respidral. he sued the company, the judge in philadelphia saying he's going reduce that award, the stock is higher at this time, but boeing not doing so well, downgrading boeing's debt to a minus from a, not good news, stock under pressure as you know reporting all kinds of problems with 737 max jet, just saying today that software associated with that, they found a new problem with it. stock is down as you can see, having lots of trouble. overall, though, good week and good day, good finish on a friday, thank you. melissa: gerri, thank you. connell: we move to talk about the housing market where the momentum keeps on going, construction of new homes skyrocketing in december. highest level, as a matter of fact, in 13 years, according to latest figures from the commerce

department, to jackie deangelis, jackie. >> good afternoon, connell, this was way above expectations and when you take it in context, you see part of the reason why the market is up, strong earnings, great progress on trade but strong fundamentals, very important piece of the puzzle, total housing up 40% year on year, single family up 32%, multifamily up 74% year on year. this 1.608 million for the month of december, it's the highest level since december of 2006 and as i said more than 40% year on year, single family homes, the highest since 2007, multifamily, the strongest since 1986 and as you said this is all coming from commerce itself, what's fueling the strength, though, low rates; the fed, sure, of course, freddie mac has the 30-year rate as 36.5% but not just the fed, it's also the strength in the u.s. economy, that's what makes

people feel more confident, they become more confident buyers, people who are scared don't want to commit their money even if rates are low, when you step back for a second, so many out there who are saying right now and you know who they are, the stock market it's not barometer for the economy, this kind of data is a measure and could help support further economic expansion and as i've been adding this could potentially be the longest economic expansion on record, guys. connell: all right, noted, you know who you are, jackie, thank you. melissa: tesla under fire, new claims that half of million of cars can suddenly accelerate on their own and are being blamed for more than 100 crashes over the last years, dierdre bolton in the news room. >> exactly right, sudden acceleration said to have caused crashes and 52 injuries, some

drivers say the sudden acceleration occurs when drivers attempt to park in a garage or as a curb and some of the before and after shots are extreme, drivers crashing into their own garage doors, some say using the driver assistance system can also trigger the problem, now a few months ago there was another potential defect, one that could have resulted in battery fire, so this is a separate concern, but at that time regulators allowed tesla to issue software upgrade in place of recalling 2,000 cars. since october when the company posted a surprise profit for that quarter it has been steadily climbing higher. another stock that investors are buying even with pr issues is facebook, presidential candidate joe biden calling for drastic action to be taken against the social network, he says facebook's antifact-checking policies for political ads should be illegal, mr. biden is personally the subject of a phasebook ad run by the trump

senate but he was the independent counsel and the house of representatives used the starr report as they went to impeach president clinton and used that as evidence in the senate trial and robert wray who worked with him in that capacity in the whitewater investigation, as you say the question is about witnesses and fairness, here is the senate minority leader chuck schumer. >> it would mean the first impeachment trial of the president in history with no witnesses. so in the coming days, each of us, democrat and republican will face a choice about whether to begin this trial in the search of truth or in service of the president's desire to cover it up. >> now mitch mcconnell, senate majority leader, says democrats are whipped into a frenzy over impeachment, he said the senate's job is to calm this down. >> this body, this chamber exists precisely, precisely, madame president, so we can look

anything, chad, thank you. connell: democratic campaigns are being halted by the impeachment trial, of course, senator bernie sanders, senator elizabeth warren, among those back in washington as jurors in the trial a couple of weeks before the caucuses in iowa. now president trump tweeted about that dynamic earlier today saying and we quote, they are rigging the election again against bernie sanders just like last time only even more obviously. they are bringing him out of so important iowa in order that as a senator he sit through the impeachment hoax trial, crazy nancy thereby gives the edge to sleepy joe biden, very unfair says the president, but that's the way the democrats play the game and he adds at the end it's fun to watch, with that we bring jenn caldwell. you know, absent all the crazy nancy stuff and all that, the

idea that these guys would be off the campaign trail and it would help biden, so we have no way of know if that's the reason she did it, but if it is the case, if that's the strategic goal, do you think it's effective one that will help joe biden? >> well, honestly for anyone who is willing to be intellectually honest we can all see that the fix is in, certainly as the party move forward in this primary process, i'm sure that nancy pelosi had to consider the fact that it would hurt those individual senators and considering the fact that now that bernie is in a dead heat per the aggregate of polls, showing dead heat with joe biden, this is something that's certainly would take the edge off and help joe biden, so for those who are watching this very closely and considering the fact that there's not a lot of folks excited about joe biden, there's people that are saying they are going to vote for him but not necessarily excited, they are excited bernie bros are everywhere, stale -- still

excited about bernie sanders. nancy pelosi had to realize that before he made the decision. connell: pete buttigieg as well, they will spend every day in iowa, now, to think i'm maybe overthinking this, what if one of them don't win, so biden doesn't win? iowa is all about expectations. then we start to say -- he ended up winning, maybe this lowers the bar to think about it from the other side for somebody like bernie sanders in the next couple of weeks. >> i don't think that there's a lowering of the bar in any way, the democrats as we've been seeing and van jones even said through last debate that he didn't see on the stage that can beat donald trump, so now they are going to need every bit of momentum that they can possibly get to present a case to the american people that they're next in line to win and what we have seen especially with elizabeth warren and bernie sanders is these far-left policies are exciting their base in a way, certainly not

excitement for a candidate like a barack obama or bill clinton back in '92 but certainly get folks out to the polls, anything that will hurt that effort which impeachment, whether they realize it or not is hurting effort. if you look at iowa polls, more than -- at least about half of their voters there don't want to see the president removed from office and they don't like impeachment at all. this is something that's going to be problematic for folks like bernie sanders and especially elizabeth warren, joe biden and joe biden he's running with it. connell: well, understandably, from his point of view, as i said the other one is mayor pete. he's a guy who has got to win in iowa. >> he still has problem with african-american voters. connell: maybe part of the point, if he doesn't win then, when is he going to win? >> right, so some people really like him, they think he's a smart guy, if you can't win african americans which since 1984 african americans have been

does expect to break the trial into several groups of defendants, another big take away is many lawyers in this case who represent various defendants are complaining about the volume including athletic director who received 1.5 million emails alone, now some 500 pages of documents were filed hence revealed to the public by the government earlier this week including an e-mail showing that was asked by usc to look into suspicions raised by high schools regarding some students being admitted as athletic recruits, the official wrote that the school doesn't think either of the students are serious participants, secretly in on the whole scam, there were other documents including e-mail exchange, a usc admission's

poisoning the jury pool? >> you would think so but ultimately all attorneys in such high-profile, high-risk case, they are strategizing because they want to present most advantageous case for their clients, it's probably the reason why we are also seeing that lori loughlin's team is saying that the prosecution has failed to turn over critical documents, critical evidence, critical information that would potentially exonerate her. >> are we suppose today know about the emails that are so damning? >> yes, this is all public information. melissa: wow. >> goes into the public forum, part of the reason why you may see in other cases, not necessarily in this one, people -- lawyers attempt to go -- attempting to not disclose information. melissa: what do you think about this? we thought we were legitimately giving money to the school and

in this e-mail, obviously the school is trying to solicit money from them saying, let me tell you how it might help and we are squared away on that front, how do you spin that? >> it does raise questions about how the college admission's works, it doesn't still identify or at least isolate knowledge of using a fake athletic profile to get their daughters into school, it's perhaps inferred, perhaps it's implicit but let's not forget what the prosecution's burden is beyond all reasonable doubt. and what they are ultimately probably trying to do piece together enough of this information, enough of the emails to create beyond a reasonable doubt knew what they were creating was alternative fake athletic profile as a way to get their daughters, does

before the transaction is finalized and the justice department is taking notes, carol, so many ways to go with this one. i mean, first of all, they are profiling and they are stopping transactions before they happen, they say if they flag something that's wrong, they can clear it up with just a quick phone call, but i don't know, i mean, it's kind of minority report, they are deciding that somebody is committing a crime before they commit a crime. >> i know it sounds scary but as a recovery investment banker who has built financial model in my day, this is predictive data and analytics that's been around forever, whether it's the ads that you're served on the internet our your tv, cops using to it figure out where crimes are likely to happen, data is data, now obviously if you're building this, there's something called garbage in and garbage out, if you have bad inputs you'll get bad outputs, but this is the future, it's just using data and using it more intelligently, sounds scary because it's faster and better these days, but i don't think it's a big concern.
