kennedy: welcome to it, john bolton has to testify a because we should have to hear what he has to say and be, because wouldn't it be amazing to see democrats call him a hero after decades of hating everything he stands for? all the hypocrisy, it is rich. over the weekend contents from his memoir magically leaks to the new york times. apparently bolton claims the president did indeed withhold military aid to ukraine. unless they agreed to investigate joe and hunter biden talk about it publicly. earlier today senator majority leader schumer says he is our hero and must speak. >> this is stunning.
9:01 pm
it goes right to the hearts of the charges against the president. ambassador bolton essentially confirms the president committed the offenses charged in the first article of impeachment. it boils down to one thing. we have a witness with first-hand evidence of the presidents actions for which she is on trial. he is ready and willing to testify. how consent republicans and not to vote to call that witness and request his documents? kennedy: we are told the senate will later this week vote on whether or not to allow witnesses. such as john bolton or hunter biden or both? right now the president's legal team still making the case it impeachment, and this whole trial is one big sham. >> here at home, in the world's longest standing constitutional republic, instead of a once in a century phenomenon, which it had been,
9:02 pm
presidential impeachment has become a weapon. to be wielded against one's political opponent. b5 like an angry saber. that's us have the democrats failed to make their case. >> they say their case is overwhelming and uncontested. it is not. they say they have proven each of the articles against president trump, they have not. the facts and evidence of the case, the house managers have brought, exonerate the president. kennedy: exoneration hallelujah. so will he hear from ambassador bolton? and what will that do for the trial? joining me tonight the federal senior editor she's a fox news contributor and co-author of justice on trial, my uncles favorite book of the last two years, shut uncle jon. here's molly hemingway. so i think it's very funny
9:03 pm
that democrats have embraced for people, among them they have 16 felony indictments and that includes michael cohen, michael avenatti, and left parnas. and now you add jon bolden to that mix and we looked and could not find any criminal shenanigans in his past. but it is very interesting that he is the latest person that the democrats are pinning their hopes on. what you make of it? >> just in general it's surprising to me how many people however, people like left parnas. it's also interesting that some of my donald trump brought some like john bolton into his administration. john bolton was someone in the bush administration and seem to share that president's foreign policy views. but president trump did not run on the foreign policy platform like bush. this town maids for extremely strange bedfellows and this impeachment is good showing of that.
9:04 pm
kennedy: do you think the president is batted general of accepting people into his inner circle? does he have a bad betting process or someone misinformed him? >> easily it's his biggest failure as president, who he has put close to him. i do understand this town has been incredibly hostile to him and have made it difficult for people who share his policy views to work in the administration. but still, i don't think you can blame anyone but yourself for hiring john bolton as your national security advisor and then seeing what happened here. kennedy: it is so rich that the democrats are ready to embrace and john bolton as the ultimate patriot. never mind that he would like to use patriot missile to bomb at least a third of the planet. let's talk about the book a little bit. bolton's team whether it's his warrior or the publishing company who is publishing his memoir march 17 it is
9:05 pm
available for preorder now, i'm hearing. they're saying it was not us, we did not leak this section to the new york times. but if it was the administration would to be something old rozier torts administration? >> not necessarily, 70 clearly leaked it to hurt the president. the other option would be someone and the national security council and related 20 just talked about, this president does have a lot of people who seek to undermine him. in their people currently working in the national security council who were people who reportedly reviewed the book who is known as critics of president trump. i guess that's the case being made by the publicist and the book publisher, they are suggesting at some national security council. it's possible, and this did happen to coincide with the launch of presales for the book. which is just a wonderful
9:06 pm
coincidence. kennedy: excellent timing. it is absolutely perfect given the political climate that we are in. and apparently, this has done some jostling with a moderate republican senators like susan collins and met romney. and just hearing the slow snippets, this little width of the literary opium, they now want to hear more from bolton. to think that's can happen? >> i'm not sure if it will happen. i don't know if they've thought through what it means to call more witnesses. you've never before had an impeachment where you called witnesses who were not part of the impeachment inquiry. and here everybody's talking about witnesses who are not a part of the impeachment inquiry. republicans were not allowed to call any witnesses the democrats and one called. they would like to call the whistleblower, hunter biden, joe biden the intelligent community inspector janitor general. there somebody people republicans want to call that would help bolster their case. kennedy: let me ask you this.
9:07 pm
if you call to witnesses, so everyone agrees to the bolton for biden trade. so if you had to witnesses, doesn't open the floodgates? or is there a way to capping it at three and flee? >> will people talk about they talked tit-for-tat you get this witness we get this witness. it seems a little unfair that in the house proceedings democrats called everybody they wanted to, and republicans didn't get the call anybody unless they happen to be on that list. then you would go for one-for-one. the other thing is if you call these witnesses it can go through weeks and possibly months of more impeachment proceedings. i'm not entirely sure either democrats or republicans want that to take place. so one thing they might do to get around it, and one way that would help avoid calling hunter joe biden, a subpoena john bolton's book and see if they could get the information there and that would also keep them from having to take a vote on whether to overcome
9:08 pm
the executive privilege that would almost certainly be asserted. it's just kind of whether they think prolonging this, generally speaking the democratic plan is to prolong this. but as we saw with the kavanaugh confirmation, at some point prolonging her democrats. kennedy: but they are not in control and they are not at the same kind of risk of overplaying their hand like we saw in the kavanaugh hearing. and i hope, especially after reading your book, i hope there are people who have internalized those lessons. because your strategy can come back to bite you in the keister. and i hope that bolton's book comes with a very large foldout map of all the places on earth he would like to obliterate. that would be fun. >> all in black, the whole thing. it also like napalm. kennedy: molly thank you so much. meanwhile fox news poll conducted as a senate trial
9:09 pm
gets underway shows 50% think the president should be convicted and evicted from the white house. forty-four think he should not be convicted or moved. annette suspected those results, what they follow party lines? but independents are starting to lean against the president. 53% of independent voters saying that she he should be removed. 34% believe in his acquittal. the polling concluded before the defense team open their argument. but will public opinion change or our independent voters showing the impeachment trial is leaving a mark on the president? let's go to the party panel. he got attorney author daniel mclaughlin's back. in the host of the jimmy weinstein show, it is jw strategies founding partner it is jamie weinstein, and lucas here media partner and the fifth column podcast host, the award-winning and much decorated camille faulkner.
9:10 pm
welcome everyone. so is this good news for democrats? this fox news poll. and what does it mean. >> if you have 53% of removal it's a very high barr, constitutionally speaking. we need 67 for varied to serious and decisive issues. not only this, i don't gaze going to get removed i can't imagine what is in the bolton book but good for him. kennedy: if there's something else is in the bolton book i think we would've heard about it. >> i think there's news tonight that the president was maybe nano odd so it's actually drip drip drip. kennedy: like robert kraft? >> no i think it was more pg than at kennedy. i think it's about the election. when you said was gonna cover the book i thought it was in a big fall down and stars actually.
9:11 pm
like they had to put on the front ends of their cars. so jamie, she is right you are not going to get 14 senators to flip over and somehow side with democrats here. so is the point of this just to hurt the president and if so is that working? >> look there is a slim chance as you said that they're going to move over to remove president trump. the chani republicans you need. that slim chances john bolton. you mentioned earlier there's a lot of new democratic heroes and many have felt needs but the one and didn't as john bolton. and i don't think it is called before the senate's and change that record and lien cause perjury. so if he comes there and says -- kinda gives in the room type of statement that really does compel the senate to question at least republicans to question the narrative they've built around this perfect call might not be true, maybe there is a chance. one thing for sure, if bolton
9:12 pm
and biden come to testify, this narrative that this is boring, that will no longer be the case. kennedy: that's a really good points because i think the boredom is a strategy. and i don't know for whom. if it's for republicans or democrats but they are definitely doing something. because you don't need three days to make a 90 minute argument. >> i think everybody's had the expectation for some time that we where on the democrats and that president will be strengthened by that. but unfortunately for the president the drip drip drip is not god in his direction. the bolton revelation is not in the president's favor. if not obvious to me will happen here. i will say, no matter what bolton says i can imagine this actually turning the tide for the support in the senate. there doesn't seem to be any indication, i'm interested in what will happen. kennedy: the case they are going to make is the ultimate end was got the weapons and
9:13 pm
they never had to publicly say they were investigating the bidens. >> they have been saying several different narratives. durso which is been doing tonight again not for the first time that look past presidents have done things that are wrong. not everything that's wrong should reap choir president be removed from office. kennedy: you wouldn't have any administration to last longer than 11 months. [laughter] >> i don't think anyone is going to disagree. kennedy: that's i'm enjoying tall thing i want to see hunter biden. >> i think everybody agrees it's very, very unlikely. but i should mention there is another article today in bolton's book he talks about turkey and what his concerns about wherewith the president with turkey and china. if he testifies in his question he starts laying out a case of what people didn't know, there's a 0% chance maybe it's a 5% chance. kennedy: i don't know that the senate would broaden the impeachment trial to include

clinton saying nobody liked him. that backfired because i like bernie was trending on twitter. i don't think the comment he made to elizabeth warren hurt him the way she and her campaign were hoping it would so close to the iowa caucuses. but also, impeachment, keeping bernie off the trail, that hasn't hurt either. so i can't imagine what happens to joe biden and elizabeth warren's campaigns if they both lose iowa and new hampshire. how do they have a path forward? >> i think elizabeth warren who is in real danger. if she falls out into fourth place in iowa and doesn't make that 15% threshold where she wins any delegates i think her campaign is the beginning of the end for her. joe biden is a bit of a different situation. he still has support among african-american voters. he has his quote unquote firewall in south carolina. it's going to be an awful long three and a half weeks between february 3 when iowa votes and
