in their articles of impeachment they have a clever rule. if they get a simple majority, they can somehow disqualify the president from running for a second term. so where do we go from here? that seems so odd. right now former republican california congressman and house oversight committee chairman, darrell is back. welcome back sir. >> welcome back kennedy and thanks for teeing it up. they are not charging the president for what they claimed he did for almost three years. and obviously, the abuse of power that eric holder is claiming, happens to be what president obama and president holder did. they obstructed justice, they lied to congress, and even a judge appointed by president obama found that in fact they withheld documents deliberately that claim in immunity, and a privilege that didn't exist for those documents. so it is interesting that we could have impeached eric holder, and even president

obama. nobody suggested it, now they're suggesting this. kennedy: they could've done that using the same guidelines. in fact something was held in contempt of congress and i still have a lot about aggression on the ironically or deal, and how we paid so much money and got so many hostages, and how that politically benefited president obama. but let's go through some of what we saw today. congress had weird rules. >> while the house makes the rules of the house makes. the senate makes the rules that they make. that's one of the interesting things the constitution that it says the body shall make their own rules. unfortunately in the house, abuse of the majority allows them to essentially say whatever we want is what were going to put in as long as we can get 218 of her own to vote for. and that's what nancy pelosi is doing. it's what she's going to do in

the rules committee tonight. what she can't do, if she can't control what the senate does. including the articles of impeachment as you said if they're trying to deny the president a second term, which is dubious in the constitution, what they are doing is giving the democrats, joe manchin and others, a real reason to say you've botched it so badly that i'm not even going to vote for. and that's likely to be what's going to happen. republicans are going to reject it. some democrats may very well objective. kennedy: and there's that one line that's tagged in one of the articles says that the president is hereby disqualified from seeking another term. and somehow that can pass by a simple majority? and there are people who very naïvely projecting that all it takes is a couple of republicans to peel off and vote for that. but what is more likely? republican senators to peel off like michalski romney, or some

of the more moderate democrat senators abandoning their democratic counterparts like joe manchin. >> i think, in joe manchin's not up for election. if he's doing it we doing it out of principle. the reality is this has been such a failed process because they waited for the mueller report to get impeachment and when it bribed completely the opposite. showing us wrongdoing by the last administration and collusion by the last administration. they pivoted to these new charges. what's dangerous kennedy, and you know this looking at eastern europe. if you allow a legislature or a leader to change the rules, every time it suits them to get a prosecution, at the end of the day the rule of law disappears. we have been teaching the rest of the world as americans not to do exactly what nancy pelosi is
