with me. she has to stay home while we work on vaccines and treatments. it is not one size fits all. i believe arizonans will make good choices for themselves and that is a model for the rest of the country. elizabeth: we have two dozen states, 20, two dozen states where cases are going down. seven states are plateauing. president is headed toe a ford factory in michigan. it is repurposed to make ventilators and ppe. senator, we want your take, switch to what is going on in washington, senator john kennedy, a lot of democrats are angry with house democrats and 3 trillion-dollar aid package. here is why it is hitting a wall. it has nothing to do with creating jobs. listen to senator kennedy. >> republicans have treed to see things from the speaker's point

of view. we can't get our heads up our rear ends. any fair-minded american would agree once they read the bill. elizabeth: so it was federalize elections, rewrite immigration laws. i think it has more mentions about marijuana as newt gingrich says than about jobs t would let federal prisoners go free during the covid-19 outbreak. are you seeing all of this too? what are you seeing? >> the 1800 pages were a lot in there. i was going to mention cannabis more than it does about job. what we're looking at it, when i'm back in arizona we need to focus on beat the disease and the virus while continuing to invest in vaccines and treatments and pp. also what will get the economy going again. it needs to be solely focused on that. we had a great economy beforehand. i visited with a waitress friend, with special needs kid, they need support they don't fall into health issues. there are people like that all

over the country. why don't we work together. we did before. there were some delays in order to really focus on as americans getting the economy going again and indsent advising jobs while we fight this virus. elizabeth: interesting when you say work together again because 14 democrats are saying we don't even like what the house democrat bill is. even top democrat rahm emanuel, saying democrats, please stop with the resistance attitude, resistance stance, start working with each other. listen to rahm emanuel here. >> on democratic side messaging, we look too much about resistance, about reopening, too much about reluctance about reopening. we should go to a message of rebuild -- we want to talk about rebuilding america in the relief. america never lost a challenge by investing in america and americans. that should become the democratic mantra. elizabeth: you know, senator, you're seeing, to what you just

said and what rahm emanuel is saying, you're seeing protests in states you wouldn't have seen protests before. we're talking new england, in new hampshire, maine, massachusetts. we're seeing protests in you know democrat-run california about this they don't like what is going on with the shutdown orders. >> well, you've got career political operatives who all they're focused on messaging. i'm not focused on messaging. i'm focused on action. there are people in my state who haven't seen a paycheck for two months. they were living paycheck to paycheck. through the cares act we got help through stimulus checks and enhanced unemployment and ppe. now what else we need to do insure small businesses survive. i introduced legislation last week allows ppe loans to include investment in ppe to be forgiven. if they use masks, gloves, other things they got to buy, that is thoughtful legislation that should be bipartisan to help small businesses get through. chuck and nancy and their allies

are just showing at that they ae playing political games. it is not about about messaging not action to help americans. elizabeth: on the local level people on the ground have to deal with top down orders, county sheriffs in michigan saying we'll not force democrat governors shut-down orders. here in new york city, bill de blasio says we'll pull people out of ocean this memorial day weekend. central valley california says we'll be a sanctuary city, a way to protect people from shutdown orders. you have states like michigan, oregon, pennsylvania yanking licenses from businesses. final thing i would like to talk to you about is this, what is happening in illinois. the sheriffs in illinois are really angry, because the democrat governor, jb pritzker, if you don't go along with my shutdown order i will pull back federal funding from cities and towns. sheriffs there, senator, you will hurt the cops. you will hurt first-responders.

today, i don't expect mr. durham's work will lead to a criminal investigation of either man. our concern over potential criminality is focused on others. >> i have no doubt that they were involved in this hoax, one of the worst things ever to befall this country in terms of political scandal. i have absolutely no doubt that obama and biden were involved and, as to whether or not it was criminal i would think it would be very serious but i'm going to let the attorney general make all of those decisions. elizabeth: your reaction? >> well, just because ag barr says there is not going to be any prosecution or, they're not going to pursue action against president obama, vice president biden, doesn't mean we can't get to the bottom of what president obama knew and vice president

biden knew of the investigation. we know james comey had his band of never-trumpers at the top echelons of the fbi by we know they were spying on the trump organization when he was the nominee for president. that is who i am really focused on with the durham report. i simply want to know who knew what and when. we knew, we know that the top echelons of the fbi failed to give sensitive briefings to the trump organization during that election. and they went on a fishing expedition with general flynn to try to catch him in a lie or get dirt on him to get him fired. we know that much. i'm eagerly awaiting the durham report. elizabeth: switching gears, we would like your take on president trump firing back at obama. obama used a graduation speech to 18 and another one to 22-year-olds over the weekend to criticize the trump administration response to the pandemic, saying a lot of them

are not even pretending to be in charge. here is the president's take on that, watch. >> look, he was an incompetent president. that is all i can say, grossly incompetent. thank you. elizabeth: congressman, your take on this fight? >> i think president obama is trying to do two things, one he is trying to deflect. it was president obama who let the strategic national stockpile dwindle to sometimes less than a month's supply of what we needed. it was president obama who under his watch we had tens of thousands of factories moving to china, weakening not only our economy but also weakening our ability to manufacture what we need here. so president obama is trying to deflect. on the political side he is very concerned that president trump is going to win again. president trump beat his secretary of state. of course hillary clinton and president trump will beat his vice president, joe biden, who coincidentally is staying in a basement and doing nothing. he is letting barack obama fight

this fight for him. elizabeth: you know, what's interesting too is, you know, the democrats are attacking the trump administration here in the u.s. over the covid response but they're silent on what is going on with china as over 110 countries now support a probe into the covid-19 outbreak in china. they want to look how china's potential coverup and delays, blew this up into global pandemic that killed hundreds of thousands. russia, india, the entire eu, all 27 countries say china blindsided the world but nancy pelosi and democrats are saying, questioning china is here quote, a diversion. what is your reaction to this story? >> this is not a diversion at all. we want to, i'm speaking about the world, house republicans and senate republicans we want to investigate china. we want to investigate the world health organization but the

♪. the. elizabeth: push back is now on. after three years of trump russia in the media, now democrats in the media are saying, let's dial it back on looking into the origins of the trump russia probe. obama officials who also were accused of unmasking the names of incoming trump officials in the transition including michael flynn, they're also now pushing back hard saying along with the media that this is all right-wing conspiracy. obama officials were merely doing their duty to see who was talking to russians in the trump transition. the problem is, it was perfectly fine for the nsa incoming advisor michael flynn to talk to russians. but here's the thing. what the media and democrats are not talking about what is wrong with the trump russia probe to begin with. leaking names to the media trying toe convict people like -- to convict people like michael flynn and others on the trump team. let's talk to robert ray. good to have you on, sir.

senator schumer this is conspiracy talk. democrats say administration trying to distract from covid-19 when you see this what is your take what is your thinking on that? >> at minimum it is a political scandal. while the news today is attorney general will not open up a criminal investigation targeting former president obama or former vice president biden for obvious reasons unless they're was a compelling reason to do so, it cannot happen in the current environment, which is the appropriate thing unless a personal action by the attorney general but you know, what remains of course, liz, is the fact that there are a number of people present when the criminal investigation was initiated, all the way into highest reaches of the obama white house. what was left unsaid by the attorney general, the investigation proceeds against them. you're talking about clapper and

brennan and susan rice, and sally yates and james comey, a number of people and what i would look for during the course of the during ram investigation is to see just as you have suggested, first, whether people can be held criminally accountable for having leaked to the media the fact that flynn was under investigation, and second, take a look at anybody who filed an affidavit or made a statement under oath to congress about whether or not there is the potential for perjury charges on that basis to the extent that they knowingly did not tell the truth. of course we still have what remains of the fisa abuse process and the u.s. attorney, mr. durham, has responsibility for that as well. that is not to suggest that there is a criminal investigation won't yield results. it may well yield results and it may yield results with regard to holding those accountable who were present during those meetings in the oval office

during the obama administration to initiate an untoward and improper investigation into the next administration by way of lieutenant-general flynn. elizabeth: yes. abuse of power. this is over, umbrella, overarching theme of it. those officials -- >> -- to americans whether or not they can bring felony charges. i would also look for congress, specifically, senator graham, to hold hearings. if there is not going to be a criminal investigation with regard to the former president and the former vice president, there certainly should be hearings to find out you know who said what to whom, and when, under what circumstances. all of which seems largely within congresses purview. elizabeth: you know, last week joe biden denied knowing, he first denied knowing about the flynn investigation. then he admitted knowing about it.

finally he ended the week again denying knowing. but you know, here's the thing, joe biden sure knew what unmasking meant when back in 2005 joe biden said, yes, unmasking is wrong. revealing the identities of individuals in intelligence documents, he saud it is wrong. he called it quote spying, when john bolton got names of 19 americans companies unmatchinged revealed to the intelligence community. watch this. >> there is assertions made by some privately, to members of the senate, and staff members about the senate, that mr. bolton was seeking names of these individuals for purposes of his intramural fights that were going on within the administration, about the direction of american foreign policy. it has been alleged, as i said that mr. bolton has been spying on rivals within the bureaucracy both inferior, and superior to

him. elizabeth: so you see that intramural fights, intramural political fights, joe biden said, and he called it spying. here's the thing, ag barr and ambassadors, also people like mark thyssen of "the washington post" said it is legal, totally legal for incoming official the like michael flynn to talk to foreign diplomats. he is incoming nsa. these send said in his column in watch poe, whoever leaked this michael. er 39 people got his name. they were not intelligence officials. they were political officials at treasury, at the justice department, at nato, at the energy department. when you saw that what was your reaction to the level of individuals getting his name unmasked? >> my reaction liz, was, this

should be bipartisan consensus here. unfortunately i guess we won't have it but we should, look for rand paul to try to do something about this, this is the danger of counterintelligence when people with political motives act in order to damage political rivals, of a political administration of an opposing party. that is what is dangerous about this. they really ought to focus and keep our eye on that ball. that should never have happened. we need to stop it from happening in the future. elizabeth: robert, stay on that for a second because the media is now saying of course it is okay to unmask if you're talking to foreign individuals, people of foreign governments, 18,000 of that unmasking requests happened under the trump administration, 2018. that is not the point. the point is you unmask individual if you're doing it for political reasons. media also is saying this is about russian interference, russian interference.

it is not a hoax. again a distraction. this is about abuse of power under the obama administration to target individuals for political reasons, to undercut the president and his incoming team. is that how you see it? >> i do and worse than that, it also a violation of the fourth amendment. we should not be intercepting even on an incidental basis the conversations of american citizens unless you go to a judge to get a wanter to do it. that -- warrant to do this. that is why the process is so dangerous. we ought to focus on what senator rand paul is doing in terms of trying to make a correction. elizabeth: robert ray, great to have you in. come back soon. >> thanks, liz. elizabeth: just ahead, we're going to stay, we're going to stay on this story about republicans saying the media is being misleading pushing back on republicans and john durham and ag barr probing what weren't wrong with the trump russia probe and abuse of the power there. the republicans now saying that the media is not digging harder into these abuses of power under the obama administration.

biggest scandal of our time. media is trying to claim president trump is using this as distraction from the coronavirus. that is not the case. every american is following news on that. a potential abuse of power that occurred here, that the media is derelict in their duty not investigating, frankly refusing to cover, writing it off as a conspiracy theory. elizabeth: yeah. the democrats funded hillary clinton's dnc, funded the steele dossier. it gets fed into the fbi. the fbi launches the trump russia probe. chris tear steele's own sources say he embellishes. take it with a grain of salt. a lot of stuff is hearsay, not good information. the case is starting to fall apart. then they target michael flynn. they set up a potential perjury trap for him. don't read him his miranda rights. doesn't have a lawyer at the white house interview. they circumvent the white house general counsel. even fbi officials who

interviewed him. he didn't mislead us. he could recollect things. he was not lying. initial 302 form disappears and gets he edited by peter strzok and -- watch this exchange between cnn's jake tapper, and ron johnson. you would think we're in two different worlds, watch this. >> there were selective leaks that wrapped up this entire russian collusion hoax, it was a hoax and who is the recipient of these leaks. >> i don't know what you call a hoax. >> 18 different outlets. what i would love to see, i would like to see members of the press actually start looking into all these leaks and how this story got spun up, the resulting in a special counsel put this country through three years of a mini constitutional crisis. that is what i would like to see. >> senator is not a hoax that the russians attempted to interfere in the 2016

legislation. >> you know that, it is not a hoax. >> they put russian disinformation into the steele dossier. elizabeth: sorry, can anybody at cnn or any other network quote anybody who said russian interference is a hoax when they are talking about the trump russia collusion idea, it was found to be not the case by the mueller report? there was no, so you see what is happening here? bipartisan senate report says yes there was russian meddling. that is self-evident. that is understood but this story is about something much, much more. this is about abuses of power. your reaction? >> right. these are two completely different stories. if you want to see how hypocritical the media has been covering it, look at coverage of so-called russia-gate. part of the reason i think it is unfortunate that what is going on now is being called "obamagate" because i think americans are reaching investigative fatigue.

from the w.h.o., but reality, when the u.s. started to criticize the w.h.o., demand transparency, a lot of people stood up to demand cover and likewise. that is where we are today. china is very interesting. the china wants the world health organization to investigate itself that would mean a whitewash for china. the dividing line, u.s. and others say look, we want this to be an independent investigation of the w.h.o. elizabeth: yeah. japan is saying do an independent investigation. you know, it is now even russia, russia is now saying yes, probe the origins of the pandemic starting in china. all 27 countries in the eu say do it. canada, japan, indonesia, new zealand say probe. why democrats silence on it? they say talking about this is just a distraction? >> obviously not a distraction.

great powers, russia, china, they're vying for influence as international organization and trying to use them not to get their views of international norms, but push international norms aside so essentially they can achieve the policies that they want. we have a bold demonstration of this in the w.h.o., the china essential using the organization to advance china's interests. there were international health regulations that were passed after china failed to meet its obligation during the sars pandemic. if china had followed those guidelines for this, countries would have had weeks, maybe months warning but they violated it because it wasn't, china didn't perceive it in their interest. so the big dividing line here is between countries that want, yeah. to want to have china investigate it and then some just want the wto investigate it. elizabeth: w.h.o. >> yeah, right. >> here is the push behind the scenes. that is okay. it is about who was going to be

the medical superpower. it is about laboratories around the world trying to dominate drugs, trying to dominate vaccine research. vaccine research is really dangerous. cold spring harbor laboratory has a study out there, not peer reviewed yet, mit and harvard support it, you know what, media? don't rule out yet this covid-19 virus did in fact break out of a laboratory. don't discount that story yet t could have happened. that is what is going on. dangerous safety standards at these laboratories doing this vaccine research. the president is now saying the w.h.o. is basically problematic here as you're pointing out colonel. he is agreeing to fund the w.h.o. now but only up to what china is paying annually. let's listen to this. >> china paid $40 million last year and we've been paying $450 million a year for many
