses, they didn't talk to the president. they didn't -- the ukraine leader never mentioned anything improper in three meetings with william taylor? >> there's so much of this that's so weak. the fact we're talking about second and third hand information in almost every instance. including tomorrow we will have ambassador yovanovitch who left her post three months before any of this -- based on impeachment, three months before any of that transpired. once again, i have to say this, in fact i am going to make a prediction, if i could, i think next week when we have had maybe half a dozen of these hearings where people will be able to listen to it, i think the american support for impeachment actually goes down. i think it will be measurably down because most americans will

listen to this and go that's all there is? you can make an analogy to watergate, if you want, but it doesn't change the facts. nancy pelosi can claim bribery if she wants but it doesn't change the facts and eventually the american people will look at the facts and go i don't think there's anything there. elizabeth: here's the other thing too, the obama white house held up aid to ukraine. the trump white house gave ukraine lethal aid it really needed. i want to go to alexandria ocasio cortez indicating what this really is about. >> we're talking about the potential compromise of the 2020 elections, so this is not just about something that has occurred. this is about preventing a potentially disastrous outcome from occurring next year. elizabeth: it is about stopping the president from getting re-elected. from the hearings, schiff said he didn't know the whistle-blower. watch this. okay. we don't have that sound bite. your reaction about preventing trump from getting re-elected >> that's exactly right.

a representative said we have to impeach him or he's going to be re-elected. ocasio cortez said it right there. that's very clear. they know they can't prove to the american people he should be removed. they know the senate is not going to remove him. this is about one thing, it is about weakening him, diminishing him, tiring him so he has a harder time being re-elected in 2020. there's no question that's their strategy. >> a democrat of illinois made this curious argument. watch this >> hearsay can be much better evidence than direct as we have learned in painful instances and certainly valid in this instance. elizabeth: okay, so hearsay, that's what he said is better evidence, you know, that's a curious argument. when you're sitting there, can you challenge him on that? can you push back? >> we tried, and the clip cut off very quickly as mike turner who is an attorney did try to push back. look, i'm not an attorney, but i'm not stupid.

and i can tell you that just common sense says second and third hand information is less valuable and that's why in most cases it is irrelevant. you have to have first-hand information and say well, we don't want first-hand. we think second hand is better? that's a more stable case? oh my gosh, that's just nonsense. there's not a person in america who actually believes that. elizabeth: congressman stewart, great to see you. come back soon. >> thank you, we will. elizabeth: all right. let's get a check up on the markets. s&p 500 delivering its 102nd record close under this president. let's to gerri willis on the floor of the big board with more. >> stocks were flat on the session but s&p 500 rallying into the close, matching yet another record, its second of the week. at the end of the day dow ending down by a point, s&p up 2, the nasdaq down 3. wal-mart turning out to be the stock of the day, hitting all-time high after the company posted 21 straight quarters of growth in u.s. stores. that's a record, unmatched by any other retail chain.

and ukraine. ne they were trying to dig up dirt to trigger congressional probe and hearings to damage the trump campaign. it involves paul manafort. your take? >> listen, i hope they continue to press for these investigations because listen, there are serious allegations in regards to ukraine and the 2016 election and also concerns about former vice president joe biden and his son hunter, his, you know, position on the board of burisma holdings. so clearly, this stuff does need to be looked into. look at how democrats are going all in investigating all things president trump, when you have this issue, for example, biden on tape, on record, on video, saying that he -- the money was going to be withheld if the ukrainian prosecutor was not fired. so clearly there is a huge double-standard here, liz. elizabeth: okay, so backing up,

what's happening with senator grassley, he's also recently asked the doj to reopen the probe. he's asking for basically to get it launched. republican devin nunes says democrats have wiped out repeatedly from the transcript the name of a contractor for the dnc reportedly who republicans say worked with ukrainian officials to collect dirt on paul manafort and the trump campaign. he reportedly met with staffers for a democrat to talk about a congressional probe. let's talk about what you brought up. one of the witnesses, key witness george kent, he made the case at the hearing yesterday for a probe of hunter biden. he testified that u.s. officials have been urging ukraine to explain why a corruption investigation into burisma that hired hunter biden was shut down. let's get your reaction after the sound bite. >> we've continued to press ukrainian officials to answer for why alleged corrupt prosecutors had closed a case

and we have till now not gotten a satisfactory answer. to summarize, we thought money was stolen. we thought a prosecutor had taken a prescribe to shut -- taken a prescribe -- taken a bribe to shut the case. those were our concerns. elizabeth: they acknowledged the only reason they hired hunter biden was to polish their image at the state department. your reaction to what george kent said? >> thank goodness for mr. kent coming forward and making those comments. this is something that americans need to know and understand what is going on and clearly the investigation should happen into what happened in ukraine and with the bidens and the 2016 election. the president has every right to be concerned about corruption with any country, and especially what we see coming forward as we delve deeper and read more and more about ukraine and what has been going on for many many years, especially when former vice president joe biden had a

relationship with the country. elizabeth: let's listen to george kent acknowledging that he was worried about a potential conflict of interest. watch this? >>? a briefing call with the national security of staff in the office of vice president in february of 2015 i raised my concern that hunter biden's status as a board member would create the perception of a conflict of interest. elizabeth: basically the obama administration brushed it off, jeanine. >> sure. and with the current testimonies and hearings that we had yesterday, adam schiff made it clear that they were not going to focus on the former vice president or his son when in fact that should be part of the investigation for sure, but unfortunately, they are blocking republican efforts on all fronts to not bring that for people to really know what happened, what is going on, and who is going to be held accountable. i mean, that is another concern as well. no one's going to be held accountable if something indeed transpired and should not have happened. hunter biden, being on the board

empty space, liz, at these trump rallies nowadays that we're covering. this is the second week in a row by the way that the president of the united states has come here to louisiana for a keep america great rally. last thursday one week ago, he was over in monroe, louisiana, and tonight's backdrop, take a look at it here. the crowd is still trickling in because the president is about 90 minutes away or so from taking the stage here. we understand he's running a little bit late tonight. the century link center is where we are. it has a capacity of about 14,000 people, and boy oh boy we have been here early since early this morning, and people have been lining up outside. it is very much like a festival type atmosphere out there. people are buying popcorn and crackerjacks and hot dogs and getting their seats to hear the president speak here shortly.

now, there is a long list of speakers that are taking the stage ahead of time to sort of warm the crowd up, secretary of state for louisiana back there and the primary reason the president has stopped here is because there is a really big election coming up in the state of louisiana on saturday. voters will be heading to the polls here to pick a new governor. and it is a very tight race. in fact, saturday's election is a run-off election. the democrat incumbent john edwards is getting a run for his money by a republican businessman by the name of kenneth raspone and he is getting a lot of traction. the latest polls show the two are within the margin of error at this point. again, this big election is on saturday. president trump using his star power, trying to get voters energized as they head to the

natural. what the representative just said or what the white house representative just said is is crystal clear. we will put a 15% tariff on 156 billion dollars more goods that the chinese are trying to sell to us on december 15th. if they don't come around the corner and start talking about going past the status quo ante and levelling the playing field. elizabeth: what you are saying about the tariffs, china weakening devaluing its currency. we know consumers pick up the tab but the president says manufacturing will come back in the u.s. if he keeps sticking it to china. is hong con destined to become another -- is hong kong destined to become another chinese city? protesters fighting for their lives there. violence escalating. actual highways lit on fire. universities closing for the semester. demonstrators now even shooting with bows and arrows. >> i think what we should say clearly and unequivocally is that the people of hong kong

this after a cease-fire was broken less than 24 hours ago. that was broken more than three times today by palestinian factions. in the distance you can hear the airstrikes ongoing. overhead israeli f-16s. the rocket fire that happened earlier today, though, was not unexpected. overnight there was an airstrike in a large city in gaza, and what happened during that time was eight people were killed, including five children. we went to the funerals today of those children and the people that were killed. the israelis say a commander with the islamic jihad lived within the house that was targeted. we also saw that house. take a look at what the scene was like earlier today. this crater is all that's left to the house of a senior islamic jihad commander targeted overnight in a series of airstrikes by the israeli military. eight people were killed in the assault, five of them children. as the bodies of those killed in the strike were marched through the streets of the gaza strip, a rare display of palestinian

unity, as the flags of islamic jihad, fatah and hamas, the three major palestinian factions were flown together. there are renewed calls for hamas, the group in control of the gaza strip to respond to israel to what officials are telling fox news is a, quote, massacre. >> since early this morning, a cease-fire brokered by egyptian negotiators has held, with the exception of several rockets, fired from gaza, the region is starting to transition back to normal. more than 450 rockets were launched into israel following the assassination of an islamic jihad commander tuesday morning. the israeli response took the lives of 32 gazans mostly militants injuring more than 100. >> our enemies got the message. we can reach anyone. i hope this lesson has been learned. >> islamic jihad officials fired right back saying one wrong move by israel could spark the

right now. can a candidate for the presidency legitimate by a jury person for a senate trial against a sitting president while campaigning against him for the oval office? let's ask my next guest, trump 2020 campaign communications director. great to see you. >> good to see you, thanks for having me. elizabeth: i know it is loud there. i will be louder. we have senator warren, bernie sanders, kamala harris ripping into trump saying he should be booted from office, he should be impeached but they would have to sit on the senate trial as objective jurors and then they have to campaign against trump. how is your campaign going to react against that if that happens? what are you going to do? >> i think under normal circumstances you would have to argue that those people would be conflicted out. i mean, if they are arguing that the president should be tossed out of office, yet they want to sit on the jury, that would try to attempt to convict him. look, we don't have too much sympathy for those senators who come from the party that's been inflicting this on to the

american people for three years now. this has been for over three years. look, i'm old enough to remember when the democrats were going to impeach president trump because he was a russian agent for goodness sake. now they have moved to ukraine as the next reason. this was an impeachment in search of a reason. since before the president actually took the oath of office, we all remember that. in fact the washington post had a story hit their website on inauguration day, 19 minutes into the trump administration, 19 minutes after he took the oath of office, they posted a story on their website saying that the campaign to impeach the president has begun. so, i'm sorry, that we don't shed any tears for what the senate democrats will have to go through whether they are on the campaign trail or in the senate being involved when this impeachment fiasco that their party is responsible for. elizabeth: they are campaigning as if accusations are tantamount to an conviction.

-- to a conviction. they want to give unauthorized immigrants free healthcare, get rid of i.c.e., mandate electric cars get rid of everybody's health insurance, including for teachers, cops, firemen and soldiers, get rid of medicare and medicaid. what will the president say tonight about impeachment? what's on the docket? what is he going to say? >> well, i think probably an irresistible topic for the president. i have no doubt he will talk about it. i think he will be talking about a bunch of hearsay nonsense. it is a hoax, just like the russia fiasco was a hoax. this is also a hoax. he made the phone call to the president of ukraine. he released the transcript for the world to see. i don't think the democrats thought he was going to do that and they could be talking about this weird, mysterious phone call that no one had an understanding of the content of. the president called their bluff and released the transcripts. now everybody can see that there was nothing wrong in that phone call. all these witnesses that the democrats are controlling and bringing up there, all they are doing is giving their opinion of a phone call, the contents of which the entire country, in

fact, the world can see for themselves. the whole thing is ridiculous. i think he will call it for what it is. elizabeth: i want to get to this, the economy is doing better than the cbo predix v dikted. -- predicted. but wage growth is kind of hitting a wall. a senior economist at bank of america merrill lynch says wages should be rising faster giving the falling jobless rate. what's going on with wage growth here? worried about the china trade deal? >> well, there's no question that if china comes to the table and gives up their bad practices or if congress would pass the usmca those would certainly help the economy. they couldn't help but help the economy. the fact is the economy is strong. continues to grow. wages are still up, at their highest level in ten years. there is better news bottom half of the wage earning spectrum, their wages are raising twice the rate at those at the top of the wage earning rate.

congressman jason chaffetz as we take on the day's news and most important developments. please be with us at the top of the hour. liz, that's the preview. elizabeth: great to see you. off packed show coming up -- you have a packed show coming up. i will be watching. attorney general barr says the justice department watchdog report on the russia probe origins is quote imminent. let's bring in former federal prosecutor, great to see you andrew. do you expect criminal referrals out of the doj ig probe because remember horowitz made criminal referrals to comey and mccabe but they didn't follow through. what do you think? >> what i think is we will look at two separate issues. william barr said what he's really looking for is was there adequate predicate to the russian probe? i think we're going to see an answer generally that even if the information wasn't good going into the probe in the first place, that we see that sort of thing all the time, in criminal investigations.

it is as the probe continued, whether it should have stopped or whether it should have -- there should have been updates done with regard to warrants before the fisa court. that's where i think there could be trouble if there are prosecutors or individuals involved who failed to update courts about the current status. elizabeth: and reveal where this steele dossier and how it was funded by the democrats. the big question did fbi officials led by james comey break the rules? because john durham, the u.s. prosecutor is doing his own probe, you know, the doj ig could refer criminal referrals to durham. in other words fisa warrant advisor carter page and others carter page is optimistic the report will come out soon. >> i think that again what we're looking at here when we're kind of looking at the fisa court representations is something that i see all the time, every day now as a criminal defense attorney, previously as a prosecutor, there's a great deal of responsibility put on prosecutors and those that are leading these investigations to go back to the court to give

good information about the nature of the evidence that they are getting, and if it is different than it was origin fally -- originally, that's an update that needs to be made. elizabeth: here's attorney general william barr testifying to your point back in april. let's listen. >> i think spying on a political campaign is a big deal. it is a big deal. i think spying did occur, yes, i think spying did occur. the question is whether it was predicated, adequately predicated, and i'm not suggesting it wasn't adequately predicated but i need to explore that. i think there was probably a failure among a group of leaders there at the upper echelon. elizabeth: that means james comey. you have to wonder how this is going to affect the impeachment inquiry. the final question, here's a simple question, andrew, the democrats refuse to answer this. why didn't the obama administration just say hey, there's russian meddling, your trump campaign officials may be targeted or involved. we don't know for sure. just give them the heads up.
