has to be the grant of the motion to dismiss. the government is just wasting resources out the wall zoo pursuing this. and the toll is taken on the defendant. liz: remember this case involves the fbi saying there is nothing there, no derogatory evidence against michael flynn as of early june or 2017 and also allegations that the fbi tried to corner michael flynn in a perjury trap. here's what's going on, emmett sullivan scheduled a july 16. next tuesday to hear from both sides, the judge could decide and motion to dismiss by the end of july which could possibly have a new round of appeals. let's welcome to the show in a fox business exclusive justice department woman kerri kupec, your thoughts on this case and what's happening now. >> the arguments are pretty interesting, they lasted two hours, the attorney general

passed the top litigator, jeff wall to argue the case is morning and liz, the bottom line for the justice department is we have the discretion, the authority as part of the executive branch whether we bring a case or forwarded, here are based on what we now know, we have decided it would not be the right thing to do toha move forward with this case and that was a point that you heard repeatedly r this morning. >> kerri, what is the reason for the judge to keep litigating the case because the judge said this is gross misconduct by the justice department and this is only that flynn is getting soft treatment from the d.o.j. and needs alia president trump, what's a reaction there? >> i don't think anyone came too much surprise and considering that he made his use public before judge sullivan decided to bring him in and argue against

the department. andy wrote an op-ed for the washington post into early may expressing his views on the flynn case in the very next day judge silva and appointed him as an outside counsel to argue against that. so no real surprises there as far as what judge thinks or thought in the past and some of the language i found vertically ironic, he used the phrasela highly irregular, he found the conduct in this case by the government highly irregular. i would say i agree on that point in a little bit of a different way, it is highly irregular for a judge to operate as a prosecutor which is happening in the state. it is highly irregular for thehe judge not to grant the department motion to dismiss after a u.s. attorney who spends ten years as a career prosecutor, ten years and fbi reprimanded to the attorney dneral what we now know he does

not believe that anyone over 93 u.s. attorneys in our country would've brought this case. and it's highly irregular to the fbi to spy on american presidential campaign and after closing anft investigation an american citizen decide in an attempt to get them to lie to inactivity an investigation that was already closed. we took quite some time on the highly irregular activity that is accrued in this case from day one. liz: what happened today, judge sullivan has been accused of bias against michael flynn saying he committed treason working for the country of turkey, the federal appeals court judges brought up race, he tried to equate whether dropping the case against flynn is the same as a prosecutor dropping a case against the white police officer, the white police officer should not have to

answer for using excessive force on a black defendant, what is your reaction when you heard that. >> of courts the judge was getting into the heart of the discretion aspect that we as the prosecutors in this case have, jeff wall, the department justice attorney, i thought he made a very important point where v he said it is not just harm to the defendant, it is not just harm to the human being mike flynn at the center of this case that is occurring but it's harm to the way that separation of power in the way our government and judge sullivan could grant our motion to dismiss in this case and by granting that motion, does not mean he agrees with us, it does not mean he is expressing his own opinion, it does not mean he thinks is the right thing to do, he would simply be acknowledging our authority as a prosecutor in the executive branch in this nrticular case because it's our authority to bring cases were dropped cases, not that of the

judiciary. liz: i hear what you're saying is about the constitutional separation of power. i just want to get in to see what is set aside in these discussions on part of the judges and the fbi declassified fbi documents show that the fbi james comey did not have a case against flynn as of late 2016 in the fbi case agent was going to drop it because he did not have derogatory information about the trump russia probe and then peter strzok and others conspired to try to catch flynn in a perjury trap and when flynn was not going to get a g memorandum morning, they talked about that and they basically talked about essentially -- flynn did not have a lawyer present in the fbi interview, there was a lot of irregularities in kerri, final words, joe biden, chief of staff unmask the name of flynn and then got to flynn's phone call with the russian ambassador leaked to the washington post
