enrich the pensions of teachers, firemen, cops, the working class and the middle class that biden says he wants to help. with us tonight, republican roger marshall on that big fight breaking out all day long. also nancy pelosi and adam schiff still demanding trump's tax returns as the supreme court blocked them yesterday. we've got republican jim jordan, he is fired up. he is going to battle them. of they claim trump's returns will show trump-russia collusion and trump basically trying to profiteer off turkey, saudi arabia and also russia. that fight too. also jee january know caldwell, he is the former positionman for the national organization -- spokesman. he will take on the defund the police push that's now growing in 20 cities. and he will also talk about the new back the badge, back the blue movement supporting cops. that's coming on strong in seven states. and i-january know's going to

take on this new battle breaking out between the republican governor of maryland, larry hogan blasting nancy pelosi for condoning, quote, lawlessness and vandalism after she downplayed rioters knocking down a statue of christopher columbus in her home town of baltimore. the president saying he wants to remove tax-exempt discuss from universities and colleges. plus, a former gubernatorial candidate on yet another media meltdown, another controversy involving cnn's don lemon. cnn's don lemon in hot water again. he said during a debate over ripping down statues of our founding fathers that, quote: jesus christ admittedly was not perfect when he was here on this earth. john cox will take that on. and we've got kt mcfar with an update into the fbi's trump-russia probe.

what is durham focusing in on? kt's with us about that. i'm elizabeth macdonald, "the evening edit" starts right now. ♪ ♪ elizabeth: thanks for joining us. you're watching the fox business network. edward lawrence is with us now, he's in washington. a lot of headlines coming out. president trump was down in florida as well. ward. >> reporter: a lot of headlines. in fact, right now the president is at a fundraiser at the home of the ceo to raise money for his campaign there. the president had earlier u.s. southern command to get a face to face briefing about the flow of illegal trucks crossing the border -- drugs crossing the border. he heard, yes, the coronavirus is affecting the flow of drugs across the southern border here. he says he will make sure the southern command has what it needs to stop the cartels.

at a discussion later about venezuela, the president sounded off against socialism saying a biden presidency would defund the police and push the u.s. in the wrong direction. >> biden is a puppet of bernie sanders, aoc, the militant left, the people that want to rip down statues and monuments to george washington, thomas jefferson, benjamin franklin. jesus, okay? jesus. they want to rip down i statues to jesus. >> reporter: now, before he left florida the president talked about roger stone. he was in court today trying to delay the start date of his prison sentences. now, the president indicated that a pardon or commutation of his sentence could be on the table. listen to this. >> i'll be looking at it. i think roger stone was very unfairly treated, as were many people. and in the meantime, comey and all these guys are walking around including biden and obama. because we caught them spying on

my campaign. >> reporter: and clearly upset about the russia investigation, also within the last hour the u.s. trade representative's office announced they would impose 25% tariffs on french items, talking about handbags and cosmetics, because france is going to impose tariffs or taxes on the digital tax on our big tech companies, talking about apple, microsoft. a 3% tax that france wants to impose. the imposition of our tariffs will not happen until january 6th of 2023 to try and -- 2021 is, but the ustr is announcing that is going to happen in 2021. back to you, liz. elizabeth elizabeth edward, thank you so much. i've got a follow-up question. edward, what did the president say about the phase two of the china trade deal? there was news about thatted today, edward, right? >> reporter: exactly.

and that's one of the things on air force one, he came back and talked to reporters about this. he a said that the relationship between the u.s. and china is severely damaged because of the coronavirus. the president believes that china let that virus spread around the world. he says that he's got too many things on his mind to even think about a phase two with china. so right now negotiating a phase two trade deal with china on hold. elizabeth: okay. edward lawrence, thank you so much. we really appreciate it. thank you for your reporting. oh, wait, sorry, forgive me. we're waiting for a guest to come join us. edward, we also had breaking news, i'm sorry to keep you, because we've got breaking news coming out of house democrat alyssa not kin out of michigan, she's a former cia analyst. she's now warning, warning democrats that the polls showing biden is in the lead beating donald trump are inaccurate because they are undercounting trump voters. that's raising eyebrows in the

d.c. media beltway, also in washington. democrats are sitting up and taking notice to what she's saying about the polls being inaccurate. go ahead, edward. >> reporter: and, liz, if you remember back in 2016 during that presidential election, the polls showed hillary clinton with a slight lead over president donald trump and again after the election the monday morning quarterback was that the polls missed the voters in the middle of america, the rural voters, they missed the trump voters who came out in droves. and that's something that possibly she's pointing to could happen in the next cycle, in this cycle coming around. so very interesting that you're starting to hear that from a democrat who may be a little concerned about their candidate coming forward. plus he has not selected a vice president yet. some of the names are sort of babbling to the top of that, kamala harris, trying to put a boost to his, give life basically to his candidacy here. but, again, the president is the one who's going out now starting

to do these rallies. the rally in new hampshire for tomorrow was canceled because of tropical storm fay, but the president is starting to get out there. you're seeing him in florida, in some of these other places. joe biden, vice president, is sort of sticking around his house in delaware at this time. he has come out of the basement there, but he is staying around and not doing the rally type thing. he's in small, contained environments. liz? elizabeth: yeah. you know, we're in breaking news mode. the roger stone commutation may come in. here's -- i want to say what you just said about waiting for potential news to come in. joe biden getting criticized for saying the president doesn't care about the working or middle class, he only cares about the stock market. biden said he wants to end the end of hair holder -- shareholder activism. stock investments have tripled since the hate '80s. can joe biden make hay with that line of argument?

>> reporter: you know, and, you know, that's tough for him to go down that road especially with some of the unions, the police union wavering on support for former vice president joe biden in his presidency. but, you know, one other thing that biden is not shy about, he wants to raise taxes. in fact, an economic policy think tank here in washington, d.c. did some crunching of the numbers. he's proposing $7.4 billion in new taxes and that would inevitably -- i mean, in new incentives, in new spending. and that would inevitably mean more taxes. this think tank calling it the most or the largest influx of public investment money since world war ii. talking about a lot of spending here, and you've got to be able to curtail that and pay for it with the spending we've already done that's necessary to get us out of the coronavirus. elizabeth: yeah. >> reporter: if you add both of those together, it's a huge amount of money. elizabeth: and stay on the

coronavirus for a second because the vice president, biden, is trying to attack the president on the covid-19 response. but politico writing a story saying, wait a second, the obama administration's swine flu response in 2009 was not state of the art, was not picture-perfect. they shut down testing flat out in the middle of it. a biden adviser now, he was with the biden administration saying they got lucky. they missed, quote, a mass casualty event with swine flu in 2009. i'm not, you know, the question is can joe biden go after the president on covid-19 when the obama administration is getting attacked for poor vaccine response, stopping funding, stopping testing for swine flu in 2009? >> and you saw that on the screen. you guys are are showing that the obama administration just abruptly stopped testing for h1n1 in the swine flu. and that would inevitably lower

the numbers that you have related to the number of cases, you know, falling short of a pandemic for the swine flu. but, you know, experts around the globe point back to h1n1, also the swine flu both coming out of china to the rest of the world as something, you know, as sort of a framework that they look at how the coronavirus -- which is more, which is more, it spreads more quickly and possibly could be more deadly than those two. but, again, they look back at that and they see that, you know, the pandemic sort of, it comes through countries like this, and it depends on how open and honest those countries are. in terms of testing. elizabeth: yeah. yeah, we have a -- no, we have a china virologist saying, yeah, china did cover it up. she's on a fox business exclusive on the web site. edward lawrence, thanks for staying with us. the president may commute the sentence of roger stone at any

♪ ♪ elizabeth: house intelligence chair adam schiff, democrat of california, now saying if congress cannot get president trump's tax returns, the country will, quote, be in jeopardy, adding that democrats believe trump's taxes will show whether trump has, quote, financial entanglements with russia, turkey or saudi arabia. welcome back to the show ranking republican jim jordan of ohio. great to have you back on, congressman. your take on what adam schiff is saying there. >> i don't think many people think anything out of schiff -- adam schiff says. remember all the things he told us that he was going to prove during the whole trump-russia, during the whole impeachment, during all those, both of those hoaxes, both of those sagas. and, you know, here we go again. actually, you know, if you follow some of the mainstream

press, you'd think yesterday was a bad day for the president, but in actual terms it really wasn't. because neither the congress, nor the new york district attorney are going to have access to the president's tax records anytime soon. and so overall, i think in sort of practical terms it wasn't a bad day at all for the president with the supreme court. elizabeth: you know, there have been 80, 80 different probes, the subpoena cannon has has been fired by the democrats for a long time. the supreme court has said you have to have a legislative reason to get tax returns. what's a legislative reason for these 80 different proposes that the -- probes? >> you know, great point, liz. and that -- look, the oversight authority and power of the congress is broad, and it's pretty expansive, but there has to be -- but it still has to be a legitimate legislative purpose, and you have to counter that. this is what the court talked about, you have to counter that, obviously, with another separate

and equal branch of the federal government, i.e., the executive branch. i thought the court was pretty clear on that, and it told the president that he also has recourse, can go back to court and on other grounds challenge some of the decisions that the court made. so, again, i think it was pretty good. i think it's also important to step back and think about what was going on. the average american petrified of being audited by the irs, but what the democrats, if they had their way, it's not the irs auditing the president, it would be pelosi, schiff and maxine waters auditing the president. and if that is, that is scary when you think about it. so the president exactly right, his legal counsel in fighting this. we'll see how it all shakes out here down the road. elizabeth: yeah. there's an important broader context here. it's about abuse of power. do we want to live in a country where the irs can be used to attack, intimidate and basically threaten political to opponents.

i mean, here's the other thing, should only presidents have to release their tax returns, or should all lawmakers too? listen to nancy pelosi on this. >> if i decided to run for president, i would most certainly release my tax returns. elizabeth: so what do you think of all that? what's your take -- >> the first thing i would say, that's a scary thought. that's as bad as joe biden. look, we don't want the federal government going after anybody. we want equal treatment under the law. remember it was just a few years ago when the obama administration used the irs to systematically the same period of time target people who were against obamacare and all the crazy spinning under president obama. they went after tea e party groups. we don't want that. we just lived through, and we're still living through this. michael flynn's still not out of the woods with what the obama-comey cabal, the obama

administration did when they went after the trump campaign. never forget this fact, 38 different people between election day 2016 and inauguration day 2017, 38 different people 49 separate times una masked flynn's name. comey, clapper, brennan, biden did it as well. and yet when those people were interviewed under oath in front of the intelligence committee, every single one of them said there was no predicate for launching the information in the first place. so they launched an investigation where they said there was no evidence of collusion or coordination between the trump campaign and russia to impact the election, had no evidence of that and yet 49 separate times they unmasked michael flynn's name, and michael flynn has had to live with this for three and a half years and still not out of the woods even though everyone in this country knows he's innocent. that's how bad this is when you use the government to target people, and that's why john durham's investigation is so darn important.

elizabeth: you wonder if michael flynn could file an emotional abuse case against what's going on. final word. >> no, you're exactly right. i've said many times we should all remember, if they can do it to a president, to a three-star general, imagine what they can do it to you and i, liz, or the people that i represent in ohio. that's what's scary. elizabeth: yeah, that is scary. congressman jim jordan, come back soon, sir. >> thanks, liz. take care. elizabeth: up next, fox news contributor gianno caldwell on president trump now threatening, we've got news on this, president trump threatening to remove the tax-exempt status of universities for, quote, indoctrinating students. the president says that's what leading to the riots and protests that have gotten out of control nationwide. nancy pelosi also downplaying rioters knocking down a statue of christopher columbus in her hometown of baltimore. gianno caldwell will be on that one as well next.

families are saying our students are in the getting a proper education -- are not getting a proper education. the president instructing the treasury department to re-examine the tax-exempt status of universities and colleges claiming too many schools are driven by radical left indoctrination. this is tuition gouging, this is what middle class families are paying for. let's bring in fox news political analyst gianno caldwell. we've been reporting on this story for years and years, and that's what their complaint has been. your take on the president's threat here? >> well, i think it's great to look into these universities. as you may recall, these free speech zones with the case of professors and administrators showing hostility towards conservative students. and in many cases, you saw faculty donating to democratic politicians. we didn't see the situation whereas they were just teaching them history or what's going on in the world, they were giving them an agenda to follow.

it wasn't a mere teaching, it was an instruction as to what beliefs to hold. and that becomes problem proble. yeah, what may be a consideration for president trump is he can -- a lot of these public schools are largely funded by state and local taxes. so clearly, the federal government can get involved, but how much they can do, we don't know. elizabeth: yeah, i hear you. let's move on to this story, the republican governor of maryland, larry hogan, he is now criticizing house speaker nancy pelosi for -- he's saying there's no place in maryland for lawlessness after nancy pelosi expressed indifference about rioters in baltimore knocking down a statue of christopher columbus in her hometown of baltimore. watch nancy pelosi here. >> in baltimore, in little italy, a statue of christopher columbus was removed or taken down. [inaudible] >> well, i'm not a big, you know, i don't even have my

grandmother's ear rings. i'm not a big, let's see what we have in terms of monuments and that. i'm more interested in what people have accomplished. i think that it's up to the communities to decide what statues they a want to see. >> could that be done by city council, not in the middle of the harbor? >> people do what they do. elizabeth: okay. governor hogan, gianno, says there's no place for lawlessness. this was government property that taxpayers paid for. your reaction? >> yeah, absolutely correct. and for nancy pelosi to really provide room for people to interpret her comments, oh, however they come down, they come down. it's really fortunate for her. i've got a dear friend of mine who put together a petition to have a particular statue come down, and that's the way you do it. the community comes together and you say what you want to be there, what you want the

taxpayer dollars to maintain and what you don't. this idea that you can just go smash down a statue because you feel like it, and in a lot of cases the people don't even know who the individuals are. and in some cases, these are individuals who fought against slavery, yet you're smashing them down and defacing property? that's the problem. and people should go to jail for that. elizabeth: yeah, that is a problem. right. i want to, i want to show this footage of what happened in columbus, ohio. police officials there are asking for help. dozens, by the way, there have been dozens of people still to protest the riots. a man driving a car, he had cerebral palsy. the dreier of this car -- the driver of this car disabled. rioters pulled open the doors of his car and his trunk, they threw a bicycle at the back of his car. the police are still trying to find the people who attacked this disabled individual, frying to basically -- trying to basically continue on with his

day. look at that footage. mayor de blasio is canceling all large events in new york city, he's letting protesters continue marching through city streets. there are 20 cities moving to cut budgets for the police. all of these cities are democrat-run, all except san diego. let's show the list to the viewers. gianno, take this on, cities moving to cut police budgets, because we always have a big movement taking hold in seven states, back the police, back the badge, back the blue. your reaction. >> i think that it disenfranchises people who -- i'm from chicago, and people are legitimately afraid. they're afraid that they're not going to be able to get the help that they need. and i think president trump, his reelection committee did a campaign ad on what defunding the police may look like. now, there's been over 19 cities who have defunded the police or reallocated funds. we know in new york they cut a

billion dollars from the police department. but i the people of the united states of america do not favor it. i pew did a research study which said 42 percent of americans wanted funding to stay the same. 31% of americans want to see that funding increased. we also know that in the city of new york and other places as well, in the city of new york retirements are up 411%, 503 cops have retired at least thus far. so what do you get when you defund the police? you get communities that are, have the thugs, they take over. there's lawlessness and no one's safe. so this is one of the most radical and stupid experiments that i've ever heard of. and for joe biden to have to come out very clear and tough, joe said he would -- [inaudible] if he becomes president of the united states. elizabeth: now we've got a group of retired cops, the product our police pac if, it's devoted to

♪ ♪ finish if. elizabeth: welcome back. there's a lot of outrage over this next media controversy. watch cnn's don lemon try to make his case by criticizing -- he went there -- jesus christ in a debate about tearing down statues of our nation's founding fathers. now, media critics are still scratching their heads over don lemon's word salad. they're having trouble deciphering what he's saying. watch this. >> but here's the thing, jesus christ, if you believe of, if that's who you believe in, jesus christ, admittedly was not perfect when he was here on this earth. so why are we deifying the founders of this country, many of whom owned slaves? and in the constitution, the original one, they didn't want -- they put slavery in there, that slavery should be abolished because it was the way the king -- and then the congress said, no way. so they had to come up with an alternative about three-fifths

this movement to rewrite history. liz, we certainly know that our founding fathers and people who let -- led our country through great trials like abe a hamlin con and ulysses s. grant -- abraham lincoln, certainly were flawed individuals. i'm not going to include in that because he was the son of god. lincoln was not and so was grant. but i'll tell you one thing washington especially did, he didn't want to become a king. he didn't want the absolute power. he gave up the presidency after two terms and went back to his his -- his farm, and he did free his slaves before he died. certain actions by our founding fathers and by our leaders are certainly not what we would want, but many of them are good. and let's focus on the good things that people did and not get this cancel culture that really tries to rewrite history because of some small or some

and many people are being shot dead in broad daylight. come down off your ivory tower, come out of your media bubble and get in the real world. what do you say, john? >> how about reading a newspaper? how about actually watching the news on occasion. i mean, my hometown of chicago has had a hundred shootings, has had kids killed on the sidewalk doing just normal play, and people come by and shoot 'em. there was an incident in new york where some car, some guy stuck a gun out a car and shot somebody in broad daylight. a young 5-year-old was murdered right in their front yard in san francisco the other day. what are these guys doing? are they too busy endorsing bill de blasio's effort to paint black lives matter on the front of the trump tower? are -- these stunts that are going on, let's do something, let's not let criminals out of jail, let's make sure that we educate our kids in the inner

cities so they don't turn to crime. these are the positive things, liz, that i would hope that a we would all focus on instead of this craziness. i really believe that the democrats are overplaying their hand here, liz are. this defund the police movement, this idea of letting people out of jail who are repeated. criminals is just ridiculous, and the voters are going to remember this. just like 1972 men nixon roll -- when nixon rolled to a landslide over george mcgovern, you know, then as now the democrats overplayed their hands. they wanted everybody let out of jail, and i they's going to result in a massive -- i think's going to result in a massive loss for them. elizabeth: ucla law school says now more than 92,000 prisoners have been let out of jails due to covid-19. there are a lot of mistakes being made in that, in those releases. we're going to stay on that developing story. john cox, you're terrific.

experience having served three years in combat zones those starts of battlefield interrogations from especially taliban if fighters, they're often interested more in influencing than they are in informing. the administration, the intelligence community did the right thing. they disseminated what was duty to our soldiers on the front lines and coalition forces immediately, and then before taking any policy action, they sent out requirements so that the intelligence community could collect intelligence and determine the veracity of this reporting. the last thing you want to do is expel russian officials or pile on the sanctions before you actually confirm what was going on. elizabeth: yeah. we've got defense secretary mark esper and general mark milley, the chair of the joint chiefs of staff, testifying to congress that u.s. defense intelligence agencies could not corroborate "the new york times" story, they don't believe any american troops were killed. also we have the top general in the mideast command, kenneth mcken key, saying the same thing -- mckenzie.

there's little authenticity, not a lot of intelligence to support it. your reaction to that. >> i would say that's not surprising to me. it also wouldn't be surprising if it were true. i mean, the russians have been providing training and small arms to the taliban for years, and their doing it so that they can gain some influence in an area where they're competing, frankly, with pack tan and china and iran -- pakistan and china and iran for influence. i will say that what russia's doing in afghanistan pales in comparison to pakistan which has provided safe haven to the taliban and is impeding our mission in afghanistan to a far greater extent that russia ever could. elizabeth: yeah. and colin powell said russia doesn't want to have a war with the u.s. interesting point by colin paul and great points by you, dan. thanks so much for joining us. come back soon. >> thank you. elizabeth: okay. coming up the latest on u.s. attorney john durham's criminal investigation into the

♪ ♪ elizabeth: u.s. attorney john durham is under pressure to wrap up his e criminal investigation into the fbi's trump-russia probe. he may wait to reveal his findings or do prosecutions until after the elections. this is according to fox news. let's welcome back to the show president trump's former deputy national security adviser, kt mcfarland. kt, it's always great to see you. your reaction to that. >> crazy! i mean, we want to wait until after the election because it's too political. political, are you kidding? this is going to be political no matter when it comes out because each side is going to claim either vindication or cover-up or whatever else they're going to claim. so it's crazy to try to put it off. and and here's why i think it's a big pop if it is put off -- problem if it is put off. what happens if joe biden's elected? that report's never going to see the light of day. archaeologists are going to have to find that thing thousands of years from now, it's going to be

so buried in the to toe mack. the american people -- potomac. the american people deserve an explanation of what happened. every week there's more evidence that something really bad went on, and it's not just anonymous sources, it's documents, it's transcripts, it's text messages, it's e-mails that are being publicly released. so i think to clear the air and to salvage the reputation of the department of justice and the fbi and to let the american people know that there is accountable, i think it's got to come out sooner rather than later and let it all a hang out. elizabeth: yeah. if the fbi officials under comey abusing the nice ca court -- fisa court, i mean, rosenstein testify thed he would never have signed off on those fisa wiretaps which were broader in scope than criminal wiretaps, they hit a lot more devices, he would never are signed off because of the fbi misleading the fisa court. the backdrop is a big one.

kt, christopher steele, the guy who was paid by the hillary clinton campaign and the democrats to dig up political opposition dirt on trump, again, he was paid by then, he testified to that british court that basically, you know, he was doing that, hillary clinton campaign had hired him to dig up dirt because why? because they planned to fight and challenge a 2016 election if trump won and hillary lost. so that's the key. the democrats got the fbi to fall for his opposition research to spy on the trump team. that's the broad goal, and the fbi knew it. the fbi knew in july 2016. let's show it to the viewer what the fbi was told by christopher steele that, yeah, he was getting paid by the democrats. go ahead. >> yeah. and the other thing is once it didn't work, once hillary clinton and donald trump won in 2016, for that three month period between the election and the transition, i worked for

president trump at trump tower. and it was very clear that there were no violations, nothing wrong was done. even the fbi in documents has come out and said general flynn didn't do anything wrong, nobody did anything wrong. and yet when the fbi came, tap, tap, tap, knocking on my door nine months later, what were they talking about? wrongdoing that general flynn had done. so the whole thing stinks to high heaven. it stinks that there was something to influence the 2016 election, and it really stinks if it was after the election that people decided we don't like donald trump, we don't like the result of that election, we're just going to get rid of him. that's an internal coup by the highest levels of the intention community. -- intelligence community. elizabeth: yeah. and james comey testified to congress in the summer of 2017 that there was no active investigation into trump-russia collusion at the fbi. when he left, james clapper indicated the same, that they didn't have the goods.
