liz: the facts are, there are no inconsistencies to date and what terror read is saying about the sexual assault allegations against joe biden. your reaction to the interview? >> my reactions are simple, not about whether he did or didn't do it, it's a breathtaking hypocritical double standard in the kavanaugh manner because of political toxic city and the perception that brett kavanaugh would be the swing vote to the roe v. wade. and that will happen in the first week and that never did. let's get them back on to ask them why they said that. in kavanaugh, they said victims must be believed, today what they did, they took out the semantic toolbox and they change that to victims have to be heard. but the point i am making, they're twisting themselves into semantic pretzels because her humiliated and embarrassed. enter by the idea that they said

everybody must believe willy-nilly, case closed, that goes against everything i learned as a lawyer in the last 35 years. liz: by the way tara reid is saying now, basically the democrats have just totally marginalized, she's a democrat, she feels totally betrayed, five women have stepped -- backup, five people have stepped forward to a greater story, many of them contemporaneously. several women have accused biden of misconduct and inappropriate behavior. she's asking them why is it real for doctor to accused brett kavanaugh but not for tara reid. biden is saying to the right to comported but the allegations are not true. it was a bizarre interview reaction coming in, he looks like he is bullying and he also brought up, you cannot bring up his papers that are held at the university of delaware because

their speeches in there and he mentioned putin. it just derailed rapidly. your reaction. >> my reaction is you cannot work both sides of the semantic of using the word semantic, but that's a toolbox of a lawyer. and you cannot turn around after the again, broken record, hysterically screamed in everybody's faces that most people be believed and credited the harvard law graduates in congress saying she's to be believed, believed, not heard and now they're embarrassed because this is doubled back in their face like a tsunami in 18 well truck. it is what it is and they will have to deal with this. the point is, soever it is clear where i stand and everybody knows, everybody is entitled to due process 2800 day in court cross-examination et cetera et cetera.

here is michigan, now on the leading edge of the reopen debate, hundreds of people including armed protesters carrying guns, they really got michigan's capital building in lansing to in the states lockdown, your reaction to the protest, people are saying why bring guns, this is not about gun rights, people are scared, upset, losing their jobs, their worry, what your reaction. >> my reaction is like every other american, i've been home here for the better part of seven weeks and we see americane president and said you can i'm not the solution be worse than what the problem is. people want to get back to work and provide for their families, we need to do so in a responsible manner. i think these governors need to understand that you have to give people the opportunity to have personal responsibility and start opening up the state again so they can provide for their families because we cannot just have a system where you have a potentially catching a pandemic or virus and that's a terrible tragedy particular in a high

risk category but what is much worse, they cannot provide for your family, you lose your home or your job or you can feed your family that's a much worse crisis than catching a pandemic. liz: people are really scared. here's what's going on michigan republican led state voted to sue the executive orders. she has said she does not need legislative authorization, she has a new 28 day on her extension of her emergency orders and critics are saying they are confusing, their aggressive bans on gardening, landscaping, golfing, boating, construction even things like buying paint or carpet or flooring. it feels very arbitrary. a reaction. >> look, how about this for an

idea, how bout as the government closes all the businesses, the small businesses getting decimated, however, the government employee stop getting paid, however, the governor does not get paid, how about the legislators don't get paid. let me tell you if that was the case these guys would come up with a solution and be opening the state as quick as possible because the one thing that they no is that their own pocketbooks are not being affected by it. this notion that you cannot go out and garden in your own yard is so preposterous it's antithetical to what america -. liz: he is also what's going on. today we announced 30 million people have lost their jobs over the last six weeks, now we have at least 35 states movie to relax its restrictions. there is growing anger that governors are deciding which is an essential business, which isn't, liquor stores are essential businesses in new york but not retail stores, that's was going on. so macy says it will reopen about 16 stores around the country, we know there's a slow move to reopen but i'm not sure americans out there really understand the pain and anguish in various states that have arbitrary bands and lockdowns on

certain activities. they understand yes the need for social distancing, we know michigan is in the top three of the hardest hit states, their sane local governments are doing locally. watch that, what is your take. >> this is a government picking winners and losers, there deciding which businesses can't survive and which ones can pray that's not what the market way is supposed to be about. what we need to do is have a level playing field, if you want to get a tattoo or go to a sitdown restaurant, you have to drive to georgia. i praise those governors particular in the midwest and the west who says one size does not fit all, were not going to close our stay, they look in a basket south dakota and iowa, those governors held back and said we have no reason to completely close our state and their economies have not been decimated like some other plac places. liz: but there has been a pushback, why bring guns. why not have a nonviolent

peaceful protest because that's a very powerful way to do it. nonviolent and peaceful. >> i agree with you, she was a supporter of the second amendment, guns are not there to be used. it is their civil right, the right under the constitution to keep and bear arms, we should all be afraid about. we've been a society that had to use gun since our inception since 1776 when we fought for our freedoms, guns were part of that. >> i understand, i understand that. this is not a fight about gun rights, we understand that, we understand the message that you're sending, that's what critics are pushing back on, should it be nonviolent, peaceful, why do you have to come armed, people say they don't like that but they understand absolutely 100% with the protesters are saying go ahead. >> the protesters, want to make their point and they know by bringing weapons, the get additional media attention and these people feel like their livelihoods are being taken away from them that the government is stepping on them unfairly and

investigate crimes not because 70 loses their jobs, that is their motive here. this is a horrible situation and you have to remember that an indictment in federal court is going to cost the subject over a million dollars, who has that kind of money, then either on top of that they're threatening to indict his son. you have to understand why he's intimidated and pleaded guilty to a crime he never committed. the fbi agents on the interview said he did not lie. he told the truth, how do we get there. i think we know how he got there. the bureau pushed it and by the way this is not an fbi case, this was a james comey case. they do not let the fbi pursue this case. liz: generally fourth said they were going to close investigation into flynn but peter strzok intervened and told flynn case agent to keep it open

don't close it because senior leadership, the seventh floor wanted to stay open and the fbi was saying listen there is no derogatory proof that he is for the pro. then the next day, they keep the flynn case open then the next day january 5 he briefs president obama and joe biden and other officials about his plan to talk to trump about the debunked steele dossier truck tower in manhattan and then they set up a plan to give flynn a pretense on the briefing on russia. the documents show that william present is to be and on this. what's our goal here truth or mission to get him to life so we can prosecute him or get him fired, those are direct quotes. your reaction? >> again they're supposed to investigate crimes, not create

the white house and did not tell the white house counsel office about it and he admitted he did not follow protocol and that he could get away with doing that saying it was not something that i probably wouldn't have done or maybe got away with in a more organized demonstration. your take on that. >> first of all it's interesting that these people recorded criminal activity. those notes and go back to the original text messaging, i think it records a criminal conspiracy, it's almost like they're trying to do a here. it is outrageous to me becaus because -- not the fbi but james comey would use his color of office to divine only general flynn but anybody involved of the constitutional rights for those called constitutional tort and the remedy is frankly civil litigation and they can be sued for that but more importantly the color of office is a civil rights violation and that's criminal. i think they start with that and let's see what happens.

liz: final word on this, i want your reaction to this, chuck grassley is saying throw the book at these guys. he saying hold them accountable because james comey later said that the fbi saw nothing that led them to believe that flynn was lying and he did not believe d.o.j. would even charge flynn. do you think they should throw the book at him? >> i think exactly, i think he is right, i actually know him and this is criminal in my view. it's the most egregious thing i've ever heard of anybody doing under the color of office, to go after, is not just the fact that general flynn is a general, he's a person, u.s. citizen and i think the fact that they went after him like this and i think they tried to trap him and i don't think there's a perjury. i would like to see this whole case thrown out and then i would like to see a pardon if that does not work. it's egregious and we need a

community get definitive on how this started, that's a big deal. but it is unquestionable that china lied about it and still is. i think wipe it out $2 trillion worth of debt with china will be a long wait and going with this. i do not think we've got military options that we should be using, i think this is a financial deal that we should do. liz: then there's concerns a president said that would hit the u.s. dollar if you do that. >> there's a lot of smart people in economics than me in this previous probably, they're probably trying to do a deal with china, the problem is you're out of options. and financial is seems to be in better control of that and for example private citizens trying to sue china, that was dry with saudi arabia 9/11, it does not work great well, takes an awful long time and i don't see it happening with china, we as u.s. government have the ability to get that done and make china pay for it. they need to as a minimum for

like they seized mike from flynn's files and government records and logs and text messages and e-mails. and then tried to use those to trap him to get him confused so he said i thought that phone call happened on tuesday night and it really happened on wednesday morning, they could say that's a lie, that's perjury, will charge her with a crime. so i think they did a lot of the same things to him they did with me which is perjury traps, got two questions and in his case they attempted to blackmail him. they said they would charge her son with a crime unless flynn pleaded guilty. they knew flynn pleaded guilty to a crime he did not commit. liz: instead of investigating a crime, the shalala manufacturing create and cookout crimes to railroad people to get them. do think they were trying to go after trump and chuck grassley said throw the book at them. do think john durham is going to go after them. >> i think he will.

>> flynn is collateral damage and i was collateral damage, they did not care about us they wanted trump. and they wanted to go after flynn, blackmail full and so he would turn on trump and maybe make stuff up about him. they did the same thing to me, they implied that they let me off if i pleaded guilty to a crime i did not commit or if i implicated in this case flynn and trump himself in crimes that they did not commit. that was the game but in flynn's case there were two other things going on. flynn made it pretty clear he wanted a reorganization of the intelligence committee and the trump administration. he had been head of the intelligence agency of the obama administration made significant reforms, streamlined and ruffled a lot of feathers. he was intending to do the same thing with the 16 agencies of

the intelligence committee. to a certain extent with the fbi and justice department did and probably the cia, get rid of him before he can go after them. secondly i don't think this is gotten enough attention. years before the trump administration, woman accused andrew mccabe, justice department, fbi andrew mccabe of sexual harassment. and flynn endorses woman, he supported her claim and i don't know whatever happened to that claim, maybe a disappeared or maybe it's still there. andrew mccabe had a real vendetta against flynn because of the sexual-harassment against mccabe. liz: we never heard that and that should be given a careful vetting. that's important what you just said. so what kind of crimes were they trying to get you to implicat implicate -- >> let me give you an example. they kept trump must to give you
