"lou dobbs tonight" starts right now. ♪ lou: good evening, everybody. if we begin with another -- we begin with another extraordinary, bizarre twist in the radical dems' and deep state's effort in the persecution of former trump national security adviser general michael flynn. clinton-appointed judge emmett suggest -- sullivan is now demanding the entire for d.c. court of appeals which overruled him, he wants them to rehear the decision from two weeks ago, a decision from that three-judge panel that, well, created an end to flynn's case. calling upon the judge to dismiss the case and move on. judge sullivan refuses to do what his bosses in judicial

terms told him. judge sullivan again proving he's a partisan activist trying to destroy the life of general flynn. and, by the way, not making the judiciary look any better. the d.c. court of appeals doesn't have to take up the judge's request. we'll see what happens. judge sullivan's decision follows a major day at the supreme court, a day of important victories again for president trump. the justices closed out their term by delivering split opinions on two cases concerning the release of president trump's tax returns and financial records. in separate rulings, justices delivered a victory for president trump in blocking the radical dems in congress from having access to the president's financial records. at the same time, the high court also ruled president trump -- nor does any president in their ruling -- have absolute immunity from prosecution, as if that was the issue. and the ruling by the court is

that manhattan's activist, left-wing democrat cy vance, the manhattan district attorney, can have access to those documents and subpoena his tax returns from his accounting official in this instance. a contradictory and, again, extraordinary ruling from a court that has obviously simply if left its moorings. white house press secretary kayleigh mcenany focused on the radical left's coordination with the radical dems, in this case the manhattan d.a., as they work to harass and subvert president trump. >> justice thomas noted that the district attorney for the county of new york, cyrus vance, served a subpoena on the president's personal accounting firm that, quote: was merely identical to a subpoena issued by a congressional committee requesting nearly ten years of the president's financial records. so the partisan attorney, the democrat from the new york, is

aiding and abetting the democrats, lawless democrats like nancy pelosi who have pursued this president with bogus charges of collusion, with bogus charges in the impeachment inquiry and are now pursuing this and assisted by cy vance. lou: president trump today making his displeasure if with those rulings very clear, indeed. >> the rulings were basically sending everything back down to the lower courts and to start all over again. so from a certain point, i'm satisfied. from another point i'm not satisfied because this is a political witch hunt the likes of which nobody's ever seen before. it's a pure witch hunt, it's a hoax. just like the mueller investigation was a hoax that i won, and this is another hoax. this is purely political. lou: the president likes the word "hoax." i prefer the word "overthrow." they're trying to overthrow the president of the united states.

lou: well, the u.s. army says they ma mistake in distributing a handout that labeled the phrase "make america great again" an example of white supremacy. this from the united states army, they made a mistake. the handout invited soldiers and civilian personnel at the army's arsenal in huntsville, alabama, to attend seminars entitled, quote, operation inclusion. i mean, this is outrageous.

after the election. that is criminal. that is just criminal, in my opinion. i want to hear yours. >> yeah, listen, i've seen a lot of activity over the last three or four months showing that they're building a criminal case. i think there's going to be a pretty the baby sort of solution here, and that is that there may be some actions around labor day, a handful of of indictments or a plea bargain that comes out that begins to tell the story. but there is a little bit of a rope-a-dope, and i think sending flares this is going to carry past the election. based on the evidence i'm seeing, witnesses being interviewed, talk, documents changing hands, that there is still the possibility of some indictments, some criminal action in september. and, you know, some of the excuses we hear don't make sense. all right, it was covid, there aren't grand juries. well, a grand jury was able to indict in new york last week.

it can't be that hard to get this done, and lord knows the evidence is standing in public. the case has already been made in public. lou: well, i mean, what we're really hearing from this attorney general and this justice department is that this isn't a priority, to know who tried to overthrow the president of the united states, to hold accountable justice department officials, intense community officials and department and agency leaders within that i.c. and, frankly, how many people in the white house were involved, how many people in the white house were actually controlling spygate and the greatest scandal in this country's pretty if call history. -- political history. i mean, this is as nonsensing call, as you put it, this is nonsensical. ghislaine maxwell is more damn important than getting to the root of a massive political corruption in the federal government? my god, man -- >> yeah.

justice? hasn't happened. lou: the judiciary, do you believe it's as corrupt as every other part of the justice department and the fbi? >> well, listen, i think all of our institutions this used to be apolitical have shown increasing signs of politics whether it's pete strzok's e-mails, judge emmet sullivan's rope-a-dope and not dismissing the case against flynn. you're seeing apolitical agencies dripping with politics, and that's bad for the future of america's democracy. there's no doubt about it. lou: yeah. you know, we've seen a lot of people in the streets here lately. ooh -- i'm thinking it's starting to look like all americans are going to have to get in the street to be taken seriously. it's really asinine to see what we are witnessing with the left-wing media trying to control speech and thought, the left in this country trying to dismember this great nation of ours and people sitting around going, well, what the hell, you know?

built on knew chul respect, i had dinner last night with the president of mexico's chief of staff, a business guy who understands that what's good for america good for the entire region not just for american citizens. and as we had that discussion, it was very eye-opening that it was the president's personal appeal to their, to mexico's president that actually made a big difference. and we talk about border security, we talked about economic prosperity. and ultimately, that's a story that most in the mainstream media would like to ignore. but this president has been not only engaging there, but around the world doing what's best for americans and really keeping an america first policy initiative. lou: yeah. and the left-wing national media doesn't much, mark, like to give this president credit for the usmca which replaced nafta and

through his accounting firm while the congress of the united states cannot, every, you know, every local d.a. in the country could persecute a president, a sitting president. it's mindless. what -- your thoughts. >> well, i can tell you, obviously, we're in a different branch and perhaps not as free to express our personal opinions as you might there -- lou: right. >> but i can say this, this was nothing more than setting up a fishing expedition for every local d.a. across the country. i would call it the presidential harassment decision. if you look at it on its face as they remanded it back to lower courts, hopefully we'll see a little bit different opinion coming out of that. and they did put in a few caveats that would say you can't just harass the president, but you and i both know that that's what congress has been doing, that's how this originated -- lou: that's all that congress has been doing. >> listen, they're not passing

anything that matters to moms and dads or aunts and uncles on main street. what they're really doing about trying to affect the november elections by trying to conduct, quote, oversight that really is more weaponizing the oversight committee, and it's just a shame. lou: so help me out on this, peeking of doing something -- speaking of doing something to mess up the elections again as they did in 2018, now we hear that john durham may not have any charges ready by the end of the summer. and if he doesn't, that he probably wouldn't bring charges at all until after the election which, as i just said to john solomon, i mean, that's just criminal conduct on the part of our justice department. it's -- the justice department led by this president. what the hell is going if on over there? >> well, there's two things, two ways things happen here in washington d.c. that's slow and never.

and i can tell you that, hopefully, on this particular if case it's more a case of being slow and judicious. i can say that we don't have a whole lot of visibility into the timing or what may or may not happen. i do have visibility from my previous job in terms of what john durham a may be reviewing, and i -- it's very, very damning. when we look at the kind of evidence that i've been able to see, the kind of investigation i believe that he is conducting, what we'll ultimately see is justice will prevail. you know, you can't rush these things. but i think for most americans, myself included, i think we should are had justice months and years ago. and for it to be suggested that we may have to wait another year is just, very, very disappointing. lou: absolutely. and frustrating and annoying as hell, if i may say for myself.

good to have you with us. let's start with those carriers in the south china sea. we heard andy biggs, congressman andy biggs say esper may be in the wrong job because we're getting very little press coverage what is happening out there. i suggested that he remind the defense secretary that we have combat photographers in every branch who could be bringing us video and reporting on what's out there. your thoughts? -- on importance. >> obama's secretary of defense ash carter, went out to one much carriers in a exercise just like this, lou, south china sea, he made a speech looking at china from the deck of the carrier with a large number of media photographers there, while he ordered china to obey united nations and the law of the sea. so that is quite a contrast with now, sort of a press blackout. we also see the chinese media

implying that the americans notified china advance of this exercise. now we're not supposed to do that usually. usually we can do an exercise on the high seas without seeking permission or notifying the host government. so if that happened it implies sort of a gesture of goodwill toward the china in the middled of these difficult times. that is very strange, lou. lou: it also implyies, subordination in point of fact preceeding as a supplicant, to see whether or not freedom of navigation can be in fact defended by the united states. if he did that, if the defense department did that, they ought to be fired on the spot because otherwise, what is the point of this exercise if it is not to assert freedom of navigation and to make it very clear that we're going to have a strong presence? this is asinine. this is -- the president

promised smart government. we've got some really dumb people running the defense department in a number of levels, in a number of quarters. do you think i'm wrong? >> well, there is no doubt the chinese media is suggesting to the world we're they're for these exercises with china's permission at their pleasure. that surprised me. they often complain about the a surprise, the americans didn't seek commission. in this case there seems to be notification of to china advance. lou: your thoughts about the effectiveness of the exercises as best you understand what's happening because there is effectively a news -- make this clear for the white house and everyone in government. right now the national left-wing media is a firewall for the radical dems and the deep state. they are keeping as much from the american people as they possibly can all this
