they cheered after the first article was adopted. earlier in the day she ordered her colleagues not to gloat. she coordinated her outfit, wearing funeral black to what he she called a solemn proceeding. lauren: one of president trump's top priorities set to go before the house today. lawmakers expected the to approve the usmca trade deal which would replace nafta. robert lighthizer says the new nafta will be better for american workers, manufacturers and farmers. the senate is expected to consider the agreement in january. mexico has already approved usmca. canada also expected to pass it. 2020 democrat presidential candidates are taking the stage for the final time in 2019 tonight at lo loyola in los angeles. this will include joe biden, senator bernie sanders, senator elizabeth warren, pete buttigieg, amy klobuchar, tom steyer, michael bloomberg failed

to qualify for th the debate. lauren: the central pillar of obamacare struck down. a federal appeals court says forcing people to have healthcare insurance is not legal a lower court will decide if the rest of the affordable care act should stay intact. the president said the individual mandate is unconstitutional. president trump is looking into ways to reduce heaping piles of student debt. >> tracee carrasco with us now with the details. tracee, we know this is the number one category after mortgages weighing on americans. >> reporter: according to senior administration officials the white house is looking to help alleviate the student debt crisis, including the ability to eliminate debt in bankruptcy.

43 million americans owe a total of $1.5 trillion, the second highest form of consumer debt after mortgages. officials say the plan wouldn't be completed until next year and thinks it can gain bipartisan support. there are early retirement packagepackages at freddie mac. they are looking to remove them from government control, improve access to mortgages. uber settling the federal investigation into its workplace culture. the company agreeing to establishing a fund of $4.4 million to pay former and current employees who were sexually harassed at work and agreeing to three years of monitoring to ensure it changes its practices.

employees who worked at the company after january 2014 are eligible to submit claims to the commission. uber's total revenue for the last quarter, $3.8 billion. and grammy award winning artist marc anthony's yacht bursting into flames. it was docked in miami and caught fire around 7:30 a.m. with dark smoke and tall flames engulfing the yacht. the fire was under control within two hours but has since capsized, sustaining enough damage to be a total loss. marc anthony was not on-board when the fire happened but a half dozen crew members were evacuated. no injuries reported there. that's what's happening now. look at those images. lauren: that's unbelievable. do we know what caused it. tracee: i don't know of a cause yet. i'm sure they're still investigating that. lauren: thank you very much. what an unbelievable night and day this is. the house is going to bring usmca to the floor.

the president touted the economy during a major merry christmas rally in michigan last night, battleground state and he was just impeached by the house of representatives. >> if you look at futures, investors are clearly not concerned about the house's impeachment vote. lauren: why do you think that is? because he's expected to be acquitted in the senate or because they're looking at their portfolios and they're up? >> i think all those reasons. i think that's a all the case. most of the volatilities in the markets has come from trade headlines, whether it's u.s.-china, or usmca, that's really what's been driving sentiment more than any of the political tension. lauren: waiting for the deal to be signed but optimism. looking at the nasdaq futures, nasdaq was at a record for five days in a row, any gain today would be record day number six. so many parallels whe pair to 1- parallels to 1999. president trump, he's been

lauren: president trump impeached by the house of representatives last night but you might have to wait to he see how the senate will proceed. speaker of the house nancy pelosi suggesting she may wait to send their articles of impeachment over to the senate because of fears of their inability to hold what she says a fair trial. listen. >> we have legislation approved by the rules committee that will enable us to decide how we will send over the articles of impeachment. so far, we haven't seen anything that looks fair to us, so hopefully it will be fair and when we see what that is, we'll send it. lauren: what is her plan? thwill the impeachment proceedis move forward anytime soon. we ask constitutional law attorney, kevin bellkin. what does the law say about this. >> she is going to put it over to the senate. the rules are set by the federal rules of evidence. i think democrats are concerned that a lot of the evidence used in the house may not be

admissible under the federal rules. lauren: does nancy pelosi have sway over what happens in the senate? isn't that mitch mcconnell, chuck schumer. >> the senate is going to decide what rules apply, how to conduct the trial and the chief justice of the supreme court will preside over it. she's delaying it, thinking they'll get concessions on the rules. lauren: a lot of people ar are saying because the democrats want their witness toss be called, including john bolton and mick mulvaney and others. >> it will be up to these people whether they come in to testify. it's going to be up to them to make their case, the democrats. lauren: the timing of all all this is just extraordinary. today's the anniversary, 21 years since the house voted to impeach bill clinton but to impeach him it took them 1500 days, 85 for donald trump. 85, he's impeached and we don't know what's going on in the senate trial. >> probably they wanted to

impeach him from inauguration day. they had to wait to see, let him build a record and see if we can get him on something. the charges are very flimsy. even if everything they've alleged he did, he did n a worst case scenario, it's not clear that he committed a crime, so what's the impeachable offense. lauren: they said several -- several house democrats said yesterday even if he's acquiting in the senate which is very lyinlikely, and reelected in 20, they'll find something else to act on. it's incredibly partisan. what can we expect from a senate trial whenever it does happen? >> look, it's going to be on the democrats to prove his guilt and there's some case law that suggests an impeachment proceeding, the standard by which they have to prove it is beyond a reasonable doubt. there are potential criminal consequences. i'm not sure you get beyond a reasonable doubt with hearsay testimony, much of the evidence is hearsay and inadmissible and

i don't think you really get there. lauren: let's listen to bill barr speaking to martha mccallum on fox news. >> as a general matter i think we have to be careful about trivializing the process. they put in a hurdle of high crimes and treason, bribery and other high crimes. the articles of impeachment here do not allege a violation of a law and it looks as if it's going to be a along partisan lines. i'm concerned about it being trivialized and used as a political tool. lauren: and setting precedent, what precedent does this set? >> that is a very dangerous precedent. impeachment, this seems to be a trend we're moving towards a partisanization of the impeachment process he's, meaning that any time the opposition party gains control of the legislature, are they going to move to impeach a president, regardless of the

if you look at the markets, up the last five out of six days, if you look at futures right now, investors don't care, right? is that true. >> that is true. i think you've got positive jobs, you've got purchasing power of the economy, you've got passing trade deals, you've got a pause in interest rates. that's a pretty powerful message with the economy and so i think the market sniffed out that nothing's going to happen here. we had a good year. deirdre: for the past 17 months, a little longer than a year, to your point about trade, all of the volatility has basically -- not all, 95% has been u.s.-china trade or questions about usmca. you feel like that's going to be removed as we go into the new year, some of the uncertainty. >> since the bull market run of almost 11 years we've been had 14 5% drops. president trump has said basically with the china deal that he's pushed off any further conversations until after the

election. he gets a win to talk about for the next year. deirdre: we've been talking about the bull march cerkts an 11 year -- market, an 11 year run, unprecedented. there's a lot of people for whom that makes them nervous, there's a question of how long this can go on. >> i don't think it's an age thing. it's not the best in terms of percentage, so we have room to go there in terms of making it the best performing bull market. but in he reality, i think that the continuance of the conditions make it look like there's no reason why we can't continue with everything, the backdrop that you have with the economy and the job situation and the consumer spending that we have. deirdre: you're a certified financial planner. when your clients call and say listen, i did really well this year, i'm super anxious about 2020. what do i do? what are you going to tell me? >> this is the fifth best year since 1959. i think that puts it in perspective. the market sniffed out good things are. if you've gotten out of whack with your allocation, most

investors are 60% equities and 40% fixed income. we're up almost 30% year-to-date. and you're pushing 70 to 80% equities, you want to look at triming that back if you haven't already. deirdre: maybe on an amazing day, you sell a bit. >> get back to your original allocation. if there's 5% or 10% correction, that gives you an opportunity. deirdre: there will be more volatility. >> that gives you the opportunity to add back in. if you're 70 to 80% equities, when the market drops, you're not going to add. that gives you the ability to put money back in. deirdre: all right, doug flynn. i took notes. thank you, sir. lauren: take a look at your money right now. look, dow up 26, nasdaq up 1. this could be day number seven of up arrows for the nasdaq in a row. coming up, the democratic presidential candidates are

lauren: now that democrats have voted to impeach president trump, it seems like they're going to do everything they can to delay their articles from reaching the republican held senate. republican strategist 16789iri kim and david turner are here. what a night, what a morning. we continue to unpack everything that went down. doug, i want to start with you. cnn in an analysis by their editor at large says this, warning lights are flashing for democrat as they impeach trump and he notes to two things. he said trump's job approval rating has gone yo up and suppot for impeachment and removal has gone down. is this hurting president trump? >> i think it's clear based on the elections in 2019 where we had real world results is that impeachment is not what voters are caring about right now. it's about healthcare and education. these are the things voters will

be voting on in november of 2020. we saw in hows y louisiana, in kentucky, where he went all-in for both gubernatorial candidates, they both lost. i think that's the most concerning thing for trump right now. lauren: what do you think, sir. >> i think two state governors that are deeply unpopular losing has nothing to do with president trump. i think it's important for voters to look at the fact that nancy pelosi and the democratically controlled house don't seem to care about the constitution, they don't care about the process. when articles of impeachment are sent forward, that is a very serious matter. she shouldn't just hold it up on a whim because she doesn't want to do it. she should allow procedures and processes to go into effect. lauren: she did wear black, so it would look solemn, like a funeral, david. but david, what do you make of that? he'especially when we're waitino hear in the freshmen dems in the

donald trump districts, they noted this is a very solemn moment, this is a very serious decision we have to make, yet they cheered after the first article was indeed passed. >> well, i think that was very clear, a small knee north in the caw -- small minority in the caucus. nancy pelosi put that away very quickly. i think the bigger issue here for republicans is the fact that mitch mcconnell, somebody who says he's going to be a juror in the process, has already said he's going to work hand in glove with the defense. in no courtroom in america would you think that's a fair trial. i think nancy pelosi's doing the right thing by trying to ensure that the senate takes this seriously. the house is taking their responsibility seriously. it's up to the senate to do their job. it's not clear they're going to. lauren: you're right, it's not fair. none of it is fair. it's so highly partisan it can set an awful precedent going forward. it's going to have ramifications to 2020. l i'll let you respond to that,

sir. >> it absolutely isn't fair. if you're talking about senators being i' impartial, senator elizabeth warren said she would impeach donald trump. senator bernie sanders said he would impeach donald trump. senator say a my klobuchar said she would impeach president trump. this is not about process, not about procedure, not about law. it has everything to do with the facts that the democrats -- two things. one, can't stand donald trump and two, can't beat donald trump. lauren: all those candidates are on the debate stage tonight in los angeles. do you expect them to attack the president or attack one another? >> well, i think it's very clear they're going to present their policies about how they're going to move this country forward and pass this president, what he's done to this country. there's also likelihood they'll go after each other a little bit. i think that's what you're going to see tonight. lauren: mayor m michael bloombg

said this to msnbc. >> he's never been a manager of an organization. he's never run a school system. his wife is an educator and has good experience there. lauren.>> look, i think there't of things you can say about vice president biden but unqualified is certainly not one of them. i don't know where the mayor is coming from. i think he's probably a little upset that he's not on the stage. the fact of the matter is, we have a good crop of candidates going forward and we feel confident going into november of 2020. lauren: in a silent a attack of joe biden, if you will, by a contender and challenger, michael bloomberg. do you think that bloomberg kind of just endorsed silently donald trump? he has experience running a business. >> went bankrupt. >> i do agree with you, lauren. i feel as if michael bloomberg is being patronizing as well as being selfish. article two, section one of the

deirdre: changes could be coming to your 401-k. lauren: tracee carrasco here now with the details and our 401-ks are looking good. tracee: congress is looking to pass the first major piece of retirement legislation in a decade. the vote this week is tied to the spending bill. that means a number of changes for retirees related to the required minimum withdrawals, the way they use iras and estate planning options. the bill would raise the age for
