13%. the economy is bouncing back, let's welcome our next guest mark bittner. great to have you on the program, nobody expected this number. where did it come from, larry kudlow said april was tough, may is going to be bad too, the recovery is coming but it's going to be slow. >> i think most of us thought in june, certainly by july we would see employment gains and the reason why economists were so far off, they were looking at the weekly jobless points, usually provide a pretty good idea of what the employment numbers are going to do, those numbers have come down there still ten times higher than they were prior to the covert outbreak. where the improvement was visible and we know this going forward is surveys. even at the psa we see the majors which actually give us datdata on a daily b unit under basis and a bottom out around the middle of april and has been

improving every cent. >> economic activity has been improving and yes some people are getting back to work but it's like every state has its own timeline in its own plan on how hard it was hit depending on dave's civil rest at this particular time. somebody suggested earlier today that part of this has to do with how the paycheck protection program was run, more loans were secured last month and you have businesses paying employees, keeping them on the payroll rather than taking them off and having them file jobless claims. >> that probably helped, we saw the largest game was in restaurants. and certainly the payroll protection program was popular with a lot of owners in restaurants and that might've allowed folks to hire folks sooner but that is exactly what the program was designed for. and the fact that it worked should be celebrated. but i really do think that what this comes down to, it really

deals with what the president said about the strong foundati foundation, there was not anything that was fundamentally broken in the u.s. economy before we had the coronavirus outbreak and because there was nothing fundamentally broken, once the fever broke the economy is recovering. jackie: this was really truly an event that nobody could control. >> that's a point that we wanted. they're not the ones that we wanted. jackie: you look at the industries rebounding, just a month ago, six weeks ago when we talked about the pandemic and the coronavirus people were saying i don't know i want to get on a plane or sit in a restaurant, i was one of those people and it's interesting to see the airlines coming back in the hospitality coming back, people are being tired of being locked down. >> but we have a long way to go. we still lost jobs in the airlines and hotels in the month of may and they've only inched up a little bit in airline and

the people going through tsa checkpoint is about down 87% from a year ago. i guess if you're an optimist, that's more improvement that we have in front of us. i think we will see larger employment numbers in the month to come. one of the interesting steps, a lot of doctors offices and dentist offices were shut down and 10% with employment incurred and dentist offices and that only brings back about one third of the folks who lost their jobs because of the offices had to shut down. >> let's talk about paul for a second and his suggestion that the trump administration is in charged, perhaps these numbers were falsified by the labor statistics, can you respond to that. >> paul is a brilliant economist but when it comes to politics he goes off the rails a little bit. in terms of whether the bls did something, the folks that work there are career government

workers, they will not monkey around with the data one way or another, i never have doubts and i've never doubted at all that the data is clean and they don't think they would be inclined to help donald trump because federal government workers typically lean very heavily toward the democratic party not toward the republican party. jackie: was say what you want about president trump in your feelings about him particularly aside but to target the bls seems a little bit -- >> it would call into question the integrity of all of our data if we did that. everybody who works there knows that. but the way that they are put together no one person has that much control, there is a great deal of security that goes into putting these numbers together.

jackie: the latest push by activist asked for the killing of george floyd a call to defund police departments across the nation and some local authorities are moving in that direction in new york city more than 40 city councilmembers are calling to cut a billion dollars from the new york police department 6 billion-dollar budget in los angeles mayor eric garcetti is already announced

$100 million cut to the lapd proposed budget for next year after activist protested outside of his house, let's bring in pennsylvania congressman guy reschenthaler to discuss this. obviously, there is a lot going on, there is a lot of different actors here when it comes to the wake of george floyd's death and nobody is saying what happened in that specific instance was in any way shape or form acceptable and the consequences have to be sought for that. but having said that, do you throw the baby out with the bathwater and say let's defund the police? >> they stand for having me on, i appreciate it. defending the police is the exact opposite of what we should be doing, we should increase police funding and here's why, we need to make sure they have money to train properly. we need to make sure they have money to have mental health care, police are more likely to die by suicide than in the line

of duty and they need money for mental health care, suicide prevention, ptsd treatment and training that the deaths occurred and never happens again. that's how we would really honor george floyd's memory through that. defending the police is reckless, dangerous and frankly i cannot believe how far left the democrat party has moved and they're not only talking about doing this but like you said and ellie in newark they taken steps to do just that in the sad iro irony, this is going to hurt the communities because when you don't have policing these communities and crime rates are going to skyrocket and really hurt these communities acting deputy secretary was on with liz last night, he addressed this issue. i want you to listen. >> you're not protesting when you're being violent and a criminal in the first job of government as public safety, whether it's local, state or federal, president trump has

subtitle in the democrat mayor in the democrat governor was reckless, their curfews treating their citizens like they were in middle school, at the same time they didn't enforce a fuse on the protesters and i want to say the violent protesters, those from antifa and the anarchist. jackie: the folks coming out at night, not the people protesting making a statement about social justice right now. >> yes. there is three different things going on here. we have the peaceful protesters with our compassion and empathy and the right to protest your vows to group the anarchists and antifa are coming in and getting violent. and you have another group that are the looters taken advantage of the situation in the chaos to steal personal property and engage in vandalism and et cetera. what is so sad, the rioters and those engaged in looting are dragging out the message of the peaceful protesters who want justice for george floyd.

so that's what's going on right now. you cannot have this lawlessness going on or the anarchy going on, you have to be a country of laws. jackie: i only have 30 seconds for this, you have a lot of people in office as well, california, new york saying were not going to take campaign donation from police officers or from anybody associated with the police anymore. they are taking a stand so they know where they stand on this issue. your thoughts on that. >> is a complete stop in the face, they risk their lives ever to go david on the job. they sign up for these jobs because they want to make their community safe in turn around and snub them like this is insulting. they should be held in high regard because the vast majority of them are only doing what they're doing to help the communities and promote safety. jackie: congressman great to see you, thank you so much.

jackie: welcome back i'm jackie deangelis in for elizabeth macdonald. so far 33 former top obama officials are now facing potential subpoenas from the senate homeland security and governmental affairs committee and the probe into the russia investigation in the unmasking of michael flynn. let's bring in michael flynn's attorney sidney powell, she is on the phone. i just want to back up for a second because i was reading the

brief that judge sullivan submitted, i have it right here and basically what judge sullivan is saying at this point the justice department wants to drop the case, i don't think we should drop it, as a matter fact i think somebody else should take over and look into the review the case and asked the question if flynn should face contempt charges paid as they read the brief, it was missing a lot of information on why the justice department was inclined to do that. your thoughts. >> exactly. they create their own field of dreams and completely leave out all the exculpatory evidence in the independent reviews done by a career department of justice and fbi agent, mr. jensen, the current u.s. attorney in missouri. he spent ten years in the fbi in ten years as a federal prosecutor before he became the u.s. attorney that attorney general barr assigned the

government's own files for information that was never produced to the defense as their obligation under the constitution to produce evidence. anything that will take the defendant or the government case. that's what he did and that's what the attached, their brief was 20 pages and attached another 80 pages or so documents that showed general flynn should never have been investigated, they had no basis whatsoever to investigate so then the call transcripts came out reflecting the conversation with ambassador kislyak to show they had no reason to investigate him because the calls were appropriate in every sense of the word for the member of the presidential transition team in their cold case was made up. >> logically speaking, when you find that the calls are appropriate even if the evidence came to light later, wouldn't

you allow the justice department to drop its case because we know the prosecutor are never going to take a case forward and they know they cannot win? >> there's two key provisions of the constitution itself that prohibit judge sullivan from doing what he's done, he cannot go out and create his own controversy when the party has agreed to dismiss it and only the executive branch and the department of justice has the right to bring charges in, he does not have contempt power over the issue to pursue an attempt investigation on. jackie: when it comes to michael flynn and your client, he says basically him summarizing, he was co-hearst into giving a false confession, that does happen right? >> yes it happens a lot, the national database of exoneration has the names of hundreds and hundreds of people on it who entered pleas of guilty and were

later exonerated and by the way even the law recognizes that a plea of guilty is not a confession. jackie: what about the other players that are now associated with this. former president obama, vice president biden, we talked about jim comey, you have the susan wright e-mail of whatever might've transpired in the oval office. this might be larger than we ever thought. >> i think it is larger than most people thought unfortunately. it is going to get worse the more john durham investigates and finds additional evidence. i think that's why the country is turned upside down right now frankly, i think it has a lot more to do with going on behind the scenes than what they're claiming it is. jackie: what has it been for you and your client. >> we have an oral argument a week from today, we will have

understandable in their well within their right to do it, but then at night you saw the pictures of washington, d.c., minneapolis, los angeles, here in new york city when the violence starts to occur, how do you reconcile those two, they're not the same groups. >> they're not even of the same world, there's no doubt that george floyd deserves justice, i am thankful for folks who are protesting in the vein of john lewis because of his peaceful demonstrations led to social transformation that our country embraced and thankfully were doing better because of it, look at the violent agitators, they should not be considered in the same conversation with the peaceful protesters, peaceful protesters are selfless, violent agitators are selfish, they're taking all the focus in putting on themselves and frankly the best i've seen lately are peaceful protesters and police officers forming a line to protect businesses, that is what

america is about that's what makes america great, when people come together who may have some tension even in work together for a better outcome that the violent protesters, they are getting too much air already, we should suck the oxygen out of that room because it's not a no long-term best interest and honor short-term best interest, it's only a distraction from making progress for americans. jackie: let's talk about george floyd case specifically, all four officers arrested, they will have to answer for what happened that night, the question is is just is going to be served, how does the healing process begin? >> i see the healing process begins, we had experience with that in south carolina after the walter scott murder, myself and congressman trey started bringing african-americans and law enforcement officers together to have a conversation, no cameras, no press, just having conversations, what

ultimately occurred black leaders started doing right along with officers to realize there's no such thing as a normal traffic stop, when police officers and spent time in the african-american community to understand the pains and challenges, when you have lines of communications that are bridged we get better outcomes and frankly one of the things that congressman said and i like to take credit for even though he said it, it's hard to hate up close it's hard to hate what you know, that's a simple step, there is no law that we can pass that says we can figure out how to legislate the heart, that will not happen but what we can do is make significant progress in what were doing now is having a serious conversation about the next steps, things like giving us a preview into what's going on around the country, and give you a example of people in legislation what were working on

>> it looks like cyber chaos. our infrastructure, our state and federal governments, private industry is terribly unprepared. it is really a willed in a money issue. we have the technology to protect your systems, we simply are not words governments like iran and russia and china and north korea had military organizations designed to attack everyone in the world side really and we simply are almost defenseless. this is not democrat republican, this is across the board. >> is is about targeting presidential campaigns or is this about cyber attacks when it comes to things like american infrastructure? >> both. there is an agenda to what they're doing and as you saw four years ago, what if any

votes were change, we do know that voting registration was stolen, anybody in this business for the last 20 years and see the exact same thing, for whatever reason we are unprepared to be in the cyber world and protect ourselves and it has to do again with money and were unwilling to do it and in many cases we don't believe it's happening to us, it's too bad, the other countries are absolutely doing it. >> president trump has tried to acknowledge it when he dealt with difficult issues when it comes to ironic china, at least he drew a red line in the sand and try not to let these countries violate that, having said that, how can he specifically addressed the cyber crime issue, he tried to deal with it when he created the trade deal with china, it's very hard to negotiate on these issues with them.

>> that has to be an awful lot of money spent in a penalty. we know who is doing it and we have to be offensive with her cyber capabilities and were unwilling to do it, the reason because sometimes those governments do not care of any kind of civilians that are hurt in the cyber world. we do and it's hurting us and making governments pay who have done this. we are unwilling politically to do it, it is not just the president talking, the government has to be able to do it and they have not as is industry. jackie: we have an election coming up and were talking about the job numbers in the economy and everything happening right now into candidates that are buying on the same stage, who you would prefer to be in charge leading economic recovery after the pandemic or in the case of cybercrime, who do you think when it comes down to president trump or joe biden is better equipped to take these issues

on. >> in the cyber world, nobody has the role testator, neither the current president or whoever runs against him in this case biden. the democrats were unwilling to do it four years ago and still unwilling. this is expensive, it takes a national effort and it's not about talk, i don't know what else we can do what happened in the last election and what industry is suffering. we are terribly exposed and it takes real national leadership in government organizations and a lot of money to push back against this and up to this moment we have been unwilling to do it republican or democrat. jackie: it will be something whoever is in the white house and next time around will have to take on, you are right, 70 people terrified by this and in the meantime folks are saying they hope there is no interference with presidential campaign as we go into the election. >> you are right. welcome, take care. jackie: thank you.
