began. the president at this hour is heading to davos, switzerland, to talk about his economic successes. after a week of full bare knuckle politics ahead of the gnat impeachment rile that starts tomorrow. edward lawrence at white house with more. edward. reporter: any minute, 15 minutes the president is expected to leave for davos for that trip. his lawyers though, filing a 110-page trial memorandum against the articles of impeachment. now by the way the articles of impeachment, 111 pages. president's lawyers argued number of different things in their brief. the house does not identify impeachable offenses. that the process is irredeemably flawed because it violates due process rights. there is no evidence making any claim in the articles of impeachment, that the articles are structurally deficient. one of the lawyers on the president's legal team, the president is prepared to go

ahead with the trial without witnesses. >> this impeachment is fundamentally and constitutionally flawed. never in our history has there been an impeachment of a president without allegation a crime was committed. under the circumstances given that, that is untethered to the foundational principles that come from the constitution itself. reporter: today democrats made a whack-through of the senate floor, in preparation for the trial beginning tomorrow. democrats would like to see a number of witnesses on their wish-list. now on that list are a number of people including mick mulvaney, chief of staff, security advisor john bolton, also associate director for national security michael duffy, senior advisor to mulvaney, robert blair. >> the democrats have put forward four fact witnesses, people like mick mulvaney acting chief of staff.

all the documents show he was in the middle of all that. john bolton who called this a drug deal that went down and has said he wants to testify, if subpoenaed. reporter: republicans have their own wish-list right there. you see them hunter biden, his dad joe biden as well as adam schiff and the whistleblower all under oath as the impeachment trial kicks off, president donald trump will be in davos talking to or the world leaders touting successes to the trade deals. in addition to the meetings he will talk with the new european commission president. obviously, trade, liz will come up on that front. liz: edward, great to see you. thank you so much for your reporting my friend. as edward was reporting the talk in washington now the senate trial could mean hearings lasting for month if democrats get their way on more senate witnesses. house democrats saying coverup, if the senate does not call in the witnesses. democrats like maxine waters, now saying quote, we will not stop on impeachment even after

the senate trial. let's bring in ken buck, house judiciary. ken, great to see you congressman. house democrats threatening to call impeachment witnesses themselves if the senate does not. how would that work? >> i have no idea. they obviously could call witnesses into committees, have oversight hearings, ask those witnesses questions that would be on the same subject matter but this is clearly a fishing expedition. if the house democrats felt so strongly they could have called these witnesses, they could have had these witnesses, could have gone through the court proceedings to force the witnesses to testify over any privilege or at least had ruling by the court as to whether or not privilege would have applied. these witnesses may have nothing to say. this is delay tactic to try to continue this beyond the point, i think point is two or three-week trial on this issue. this issue should be dead. we should be moving on to important issues. liz: democrats are talking potentially bringing in chief

supreme court chief justice john roberts on this. he may have to excuse himself because weighed in on executive privilege, that argument. what is the senate republicans so-called kill switch. let trump's team ask a motion to dismiss articles fairly quickly after some evidence is presented. the democrats say they have overwhelming evidence that the president did halt aid to ukraine to force it to look into the bidens? >> yeah. i think that what majority leader mcconnell has done is try to make sure this isn't some sort of a political show. that this is a narrow and tight trial. that the president has the rights that he should have had in the house and didn't have. and that the house democrats can't control the senate calendar. i think mitch mcconnell's absolutely right, making sure that if the democrats don't meet a certain threshold the trial is over, and country gets back to its business. liz: even cnn ask why didn't democrats pursue subpoenas for

witnesses in court? cnn is also asking the democrats, are you in danger of interfering with your own 2020 candidates? i want to get to this. house intel chair adam schiff, he is the lead manager, he accused cia and nsa withholding information about ukraine. he didn't give any evidence of that. schiff dodged questions on abc this week about credibility of lev parnas the democrats new witness. parnas is under indictment on federal charges including making false claims. critics he wants to get leniency. what is reaction on adam schiff here? >> adam schiff had his opportunity and i blew it. he did not present a strong case. he presented a very weak case. it was a partisan vote in the house. if anything two democrats voted with republicans. adam schiff has failed and he is not going to succeed in the senate. he will not have a show in the senate when he failed to put a strong case together in the house. liz: house impeachment manager jerry nadler says any senators who vote against witnesses are

part of a coverup. nadler says any witnesses called about the bidens, talk about the bidens is part of a smear campaign. the biden campaign sent out an unusual memo, open memo to the media warning how they cover the biden's ukraine conflicts interests, saying story has already been debunked but author peter schweitzer said five biden family members got rich using the biden connection. we'll go deeper into the story later in the show. senator ted cruz says the president has a responsibility to the investigate the bidens, watch. >> i think one of the fundamental defenses i expect to hear from the white house this week is that the president has, inherent authority, in fact a responsibility to investigate corruption. when you look at what happened with joe biden and hunter biden, there is minimum a prima facie evidence of corruption. liz: your reaction to that? let me push back. democrats are saying this is not

material to the articles of impeachment themselves the hunter biden story? >> whole reason that president trump responded to president zelensky's statement about rudy giuliani and the bidens was, that it is relevant. that there is corruption in the ukraine. the president doesn't want to give u.s. taxpayer money to the ukraine if there is corruption that is ongoing. so he asked the president of the ukraine to look into corruption. that is part of the corruption. liz: including political rival, joe biden? >> including everybody. just because you run for president doesn't mean you get immunity. in this case the president of the ukraine should look into the bidens. i think u.s. senate should look into it. i don't know that it needs to be part of this impeachment trial. liz: senator lindsey graham really unloading on nancy pelosi. watch this. >> well, to my friend on the democratic side, you know, i like nancy pelosi. i've known her for years. i think she is a very relidge just person but when it comes to donald trump, nancy pelosi may

fox news trey yingst joins us in jerusalem with more. reporter: liz, protests continue across places like iraq and lebanon as frustration grows regarding iranian influence in the region. in baghdad, two people were killed, a dozen injured as security forces fired live ammunition and tear gas. clashes erupted as hundreds of iraqis blocked main roads to the capital of baghdad. burning tires and barricades were used to block vision of gunmen who occasionally opened fired. 14 police officers have been injured as well since new clashes began over the weekend. similar anti-government protests in lebanon are taking place as demonstrators participate in a beak of rage. in beirut and tripoli, demonstrators threw stones and set fires to buildings. they are demanding a new government amid a growing economic crisis. lebanese banks are running out of money. as one demonstrator notes the

enough aid. >> well i do think that, there is an issue with the federal post. it has to do with the promise of aid. the congress set aside $44 billion. only 16 billion of that has gotten into the hands of people to improve their lives. now part of that reason, if the government officials were speaking as opposed to me, they would say, well, we're very concerned about corruption. we're very concerned about a country that has financial insolvency, making certain that rules an regulations protections are there before we start giving american taxpayers money away to this relief operation. so there is some of that, very legitimate concerns. but i still think we're much too slow to respond to the needs of the people there. so all three governments are sharing in this responsibility of the people of puerto rico still suffering. liz: turn to the "washington post," running a head-scratching story, confusing people. the headline, trump uses

soleimani killing to burnish credentials. it quote as former military official saying that but then says, soleimani should have been taken out. here's president trump touting that drone strike on general soleimani. watch this. >> the democrats are outraged that we killed this terrorist monster. who is the king of the roadside bombs. great percentages of people don't have legs right now and arms because of this son of a [bleep] [cheering] liz: "the washington post" story also cites president obama touting as well the killing of osama bin laden. the media coverage of this story, your reaction? >> well i don't disabuse the president of conducting, taking a victory lap for taking soleimani down given the significance of what he represented, horrific loss of life we suffered under his hand, nor do i have any problem with

president obama doing much the same thing after tsunami was killed. he was up for re-election. he used that during the campaign for re-election. these are narrowly things that can take take place -- natural things that take place. the high point of the president's foreign policy, when the iranians retaliated against soleimani because it was a modest attack, the president moved towards diplomacy as opposed seeking a reattack, i believe that is the high point of his presidency. liz: getting back to the drone strike on soleimani, media, including "the washington post" still question it. israel's ambassador to the united nations danny danon told us yes, that soleimani was about to hit u.s. assets, watch this. >> i know soleimani what he did, was planning to do to u.s. targets, to your embassies, of not against israel but against american people. the decision by president trump

was important decision. liz: forgive me, president trump and white house has been attacked for saying that soleimani was going to attack u.s. embassies saying there was in proof of that. but you're saying there was? >> absolutely. liz: have you seen it? >> for 19 years mr. soleimani was mastermind of terrorism in the region and the world. we saw attacks in europe -- liz: do you have proof they were going to attack u.s. embassies? >> he was going to plan attacks against american targets, against european targets and against middle east earn targets and he was funding all those attacks. it was the right decision at the right time and we support president trump for that. liz: general, your reaction? >> listen the administration has not released all the information that they had that drove their decision to, to take out soleimani. they knew he was directing, planning, coordinating an attack. but because the information we have is so tied to the source, liz, we're not releasing that. we only released it to the two

hundreds of millions of dollars in revenue. your reaction there? >> that is been going on time in memorial, people profited off relationship with politicians. proving that is criminal act is something else again. it warrants inquiry. i want any companies that profited have any financial association with joe biden? as an investigator, commander i would want to know that. that would be one of the first things i would look at, what is the relationship, did he profit in some way? probably not but as investigator you will look at that. liz: the book claims the husband of biden's daughter ashley works at a company called start-up health. he is the chief medical officer there. joe biden helped launch this startup, visiting with the company officials, bringing them into the obama while house. looks like there is a lot of people going in and out of the obama white house on behalf of joe biden. also joe biden helped his brother frank's real estate endeavors development company in costa rica. the vice president visited the

company, oversaw the caribbean and latin america for the obama administration. the obama administration announced a big development deal involving frank biden, developers there. the story there. go ahead? >> same thing. it is profiting from your association with the vice president of united states. it is not necessarily illegal to do that. you have to show some kind of quid pro quo. that is very common term right now, did these people benefit illegally? the answer we don't know. but certainly raises enough questions to warrant inquiry. i think we should clear the deck. the question here is, do we have the courage as a country to go after an individual through criminal prosecution that may be next president of the united states. i don't know that we do. something to think about. i think it insulated hillary clinton from bosscution in her email scandals. interesting time. we have laws -- liz: critics are saying you know, the obama administration approved fisa wiretaps on an
